2 Tri-City Service District Advisory Committee Meeting Summary November 18, 2015 The Tri-City Service District Advisory Committee met for a regular meeting on November 18, 2015, at 11:30 a.m. at the Water Environment Services Administration Office in Oregon City. Introductions of the Tri-City Service District Advisory Committee, attending citizens and Water Environment Services staff were made. I. Director s Report A. Introductions i. Director Geist introduced Lynne Chicoine, newly hired Planning Engineer for WES and asked each person in the room to introduce themselves. B. Oregon Consensus Director Geist gave an update on the status of the application to the Oregon Consensus process for the discussion of governance of the districts. 1

3 II. C. Director Geist reported staff are working to review the cost sharing for operations and maintenance between districts and possible revision of the IGA. He will continue to update the group as the process continues and will report staff s findings. D. A legislative update was provided on current issues and the position of Water Environment Services (WES). E. Customer Survey Director Geist reported on the results of the customer satisfaction survey. The results were pleasing and informative and will aide in staff continuing to provide excellent service that is in-line with community values. Councilor Johnson expressed dissatisfaction with the level of questions asked in the survey and requested staff bring future survey drafts to the committee for approval. Director Geist explained that staff-level tasks like these are communicated to the members for informational purposes and that the role of the committee is to make policy recommendations to the Board of County Commissioners. F. District Boundaries Director Geist noted that staff are beginning an audit process to verify that newly annexed areas are included within the District boundaries. G. Councilor Johnson and Mayor Holladay asked if staff was going to report on the status of solids handling engineering study. Lynne answered direct questions and noted that she planned to include this information in her presentation. H. Approval of 9/16/15 Meeting Summary. There was no discussion. Director Geist abstained, all other members agreed. Presentations A. ROW Fee Collection & Disbursement Doug Waugh, WES Finance Manager reported on reconciliation of the Right of Way Fee collection and disbursement. WES slightly under-collected this year and that amount will be rolled into next year. i. Chris Story, Assistant County Counsel gave an update on the litigation process regarding the ROW Fee. Staff presented the committee s recommendations to the Board of County Commissioners. The Commissioners agreed to deliberate but no decision has been made yet. B. Omni-Processing Technology Lynne Chicoine, WES Capital Program Manager reported on a presentation made by Peter Janicki (Janicki Industries) of the Omni- Processing technology, his testing sites, and the possibilities of considering it for the solids handing at the Tri-City Water Pollution Control Plant. Ms. Chicoine noted the Omni-Processor is one of the technologies that will be considered in the engineering study. There was a lengthy discussion regarding the permitting requirements, the process of reviewing technologies, as well as the scope and timeline of the project. i. Ross Schultz, City of Gladstone Interim City Administrator proposed a resolution to hire an independent engineering firm to study how the Moni Processer would fit into the Tri-City Water Pollution Control Plant and to ship a truckload of biosolids to the testing facility in Washington for a trial. Tony Konkol, City of Oregon City Interim City Manager moved to approve the resolution. There was a lengthy discussion regarding the dewatering process currently in place at the Tri-City Water Pollution Control Plant, the benefits of testing current biosolids, and the intentions of staff moving forward with studying technologies to resolve the current solids handing issues. Mr. Schultz requested to table his proposal to allow 2

IV. staff to move forward with their evaluation of technologies which will include a review panel with representatives from all the cities involved, consulting engineers, industry experts and WES staff. Mr. Konkol motioned to table the proposal. Director Geist abstained, all other members agreed. C. Anammox Pilot Greg Eyerly, WES Water Quality Manager reviewed a pilot project to utilize a specialized bacteria to treat SideStream and remove ammonia. If this pilot is successful it could be a cost savings to both Districts and improve water quality. There was discussion regarding the timeframe of the pilot, the cost of full implementation, and the benefits to the Tri-Cities ratepayers. D. Strategic Energy Management Mr. Eyerly presented on the Strategic Energy Management program that WES is participating in. It is a program to study and reduce energy usage. This will result in cost savings as well as incentive pay from the Energy Trust for participation. E. Advisory Committee Mr. Storey asked for clarification from Mr. Schultz regarding what specifically his resolution to hire outside counsel was aiming to achieve. There was a lengthy discussion regarding the current governance model including roles and responsibilities of committees as well as the roles and responsibilities of the Board of County Commissioners, the function of County Counsel, and concerns from committee members that they feel the current model does not serve the interests of Tri-City Service District residents. Mr. Konkol motioned to move forward with Mr. Schultz s resolution to hire outside counsel to advise on the governance issue. Director Geist abstained, all other members agreed. Actions Taken A. Motion made by Mr. Konkol to approve the meeting notes from the September 16, 2015 Tri-City Advisory Committee meeting. Seconded by Mr. Schultz. Director Geist abstained, all others in favor. Opposed, 0. Motion passed. B. Motion made by Mr. Konkol for the Tri-City Advisory Committee to authorize staff to issue an RFQ for engineering support to evaluate the solids handling issue and the Janicki technology and return the list of candidates to the Tri-City Advisory Committee for further action. Part of the evaluation process to be authorizing staff to work with Janicki Industries to treat one truck load of solids from the Tri-City Water Pollution Control Plant. After a lengthy discussion, there was a motion made by Mr. Konkol to table the motion. Seconded by Mr. Shultz. Director Geist abstained, all others in favor. Opposed, 0. Motion passed. C. Motion made by Mr. Konkol to hire an attorney to review the relationship between TCSD and the Board of County Commissioners and report back to the advisory board for further evaluation and action. Seconded by Mr. Schultz. Director Geist abstained, all others in favor; Opposed, 0. Motion passed. Follow Up Items A. Director Geist will report the response from the Board of County Commissioners regarding the committees request for outside counsel. V. Next meeting 3
