1 THE CORPORATION OF THE TOWNSHIP OF MADAWASKA VALLEY BY-LAW NUMBER Being a By-Law to adopt the 2015 Water System Budget and establish the Water System Rates - effective July 15, WHEREAS Section 391(1) (a) (b) (c), of The Municipal Act, 2001, provides that the Council of a 1 local municipality may pass a by lawimposing fees or charges on any class of persons for capital costs payable by it for water and wastewater services or activities which will be provided or done by it after the fees or charges are imposed. AND WHEREAS Section 398(2) ( 1) (2), of the Municipal Act, 2001, states that the Treasurer of a municipality may add to the tax roll for the property in the municipality and collect in the same manner as municipal taxes, any unpaid fees or charges for the supply of a public utility which the owners are responsible for paying, or any property for which all of the owners are responsible for paying the fees and charges. AND WHEREAS the Township of MadawaskaValley deems it advisableto establishwater Rates for the use of the municipal water system, which are equitable and fair to all consumers. AND WHEREAS metres. for the purposes of this by-law, a unit of water shall be 1,000 gallons or 4.55 cubic NOW THEREFORE the Municipal Council of The Corporation of the Township of Madawaska Valley hereby enacts as follows: 1. That the Township of Madawaska Valley 2015 Water System Budget attached hereto as Schedule A is hereby adopted on September 8, That this by-law shall apply to all Water System connections, which includes, all of the Village of Barry s Bay and those parts of the geographic Township of Sherwood currentlyconnectedto the municipal Water System. 3. That effective July 1,2015 the Water System Rates shall be as set out in Schedule B attached hereto and are hereby adopted. 4. That an annual Water System debt consolidation charge shall be imposed upon each unit for which municipal records indicate that users have not paid for the original capital debt excluding those users who have pre paidas indicated in the Water and Sewage Capital Outlay Ledged. This charge shall be in the proportions outlined in Schedule C attached and shall continue to be imposed until the retirement of this debt in That once the budget for the current year has been adopted, rates shall be amended and be retroactive to the?rst day of July of the budget year. A surcharge may apply to any subsequent billings in a calendar year to compensate for the de?ciencies in the billing amounts, which have already been collected for the current year. 6. Billing will occur every third month for the amount equal to actual water usage or the minimum established rate will apply. Meter readings will be taken after the end of March, June, September and December of each year and bills are payable in one installment based on the rates established and shall become due and payable on November 13, 2015 and February 12, A minimum quarterly Water System consumption rate of $76.82 has been established for all meter users, regardless of the water consumption amount. The minimum quarterly Water System consumption charge shall be based on 3.75 units of water (a unit being 1,000 gallons or 4.55 cubic metres). 8. Penalty charges of one and one quarter percent (1 A%)per month shall apply on the?rst day of the month following the due date to all or any parts of unpaid Water System bills.

2 Page 2/ By-Law Number Water System bills that are in arrears sixmonths shall have that amount and any relatedpenalty and interest charges added to the tax roll for collection pursuant to the Water and Wastewater Policies and Procedures. 10. An Excavation and Hook-up Permit for water connectionmust be obtained and a fee of $ will be charged for such permit. 11. A Plumbing Permit must be obtained and an inspection of the system must occur prior to the system being engaged and that a fee of $ will be charged for such permit. 12. That a rate of $35.00 will be charged for each time that a disconnection of an existing connection is required. 13. That a rate of $35.00 will be charged for each time that a reconnection of an existing connection is required. 14. That a rate of $35.00 will be charged for each new connection to the system. 15. The Treasurer or her designate is hereby authorized to perform all tasks required to enact this by-law. 16. That the Water System Rates and fees are payable at the Township of Madawaska Valley Municipal Office, P.O. Box 1000, 85 Bay Street, Barry s Bay, Ontario KOJ 1B0 or such?nancial institutions which are authorized to accept payment. 17. That Council reserves the right from time to time, to review and make reasonable adjustments to the water system rates. 18.
