8 The Comprehensive Agreement executed in 2012 with 95 Express Lanes, LLC. (95 Express) for the 95 Express Lanes contemplated the potential future development of the Northern HOT Lanes along the I-395 corridor. 395 Express Lanes In November of 2015, VDOT and 95 Express signed a Development Framework Agreement (Agreement) outlining the Parties initial roles and responsibilities in developing this Project. 8

20 New Transit Service Point-to-point commuter service between park-and-ride facilities and regional destinations Proposed new transit service includes: Preferred Alternative (By 2040) 20 Routes with up to 13,400 daily riders Phase 1 (By 2025) 13 routes with up to 10,000 daily riders Service assumed to be operated by Fairfax Connector and PRTC Some new transit service may be started during implementation of Transportation Management Plan (TMP) 20

21 Project Procurement All short-listed teams submitted their indicative financial proposals on December 1, The toll concession model (DBFOM) was selected as preferred delivery model and CTB and Transportation P3 Advisory Committee were briefed on the decision Draft Request for Proposals (RFP) has been posted on Project Website and includes: Volume I - Draft Instructions to Proposers ( ITP ) Volume II Draft Comprehensive Agreement ( CA ) Volume III Draft Technical Requirements ( TRs ) 21

22 Key Business Terms Concession Term: 50 years (4 years of construction and 46 years of operation) Financing Permits The Developer will finance the Project at its own cost and risk and non-recourse to VDOT. Up to $600 million public contribution VDOT will obtain required NEPA, CTB and FHWA approvals for Preferred Alternative Developer will be responsible for obtaining all other permits and government approvals, and will be responsible for obtaining any required reevaluation of the NEPA approvals as a result of Developer s ATCs. Design and Construction Fixed priced contract between the Developer and the Design-Build Contractor Intermediate Milestones Intermediate parking spaces: within 18 months of Construction NTP Remove traffic signals on Route 28: within 24 months of Construction NTP Operation and Maintenance (O&M) The Developer will be responsible for O&M of the Express Lanes, except for snow and ice removal 22

30 How the Tolling Works Hours of Operations: Eastbound: 5:30 AM 9:30 AM Westbound: 3:00 PM 7:00 PM All other times there is not an HOV or Toll restriction HOV 2+ toll free in 2017, HOV 3+ toll free in 2020 All vehicles using the lanes during tolling periods must have an E-ZPass or E-ZPass Flex, if they are HOV, mounted in vehicle. 30

34 Typical Pricing Sign Layout Toll Price Signs Toll prices will be displayed on electronic pricing signs Drivers will see two pricing signs before each entry point Signs will show the total price for up to three destinations. Drivers will lock in their toll price for their destination at the first pricing sign Toll prices may be adjusted as often as every five minutes based on real-time traffic conditions Signs may display pricing information prior to tolling period 34

49 IIM-IID-3.0 Funding Requirements for Construction Program Projects - Principles Projects in the SYIP: Have an established budget and schedule and they are to be delivered on-time and within budget Data must be accurate and reliable in appropriate systems of record Are safety, operational, reconstruction and capital projects that are fully funded through completion. State and federally funded projects must be fully funded. Projects of statewide significance requiring large studies, such as NEPA, IMRs, IJRs, etc. that have been identified by the CTB, Secretary of Transportation, or Commissioner will be funded through an appropriate source Consistent with Code of Virginia (E) VDOT and locality administered projects that do not advance or that are cancelled may require payback of expended state and federal funds VDOT will maintain flexibility in working with local governments and regional planning bodes so that projects using local or regional funds (i.e., NVTA, HRTAC, local project contributions) can be funded by phase with identified funding from other sources 49
