The minutes of the Regular Meeting of the Village of Haverstraw Board of Trustees on Monday, August 20 th, 2018, beginning at 7:00 PM. PLEDGE OF ALLEGIANCE ROLL CALL Trustee Bueno - Present Trustee Watson - Absent Trustee Dominguez - Present Trustee Santana - Present Mayor Kohut - Present Mayor Kohut: The Mayor opened the meeting with the first Public Participation, inviting people to ask questions or make comments. Larry Levine, 1414 Round Point Drive: Mr. Levine requested information with regard to the work being done in the area of Maple Avenue adjacent to Head Start. Mayor Kohut: The Mayor informed Mr. Levine that Orange & Rockland (O&R) are at that location doing clean-up work due to the contamination at that site. Larry Levine: Mr. Levine then inquired if anything is planned to be built on that site after the clean-up. Mayor Kohut: The Mayor responded that there are currently no definite plans for that property. The Village would like for them to turn the property over to the Village, however, to date no decisions have been made. Amy Miele, Attorney for 45 Hillside Avenue: Counselor Miele stated that her client would like to modify an existing residential structure on this property, known as Green Hills, for use as an Adult Day Care Facility. The owners are aware that a Special Permit is required for this modification and are therefore requesting approval of the Village Board to forward their application to the Planning Board for their review and recommendation. She explained that there would be no overnight stays at this facility and that participants would be bused there in the morning and returned to their homes at the end of the day. There would be a small kitchen in the facility, however, there would be no actual cooking taking place at the facility; food would be delivered from the main facility adjacent to this building. Counselor Miele also mentioned that there is sufficient parking in the area for staff, etc. They are also aware that a review by Brooker Engineering would be required. John Atzl of Atzl, Nasher & Zigler, Surveyors: Mr. Atzl pointed out the surroundings of the area where the modification will take place and gave a brief overview of the renovations to be made to the existing building, which would include office space on the first floor and the Senior Center located in the basement of the building. To access the site, they will widen and utilize the driveway off of Fairmount Avenue. Parking will include 4 spaces, plus 1 handicapped space in the back and if not needed the parking in the front of the building will be removed. Emily Dominguez, Deputy Mayor: Deputy Mayor Dominguez asked how many people would be in the building including staff and seniors. Amy Miele: Counselor Miele responded that they actually need to further discuss occupancy in this building with the Building Inspector because currently there is nothing in the Village Code with regard to an Adult Day Care Facility ; the only items in the Code are Child Day Care and Group Homes.

Emily Dominguez: Deputy Mayor Dominguez inquired about the operating hours for the Senior Day Care. She is concerned that their buses may be running during the same time frame as the North Rockland school buses. Amy Miele: Counselor Miele believes it will be between 8:00 AM to 4:00 PM or 9:00 AM to 5:00 PM. Emily Dominguez: Deputy Mayor Dominguez then inquired if the employees would be full or part time. Amy Miele: Counselor Miele responded that the number of staff on hand could fluctuate depending on the number of participants that would be at the Center on any given day. Emily Dominguez: Having visited other Adult Day Care facilities, Deputy Mayor Dominguez inquired if there would be a nurse on staff at the facility. Amy Miele: Counselor Miele did not know if there would be a nurse at the facility, but she would find out from her client. She believes he will be utilizing some of the staff from Green Hills, but she will find out for certain upon the owner s return to the County. Joel I. A. Santana: Trustee Santana questioned if the 20 foot wide right-ofway was village property or the owner s property. John Atzl: Mr. Atzl informed Trustee Santana that is one of the village alleyways that are found on many of the old maps and is typically maintained by the Village. Mayor Kohut entertained a motion to refer this application to the Planning Board for its review and recommendation. RESOLUTION #141-2018 With no further input from the public, the Mayor continued with the agenda for that nights meeting announcing a Public Hearing with regard to changes being made to Village Code 195, Obstruction of Store Windows. Mayor Kohut entertained a motion to open the Public Hearing as stated above. RESOLUTION #142-2018 Mayor Kohut: The Mayor explained that this change came about through multiple discussions, the Streetscape completion, as well as other issues and concerns with the appearance of store windows in the downtown business district. The Mayor, along with Village Planner Max Stach and Building Inspector Ruben Berrios, have spent time walking throughout the business district and have viewed a variety of issues regarding store windows and storefronts. They came up with what they believe to be a more workable way to apply some uniformity to all the storefronts in the business district, still allowing some variety and particularity where people can display things in their windows. He mentioned that many of the storefronts are small with not a lot of room for displays and don t have a lot of storage inside the stores, however,

the Village does not want the window areas to be used as a storage facility, therefore, products must be kept away from the window unless they are in a display type atmosphere. He explained that this code will control that problem because it specifies the type of window, the type of lighting permitted and not permitted, the amount of coverage that will be permitted in a storefront window and it will give specifics regarding blinds, curtains and all other visual blocking mechanisms. The Board realizes that there are certain instances where a window needs to be blocked, such as strong sunlight damaging certain types of items including chocolate, clothing, etc., however the blockage cannot be a permanent thing. The Mayor feels that this is a sensible provision for storeowners to display their products, signage, etc. in a uniform manner. The Mayor then opened the floor to the public to ask questions or make comments. With no comments from the public, the Mayor entertained a motion to close the Public Hearing. RESOLUTION #143-2018 Seconded by: Emily Dominguez Mayor Kohut then entertained a motion to approve the changes to Village Code 195 Obstruction of Store Windows. RESOLUTION #144-2018 Seconded by: Emily Dominguez Public Participation: Zen Oster, Beekeeper, 5 Villager Court, Monsey, NY: Mr. Oster was approached by the Mayor about the possibility of keeping bees on Village property, mentioning that there are beehives on municipal properties throughout the County. He reported that bees are dying off at an alarming rate and no-one knows for sure why. Bees are a very important part of our natural ecosystem and he was happy to be invited by the Village to discuss the placement of hives at the Short Clove location. Emily Dominguez: Deputy Mayor Dominguez inquired if this is something he would take care of himself and how often he would be visiting the hives. Zen Oster: Mr. Oster stated that he and his son take care of the approximately 65 hives located throughout the County. Tending to the hives is dependent on the time of year; during the spring and fall they will tend to the hives anywhere between 3 to 7 days and during the winter months the bees hibernate so no real tending of the hives is required, however, they do visit them once a month during this time. Emily Dominguez: Deputy Mayor Dominguez inquired if there would be a cost to the Village for the care and maintenance of the hives. Zen Oster: Mr. Oster informed the Deputy Mayor that there would be no cost to the Village for this beehive project.

Emily Dominguez: Deputy Mayor Dominguez then asked what is done with the honey taken from the beehives. Zen Oster: Mr. Oster responded that he sells the honey. Joel Santana: Trustee Santana inquired if they take care of the hives at night or in emergency situations. Zen Oster: Mr. Oster informed Trustee Santana that they have been to hives at night and as needed if bees require transporting to different areas due to the loss of a queen, a hive dies, etc. In response to the Deputy Mayor s concern with regard to lighting for the area, he stated that they have special red lighting on their helmets and no other lighting is required. Judy Curcio: Ms. Curcio inquired about how much honey is extracted each year, to which Mr. Oster responded they took approximately 1500 pounds of honey the past year, which is how they recoup their cost for the care and maintenance of the beehives. Judy Curcio: Ms. Curcio then inquired if he treats the hives with any chemicals, to which he responded he does treat the hives for mites with a new natural treatment and because it is natural it does not contaminate the honey. He also mentioned that he has a farming insurance policy for a beekeeper. Robert Drexler, DPW Superintendent: Mr. Drexler inquired if the beehives are on the ground or raised up since the DPW maintains that area. Zen Oster: Mr. Oster informed Mr. Drexler that the hives sit on cinder blocks with wood shelving and he would maintain the area in close proximity around the hives, so there should be no problem for the DPW to maintain the rest of the area. Mel Post: Mr. Post inquired about the location of the hives, which the Mayor informed him would be inside the circle of Short Clove Road where the retaining pond is. Name not given: Will the hives be of a size that would be able to be seen going up or down the roadway and also how wide of an area do the bees pollinate. Zen Oster: Mr. Oster gets his bees from the Hudson Valley Bee Supply and calculated the hives to be 1½ to 2 feet, therefore they should be noticeable. The bees can pollinate anywhere from 3 to 5 miles. Judy Curcio: Ms. Curcio has 2 beehives in her yard and informed the public that these bees are not troublesome or annoying, they always use the same flight pattern and that all the plants and flowers prosper from bee pollination. Joel Santana: Trustee Santana inquired if Mr. Oster would be willing to do a couple of tours for the kids at the Community Center, which he feels would be a great learning tool for the kids, to which Mr. Oster responded he would be happy to do tours for the kids. Mayor Kohut: The Mayor explained his reasoning for wanting the bee hives in the Village is for people and especially the kids to be able to see and learn the good the bees do for everyone. He feels it could be more of an ecological center in our village.

Mayor Kohut: REPORTS OF VILLAGE OFFICIALS VILLAGE ATTORNEY, Jay Hood, Jr.: Counselor Hood was excused from the meeting, therefore no report was given. VILLAGE TREASURER, Judith Curcio: Ms. Curcio had nothing to report. MAYOR S REPORT, Mayor Kohut: Mayor Kohut entertained a motion authorizing him to sign the Amended 2018-2020 HUD/CDBG (Community Development Block Grant) Agreement with the County of Rockland. RESOLUTION #145-2018 The Mayor reported that repairs are needed to the roof, gutters & leaders and drywall at 16 Front Street. An estimate in the amount of $2,800.00 has been received from Construction by Allison, Inc. Mayor Kohut entertained a motion to approve the necessary repairs to 16 Front Street as stated above. RESOLUTION #146-2018 The Mayor reported that the gym floor at the Community Center is in dire need of repair. Excessive dampness caused mold and mildew under the tiles and therefore the entire floor needs to be taken up along with the existing water damaged underlayment, and everything necessary to prepare for the new flooring to be installed. An estimate of $14,800.00 has been received from Hudson Valley Sport Club, Inc. to do all the necessary repair work, plus painting all the necessary game lines for sports activities. Mayor Kohut entertained a motion to approve repair work on the Community Center gym floor by Hudson Valley Sport Club, Inc. as stated above. RESOLUTION #147-2018 The Mayor then reported on trees in the Village that need to be removed or trimmed, the 1 st on Gurnee Avenue, the 2 nd on Hudson Avenue and the 3 rd at Emeline Park. An estimate has been received from Northern Tree Service II, Inc. in the amount of $4,300.00 to remove the above 3 trees. Mayor Kohut entertained a motion to approve removal of 3 trees in the Village by Northern Tree Service as stated above.

RESOLUTION #148-2018 The Mayor has been notified that repair work is needed on the filter pump system for the fountain at the Harbors. He has received an estimate from American Pool to make the necessary repairs at a cost of $2,565.00 which includes labor and materials. Mayor Kohut entertained a motion to approve the necessary repair work to the fountain at Harbors as stated above. RESOLUTION #149-2018 The Mayor then mentioned that a new traffic light is needed at the corner of Gurnee and Westside Avenues. He has received an estimate from HUSH Electrical Contracting in the amount of $4,025.00, which includes labor and material, to install a new traffic light at this location. Mayor Kohut entertained a motion to approve the replacement of a village traffic light by HUSH Electric, as stated above. RESOLUTION #150-2018 The Mayor received a request from Hudson River Healthcare to host a mobile blood drive on Friday, September 14 th from 12:30 to 5:30 PM and to be able to park their vehicle (bus) in the parking lot located at 31 West Broad Street, adjacent to the Knights of Columbus, from 11:30 AM to 6:30 PM for set up and to finish processing donors. Mayor Kohut entertained a motion to approve the Hudson River Healthcare Blood Drive, allowing them to park their vehicle in the Village Parking Lot as stated above. He also mentioned that any employee wanting to give blood will be given the incentive of paid time to donate. RESOLUTION #151-2018 The Mayor has received a proposal from Carpets Plus, to rip up and replace the carpeting in the Court Room with luxury vinyl tile and repair the carpet in the Clerk s Office at this location for a total cost of $6,500.00. Mayor Kohut entertained a motion to replace carpeting in the Village Hall as stated above. RESOLUTION #152-2018

The Mayor requested approval of the Board to attend a Pattern s for Progress seminar on September 28 th at a cost of $60.00. Mayor Kohut entertained a motion to approve his attendance at a seminar as stated above. RESOLUTION #153-2018 Seconded by: Emily Dominguez Mayor Kohut then entertained a motion to award the Government Accounting Standards (GASB) 75 Actuarial Services Contract to Danziger & Markhoff at a fee of $2,950.00, which was the lowest proposal received. This contract is for other post employment benefits. RESOLUTION #154-2018 Mayor Kohut entertained a motion to authorize attendance by Justice Court staffers, Esther White, Toni Jones and Ryan Bates at the Annual Court Conference, to be held in Lake Placid, New York from September 16 th through September 19 th, 2018 at a total cost of $2,970.00 (cost to be taken from Justice Court budget). RESOLUTION #155-2018 Mayor Kohut entertained a motion authorizing the Mayor to sign the Renewal Agreement with Harbors Haverstraw HOA for Promenade maintenance in the amount of $15,000.00. RESOLUTION #156-2018 Mayor Kohut entertained a motion to authorize Village Attorney Jay Hood to sign the Tax Certiorari settlement with Mark Auto for a refund due of $3,646.14. RESOLUTION #157-2018 Mayor Kohut entertained a motion authorizing him to sign a 3 year contract with Paycheck for weekly payroll services at an approximate cost of $9,000.00 per year. RESOLUTION #158-2018

Mayor Kohut entertained a motion to schedule a Public Hearing for September 17 th with regard to establishing a Local Law restricting smoking of any kind in all Village parks. RESOLUTION #159-2018 Mayor Kohut then entertained a motion authorizing the Village Clerk to surplus 2 Ford Taurus vehicles. RESOLUTION #160-2018 The Mayor requested the Board s acceptance of the resignation by Mariely Urena from the position of Receptionist/Typist Spanish Speaking, wishing her the best in her future endeavors. Mayor Kohut entertained a motion to accept Ms. Urena s resignation effective the end of the month. RESOLUTION #161-2018 The Mayor then mentioned that this resignation will leave a vacancy in the front office which needs to be filled as soon as possible to continue running the office in a professional manner. Interviews have been held and a decision has been made to offer the position to Elaine Fernandez. Mayor Kohut entertained a motion to hire Elaine Fernandez to fill the vacated position in the front office. RESOLUTION #162-2018 The Mayor had nothing further to report. PUBLIC WORKS, BUILDINGS & GROUNDS Trustee Terence Watson: In the absence of Trustee Watson, Mayor Kohut read the following report submitted by Robert Drexler, Superintendent of Public Works, as of August 20 th, 2018: 1) Major renovation to catch basin pipe in the area of 164 Hudson Avenue. 2) Repaired damaged fencing at Jefferson Street Park, in the area of 164 Hudson Avenue and at Emeline Park where damaged parts in the playgrouond area were removed. 3) Repaired damaged benches and tables on both Broadway and Jefferson Street. 4) Repaired damaged electrical box at Emeline Park caused by a vehicle accident. 5) Repaired damaged drain on Sidewalk #9 (Main Street). 6) Fixed water problem in playground area at the Haverstraw Center. 7) Painted crosswalks and stop bars throughout the Village. 8) Trimmed and cut alleyways between New Main Street to Westside Avenue and 2 separate locations on Santiago Avenue. Continuing to water all plants/trees throughout the Village. 9) Blacktopped all village streets as needed. 10) Did work at the Manny Lopez Baseball Field. 11) Put millings in all alleyways throughout the Village for the upcoming winter season. 12) Put up safety wire for generator at the Municipal Building and cascade room. 13) Installed new signage on Allison Avenue and Halgren Crescent, and at the corner of Lopez Way & Broadway. 14) Set up and cleaned up for the Latin Day Festival. 15) A sewer job was completed at Clove & Fairmount Avenues and a new sewer manhole was installed at Clove Avenue alley off of Fairmount.

16) Removed everything from the gym area at the Haverstraw Center in preparation for the new gym floor. The Mayor then reported that Robert Drexler, DPW Superintendent is requesting permission to rent a Sealmaster System and materials to repair cracked ceilings in the Village at a cost of $10,150.00. Mayor Kohut entertained a motion to that effect. RESOLUTION #164-2018 Seconded by: Emily Dominguez The Mayor also reported that the Superintendent is looking to purchase a new 20 yard roll-off container for the purpose of snow removal. YOUTH & FAMILY SERVICES - Trustee Joel Santana: Trustee Santana read the following report of activities at the Community Center for the period of through August 20 th, 2018: 1) The Haverstraw Collaborative continues to meet monthly at the center. 2) Village Summer Camp began on July 9 th and will end on August 17 th with approximate attendance of 160 children. The camp hosted its Field Day on August 14 th and camp ended with a Talent Show on August 17 th. 3) Homework Program is scheduled to begin on September 5 th and there are currently 65 children, grades 3 through 8 signed up for the program. 4) Positive Alternatives will be run by Tim Sanders who will be holding basketball practice every Tuesday night for approximately 20 youth. 5) The camera system for the Center is almost complete and the P.A. system is still being worked on. 6) Completed repairs to the gym floor. Trustee Santana then thanked the Town of Haverstraw Police Department and the Village DPW for a job well done during the Latin Day Festival. Trustee Santana had nothing further to report. BUILDINGS & CODE ENFORCEMENT Deputy Mayor Emily Dominguez: The Deputy Mayor read the following report submitted by the Building Inspector, Ruben Berrios, for the period of July 16 th thru August 3 rd, 2018: Miscellaneous inspections - 109 Complaints - 15 Municipal searches - 6 Construction inspections - 6 Violations/Tickets - 27 Building Permits & C.O. s - 7

Fines collected at court - $3,500.00 Deputy Mayor Dominguez then gave the report for the period of August 6 th thru August 17 th as follows: Rental Registrations - 1 Miscellaneous inspections - 126 Complaints - 9 Municipal searches - 6 Construction inspections - 20 Violations/Tickets - 36 Building Permits & C.O. s - 6 Deputy Mayor Dominguez also expressed gratitude to both the Police Department and the Village DPW for the great job they did to make the Latin Day Festival a huge success. She had nothing further to report. MINUTES: The Mayor presented the minutes of the Regular Meetings of June 18 th and July 16 th for approval by the Board. Mayor Kohut entertained a motion to approve the above stated minutes as written. RESOLUTION #166-2018 Mayor Kohut: OLD BUSINESS None. Mayor Kohut: NEW BUSINESS None. Mayor Kohut: 2 nd PUBLIC PARTICIPATION Mel Post, 1422 Round Point Drive: Mr. Post inquired if any general public meetings scheduled will appear on the Village Website. Mayor Kohut: The Mayor informed Mr. Post that if it is a special meeting it will appear on the Village Website. Judith Curcio: Ms. Curcio also informed Mr. Post that any public hearings will appear on the Village Website and are also published in the newspaper. Mel Post: Mr. Post then requested an update on the Maple Avenue apartments and if the property is still owned by the same owner. Mayor Kohut: The Mayor responded that there has been no change of ownership or plans.

Mel Post: Mr. Post asked if the Beekeeper is a for profit organization. If so he feels he should be paying some kind of fee to the Village. Mayor Kohut: The Mayor would first like to talk with the County to see what they are doing with regard to remuneration. Mel Post: Mr. Post requested an update with regard to an agreement with Mr. Ginsburg. Mayor Kohut: The Mayor responded that it is a continuing process with little forward movement. He feels at some point soon there has to be some tax negotiations with the other taxing municipality or Mr. Ginsburg will just stop all dealings. He explained that the developer wants it all and the taxing jurisdictions are not in agreement. GDC is still moving forward with Site A, but the Mayor is not sure what is going to happen with Site B if Mr. Ginsburg does not get his way. Larry Levine: Mr. Levine inquired about the Village s responsibility with the lagoon area and the lighting maintenance because the lights have been on 24-7. Mayor Kohut: The Mayor informed Mr. Levine that the money he referred to is to offset some of the other costs (landscaping, snowplowing, flowers, the promenade, etc.). He reported that the Village has ownership of and is responsible for the promenade and everything between it. He informed Mr. Levine that the Village is also responsible for the lighting and any maintenance required, however, the Village has had that problem looked into that Mr. Levin previously asked about, but he will have it checked again. Larry Levine: Mr. Levine then inquired if it is the Village s responsibility to take care of the area from the rock area path to the water because there is so much debris and overgrowth in that area it is becoming an eyesore. Mayor Kohut: The Mayor responded that in essence it is the responsibility of the Village to maintain that area, however, it is not practical for the DPW staff to safely work in that area because they are not equipped for that type of clean-up. Mel Post: Mr. Post inquired if the rusted out wires were ever fixed or replaced at the Promenade. Robert Drexler, DPW: Superintendent Drexler informed Mr. Post that new synthetic roping has been ordered for the Promenade, but has not yet arrived. Mayor Kohut: With no further business to be conducted by the Board, the Mayor entertained a motion to adjourn the meeting in memory of Gil Musinger, Dale O Dell and Aiyanna Faria.
