Terms and Conditions Governing OCBC Bank 2012 Data Collection Promotion 1. Promotion 1.1. The OCBC Bank 2012 Data Collection Promotion ( Promotion ) is organized by OCBC Bank (Malaysia) Berhad ( OCBC Bank ). The Promotion is open to all Eligible Customers (defined below) and runs from 29 October 2012 to 16 November 2012 ( Promotion Period ) subject to these terms and conditions. 2. Eligibility 2.1 Participation in this Promotion is strictly by invitation only. OCBC Bank s customers who shall receive distribution mailer ( Promotion Mailer ) containing a form prescribed by OCBC Bank for the customers to update their contact details maintained with OCBC Bank ( Prescribed Form ) shall be eligible to participate in this Promotion save and except the following who shall not be eligible and are disqualified from participation in this Promotion (notwithstanding that such customers have received the Promotion Mailer) : (a) employees of OCBC Bank; (b) customers who are younger than 18 or older than 65 years old; (c) customers who do not have any currently valid savings or current account with OCBC Bank or credit card issued by OCBC Bank; (d) customers whose accounts with OCBC Bank shall have been suspended or terminated or who are not in good standing (as determined by OCBC Bank at its sole and absolute discretion); (e) customers who shall have breached any agreement with OCBC Bank, (an OCBC Bank customer who is invited by the Promotion Mailer and not disqualified is referred to as an Eligible Customer ). 3. Promotion mechanics 3.1 The Promotion Mailer containing the Prescribed Form will be dispatched to OCBC Bank s customers by post throughout the Promotion Period. 3.2 To participate in the Promotion, an Eligible Customer who receives the Promotion Mailer shall do and fulfil all of the following steps on or before 16 November 2012 : (a) fill in and complete the Prescribed Form with the Eligible Customer s latest information; (b) sign agreement with the terms and conditions as indicated in the Prescribed Form; and (c) send the duly completed and signed Prescribed Form to OCBC Bank by any one of the following mode of delivery : (i) by personal delivery to any of OCBC Bank branches in Malaysia; or (ii) by contacted through OCBC Bank Contact Centre at [1300 88 5000]; or (iii) by post to OCBC Bank via OCBC Business Reply Envelop, provided that these steps in clause 3.2 shall only be considered fulfilled by the Eligible Customer if and when the Prescribed Form actually received by OCBC Bank by 16 November 2012], and the Eligible Customer s signature affixed on the Prescribed Form must match the specimen signature in OCBC Bank s records. 3.3 Each Eligible Customer : (a) represents and warrants that all the information provided in the Prescribed Form is correct, accurate, complete and up-to-date; (b) authorises and instructs OCBC Bank, upon receipt of the Prescribed Form, to forthwith modify and update the information currently kept in OCBC Bank s records, in accordance with the information provided in the Prescribed Form; (c) authorises OCBC Bank or its authorized agents/representatives to contact the Eligible Customer at the contact information provided in the Prescribed Form, in any manner and for any purpose (including purposes not connected with this Promotion) as OCBC Bank shall in its absolute discretion deem appropriate; and (c) agrees to indemnify OCBC Bank from and against all losses, damages, costs, expenses and fees if any of the information provided in the Prescribed Form is incorrect, inaccurate, incomplete or outdated. 2012 Data Collection Samsung Galaxy S3/ Page 1 of 7

3.4 An Eligible Customer who has fulfilled all the steps in clause 3.2 above to OCBC Bank s satisfaction ( Participating Customer ) shall be given: (a) 5 chances (if the mode of delivery is by personal delivery or contacted through contact centre under clause 3.2(c) (i) or (ii) above); or (b) 1 chance (if the mode of delivery is by post under clause 3.2(c) (iii) above), to be selected to win a Prize (defined below) subject to these terms and conditions. 3.5 On [21 December 2012] ( selection date ), 3 Participating Customers will be selected randomly from the pool of Participating Customers based on the number of chance(s) earned in the manner stated above. Once a Participating Customer is selected, all the chance(s) earned by the selected Participating Customer shall be extinguished, cancelled and of no further effect whatsoever, regardless of whether or not the selected Participating Customer eventually wins any Prize (defined below). 3.6 The 3 selected Participating Customers will be contacted by telephone (at the number provided in the Prescribed Form sent to OCBC Bank) within [5 working days] from the selection date. Should the first attempt to call the selected Participating Customer fail for whatsoever reason such as no reply, telephone number not in service, no connection, or any other reasons, another two (2) attempts shall be made within the next two (2) hours of the first attempt. If the selected Participating Customer cannot be contacted by the third attempt, the selected Participating Customer shall forthwith be disqualified from the Promotion. In that event OCBC Bank may, but is not obliged to, select again from the pool of remaining Participating Customers based on the number of chance(s) earned, and such selected Participating Customer shall be subject to the same terms and conditions stated above. 3.7 Upon being contacted, the selected Participating Customer will be required to answer one (1) question correctly, to be entitled to receive a Prize (defined below). If the selected Participating Customer fails to answer the question correctly, he/she shall forthwith be disqualified from the Promotion and shall not be entitled to receive any Prize (defined below). Whereupon OCBC Bank may, but is not obliged to, select again on the terms and conditions set out above for selection of potential winners. 3.8 A selected Participating Customer who shall answer the one (1) question asked of him/her correctly upon being contacted in the manner provided above, shall be announced as the Winner to entitle to receive a Prize (defined below). 4. Prizes 4.1 OCBC Bank is giving out a total of 3 units of Samsung Galaxy S3 handphone ( Prizes, each unit is a Prize ) in this Promotion. The following terms and conditions apply to the Prizes: (a) The Prizes are given on an as is where is basis and do not include any accessory items which may be shown in any advertisements or promotional materials as they are for illustrative purposes only. (b) (c) (d) (e) The Prizes are not transferable and not exchangeable for cash, credit or kind The Prizes are manufactured or produced by third party (ies) ( Manufacturer(s) ). To the fullest extent permitted by law, OCBC Bank does not make and hereby expressively excludes and disclaims any representations or warranties with respect to the Manufacturer(s) and the Prizes. In particular, OCBC Bank gives no warranty or endorsement, express or implied, written or oral, including but not limited to, any warranty in respect of merchantability quality or suitability or fitness for any purpose in respect of the Prizes. Any issue or query in respect of the Prizes shall be dealt with directly with the Manufacturer(s). OCBC Bank reserves the right to substitute any of the Prizes with other products or services with prior notice, in which case the substituted products or services shall be subject to the same terms and conditions governing the Prizes mutatis mutandis. 4.2 The Prizes will be sent by registered post to the Winners within [30 days] from the winner announcement, the Winners addresses to be based on the information provided in the Prescribed Form. OCBC Bank shall not be responsible for, and shall not be obliged to replace, any Prizes which are damaged, lost, returned or undelivered for whatever reasons and OCBC Bank will not make any alternative arrangement for delivery or collection of the Prizes. 2012 Data Collection Samsung Galaxy S3/ Page 2 of 7

4.3 The Prizes will be sent to the Winners by third party seller(s)/vendor(s). The Winners by their participation in the Promotion by answering the question referred to above shall be deemed to have authorised OCBC Bank to disclose their personal data to the third party seller(s)/vendor(s) for purposes of sending the Prizes. 4.4 Notwithstanding anything herein, OCBC Bank reserves the right to forfeit the Prize and disqualify the Winner at any time in any of the following circumstances: (a) a Winner shall breach any agreement with OCBC Bank; or (b) a Winner shall be found to be ineligible or disqualified from participation in this Promotion; or (c) a Winner shall cease to hold any account(s) with OCBC Bank. 5. General 5.1 OCBC Bank shall not be held liable to anyone for any loss or damage arising from or in connection with the Promotion, including without limitation, any error in computing any chances, any breakdown or malfunctions in any computer system or equipment. Without prejudice to the generality of the foregoing, OCBC Bank assumes no responsibility for lost, late, misdirected, damaged, incomplete, illegible and/or postage-due mail. 5.2 The decision of OCBC Bank on all matters relating to the Promotion including, without limitation, the eligibility of any participant in the Promotion, the bases and methods of awarding the chances, any dates in connection with the Promotion and the timing of receipt of duly completed Prescribed Forms by OCBC Bank, shall be final and binding on all participants of the Promotion and any other persons, including, without limitation, any decision to cancel or suspend the Promotion. No correspondence will be entertained. 5.3 In the event of any inconsistency between these terms and conditions and any brochure, marketing or promotional material relating to the Promotion, these terms and conditions shall prevail. 5.4 OCBC Bank may at any time at its absolute discretion and without assigning any reason therefor, delete, vary, supplement, amend or modify any one or more of these terms and conditions, with notice. In addition, OCBC Bank reserves the right at its absolute discretion without being required to assign any reason to terminate the Promotion without any liability on its part (whether accrued or otherwise). 5.5 Each participant in the Promotion shall indemnify OCBC Bank for any claims, actions, losses, damages or costs (including legal costs on a full indemnity basis) made against or incurred by OCBC Bank in respect of or in connection with the Promotion. 5.6 OCBC Bank s record(s) and documentation on any matters in connection with the Promotion shall be binding and conclusive for all purposes and in any legal proceedings. 5.7 Without prejudice to these terms and conditions, all participants in the Promotion expressly and irrevocably permit and authorise OCBC Bank to disclose, reveal and divulge information regarding their particulars to the parties involved in organising, promoting and conducting any marketing or promotional activities in connection with the Promotion and any other party as OCBC Bank may consider necessary, expedient or desirable for the purpose of or in connection with the Promotion. 5.8 These terms and conditions shall be governed by and construed in accordance with the laws of Malaysia, and the participants shall be deemed to have agreed to submit to the exclusive jurisdiction of the Malaysian Courts. 2012 Data Collection Samsung Galaxy S3/ Page 3 of 7

Promosi 1.1 Promosi ("Promosi") Pengumpulan Data OCBC Bank 2012 yang dianjurkan oleh OCBC Bank (Malaysia) Berhad ("OCBC Bank"). Promosi ini terbuka kepada semua Pelanggan yang Layak (ditakrifkan di bawah) dan berlangsung dari 29 Oktober 2012 hingga 16 November 2012 ("Tempoh Promosi") tertakluk kepada terma dan syarat. 2. Kelayakan 2.1 Penyertaan Promosi ini adalah melalui jemputan sahaja. Pelanggan OCBC Bank yang menerima mailer ("Promosi Mailer") yang mengandungi borang maklumbalas yang ditetapkan oleh OCBC Bank untuk pelanggan mengemaskini maklumat penghubungan mereka dikekalkan dengan OCBC Bank ("Borang Maklumbalas") adalah layak untuk menyertai Promosi ini kecualiyang tidak layak dan hilang kelayakan untuk menyertai dalam Promosi ini (walaupun bahawa pelanggan itu menerima Promosi Mailer) adalah seperti berikut: (a) Kakitangan OCBC Bank (b) Pelanggan yang berusia kurang daripada 18 tahun dan lebih daripada 65 tahun. (c) Pelanggan yang tidak sah memiliki OCBC Bank Akaun Simpanan atau Akaun Semasa atau Kad Kredit keluarkan oleh OCBC Bank. (d) Pelanggan yang memiliki akaun yang telah digantung atau ditutup atau yang tidak berada dalam kedudukan yang baik (seperti yang ditentukan oleh OCBC Bank atas budi bicara tunggal dan mutlaknya) (e) Pelanggan yang pernah melanggar syarat perjanjian OCBC Bank. (pelanggan OCBC Bank yang diundang oleh Mailer Promosi dan tidak hilang kelayakan dirujuk sebagai "Pelanggan Yang Layak"). 3. Mekanik Promosi 3.1 Mailer Promosi mengandungi Borang maklumbalas yang akan dihantar kepada pelanggan OCBC Bank melalui pos dalam Tempoh Promosi. 3.2 Untuk menyertai Promosi ini, Pelanggan yang Layak yang menerima Mailer Promosi hendaklah dilakukan dan memenuhi semua langkah-langkah berikut pada atau sebelum 16 November 2012: (a) Pelanggan yang Layak hendaklah isi dan lengkapkan Borang Maklumbalas dengan mengemaskini maklumat terkini (b) Menandatangani perjanjian dengan Terma dan Syarat seperti yang dinyatakan dalam Borang Maklumbalas; (c) Kembalikan Borang Maklumbalas yang lengkap diisi dan ditandatangani kepada OCBC Bank melalui salah satu mod penghantaran berikut: (i) Penghantaran peribadi kepada sebarang cawangan OCBC Bank di Malaysia; atau (ii) Mengemaskini melalui hubungi Pusat Perhubungan OCBC Bank di 1300 88 5000; (iii) Melalui pos kepada OCBC Bank dengan Sampul Surat Jawapan Perniagaan, dengan syarat bahawa langkah-langkah 3.2 fasal hanya akan dianggap dipenuhi oleh Pelanggan yang Layak jika dan apabila Borang Maklumbalas diterima oleh OCBC Bank 16 November 2012, dan tandatangan Pelanggan yang Layak yang dilekatkan pada Borang Maklumbalas mesti seperti tandatangan dalam rekod OCBC Bank. 3.3 Setiap Pelanggan Yang Layak: (a) Mewakili dan menjamin bahawa semua maklumat yang diisi dalam Borang Maklumbalas adalah betul, tepat, lengkap dan terkini. (b) Membenarkan dan mengarahkan OCBC Bank, apabila menerima Borang Maklumbalas, dengan serta-merta mengubah dan mengemaskini maklumat yang kini dalam rekod OCBC Bank seperti maklumat yang diberikan dalam Borang Maklumbalas; (c) membenarkan OCBC Bank atau ejen yang diberi kuasa / wakil untuk menghubungi Pelanggan Layak di maklumat perhubungan yang diberikan dalam Borang Maklumbalas, dalam sebarang cara dan untuk sebarang maksud (termasuk tujuan yang tidak berkaitan 2012 Data Collection Samsung Galaxy S3/ Page 4 of 7

(d) dengan Promosi ini) sebagai OCBC Bank hendaklah mengikut budi bicara mutlaknya difikirkan sesuaidan. Bersetuju untuk menanggung rugi OCBC Bank daripada dan terhadap segala kerugian, kerosakan, kos, perbelanjaan dan yuran jika mana-mana maklumat yang disediakan dalam Borang Ditetapkan adalah tidak betul, tidak tepat, tidak lengkap atau ketinggalan zaman. 3.4 Pelanggan Layak yang telah memenuhi langkah-langkah dalam fasal 3.2 di atas untuk kepuasan OCBC Bank ("Pelanggan Penyertaan") hendaklah diberikan: (a) Lima (5) peluang (jika penghantaran adalah dengan penghantaran peribadi atau mengemaskini melalui pusat hubungan di bawah fasal 3.2 (c) (i) atau (ii) di atas); (b) Satu (1) peluang (jika penghantaran adalah melalui pos di bawah fasal 3.2 (c) (iii) di atas),akan dipilih untuk memenangi Hadiah (ditakrifkan di bawah) tertakluk kepada terma dan syarat. 3.5 Pada [21 Disember 2012] ("Tarikh Pemilihan"), Tiga (3) Pelanggan yang Menyerta akan dipilih secara rawak dari kolam Pelanggan Sertaan berdasarkan bilangan peluang yang diperolehi dalam cara yang dinyatakan di atas. Setelah Pelanggan Sertaan dipilih, semua peluang yang diperolehi oleh Pelanggan yang dipilih Penyertaannya hendaklah dipadamkan, dibatalkan dan tidak dapat dikesan lagi jua, tanpa mengira sama ada atau tidak Pelanggan yang dipilih Penyertaannya memenangi sebarang Hadiah (ditakrifkan di bawah). 3.6 Tiga (3) Penyertaan Pelanggan dipilih akan dihubungi melalui telefon (seperti nombor yang tertera di dalam Borang Maklumbalas yang dikembali kepada OCBC Bank) dalam tempoh [5 hari bekerja] dari tarikh pemilihan. Sekiranya percubaan pertama untuk memanggil Pelanggan yang dipilih tidak berjaya atas sebab-sebab seperti tiada jawaban, nombor telefon tiada dalam perkhidmatan, tiada sambungan, atau sebab lain, dua (2) kali panggilan akan dibuat dalam masa tempoh dua (2) jam seterusnya selepas cubaan pertama. Jika Pelanggan yang dipilih tidak dapat dihubungi oleh percubaan ketiga (Pelanggan yang dipilih adalah serta-merta hilang kelayakan daripada Promosi. Dalam bahawa acara OCBC Bank boleh, tetapi tidak diwajibkan untuk memiilih lagi dari baki kolam Pelanggan Penyertaan berdasarkan bilangan peluang yang diperolehi, dan Pelanggan dipilih hendaklah tertakluk kepada terma dan syarat yang sama yang dinyatakan di atas. 3.7 Apabila dihubungi, Pelanggan yang dipilih dikehendaki menjawab satu (1)soalan ringkas, hadiah akan diberikan kepada Pelanggan yang Menyerta yang mejawab dengan betul (ditakrifkan di bawah). Jika Pelanggan yang dipilih tidak berjaya menjawab dengan betul, dia hendaklah dengan serta-merta hilang kelayakan daripada Promosi dan tidak berhak untuk menerima sebarang Hadiah (ditakrifkan di bawah). OCBC Bank boleh dan tidak diwajibkan untuk memilih lagi pemenang berpotensi tertakluk di atas terma dan syarat yang dinyatakan. 3.8 Sekiranya Pelanggan yang terpilih menjawab satu (1) soalan dengan betul akan dimaklumkan sebagai Pemenang dan menerima Hadiah (ditakrifkan di bawah). 4.Hadiah 4.1 OCBC Bank menyediahkan 3 buah bimbit telefon Samsung Galaxy SIII ( Hadiah ) untuk promosi ini. Berikut Terma dan Syarat terpakai kepada hadiah: (a) Hadiah diberikan dalam kondisi seadanya dan tidak termasuk aksesori tambahan yang ditunjukkan dalam risalah iklan atau promosi yang untuk tujuan ilustrasi sahaja. (b) Hadiah tidak boleh ditukar milik atau ditukarkan dengan wang tunai, kredit atau sebaliknya, secara keseluruhan atau dibahagikan. (c) Hadiah adalah pembuatan atau dihasilkan oleh pihak ketiga ( Pihak Pengeluar ). Maka selagi dibenarkan di bawah undang-undang, OCBC Bank tidak membuat sebarang tuntutan dan secara terbuka mengecualikan dan menafikan sebarang perwakilan atau jaminan ke atas Hadiah yang diberikan dalam promosi ini, terutamanya, pihak OCBC Bank tidak memberi termasuk sebarang jaminan atau sokongan, baik secara langsung atau tidak langsung, bertulis atau lisan, tetapi tidak tertakluk kepada sebarang jaminan kualiti, kualiti boleh dagang Hadiah yang diberikan atau kesesuaiannya untuk sebarang kegunaan. (e) Pihak OCBC Bank secara mutlaknya berhak untuk mengganti atau menukar Hadiah dengan produk yang mempunyai nilai yang sama pada bila-bila masa dengan memberi notis terlebih dahulu. di mana produk atau perkhidmatan yang digantikan hendaklah tertakluk kepada terma dan syarat yang sama mengawal Hadiah. 4.2 Hadiah akan dihantar melalui pos berdaftar kepada Pemenang dalam tempoh 30 hari daripada pengumuman pemenang, alamat Pemenang 'berdasarkan kepada maklumat yang diberikan dalam Borang Maklumbalas. OCBC Bank tidak akan bertanggungjawab untuk menggantikan, mana-mana Hadiah yang rosak, hilang, dipulangkan atau tidak dihantar atas apa-apa sebab dan OCBC Bank tidak akan membuat apa-apa alternatif untuk penghantaran atau pengambilan Hadiah. 4.3 Hadiah akan dihantar kepada Pemenang oleh penjual atau pihak ketiga. Pemenang yang Menyerta dalam Promosi ini yang berjaya menjawab soalan yang disebut di atas hendaklah disifatkan mempunyai OCBC Bank dibenarkan untuk mendedahkan data peribadi mereka kepada penjual / pihak ketiga bagi tujuan menghantar Hadiah 4.4 Pihak OCBC Bank berhak secara mutlaknya untuk membatalkan penyertaan terbabit dalam Promosi ini dan menarik balik hadiah yang telah dimenangi oleh Pemenang sekiranya keadaan berikut berlaku: (a). Pemenang yang melanggar perjanjian dengan OCBC Bank. (b) Pemenang didapati tidak layak atau hilang kelayakan daripada penyertaan promosi ini ; atau (c) Pemenang hendaklah yang berhenti memiliki mana-mana akaun dengan OCBC Bank. 5. Umum 5.1 OCBC Bank tidak akan bertanggungjawab kepada sesiapa terhadap sebarang kehilangan atau kerosakan yang berbangkit daripada atau berhubung dengan Promosi, termasuk tanpa had, apaapa kesilapan dalam pengkomputeran sebarang peluang, apa-apa kerosakan atau kepincangan dalam sistem mana-mana komputer atau peralatan. Tanpa menjejaskan keluasan peruntukan yang terdahulu, OCBC Bank tidak bertanggungjawab untuk kehilangan, kelewatan, kesalahan arahan, kerosakan, ketidak lengkapan dan/atau ketidak boleh dibacaan yang disebabkan pos mel. 5.2 Keputusan OCBC Bank ke atas semua perkara yang berkaitan dengan Promosi termasuk, tanpa had, kelayakan mana-mana peserta dalam Promosi, asas dan kaedah pemberian peluang, sebarang tarikh berkaitan dengan Promosi dan masa penerimaan sewajarnyasiap Borang Maklumbalas oleh OCBC Bank, adalah muktamad dan mengikat semua peserta Promosi dan mana-mana orang lain, termasuk, tanpa had, apa-apa keputusan untuk membatalkan atau menggantung Promosi. Sebarang surat-menyurat tidak akan dilayan. 5.3 Sekiranya berlaku apa-apa ketidakselarasan antara terma dan syarat ini dan mana-mana brosur, bahan pemasaran atau promosi yang berkaitan dengan Promosi, terma dan syarat ini akan diguna pakai. 5.4 OCBC Bank boleh pada bila-bila masa mengikut budi bicara mutlaknya dan tanpa memberikan apa-apa sebab baginya, memadam, mengubah, menambah, meminda atau mengubahsuai manamana satu atau lebih daripada terma dan syarat ini, dengan notis. Di samping itu, OCBC Bank berhak mengikut budi bicara mutlaknya tanpa perlu memberi sebarang alasan untuk menamatkan Promosi tanpa sebarang liabiliti pada bahagian (sama ada terakru atau sebaliknya). 5.5 Setiap peserta dalam Promosi ini hendaklah menanggung rugi OCBC Bank untuk apa-apa tuntutan, tindakan, kerugian, kerosakan atau kos (termasuk kos guaman atas dasar indemniti penuh) yang dibuat terhadap atau ditanggung oleh OCBC Bank berkenaan dengan atau berkaitan dengan Promosi. 5.6 Rekod OCBC Bank dan dokumentasi ke atas mana-mana perkara yang berkaitan dengan Promosi hendaklah mengikat dan muktamad bagi segala maksud dan dalam apa-apa prosiding undangundang. 5.7 Tanpa prejudis kepada terma dan syarat ini, semua peserta dalam Promosi telah menyatakan dan tidak boleh ditarik balik permit dan membenarkan OCBC Bank untuk mendedahkan, mendedahkan dan mendedahkan maklumat mengenai butir-butir mereka kepada pihak yang terlibat dalam menganjurkan, mempromosi dan menjalankan apa-apa aktiviti pemasaran atau promosi yang 2012 Data Collection Samsung Galaxy S3/ Page 6 of 7

berkaitan denganpromosi dan mana-mana pihak lain sebagai OCBC Bank difikirkan perlu, suaimanfaat atau wajar bagi maksud atau berkaitan dengan Promosi. 5.8 Terma dan syarat hendaklah ditadbir oleh dan ditafsirkan selaras dengan undang-undang Malaysia, dan peserta hendaklah disifatkan telah bersetuju untuk menyerahkan kepada bidang kuasa eksklusif Mahkamah Malaysia. 2012 Data Collection Samsung Galaxy S3/ Page 7 of 7
