1 New Zealand Multi-currency Cash Passport Campaign - WIN NZ$1,000 holiday spending money Cash Passport Competition Terms & Conditions of Entry ( Conditions of Entry ) 1. Information on how to enter and prizes form part of these Conditions of Entry. If there is any conflict between these Conditions of Entry and any other published material, these Conditions of Entry are to prevail. 2. The promoter is Access Prepaid New Zealand Ltd (registered office: Level 3, MasterCard House, 136 Customs Street West, Auckland, 1010.) ( Access or the Promoter ) 3. Entry to the Draw is open to any person who purchases or reloads a Multi-Currency Cash Passport Card ( Cash Passport Card ) with a load or reload value (excluding fees and commissions) of NZD1, (or NZD Equivalent) or more in a single transaction from a participating partner s branch (list of participating partners available at in New Zealand, or conducts an in-branch reload in one of those branches between the 01/05/13 00:01 and 31/07/13 23:59 ( Eligible Entrant ). Each Eligible Entrant will be automatically entered into the Draw. 4. Entries into each draw must be received within the following times to be eligible. Each Eligible Entrant will be limited to one entry to this competition regardless of the number of Cash Passport Cards purchased or reloaded during the relevant period for the Draw. 6. Employees of the Promoter and participating partners, their related bodies corporate and their immediate families are not eligible to enter this competition.

2 7. All entries submitted become the property of the Promoter. All details will be held in accordance with Access Privacy Policy which can be accessed by visiting or calling in New Zealand Draw 8. Except where prohibited by law, each winner agrees that the Promoter in conjunction with the participating Partner may use the name and photograph of the winner for promotions, marketing and publicity, unless otherwise advised. 9. The Prize draws will take place weekly at Access Prepaid Australia Pty Limited Level 6, 165 Walker St, North Sydney, NSW, 2060 Australia on the following dates. The first valid winners in each draw will win a Prize. 11. The Prize winners of all draws will be notified within 3 business days of the relevant draw by phone and in writing using the details provided by the Eligible Entrant. The decision of the Promoter is final and not correspondence will be entered into. Prize 12. There will be thirteen major prizes valued at NZD1,000 each (the Prize ) and will be credited to each winners Cash Passport Card s NZD Purse. 13. The total prize pool for this competition is valued at NZD13, The winner s Cash Passport Card will be credited with the Prize within 10 business days following each successful prize draw. 15. The Prize must be taken as stated. If a winner is unable to use the Prize as stated it will be forfeited and no compensation will be payable. 16. A winner may be liable to declare the Prize for tax purposes. The Promoter takes no responsibility for any tax payable on the Prize. If any tax is payable on the Prize it is the sole responsibility of the winner.

If the Prize is not available for reasons beyond the control of the Promoter, the Promoter reserves the right to substitute a prize of similar theme and value will be at the Promoter s sole discretion, subject however to state regulation. 18. The Cash Passport Card is subject to the Multi-currency Cash Passport Terms and Conditions. By accepting the Prize, a winner agrees to be bound by the Cash Passport Terms and Conditions and to satisfy any necessary identification requirements. Fees and charges apply to the use of the Cash Passport Card and these are set out in the Cash Passport Terms and Conditions Brochure. The complete Cash Passport cardholder Terms and Conditions Brochure including a full list of current fees and charges is available at Any applicable exchange rates, ATM fees or charges will be deducted from the total amount of funds on the Cash Passport Card at the time the transaction is made. The Cash Passport Card is valid for five years but inactivity fees apply after 12 months of non-usage of the Cash Passport Card. The total amount of the Cash Passport Card can be withdrawn at once and will incur a fee depending on the country of activity. 19. Any Prize winner who does not accept or agree to these Conditions of Entry or forfeits the Prize, the Prize will be considered to be unclaimed and will cause the Prize to be redrawn. 20. If a Prize remains unclaimed for 3 months after the Draw a redraw will take place for that Prize. The redraw will be conducted at the relevant premises set out above and the winner will be notified by phone and mail within 3 business days of the redraw Other conditions 22. To the extent permitted by law, the Promoter and its associated agencies or companies and the participating Partner are not liable for any: - Error, omission, interruption, deletion, defect, delay in operation, theft or destruction or unauthorised access to, or alteration of entries; or

4 - Loss or damage whatsoever (including but not limited to direct or consequential loss) or personal injury however caused including, but not limited to, by their or any of their negligence, suffered by the Eligible Entrant or any other person relating to the use or enjoyment of, or non-delivery or non-use ability of a prize. 23. If for any reason, the Promoter is unable to run this competition as planned, including tampering, infection by computer virus, bugs, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter that corrupt or otherwise affect the administration, security, fairness, integrity or proper conduct of this competition, the Promoter may in its sole discretion disqualify any person who tampers with the entry process, and cancel, terminate, modify or suspend this competition without prior notice, subject however to any written directions given under applicable law. Disclaimers 24. The Promoter is not responsible for any incorrect or inaccurate information, either caused by you or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line, theft or destruction or unauthorised access to or alteration of entries. 25. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry. 26. Any form of automated entry using any other devices or software will be deemed to be invalid. We reserve the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry. 27. The Promoter is not responsible for lost, late, incomprehensible or incorrect entries in this competition. 28. In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event outside our reasonable control, we are entitled to cancel, terminate, modify or suspend this competition without prior notice - subject to any written directions from the various regulatory bodies responsible for supervising the conduct of this competition in New Zealand. 29. As a condition of accepting the Prize, the winners (and any companion/s) must sign any legal documentation in the form required by the Promoter in its absolute discretion including but not limited to a legal release and indemnity form. Exclusions and our liability 30. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including without limitation direct, indirect and consequential loss and damages) or for personal injury suffered or sustained as a result of entering or trying to enter this

5 competition or accepting any prize offered as part of this competition, except for any liability which cannot be excluded by law. 31. The law implies various conditions and warranties which might apply to us supplying goods or services to you. The Promoter excludes all of those conditions and warranties to the fullest extent permitted by law, including without limitation implied warranties of merchantability and fitness for a particular purpose. 32. Provisions of the Consumer Guarantee Act 1993 and other statutes in some cases either cannot be excluded, restricted or modified; or can only be restricted or modified to a limited extent. If any of those provisions apply, then to the extent permitted our liability under those provisions is limited as set out below. Our liability in relation to goods we supply is limited at our option to: a) replacement of the goods or the supply of equivalent goods; or b) repair of the goods; or c) payment of the cost of replacing the goods or of acquiring equivalent goods; or d) payment of the cost of having the goods repaired; and our liability in relation to services we supply, is limited at our option to: a) the supplying of the services against; or b) the payment of the cost of having the services supplied again. Termination 33. The Promoter may terminate or cancel your entry in this competition immediately in our reasonable discretion or if you breach any of your obligations under these Conditions of Entry. Your personal information 34. All entries become the property of the Promoter. By entering this competition, you are agreeing to receive further information from us delivered via to the address you use to enter this competition. If you wish to stop receiving this information, you may unsubscribe at any time using the unsubscribe facility included in each communication that we send you. We collect your information so that you can participate in this competition. If you do not give us the information, you cannot participate. We may use this information for the purposes of the conduct of this competition and the compilation of survey results and evidence. We may disclose this information to third parties who provide us with administrative services. This information will be stored at the office of the Promoter. You can contact our Privacy Officer if you would like details of the personal information we hold about you at By entering this competition, you consent to the Promoter using and disclosing your personal information in these ways. 36. The Promoter will not otherwise disclose your personal information to third parties. 37. If you advise the Promoter that you do not wish us to use your personal information for any particular purpose, the Promoter will endeavor to take the necessary measures to meet your request. Exceptions to this are: (i) where the Promoter are required to disclose information by law; (ii) where the Promoter believe that the use or disclosure is reasonably necessary to assist a law enforcement agency or an agency responsible for government or public security as a necessary part of their business; and (iii) if the

6 Promoter notify you of an intended use or disclosure of your information and you do not object to that use or disclosure. You indemnify us 38. You release and agree to keep the Promoter indemnified from any claim, cost, demand, tax, liability or damage (including legal costs on a full indemnity basis) suffered or incurred by us, our directors, employees, agents and representatives arising out of your entry in this competition or any claim by a third party arising from an act or omission by you. Failure to comply and severability 39. The Promoter is not liable for any failure to comply with these conditions. If any part or provision in these conditions is found to be invalid, unenforceable or illegal for any reason, that part or provision shall be severed and the remaining provisions shall continue in full force. Entire agreement and governing law 40. These Conditions of Entry constitute the entire agreement between you and the Promoter as to its subject matter. By entering this competition, you accept that this agreement is to be interpreted, and any disputes are to be determined by the courts having jurisdiction in Australia, in accordance with the laws in force in New Zealand from time to time, subject to any written directions from any regulatory authority.
