2 Page 2 of Report Reference to Strategic Plan: Background: N/A In the 1970 s and 1980 s many of the noise barriers that were constructed in the City of Burlington were constructed utilizing precast concrete sections manufactured by Evercrete Limited. In the 1990 s and 2000 s many of these barriers showed some form of failure requiring either replacement of the failed sections or complete replacement of the wall. In addition the company Evercrete Limited went into bankruptcy and closed down. In 2004 a request for proposal was issued and the Durisol noise wall was selected to replace a section of failed noise wall. The section of Walker s Line noise wall from Ketelby Court to 110 metres north was replaced. This project is a continuation of the 2004 project. Roads and Parks Maintenance is preparing a report on graffiti issues and the maintenance of sound walls that will be included in the June Committee meeting schedule. The repair of this noise wall is consistent with our ongoing responsibilities for noise walls on public property. Discussion: Proposed Work This project includes the replacement of 236 metres of noise wall. from 110 metres north of Ketelby Court to Palmer Drive on the Walker s Line right of way at the rear yards of Riley Ave. This project will complete the entire block of noise wall replacement from Ketelby Court to Palmer Drive with the same material. The noise walls are not in a condition to be repaired and must be replaced. Existing panels of the wall in good condition will be salvaged and used to repair other noise walls in the City. Construction Schedule Construction Start: June, 2010 Construction Completion: August, 2010

4 Page 4 of Report Tender Process: Tender Closed Wednesday March 24, 2010 Tenders Received The following table presents a listing of the bidders and their associated bids. Bidder Bid (Pre-tax price) 1. R S Construction & Contracting $208, Dig-Con International Ltd. $239, Brennan Paving & Construction Ltd. $260, Peninsula Construction Inc. $311, Harmonized Sales Tax Effective July 1, 2010 the 5% GST and 8% Ontario Retail Sales Tax, (ORST or PST ) will become harmonized into one tax of 13%, i.e. the Ontario Harmonized Sales Tax, (OHST or HST). Bidders were advised to reflect this change in their pricing calculations. The City receives a full rebate of the 5% GST. After July 1,2010, the rebate will be approximately 11.24% (of the 13% HST). As a result all work performed after July 1, 2010 must be budgeted with the additional tax (1.76%) accounted for. The following table for Total Estimated Cost makes provisions for this additional cost. Recommended Contractor City Staff are recommending R S Construction and Contracting be awarded this contract as they have completed other successful projects with the City of Burlington.

Capital from Current $0 $53,000 Total Financing Requirement $180,000 $233,000 Financial Matters: Additional Project Funding Requirements The project is $53,000 over estimate. The original estimate was based on an allowance not a specific project. While staff considered shortening the limits of replacement to be in line with the budgeted amount, it is important to complete the noise wall replacement to the natural break point at Palmer Drive. This project will complete the replacement of the noise wall from 110m north of Ketelbey Court to Palmer Drive in the same material that was used in 2004 when the first 110m was replaced to ensure consistency for the entire street to street unit. Future Capital Budgets will make provisions to complete the remaining sections of noisewall north of Palmer Drive and south of Ketelbey Court. Additional Project Funding It is recommended that financing for the additional $53,000 come from Report E36-10 Tender Award Walkers Line Reconstruction From Dundas Street to Highway 407.

Conclusion: Staff are recommending that Engineering Tender ENG 10-17, Walker s Line Noise Wall Replacement be awarded to Ontario Inc. operated as R S Construction & Contracting.
