2 LETTER FROM THE CHAIRMAN Dear Fellow Conservative, The American Conservative Union Foundation is proud to present our ratings of the 2017 meeting of the North Carolina General Assembly. Like our Congressional Ratings, which date back 46 years, these ratings are meant to reflect how elected officials view the role of government in an individual s life. We begin with our philosophy (conservatism is the political philosophy that sovereignty resides in the person) and then apply our understanding of government (its essential role is to defend life, liberty and property). Because our ratings are designed to educate the public about how consistently their elected officials adhere to conservatism, we carefully examine the entire docket of legislation introduced in each state every year. We select the most meaningful bills and publish the results after the dust has settled. The ACU Foundation is the only organization to score over 8,000 elected officials each year, including lawmakers from all 50 states and Congress. The 2016 election dramatically impacted the political landscape of not only Washington but state legislative chambers all across the country. Republicans now have control of both legislative chambers in 32 states, more than double the number they controlled in With these victories comes an ability to implement policies that restore individual liberty and return us to a limited form of government run by and for We the People. It is our hope that these ratings will serve as a guide showing who can be relied on to fight for conservative principles and restore the role of government to what our nation s founding fathers envisioned. We selected bills that focus on Ronald Reagan s philosophy of the three-legged stool : 1) fiscal and economic: taxes, budgets, regulation, spending, healthcare, and property; 2) social and cultural: 2nd amendment, religion, life, welfare, and education; and 3) government integrity: voting, individual liberty, privacy, and transparency. This wide range of issues are designed to give citizens an accurate assessment that conveys which of North Carolina s elected leaders best defend the principles of a free society: Life, Liberty and Property. 6 NORTH CAROLINA SENATE VOTE DESCRIPTIONS 1. S 75 Tax Limitation Amendment. This bill places on the November 2018 ballot a constitutional amendment to reduce the cap on the income tax to 5.49 which is the current tax rate. ACU supports lowering the cap from its current level of 10 in an effort to protect taxpayers from any future increases and supports this bill. The Senate passed the bill on March 14, 2017 by a vote of S 223 Business Subsidies. This bill busts the annual expenditure cap on the Job Development Investment Grant (JDIG) Program and expands the program beyond selected counties. This program doles out government grants to transformative projects ACU opposes these programs that favor one form of business over another and lends itself to corruption and political influence and opposed this bill. The Senate passed the bill on March 27, 2017 by a vote of S 325 Tax Cut. This bill reduces taxes across the board, including a reduction in the personal income tax rate from 5.49 percent to 5.35 percent, an increase in the standard deduction and cuts to the corporate income tax and franchise tax. Reducing tax burdens increases economic growth, which increases family prosperity, as illustrated by the ACU Foundation s Family Prosperity Index. ACU supports progrowth tax relief and supported this bill. The Senate passed the bill on April 5, 2017 by a vote of S 145 Sanctuary Cities. This bill withholds state funds from local governments and college campuses that refuse to cooperate with authorities in enforcing immigration laws. ACU supports the enforcement of federal immigration laws and supported this bill. The Senate passed the bill on April 26, 2017 by a vote of S 375 Paycheck Protection. This bill repeals a law that allows government employee unions to set up a payroll deduction system to automatically collect union dues. ACU opposes government acting as a dues collector for unions and supported this bill. The Senate passed the bill on April 26, 2017 by a vote of H 467 Tort Reform. This bill limits economic damages in temporary nuisance lawsuits that are filed against agriculture or forestry operations, resulting in the award of either the fair rental value of the property belonging to the person filing the suit or the market value of the property outlined in the lawsuit. ACU supports tort reform in an effort to limit nuisance lawsuits and put common-sense limits on damage awards and supported this bill. The Senate voted to override the governor s veto of the bill on May 11, 2017 by a vote of H 469 Driverless Vehicles Regulation. This bill allows fully autonomous vehicles, known as driverless vehicles, to be operated by an adult without a driver s license, requires an adult to accompany any child under 12, and sets up a committee made up of government and industry to oversee rules and regulations of these full autonomous vehicle. ACU supports the development and commercialization of new technologies in a free market and supported this bill. The Senate passed the bill on June 26, 2017 by a vote of H 434 Taxes on Precious Metal Bullion. This bill eliminates the sales and use tax on precious metal bullion, such as gold and silver coins. ACU supports a free and competitive market in currencies, especially at a time when the Federal Reserve is engaging in unprecedented and dangerous monetary policy and supported this bill. The Senate passed the bill on June 27, 2017 by a vote of S 257 Budget Bill. The Fiscal Year 2018 budget bill includes significant tax cuts, including the franchise tax for S Corporations, as well as individual rate reductions. The bill also includes additional funding for school voucher programs and a new education savings account program for children with special needs. Reducing tax burdens increases economic growth, which increases family prosperity, as illustrated by the ACU Foundation s Family Prosperity Index. ACU supports pro-growth tax reductions and the expansion of school choice and supported this bill. The Senate passed the bill on June 27, 2017 by a vote of H 800 Charter School Teachers. This bill allows charter schools to retain outside organizations to help recruit teachers and implements a fast track employment process that requires a hiring decision within 120 days of the application. Educational attainment is an important value that yields substantial economic returns for families and for states, as illustrated by the ACU Foundation s Family Prosperity Index. ACU supports utilizing private enterprise to recruit the best teachers and supported this bill. The Senate passed the bill on June 28, 2017 by a vote of H 527 Free Speech on Campus. This bill takes steps to protect free speech on campus by preventing public universities from limiting speech, ideas and opinions they find objectionable and puts sanctions in place for those who disrupt events and interfere with others free speech rights. ACU supports protecting free speech on campuses and supported this bill. The Senate passed the bill on June 28, 2017 by a vote of

7 12. S 615 Paycheck Protection for Agricultural Workers. This bill prevents agricultural producers from deducting union dues from direct deposit wages and prevents farmers from settling lawsuits by agreeing to union contracts. ACU opposes the forced deduction of union dues from paychecks and forcing workers to abide by union contracts and supported this bill. The Senate passed the bill on June 28, 2017 by a vote of S 599 Teacher Hiring Flexibility. This bill allows private entities to be certified to help with teacher preparation, ensures the availability of information regarding teaching vacancies, and is designed to be more flexible in terms of allowing new potential teachers into the system. Educational attainment is an important value that yields substantial economic returns for families and for states, as illustrated by the ACU Foundation s Family Prosperity Index. ACU views the state-mandated requirements to qualify to become a teacher as arbitrary, supports the effort to provide greater flexibility to hire the most talented teachers, and supported this bill. The Senate passed the bill on June 29, 2017 by a vote of S 552 Tax Increase to Promote Tourism. This bill sets up local bureaucracies, called Tourism Authorities, funded by a new occupancy tax on hotel rooms and camping sites, to promote area tourism. Higher tax burdens suppress economic growth, which reduces family prosperity, as illustrated by the ACU Foundation s Family Prosperity Index. ACU opposes tax increases to run programs that should be funded through private enterprise and opposed this bill. The Senate passed the bill on August 3, 2017 by a vote of S 16 Regulatory Reform. This bill eases regulatory requirements on a number of businesses, most specifically allowing the Atlantic Coast Pipeline to be built through North Carolina. ACU supports cutting red tape regulations for businesses and abundant, affordable energy and supported this bill. The Senate voted to override the governor s veto of the bill on October 5, 2017 by a vote of H 559 Hunting Regulations. This bill further eases restrictions on Sunday hunting following a bill in 2015 that legalized Sunday hunting for the first time since the 1860s. Under this bill, hunting migratory birds on private land will be legal on Sunday afternoons and public land managers are authorized to consider allowing some Sunday hunting on government-owned land. ACU supports easing these outdated restrictions and supported this bill. The Senate passed the bill on June 29, 2017 by a vote of

11 NORTH CAROLINA HOUSE VOTE DESCRIPTIONS 1. HB Eminent Domain. This bill amends the state constitution to restrict the use of eminent domain to public use, rather than the current definition of public use or benefit, and requires just compensation to be determined by a jury if requested. The ACU Foundation s 21st Century Center for Property Rights engages heavily on issues that help to safeguard and strengthen the legal protection of private property. ACU believes eminent domain should be strictly limited to public use and supported this bill. The House passed the bill on February 16, 2017 by a vote of H 174 Concealed Carry. This bill allows those with a concealed carry permit to carry a handgun on school property outside of operating hours and places of worship. ACU supports the founder s belief in the Second Amendment and supported this bill. The House passed the bill on March 27, 2017 by a vote of H 206 Insurance Mandate. This bill requires all health insurance plans that provide coverage for any cancer drugs include equal coverage for orally- administered cancer drugs. ACU opposes these mandates that drive up the cost of health insurance for everyone and opposed this bill. The House passed the bill on April 10, 2017 by a vote of H 35 E-Verify. This bill requires government contractors to use the E-Verify system to check their worker s immigration status. ACU believes everyone should follow our immigration laws and taxpayer-funded projects should be heavily scrutinized to ensure they are performed by only those in the U.S. legally and supported this bill. The House passed the bill on April 25, 2017 by a vote of H 819 Right to Work Constitutional Amendment. This bill proposes a constitutional amendment to assure that North Carolina s law prohibiting a requirement that workers either join or pay dues to a union is enshrined in the state constitution. ACU supports the right to work and supported this bill. The House passed the bill on April 25, 2017 by a vote of H 779 Charter School Growth. This bill allows charter schools to grow by 30 percent without obtaining state approval through a performance review. Educational attainment is an important value that yields substantial economic returns for families and for states, which is illustrated by the ACU Foundation s Family Prosperity Index. ACU supports the expansion of school choice and supported this bill. The House passed the bill on April 26, 2017 by a vote of H 514 Charter School Expansion. This bill allows the towns of Matthews and Mint Hill in Mecklenburg County to operate charter schools. Educational attainment is an important value that yields substantial economic returns for families and for states, which is illustrated by the ACU Foundation s Family Prosperity Index. ACU believes all jurisdictions should be free to operate charter schools and supported this bill as a step in the right direction. The House passed the bill on April 27, 2017 by a vote of H 467 Tort Reform.
