JOMPAY TM BILL PAYMENT EXCLUSIVE CAMPAIGN TERMS AND CONDITIONS ORGANISER The JomPAY TM Bil Payment Exclusive Campaign ( Campaign ) is organised by Telekom Malaysia Berhad (Company No.128740-P) ( TM ) (referred to as the Organiser ). SPONSOR CIMB Bank Berhad (Company No. 13491-P), CIMB Islamic Bank Berhad (Company No. 671380-H) and RHB Bank Berhad (Company No. 6171-M) are referred to as sponsors of the Exclusive Prizes respectively, for this Campaign and NOT referred to as the Organiser. CAMPAIGN PERIOD 1. The Campaign commences at 00:00:01 on 1 October 2017 and ends at 11:59:59 on 31 December 2017 (Malaysia Standard Time), both time and dates inclusive ( Campaign Period ). 2. During the Campaign Period, any TM customers who have paid their TM bills via JomPAY would be automatically deemed to be participating in this Campaign. ELIGIBILITY 1. This Campaign is open to all TM customers who pay their TM bills via JomPAY (the Customers ). Only Customers who are eighteen (18) years of age and above, have valid active TM accounts and have a valid identification document (example: identity card or passport) are eligible to participate in the Campaign ( Participant ). 2. Participant(s) will be automatically disqualified if the Participant s TM account is not valid, cancelled, or terminated for whatever reasons. 3. The TM bill payment ( Transaction ) must be made during the Campaign Period and comply with the eligibility and qualifying criteria mentioned herein, in order to be considered as an eligible entry ( Eligible Entry ). Transactions made outside the Campaign Period will not be accepted as Eligible Entry and will be disqualified. ELIGIBILITY FOR PRIZES 1. Exclusive Prizes i. To qualify for the Exclusive Prizes, Participant must make full payment to their active TM Account via JomPAY in 3 consecutive Campaign Months. Participants also need to add JomPAY as a favourite biller. ii. Total of 65 units of Samsung Galaxy J5 will be offered exclusively to CIMB Bank Berhad and/or CIMB Islamic Bank Berhad customer at the end of the Campaign Period. 35 units will be allocated to CIMB Clicks customer and 30 units to BizChannel@CIMB customer. iii. Total of 16 units of Huawei P10 Lite will be offered exclusively to RHB bank customer at the end of the Campaign Period. 8 units will be allocated to RHB Now customer and 8 units to RHB Reflex customer. iv. The Prizes are as follows: Prizes Exclusive Prizes Total Prizes 65 units x Samsung Galaxy J5 16 units x Huawei P10 Lite
2. Daily Prizes i. To qualify for the Daily Prize, Participant must make full payment to their active TM account via JomPAY in any Campaign Month. ii. To be eligible for the daily prizes of 1,000 TM Rewards points, customer must be TM Rewards members. Customer who is not yet a member will be automatically registered as TM Rewards members by participating in JomPay campaign for this period. iii. However, non TM Rewards members with incomplete data will not be eligible to win TM Rewards points. iv. Winners are able to check the status of point credit into their account one month after campaign ends. v. Total of 9,000,000 TM Rewards Points will be offered during the Campaign Period. Campaign Month Start Date End Date 3 months 1 October 2017 31 December 2017 Prizes 9,000 x 1,000 TM Rewards points SUCCESSFUL PARTICIPANT SELECTION PROCESS The followings are the selection process that will be adopted to determine the Successful Participants:- 1. Campaign report extraction will be done at the end of Campaign Period. 2. Exclusive Prizes Successful Participant selection: i. The potential winner ( Shortlisted Participant ) for Exclusive Prizes will be determined by an automated selection system. ii. TM will contact the Shortlisted Participant(s) via telephone (office telephone or mobile number) or email as per TM s record. iii. Shortlisted Participants will be required to answer one (1) question. iv. Only Shortlisted Participants with the correct answer will win a Exclusive Prize ( Successful Participant ). 3. Daily Prize Successful Participant selection: i. TM will shortlist the potential winner ( Shortlisted Participant ) based on the first 100 th ii. customers who pay via JomPAY. TM will contact the Shortlisted Participants via telephone (office telephone or mobile number) or email as per TM s record. 4. Should there be any case where a Shortlisted Participant is unable to answer the question correctly / un-contactable; the next Shortlisted Participant from the same listing will be selected to answer the question.
FULFILMENT OF PRIZES 1. Each Shortlisted Participant is only entitled to win a maximum of one (1) prize (whether Daily or Exclusive Prize) during the Campaign Period. Repeated Successful Participants are not allowed. 2. Exclusive Prizes will be delivered to the address as informed by the Successful Participant. 3. The Prizes are given on an as is basis and are not exchangeable for cash, credit, other items or vouchers in part or in full. The actual color and size of the Exclusive and Daily Prizes may vary from the pictures shown in the advertisement. 4. Successful Participant(s) shall be responsible to notify the Organiser in writing or via telephone no later than 28 February 2018 for non-receipt of prize, failing which, Successful Participant(s) shall be deemed to have had received and accepted the prize from the Organiser. 5. CIMB Bank Berhad, CIMB Islamic Bank Berhad and RHB Bank Berhad will not be responsible for any delay, defective, lost or unclaimed prize after 28 February 2018. 6. To the fullest extent permitted by law, CIMB Bank Berhad, CIMB Islamic Bank Berhad and RHB Bank Berhad excludes any responsibility and liability arising from any postponement, cancellation, delay or changes to the Prizes details or any other unforeseen circumstances beyond the Bank s reasonable control and for any act or default of any of the Service Agents. 7. CIMB Bank Berhad, CIMB Islamic Bank Berhad and RHB Bank Berhad offers no warranty or representation whatsoever, express, implied or statutory, in relation to the Campaign, the Prizes including, but without limitation, the merchantable quality and fitness for purposes in respect of the Prizes and level of care and skill of the Service Agents. 8. CIMB Bank Berhad, CIMB Islamic Bank Berhad and RHB Bank Berhad bears no liability in the event the Selected Winners are unable to utilise the Prizes for any reason whatsoever, including but not limited to reasons arising from breach of the terms stipulated in the Prizes. The Selected Winners hereby agree to participate in all publicity accompanying or resulting from the prize award. 9. All unclaimed Prizes will be forfeited and any enquiries thereafter will not be entertained. No refund will be given for any unclaimed Prizes. CIMB Bank Berhad, CIMB Islamic Bank Berhad and RHB Bank Berhad shall not be liable and/or responsible for the transportation cost pertaining to the collection and/or delivery of the Prizes. All taxes, charges and incidental costs in this regard shall be solely borne by the Selected Winners.
GENERAL TERMS & CONDITIONS 1. The Organiser decisions on all matters relating to the Campaign including the determination of a Successful Participant(s) shall be final. All prizes are not transferable and subject to the terms and conditions stated herein. No correspondence, queries, appeals or protests shall be entertained. 2. The Organiser reserves the right to disqualify all entries from any Participant in this Campaign and prohibit that person from further participating in this Campaign in the event that there is a suspicion that the Participant tampered with or benefited from the tampering regulations of this Campaign or the Terms and Conditions stated herein. 3. The Organiser reserves the right to amend the Campaign Period at any time. The Organiser also reserves the right to cancel, terminate or suspend the Campaign for any reasons without any prior notice. The cancellation, termination or suspension of the Campaign shall not entitle the Customers to any claim or compensation against the Organiser for any loss or damage suffered caused by such cancellation, termination or suspension. 4. Organiser s decision is final and no correspondence disputing Organiser s decision will be entertained. Organiser reserves the right at discretion provided that Organiser have given notice of twenty one (21) calendar days to vary, delete or add to any of these Terms & Conditions from time to time either displayed at the Organiser websites and/or other means of communication that may be deemed appropriate by the Organiser. If any future modifications of these Terms and Conditions are unacceptable to the Participants, they should discontinue any further participation on this Campaign. 5. The Organiser reserves the right provided that the Organiser have obtained the Successful Participant s consent to publish or display the name and the last 4 digit of identification numbers of the Successful Participant(s) for advertising and publicity. 6. The Organiser shall not be liable for any default in respect of the Campaign due to any act of God, war, riot, strike, lockout, industrial action, fire, flood, storm, technical or system failures or any event beyond the reasonable control of RHB. 7. All Prizes(s) are non-transferable to any 3rd party, non-negotiable and non-exchangeable for cash or credit of any kind, in part or in full. 8. In the event of any inconsistency between these Terms and Conditions and any other brochure, marketing or Campaign materials relating to the Campaign, these Terms and Conditions shall prevail. 9. By participating in the Campaign, the Participant(s) agree to be bound by the Terms and Conditions.
TELEKOM MALAYSIA S SPECIFIC TERMS 1. TM shall not be liable to the Participants for (a) any loss or damage suffered by the Participants arising from their participation or non-participation in the Campaign due to any act or omission by TM and; (b) for any misuse of any prize or for any claims or liability arising from the use of the prizes. 2. To the fullest extent permitted by law, TM makes no representations and/or warranties with respect to any prizes provided under this Campaign. In particular, TM gives no warranty with respect to the merchantability, quality of the Contest Prizes or their suitability for any purposes. 3. TM shall not be liable for any misinterpretation of facts in respect of the Prizes offered and published in any mass media, marketing or advertising materials. 4. TM is not responsible for any misrepresentation of facts, injuries or loss of lives or valuables resulting from any of the Prizes won through this Campaign and further shall not be liable, whether direct or consequential, for any loss or damage and/or whatsoever suffered by the Participant(s) resulting from their participation in the Campaign or as a result of any act or omission on the part of TM. 5. By participating in this Campaign, Participant/ Campaign winner hereby grants TM perpetual and nonexclusive rights to broadcast the names, pictures or display any matter related to any of the Campaign winner for advertising purposes and publicity related to the Campaign without any further notice to the Campaign winner. The Campaign winner is not entitled to claim any payment in any form, fee or compensation for the use of their images or details in relation to the above. 6. By participating in this Campaign, Participants will be deemed to have read, understood and agreed to be bound by these Terms and Conditions. TM reserves the exclusive rights to change the mechanism of the Campaign and/or amend, delete or add on these Terms and Conditions without any prior notice. 7. In the event of any dispute, conflict, uncertainty or ambiguity relating to the Terms and Conditions hereto, or any matter involving this Campaign, TM will resolve the matter in its absolute and unfettered discretion and the entire decision in the matter by TM shall be conclusive and final.
