1 Maine VOTING RECORD YOUR S VOTING RECORD ON SMALL BUSINESS ISSUES 2018 EDITION SESSIONS: Votes cast by members of the 128th Maine Legislature on bills of interest to small business owners during the past two years are listed below. Although this Voting Record cannot reflect every consideration that legislators take into account when casting votes, it can serve as a guide to evaluating lawmakers understanding of issues important to small business. Votes on key issues below may reflect partisanship, conflict with the governor, or belief a bill would be vetoed. Please thank those legislators who helped maintain a good business climate in Maine PERCENT INCOME SURTAX (LD 390): Eliminates the 3 percent surtax on taxable income above $200,000 that was part of the 2016 school funding referendum. Anecdotal information and an economic study indicated the tax would have cost jobs, businesses, and high-income residents if not repealed. A Yes vote supports the NFIB position to repeal this economically ruinous tax while also trimming the amount of increased school funding that would have occurred with the tax. Emergency enactment voted in the Senate 35 0 and in the House (2017). 2. TIP CREDIT (LD 673): Restores the minimum wage tip credit for tipped wait staff at table service restaurants. The 2016 minimum wage referendum required that tipped wait staff be paid a full minimum wage regardless of how much they earned in tips, which threatened the business plans of affected restaurants. A Yes vote supports the NFIB position to preserve long-standing business practices. Ought to Pass as Amended report accepted in the Senate and in the House (2017). 3. WAGE EQUALITY (LD 1259): Makes an inquiry about a job applicant s wage history evidence of discrimination and also outlaws employers from prohibiting employees from discussing or disclosing wages of other employees. A Yes vote in the Senate and No vote in the House supports the NFIB position to protect small employers from new discrimination legal traps. Ought Not to Pass report failed in the Senate Ought to Pass as Amended report accepted in the House (2017). 4. LOCAL OPTION TAX (LD 1522): Allows municipal voters to adopt a 1 percent tax on meals and lodging (effectively increasing the state tax to 9 percent). A Yes vote in the Senate and No vote in the House supports the NFIB position to reject this attempt to raise taxes, increase business costs, and open the gate to other local-option taxes. Ought Not the Pass report accepted in the Senate Ought to Pass as Amended report failed in the House (2017). 5. MINIMUM WAGE (LD 1757): Slows down increasing the minimum wage to $12 an hour in 2020 (it s now at $10 and goes to $11 in 2019) by increasing the wage by 50 cents a year until it reaches $12 in Many small business owners say they are struggling with the current $10 wage some already are laying off workers, cutting hours, increasing customer prices and they expect severe trouble as the wage goes up to $12. A Yes vote in the Senate and House supports the NFIB position to slow down the ramp up to $12. An amendment for 50-cent annual increases adopted in the Senate by A motion to concur failed in the House by (2018) PERCENT PAYROLL & INCOME SURTAXES (LD 1864): This referendum issue, which will be on the November ballot, creates a 3.8 percent payroll tax on an employee s wage that exceeds the social security tax threshold ($128,400 in 2018) as well as a 3.8 percent surtax on Maine adjusted gross income that exceeds the threshold. The $310 million in projected annual tax revenues would be used to fund the nation s first universal home-care program for seniors 65 and older and disabled people. A Yes vote supports the NFIB position to refer the proposal to a legislative committee for public hearing and scrutiny. Reference to the Taxation Committee passed in the Senate A similar motion failed in the House (2018).
