The Sustainable Communities Strategy is a coordinated land use and transportation planning effort that will identify a preferred 20 year growth scenario that achieves greenhouse gas targets for the Monterey Bay region pursuant to California Senate Bill 375. *** AGENDA Complete agenda packets are on display at the Transportation Agency for Monterey County office and at these public libraries: Carmel, Monterey, Salinas Steinbeck Branch, Seaside, Prunedale, and King City. Any person who has a question concerning an item on this agenda may call the Agency Secretary to make inquiry concerning the nature of the item described on the agenda. Please recycle this agenda. 1. ROLL CALL: Call to order and self-introductions. According to Transportation Agency and Committee bylaws, Committee membership consists of representatives from the Transportation Agency voting and ex-officio members, and other agencies that may be appointed by the Transportation Agency. Currently the Committee membership includes representatives from 12 Cities, the County, MST, Caltrans, City of Watsonville, the Air District, and AMBAG, for a total of 18 members. Five members of the Technical Advisory Committee, representing voting members of the Transportation Agency Board of Directors, constitute a quorum for transaction of the business of the committee. If you are unable to attend, please contact the Committee coordinator. Your courtesy to the other members to assure a quorum is appreciated. 2. PUBLIC COMMENTS: Any member of the public may address the Committee on any item not on the agenda but within the jurisdiction of Transportation Agency and Technical Advisory Committee. Comments on items on today's agenda may be given when that agenda item is discussed.

Any member may pull an item off the Consent Agenda to be moved to the end of the CONSENT AGENDA for discussion and action. 3.1 APPROVE minutes of the Technical Advisory Committee meeting of November 1, Mike Zeller Pages RECEIVE schedule of 2013 Technical Advisory Committee meetings. Myers Pages 8-10 As stated in the Committee bylaws, Meetings will be held on a date that staff determines to be convenient for a majority of the members. Attachment 1 is the tentative schedule of meetings for the Committee in accordance with the regular meeting on the first Thursday of the month, 9:30 a.m. END OF CONSENT AGENDA 4. SELECT members of the Technical Advisory Committee to serve as the 2013 Chair and Vice-Chair and RECOGNIZE outgoing Chair Dale Lipp for his service during Myers Page 11 The Technical Advisory Committee chairmanship changes each calendar year. The Committee needs to elect the 2013 Chair and Vice-Chair to serve the remainder of the Technical Advisory Committee s 2013 meetings. 5. REVIEW and COMMENT the draft 2013 Legislative Program. Cheung Pages The purpose of the legislative program is to set general principles to guide staff and Board responses to proposed legislative or budgetary issues. The program also notifies state representatives of the Transportation Agency s position on issues of key importance to the Agency.

PROVIDE input on goals and objectives being considered for the Draft Policy Element. The Transportation Agency must prepare a Regional Transportation Plan by June, 2014 to comply with Senate Bill 375 requirements for addressing greenhouse gas impacts associated with implementation of transportation plans, as well as other state and federal planning requirements. The Policy Element for the regional plan identifies goals, objectives and performance measures for selecting projects to include in the plan. 7. REVIEW and COMMENT on the construction management on-call consultant scope of work; and FORM a subcommittee to review and rank statements of qualifications received and participate in consultant interviews as necessary. - Myers Pages The current on-call consultant list for construction management was approved on March23, 2011 for a period of two years and a renewal of the list is required at this time. The proposed scope of work will be included in the request for qualifications process used to solicit consultant proposals for this work. Staff will return to the Board with a list of selected consultants for approval. The availability of ready to use on-call consultants will maximize member agencies resources should funding become available for local transportation projects in our area. 9. ROLL CALL Chair Lipp, City of Greenfiled, called the meeting to order at 9:30 a.m. Introductions were given, and a quorum was confirmed. 2. PUBLIC COMMENTS None this month. 3. BEGINNING OF CONSENT AGENDA M/S/C Deal/Hurtado/unanimous 3.1 Approved minutes of the Technical Advisory Committee meeting of August 2, Received the call for nominations for the eleventh annual Transportation Agency Excellence awards to honor individuals, businesses, groups or projects for their efforts to improve the transportation system in Monterey County. END OF CONSENT AGENDA Regional Transportation Plan Update The Committee received report on the 2012 Regional Transportation Plan Update. 1. Provided input on historic and future funding sources for local projects; 2. Provided input on future funding assumptions; and 3. Received information regarding the call for projects for the 2014 Regional Transportation Plan Update. Andy Cook, Associate Transportation Planner, reported that the Transportation Agency prepares a long-range Regional Transportation Plan for Monterey County every four years, which serves as the basis for short-range programming actions and fund allocations to projects. The project list included in the plan must be limited by a long-range revenue forecast, which includes local, state and federal fund sources. He requested that the jurisdictions submit information on local revenue sources by November 5, 2012, and information on project updates by December 14 th.

7 Draft Minutes Technical Advisory Committee August 2, BICYCLE AND PEDESTRIAN SAFETY PLANNING The Committee received information and discussed local agency bicycle and pedestrian safety planning. Hank Myers, Associate Transportation Planning Engineer, reported that the Transportation Agency needs the assistance of each local agency to provide information about their primary sources of data for tracking bike-pedestrian collisions and how this information is then utilized to make bike-pedestrian safety and route planning decisions. Rich Deal noted that the City of Monterey also uses Crossroads to track their incident data. The committee commented on the difficulty of collecting quality information that can be used for planning purposes REGIONAL DEVELOPMENT IMPACT FEE NEXUS STUDY UPDATE The Committee received a progress report for the update of the Regional Development Impact Fee. Mike Zeller, Associate Transportation Planner reported that as part of the Joint Powers Agreement that established the program, the agency is required to update the fee program once every five years. The project got under way with Board approval of the scope of work and selection of Wood Rodgers as the consulting team at the August 2012 Board meeting and will finish within the five year deadline of August Ravi Narayanan, Wood Rodgers, presented on the modeling work completed for the project so far and received input from the committee on projects and affordable housing credits. 7. Support efforts to improve the ability of agencies to plan and deliver transportation projects in a timely and cost effective manner, including updates to storm water runoff requirements. 11S. Monitor California High-Speed Rail project and seek funding as possible for Monterey County rail projects. 12S. Support legislation that promotes transit-oriented development, transit villages and smart growth, and support eligibility for housing bond funds. 13S. Support complete streets and development guidelines that integrate alternative forms of transportation, such as transit, bicycle and pedestrian commuting. 14S. Improve the convenience and quality of trips, especially for walk, bike, transit, car/vanpool and freight. To improve safe, attractive and affordable access to work, school, goods and other key destinations by walking, bicycling and transit. Improve travel time and travel time reliability for pedestrian and bicyle trips between key origins and destinations. Improve travel time reliability and speed consistency for transit, car/vanpool and freight trips between key origins and destinations. Improve the quality of walk, bicycle, car/vanpool and transit trips. Percentage of work trips that are 30 minutes or less by mode. Improve average work trip travel time. Safety & Health Design, operate, and manage the transportation system to reduce serious injuries and fatalities, promote active living, and lessen exposure to pollution. 21 Agenda Item: 7 Attachment 1 Attachment 1 TAMC 2013 ON-CALL CONSTRUCTION MANAGEMENT SERVICES SCOPE OF WORK : The local agency representative will provide or work with the consultant to provide a scope of work to oversee the construction project. The consultant will, in turn, provide a not-to-exceed cost estimate based upon the fixed fee schedule included in their submittal and then execute a contract directly with the local agency. Individual construction management contracts will be awarded on a project-by-project basis at such times as the local agency needs arise. Transportation projects will cover a broad range including street and highway projects, rail projects, transit projects, bicycle and pedestrian projects, and various other municipal transportation-related projects. The scope of each project will include obtaining approvals and completing all paperwork necessary to comply with all local, state, and federal requirements. The federal projects will require compliance with the Local Assistance Procedures Manual (LAPM), specifically, Chapter 16, Administer Construction Contracts. Consultants may be asked in the scope of work to complete federal submittals such as: Request for Authorizations, Plans, Specifications and Estimate Certification, Award Package and Project Completion paperwork. The following is a general overview of the scope of services that may be requested: TAMC 2013 On-Call Construction Management Scope of Work

22 Agenda Item: 7 Attachment 1 SCOPE OF SERVICES Construction Management Services may include but are not limited to: Pre-Construction: o Performing a constructability review o Bid package management Assembling Advertising Reviewing proposals o Developing a public information plan o Conducting the pre-construction conference o Coordinating with utility companies Construction: o Monitoring contractor's performance and enforce all requirements of applicable codes, specifications and contract drawings. o Performing field inspection and other quality control activities including necessary materials testing. o Monitoring construction schedules throughout the course of construction o Reviewing working days, contract time and documenting time extensions. Documentation similar to the Caltrans Local Assistance Procedures Manual (LAPM) Exhibit 16-A, Weekly Statement of Working Days will be required in the project file. o Maintaining a daily inspector's report system that records the hours worked by men and equipment. Detail must be sufficient to permit the review of the contractor s costs of the work in a manner similar to force account. Equipment must be identified sufficiently to enable determination of the applicable rental rates and operator s minimum wage. The narrative portion of the report shall include a description of the contractor s operation and location of work and any other pertinent information. An example of the daily report forms can be found in the Caltrans Construction Manual. o Tracking subcontractor s work. Ensuring contractor submits written request prior to substituting a contractor. o Maintaining well-organized photographic/video records. o Ensuring contractor properly provides for the safety of the workers. o Managing change orders and obtaining required local agency approval. This includes keeping track of contingency money and notifying local agency when 80% of contingency money has been used. If using federal funds a Request of Authorization for additional construction funds will be needed if change orders will exceed authorized amount. This must be done prior to the approval of change order. o Managing submittals and monitor designer's review activities. TAMC 2013 On-Call Construction Management Scope of Work

23 Agenda Item: 7 Attachment 1 o Managing claims. o Managing contractor s Request for Information (RFI). o Reviewing and recommending progress payments. o Determining materials sampling, testing requirements and provide acceptance testing services in compliance with local agency s Quality Assurance Program. o Enforcing Labor Compliance by preparing daily reports with required information, monitoring Certified Payrolls and doing spot check labor surveys and interviews. o Supervising contractor's detours, lane closures, and staging plans. o Providing final inspection and coordinate road openings for each stage. o Establishing a punch list system. o Establishing a record file which supports: 1) adequacy of field control, 2) conformance to contract specifications, 3) payments to contractor. The file must be complete, organized and maintained in a manner that permits inspection by the local agency, Caltrans or FHWA. Example of project filing system can be found in the LAPM, Chapter 16. Post Construction: o Completing all project documentation including, but not limited to, change order summary, final detail estimate, project acceptance documentation, and claims management/resolution. o Preparing a final construction project report per Chapter 17 of the LAPM.
