Except as otherwise indicated, I have personal knowledge of the matters set forth herein and, if called as a witness, would testify competently thereto. 2. Notice of Rate Increase. I submit this declaration in accordance with the Hogan Lovells Retention Order indicating "In the event that Hogan Lovells rates increase, the Debtor will file a notice detailing the new rate structure and will serve such notice on the Notice Parties (as defined in the Application)." [Dkt. No. 87-1, 17.] 3. Effective January 1, 2019, Hogan Lovells has implemented firm-wide rate increases. Attached hereto as Exhibit A is a summary of the 2019 Standard Hourly Time Charge Schedule effective January 1, As disclosed in the Declaration Of Christopher R. Donoho, III In Support Of The Application Of The Debtor For Entry Of An Order Pursuant To Bankruptcy Code Sections 327(A), 328, 330, And 1107 Authorizing Employment And Retention Of Hogan Lovells US LLP As Counsel For The Debtor In Possession Nunc Pro Tunc To The Petition Date And Statement Required By Bankruptcy Code Section 329 [Dkt. No. 87-1, 17], Hogan Lovells hourly rates are subject to periodic adjustment to reflect economic and other conditions consistent with the rates that Hogan Lovells charges in other matters. The increase noticed herein is reasonable pursuant to section 330(a)(3)(F) of the Bankruptcy Code as it is applied firm-wide, and the new rates are comparable to those used in similar circumstances by similarly skilled professionals. 5. Hogan Lovells will provide notice of this Declaration to the following parties, or, in lieu thereof, their counsel: (a) the Office of the U.S. Trustee for the District of Delaware; (b) the Debtor; and (c) any party that has requested notice pursuant to Bankruptcy Rule A 2
