ART TAIPEI 2010 Terms and Conditions To protect the rights of participating members in ART TAIPEI 2010, please act in accordance with the following conditions. I. Sectors and Admission Requirements Art Galleries:For all galleries Mega Contemporary : For contemporary arts only Ela-Video:For electronic arts only (video, film, multimedia, digital, interactive) Art Taipei PHOTO:For photography only Decisions on the selection or rejection of exhibitors are made by Art Taipei 2010 Executive Committee. The exhibitor guarantees that all application information is accurate and that all work submitted for exhibition is authentic and will not be changed after application. Organizer reserve the right to terminate the exhibitor s participation or remove any exhibiting objects if exhibitor for those who didn t follow this clause. II. Shipping Only the shipments forwarded through ART TAIPEI 2010 appointed official forwarder can have the tariff-free (5%) and other service from organizer. The exhibitor should pay for 5% VAT for sold artworks. For those who chose other forwarders under any circumstance, tariff and related fees for exhibition are at exhibitor s own expense. III. Withdrawal Subject to this Clause, the Exhibitor may, by notice in writing delivered to the Organizer and cancel its booking by way of cancellation fees shall be payable by the Exhibitor as following. Cancellation Date & Cancellation Fee Before March 15 th 2010: US $1,000 administration fees will be charged. No refund can be made after March 15 th, 2010 Organizer reserve the right to terminate the exhibitor s participation or remove any exhibiting objects if exhibitor lease booth to other exhibitors, failure to make payments by deadlines, interfere with the exhibition or cause physical danger to other exhibitors, visitors or organizers. IV. Security and Insurance 1. 24 hour security service will be arranged for the exhibition areas from the first day of installation until all the booths are dismantled. All items on the exhibition area cannot be taken out without the permission from the organizer during the fair period. 2. During the installation and exhibition, all exhibitors and agents and employees can only enter the venue with Exhibition Pass. 3. In order to maintain exhibition s security, before artwork is released from exhibition, please fill out Art Taipei Release Form and bring it with Exhibitor Pass or business card to the Exhibitor Service Center. After examination from the executive committee, the artwork will be released. 4. Each exhibitor should obtain full insurance coverage for loss or damage to all exhibits and properties during the fair period. All exhibitors shall be responsible to hold every disaster- prevention and safety rules applicable for the exhibition site and must obtain insurance coverage for damage or loss due to fire, theft, burglary, breakage, leakage, water damage and the risks of transport to during the exhibition. In any event, the exhibitor assumes all risks of loss related thereto. The organizer and staff shall not be responsible for any injuries of exhibitors, the related workers, or visitors and for any damages or loss of exhibition materials or decorative display equipments during carrying-in/ out and the exhibition period. All exhibitors shall be responsible for the compensation for the damage and loss caused by the related workers on other exhibitors and display materials, visitors and on facilities in the exhibition hall. The organizer
will not be liable to any exhibitor for any direct, incidental or consequential damage or loss to exhibitor or his/ her property arising from or connected with exhibitor s participation. V. Occupation of Space 1. The Exhibitor shall occupy the whole of its allocated Space at the commencement of the Exhibition and for the entire duration of the opening hours of the Exhibition. 2. The Exhibitor shall not sub-let, share or part with occupation of the Space or any part of it. 3. The Exhibitor s Stand shall be constructed in accordance with the regulations set out in the Exhibition Manual. The Exhibitor shall comply with all instructions of the Organizer and/or its agents in respect of the construction of the Stand. 4. The allocated space location and floor map shall be provisional and subject to change prior to the Exhibition. The Organizer shall be entitled to relocate the Exhibitor s Space at any time prior to the Exhibition and, if necessary, reduce the Space allocated provided that a rebate of the Fee is granted to the Exhibitor pro rata to the reduction of the Space. 5. The Exhibitor shall vacate the Space at the end of the period of the Exhibition or otherwise in accordance with the Organizer s request. In the event that the Exhibitor fails to vacate the Space, it shall indemnify and keep indemnified the Organizer against any losses, costs incurred as a result of the Exhibitor s failure to vacate. VI. Exhibitor s Obligations 1. The Exhibitor shall not supply from the Stand or elsewhere at the Exhibition any food, drink or tobacco. 2. The Exhibitor shall comply with and observe all laws and regulations relevant to his use of the Stand during the Exhibition, including but not limited to the house rules of the Venue. 3. The Exhibitor shall indemnify the Organizer and hold the Organizer harmless against all loss, damages, claim and costs resulting from the Exhibitor s use of the Space and the acts and omissions committed by the Exhibitor and its agents, servants and invitees. VII. Force Majeure In the presence of any good and sufficient cause, third-party default, accidental happening, political and economic events, and orders by authorities, the Exhibition Management has the right to postpone an event, shorten or prolong its duration, cancel it, or adapt its operation to circumstances. In all such cases, the Exhibition Management rejects any liability, and the exhibitor will not be entitled to withdraw from the contract or to claim compensation. Compensation or refund will not be given in such occasions.
