3 Mayor and Council Communication Budget Adjustment April 20, 2015 Page 1 of 2 SUBJECT: Resolution to Approve the 2015 Cass County Vector Control (CCVC) Mosquito Control Agreement (Budget Adj #15-008) RECOMMENDATION: The Mayor and City Council are asked to consider a resolution to approve an agreement between the City of Moorhead and Cass County. The agreement proposes CCVC provide mosquito surveillance and mosquito control to the City of Moorhead. BACKGROUND / KEY POINTS: In 2014, the City discussed the possibility of a 2-phase transition of the mosquito control program from the City of Moorhead Public Works Department to the CCVC. Phase 1 transferred mosquito surveillance to the CCVC. This was completed in 2014 and was very successful. The transfer reduced the workload for Public Works while improving the level of service to the City of Moorhead. Phase 2 transfers mosquito control surveillance and operations, with the exception of aerial mosquito spraying, to the CCVC. Originally, the transfer of mosquito control operations was planned for In early 2015, the City of Moorhead Public Works Director and the CCVC Director worked on an agreement to accelerate the transition from 2016 to The terms of the agreement and costs are summarized below. The entire agreement is provided as an attachment to this Council Communication: CCVC will provide the following services ($98,000): Adult mosquito surveillance (trap collection and specimen identification) Data reporting Pesticide application to include larvicide and area ultra-low volume (ULV) spraying City-wide ULV spraying Technical direction, coordination of activities, and public relations Administration, mapping, training, operational supplies, field supervision, data management, and product procurement City of Moorhead will maintain Decision Making and Operator rolls as specified by applicable permits City of Moorhead will provide 2 pickup trucks and 2 truck-mounted ULV sprayers to CCVC. Assets will come out of the existing vehicle/equipment inventory. Ben Prather, CCVC Director, and Cass County Commissioner Mary Scherling will attend the presentation to City Council. Commissioner Scherling is a voting member of the CCVC Board. FINANCIAL CONSIDERATIONS: A detailed budget comparison is included as an attachment. The budget comparison outlines: (1) the Current 2015 Budget; (2) a Revised 2015 Budget that includes increased revenue from the 2015 mosquito control fee increase, as well as budget increases to provide funding for city-wide aerial spraying and larvicide application in the former Oakport Township area; and (3) a CCVC Budget supporting the CCVC proposal. The following budget adjustment is required to fund the CCVC proposal:

6 Ben Prather Director Cass County Vector Control 1201 Main Ave West West Fargo, ND Mr. Moore, The initial draft agreement for contracted services was based upon previous annual expenditures for materials and labor incurred by City of Moorhead Public Works FY 2014 budget. This ultimately did not include areas of Oakport Township. Previously, we had mapped in about 300 acres of potential breeding sites. Our standard low cost treatment utilizes BTI granules at 10lbs of product per acre which yields a cost of $14.00 per acre for materials. Estimated employee labor will cost approximately $24,000 for the year. $56,500 - $24,000 Labor = $32,500 potential cost for product/$14.00 acre = 2,300 acres of treatment/300 acres per round = capacity for about 8 rainfall events. This was a good starting point. Within this estimate there are several factors that provide wiggle room: We typically wouldn t need to apply pesticides to every site after a rain. We don t need to apply product every foot of mapped area - such as open water on the golf courses or areas that are dry within these sites. Lastly we can adjust our rate of application if necessary, we are able to drop down to as low as 5 pounds per acre of water and still see 75% reduction. However, upon further investigation, I believe there still is a significant need to augment the agreement in order to provide adequate services. At present, our mapping of Moorhead identifies approximately 450 acres of water in 249 potential breeding sites within the City of Moorhead including newly annexed Oakport Township. Again these preliminary figures are not exact and can grow as we locate new breeding habitat. In light of this analysis I would recommend adding and additional $14,000 to the contract- 4k for additional ATV operator labor and 9k for product. This represents a 16.6% increase to the original draft of the contract. Do keep in mind that the contract allows for departure above the estimated cost via request and authorization from the City of Moorhead if necessary. We will be closely watching daily pesticide totals and are able to monitor expenditures in near real time. Ultimately, if the dry weather/drought continues- it will only help to limit expenses as billing for product will decline.

9 City of Moorhead 2015 MOSQUITO CONTROL AGREEMENT BETWEEN THE CITY OF MOORHEAD AND CASS COUNTY GOVERNMENT This agreement for mosquito control services is made between the City of Moorhead whose office is at Po Box 779, 500 Center Ave Moorhead, MN hereinafter CITY, and the Cass County Commission, whose office is at 211 Ninth Street, Fargo, North Dakota Mailing address is Box 2806 Fargo, ND hereinafter CASS COUNTY. WHEREAS, pursuant to Chapter , N.D.C.C. and Minnesota Statutes Section , the above-named governmental units have the legal authority to enter into an agreement, through action of their respective governing bodies, to jointly or cooperatively exercise any power common to the contracting powers or any similar powers, including those which are the same except for territorial limits within which they may be exercised. THE PARTIES STIPULATE AND AGREE AS FOLLOWS: 1) The purpose of this agreement is to collaborate under a single unit for the control of mosquitoes and related pests in the joint jurisdictions. CASS COUNTY agrees to provide mosquito control activities throughout the CITY commensurate with available funding and resources. 2) All activities herein are to be funded by the CITY. These activities include but are not limited to: collection of adult mosquito traps, specimen identification, data reporting, pesticide applications on public and private lands, inspection of public and private property, as well as applications for the control of adult mosquitoes. 3) CITY agrees to provide full funding for all labor, supplies, and additional cost of any and all activities within and adjacent to CITY as designated by CITY. 4) Estimated annual cost for items in paragraph 2 is $70,500. Estimated start and end dates for the above activities is May 15th to Sept. 15th respectively. 5) CITY agrees to fund the cost of City-wide adult mosquito spraying at $1,500 per application. Estimate between 5 and 10 applications per season dependent upon conditions. Adult mosquito spraying will be invoiced monthly. 6) CASS COUNTY will provide 4 statements of time and materials referred to in paragraphs 2 and 3 covering the following date ranges: April through June 15, June 16 to July 15, July 16 to Aug 15, Aug 16 to Season End. 7) The Cass County Director of Vector Control and other fulltime CASS COUNTY staff will provide technical direction, coordination of activities, public relations, and any other miscellaneous activities as requested. The Vector Director will also work in cooperation with CITY officials to provide other technical and administrative assistance as necessary.
10 8) CASS COUNTY will provide the following goods and services: Administration, mapping, training, operational supplies (PPE), field supervision, data management, and product procurement. The CITY agrees to provide funding to support the activities referred to in this paragraph. The estimated total cost for these activities is $20,000 annually. This will appear as a $5,000 Administration Charge on each statement. 7) If at any time total charges to CITY exceeds $98,000; the CITY can request a stoppage in service. To request a stoppage in service, CITY must provide CASS COUNTY written notice 14 days in advance of requested termination to Cass County Vector Control at the following address: CASS COUNTY VECTOR CONTROL 1201 Main Ave West West Fargo, ND ) CITY acknowledges and maintains Decision Maker and Operator rolls as specified by all applicable Local, State and Federal laws regarding pesticide applications. 9) CITY agrees to provide the use of 2 pickup trucks and 2 truck mounted ULV sprayers. CITY Agrees to provide the use of any surplus materials and equipment designated for the previous seasons mosquito control program as requested. 10) CITY agrees to provide authority under Moorhead Council Policy in acceptance of this contract for CASS COUNTY employees, appointees, or other designated party to enter upon any land, public or private, within the CITY and extraterritorial space at any reasonable time to inspect for or to control public health vectors and their breeding places. 11) CITY agrees to fund any additional costs for aerial spraying when CITY requests the contracted services of an aerial applicator. CASS COUNTY will coordinate the aerial spray operation upon the CITY s approval or after expressed written permission is given by the CITY authorizing the Vector Control Director as its agent to make the determination to engage the service. 12) CITY agrees to provide assistance in matters of permitting, licensing, and any other state of Minnesota statutory legal obligations in result of this agreement. 13) CASS COUNTY agrees to assume all liability and agrees to indemnify and defend the CITY from all direct and indirect, present and future claims or causes of action, which in any way result from the activities of CASS COUNTY in completion of the tasks stated herein or may result from the decisions, recommendations, actions, omissions of actions or other errors on the part of CASS COUNTY, its employees or contractors and any party from which CASS COUNTY may obtain information or services for the completion of the same. This assumption of liability and agreement to hold harmless is intended to cover any present or future activities undertaken by CASS COUNTY in furtherance of this agreement. 14) CITY agrees to assume all liability and agrees to indemnify and defend the CASS COUNTY
11 from all direct and indirect, present and future claims or causes of action, which in any way result from the activities of the CITY in completion of the tasks stated herein or may result from the decisions, recommendations, actions, omissions of actions or other errors on the part of CITY, its employees or contractors and any party from which CITY may obtain information or services for the completion of the same. 26 Mayor and Council Communication Budget Adjustment April 20, 2015 Page 1 of 2 SUBJECT: Resolution to Approve the Aerial Mosquito Control Contract with Airborne Custom Spraying (Budget Adj #15-008) RECOMMENDATION: The Mayor and City Council are asked to consider a resolution to approve the Aerial Mosquito Control Contract. The City of Moorhead Public Works Department (PWD) will administer the contract. BACKGROUND / KEY POINTS: The previous aerial mosquito control contract (Airborne Custom Spraying) expired at the end of The Cass County Vector Control (CVCC) Director issued a joint request for proposal that included Cass County and the Cities of Fargo, West Fargo, and Moorhead. Airborne Custom Spraying was the only bid received by the CCVC. The terms of the contract and costs are summarized below. The entire contract is provided as an attachment to this Council Communication. Conduct aerial spraying of pesticides covering approximately 12,000 acres (area includes the former Oakport Township) Aerial spraying will be conducted only when approved by the City of Moorhead Public Works Director after consultation with the CCVC A retainer fee of $12,000 is provided annually and will be subtracted from the billing cycle until 100% of the retainer fee is assessed The price per acre is based on the use of the chemical Permethrin Permethrin was used in previous contracts and is the CCVC-approved aerial pesticide To achieve maximum effect, aerial applications will be conducted at the same time as Fargo and West Fargo to the greatest extent possible. This approach was used last year and was highly effective. Additionally, the price per acre is $2.05 if applied with Fargo and West Fargo. The cost per application under these conditions is $24,600. The cost will increase to $2.40/acre if the City of Moorhead requests an aerial application independently. The cost per application under this condition is $28,800. The number of applications is estimated at 3-4 times per year. This contract will begin once approved by Council Resolution and will terminate on October 31, FINANCIAL CONSIDERATIONS: The estimated cost is $98,400 (based on 4 aerial applications). The funding required for this contract is included in Budget Adjustment # included in the CCVC Mosquito Control Agreement Council Communication. 40 Mayor and Council Communication April 20, 2015 Page 1 of 2 SUBJECT: Resolution to Proceed with Joint Planning and Design of a Future Law Enforcement Facility RECOMMENDATION: The Mayor and City Council are asked to consider a resolution of support for the City of Moorhead to enter into joint planning, design, and development of a future Joint Law Enforcement Facility with Clay County. BACKGROUND / KEY POINTS: On March 2, 2015, the City Council, Clay County Commission, and Moorhead School Board met in joint session to discuss future capital projects in each of the entities, with a small working group appointed to continue a broader conversation regarding the purpose, need, and timing of future capital projects throughout Moorhead and Clay County. The working group will hold its first meeting on May 4, 2015 to continue discussions that began on March 2 nd with the elected bodies. The Clay County Jail Committee, of which Moorhead is a member, continues to proceed to preliminary engineering, architecture, and design for the proposed Clay County Jail. Recently the Clay County Commission approved a professional services agreement with Klein McCarthy Architects (KMA), a firm specializing in justice architecture and law enforcement facilities. At the direction of Clay County, KMA will proceed with the aforementioned design tasks for the jail and continue to shape the project from a facility requirement and design perspective. As the jail project proceeds to the next phase of development, it is appropriate that the City and County begin conceptualizing a future law enforcement facility and perform various due diligence activities. The Clay County Jail Committee, together with local law enforcement, has expressed an interest in continuing the existing partnership between the Clay County Sheriff s Office and Moorhead Police Department that has been in place for decades, and both entities desire to study the feasibility of constructing a new facility following the Clay County Jail project. For an economy of scale and efficiency reasons, Clay County intends to solicit a scope of services from KMA to serve as the consulting architect on a future Joint Law Enforcement Facility. Facility design and locational consideration, among other tasks, will be the focus of this service engagement. FINANCIAL CONSIDERATIONS: As 50% owner of a future Joint Law Enforcement Facility, it is appropriate for the City of Moorhead to participate financially in preliminary engineering, architecture, and design services for the facility. While a project will not be constructed until 2017 or 2018, it is necessary for the County and City to pledge partnership and commitment to a future project, if feasible, cost-effective, and the desire of the two elected bodies. A preliminary scope of services will be developed to include a not-to-exceed number of hours and cost to begin this work. This scope is in development and will be presented to the Mayor & City Council at a later date, along with a commensurate budget adjustment. VOTING REQUIREMENTS: Majority of Quorum

ITEM DESCRIPTION: Resolution to Proceed with Joint Planning and Design of a Future Law Enforcement Facility PREPARED BY: Redlinger DRAFT RESOLUTION WHEREAS, the City Council, Clay County Commission, and Moorhead School Board met in joint session on March 2, 2015 to discuss future capital projects in each of the jurisdictions; and WHEREAS, the Clay County Jail Committee, of which Moorhead is a member, continues to proceed with preliminary engineering, architecture, and design for a proposed Clay County Jail; and WHEREAS, it is appropriate that the City of Moorhead and Clay County begin conceptualizing a future law enforcement facility and perform various due diligence activities at this time; and WHEREAS, the Clay County Jail Committee, together with local law enforcement agencies, has expressed interest in continuing existing partnerships and studying a future Joint Law Enforcement Facility together. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Moorhead, Minnesota that the City Council supports Clay County s jail construction project. BE IT FURTHER RESOLVED that the City Council concurs with initiating joint planning and design of a future Joint Law Enforcement Facility following the jail construction project, contingent on approval of a professional services agreement to provide technical assistance. BE IT FURTHER RESOLVED that the City Council pledges appropriate future financial and technical assistance to this planning effort as may be necessary to study the feasibility and cost-effectiveness of a future Joint Law Enforcement Facility between the City and County.
