MyWay Savings Account Mastercard Experience (17 Jul 30 Sep 2017) Promotion Terms and Conditions 1. This MyWay Savings Account Mastercard Experience (17 Jul 30 Sep 2017) Promotion (the "Promotion") is available from 17 July 2017 to 30 September 2017 (both dates inclusive) (the "Promotion Period") to all new and existing clients of Standard Chartered Bank (Singapore) Limited ( Standard Chartered or the Bank ), who are individuals and who hold a MyWay Savings Account 1 during the Promotion Period. By participating in this Promotion, you agree to be bound by these terms and conditions. Eligibility 2. To be eligible for this Promotion: a. you must hold (i) a MyWay Savings Account (the MyWay Savings Account ) as a main principal account holder and (ii) a MyWay Mastercard debit card ("MyWay Card") issued by the Bank as principal cardholder; and b. your MyWay Savings Account and your MyWay Card must be validly existing (i.e. must not be suspended, cancelled or terminated), in good standing, and conducted in a proper and satisfactory manner at all times, as determined by the Bank in its sole and absolute discretion. 3. For the avoidance of doubt, this Promotion is only applicable to MyWay Savings Accountholders during the Promotion Period only. MyWay Savings Account Mastercard Experience 4. If you satisfy the eligibility criteria in Clause 2 (read with Clause 3) above, you will be eligible to receive one (1) chance (the Chance ) as stipulated in the right-most column of Table 1 below, which corresponds to the qualifying criteria (as set out in the left-most column). Each Chance will allow you to participate in the Draw (as defined below) to win a Mastercard Experience package (the Mastercard Priceless Experience in Bali Package ) sponsored by Mastercard, for the winner and the winner s nominee. Table 1 Qualifying Criteria Every $1,000 of qualifying retail spend 2 on the MyWay Card during the Promotion Period Chance 1 (One) 1 MyWay Savings Account comprises a savings account and a MyWay Mastercard debit card which is linked to the savings account. Qualifying Criteria Every $10,000 of eligible balance in fresh funds in the MyWay Savings Account each month during the Promotion Period Chance 1 (One) Calculation of eligible fresh funds balance: 5. For the avoidance of doubt, fresh funds means funds that do not originate from any existing account with the Bank and funds that are not withdrawn and re-deposited with the Bank within the last 30 days of opening of your MyWay Savings Account. 6. The average daily balance ("ADB") in your MyWay Savings Account is calculated on a monthly basis and is used to determine the number of chance(s) earned on your eligible fresh funds balance. ADB is the sum of end-of-day account balances of all days in a particular calendar month, divided by the number of days in that month, where end-of-day account balances means account balances as of 2359 hours of each day: a. If there are n days in a calendar month and X1, X2, X3,, Xn are the end-of-day account balances from Day 1 to Day n respectively, the ADB for the account will be: X1 + X2 + X3 + + Xn -------------------------------------------- n b. For example, if (i) there are 31 days in August 2017, (ii) the end-of-day account balance on each day between 1 August 2017 and 15 August 2017 is S$0, and (iii) the end-of day account balance on each day between 16 August 2017 and 31 August 2017 is S$1,000, the ADB for the account for August will be: (S$0 x 15) + (S$1,000 x 16) ------------------------------------ = S$516.13 31 c. As this Promotion begins on 17 July, for the month of July, we will divide the sum of end of day account balances by the number of days remaining in July, starting from the date your account was opened. d. If you open your account in the middle of a calendar month during the Promotion Period, we will divide the sum of end of day balances by the number of days remaining in that month, starting from the date your account was opened. 2
7. To ascertain the eligible balance in fresh funds for a particular month, we will take the ADB of your MyWay Savings Account for that calendar month during the Promotion Period in blocks of S$10,000. To illustrate, if you have an eligible balance in fresh funds of S$19,000 you will only get one chance. 8. To ascertain the eligible card spends during the Promotion Period, we will take the total retail card spends on your MyWay Card throughout the Promotion Period in blocks of S$1,000. To illustrate, if you have eligible total spends of S$1,900 you will only get one chance. 9. At the end of the Promotion Period, we will add up all your chances earned throughout the Promotion Period. To illustrate, if you have an ADB in eligible fresh funds of S$100,000 in August 2017, an ADB in eligible fresh funds of S$100,000 in September 2017, and a total eligible card spends of S$5,000 during the Promotion Period you will get a total of 25 chances. 10. If you have more than one account /card, we will add up all your chances earned for each account /card where you are the main principal account holder. 11. The following transactions are excluded from being a qualifying retail spend for the purposes of this Promotion and will not accumulate any chances for the relevant Cardholder: i. transactions arising from the use of your linked MyWay Card as an ATM card at an ATM or at an EFTPOS or NETS terminal; ii. online bill payments; iii. income tax payments; iv. payments of insurance premiums, including premiums for investment-linked policies; v. payments to loans or credit facilities or deposit accounts; vi. payments to the Immigration and Checkpoints Authority, Ministry of Manpower and Land Transport Authority; vii. EZ-Link card transactions and other transit link transactions; viii. top-ups of any stored value facility; ix. AXS payments; x. CardUp payments; xi. any fees and charges charged to your MyWay Card; xii. any amount charged to your linked MyWay Card that is subsequently cancelled, voided or reversed (as determined by us in our sole discretion); and xiii. any other amount or payment charged to your MyWay Card as we may determine and notify you from time to time. 12. The Bank is not an agent of Mastercard or the suppliers of the Prize. The Bank makes no warranty or representation as to the quality, value, merchantability or fitness for purpose of the Prize and assume no liability or responsibility for the acts or omissions of the merchants or any non-performance or defects in the Prize. If you win the Prize, any dispute about the quality, value, condition or performance of the Prize is to be resolved directly between you and the merchants supplying the Prize. In addition, the Bank is not obliged to assist or act on your behalf in communicating with the merchants supplying the Prize for any reason, 3
and you accept the Prize as it is and subject to any terms and conditions the merchants may impose. 13. For the avoidance of doubt, the Prize is not exchangeable for cash or any other items, and is non-transferable and non-assignable. The Bank reserves the right to replace or substitute the Prize with any item of equivalent or similar value, without prior notice or reason (and the Bank shall not be obliged to disclose its reason). Lucky Draw Date and Mechanics 14. The Lucky Draw ( Draw ) will be conducted on 15 October 2017 at a venue determined by the Bank at its sole and absolute discretion. 15. One participant, who qualifies under this Promotion, shall be randomly selected by an automated computerized system for the Prize and the winner will be verified by an external auditor. The Bank shall have full and absolute discretion to change the Draw mechanics without giving prior notice or reason (and the Bank shall not be obliged to disclose its reason). The Bank may appoint, at its sole and absolute discretion, any party as the Bank deems fit as the external auditor for the Draw. 16. The Mastercard Priceless Experience in Bali Package (the Prize ) shall consist of: a. Two (2) return business class air tickets to Bali, Indonesia from Singapore. b. Airport transfer from Ngurah Rai International Airport to the selected hotel/villa accommodation; c. Hotel/Villa accommodation for 3 days/2 nights for two (2) persons on a twin sharing basis; d. Breakfast included for two (2) persons; and e. One (1) Spa package for two (2) persons. Details of the abovementioned contents of the Mastercard Priceless Experience in Bali Package shall be determined by the Bank at its sole and absolute discretion. 17. The Prize is non-transferable and cannot be exchanged for cash or other prizes. 18. The MyWay Savings Account of the winner of the Prize must be validly existing (i.e. must not be suspended, cancelled or terminated), in good standing, and conducted in a proper and satisfactory manner as determined by the Bank in its sole and absolute discretion, at the time of claiming the Prize, failing which, the Prize will be forfeited (and 4
the Bank shall not be obliged to disclose its reason) by the winner. No payment or compensation will be given to a winner whose Prize is withdrawn or forfeited by the Bank. 19. The winner of a Prize will be notified by post by 31 October 2017, and the notification will be mailed to the winner s last known mailing address with us. 20. The winner must elect a maximum of two (2) nominees (one of whom must be the winner), and provide all relevant details of the nominee(s) (including but not limited to their names, identification / passport numbers, and contact numbers) to us by no later than 15 November 2017. Failure to comply may result in the Prize being forfeited by the winner. In the latter event, the Prize will then be awarded by the Bank to another eligible participant from the Draw. 21. Notwithstanding that a participant in the Draw may have been notified that he has won a Prize in the Draw, the Bank reserves the right to subsequently withdraw the Prize if that winner is determined by the Bank to be disqualified for any reason or if the winner fails to claim the Prize in accordance with clause 20. 22. No payment or compensation whether in cash, credit or kind shall be made for any uncollected, lost, misplaced, defaced, stolen or damaged Prize. 23. It is the responsibility of the nominees participating in the Mastercard Priceless Experience in Bali Package to ensure that they possess all necessary travel documentation (including valid passports and visas) for the purposes of enjoying the Mastercard Priceless Experience in Bali Package. The nominees shall be responsible for their meals (except as provided in clause 16(d) above), transportation (except as provided at paragraph 166(b) above), travel insurance, daily expenses, and other incidental arrangements they may make in connection with their enjoyment of the Mastercard Priceless Experience in Bali Package. All costs incurred in connection with the aforementioned shall not be borne by the Bank. 24. Except for death or personal injury caused by the negligence of the Bank, the Bank shall not be responsible for, and every participant in the Mastercard Priceless Experience in Bali Package hereby agrees to release and hold the Bank harmless for, any expenses, loss (whether foreseeable or not), claim or damage suffered or incurred (whether in common law or equity) arising from or in connection with, directly or indirectly, the Prize and/or this Promotion, to the fullest extent permitted by law. Others 25. Each Participant agrees that the Bank may publish and broadcast the results of the Draw and disclose the winners information (including name and part of their identification / passport number) on its website. 26. All winners also consent to the Bank disclosing their information (including name, identification / passport number and contact number) to persons who are involved in the organisation and carrying out of the Promotion including without limitation the merchants supplying the Prize. 5
27. The Bank, at its sole and absolute discretion, reserves the right to vary, modify, add or delete any of these terms and conditions, and/or to withdraw or discontinue the Promotion or replace the Prize with any item, at any time without prior notice or reason (and the Bank shall not be obliged to disclose its reason). General 28. Mastercard does not assume any responsibility for the products and services offered under this promotion. The products are sold and services are provided solely by the relevant vendors, under such terms and conditions as determined by such vendors, and Mastercard accepts no liability whatsoever in connection with such products and services. The products and services have not been certified by Mastercard and under no circumstances shall the inclusion of any product or service in this promotion be construed as an endorsement or recommendation of such product or service by Mastercard. 29. Please refer to the Bank s Pricing Guide at sc.com/sg/pricingguide for any applicable fees and charges, or visit sc.com/sg/myway for more information on MyWay Savings Account, including the latest terms and conditions applicable to the Promotion. 30. The Bank may vary, modify, add, delete or otherwise revise any of the terms and conditions governing the Promotion or to terminate, withdraw, extend or shorten the Promotion at any time at the Bank s sole and absolute discretion, with or without prior notice or reason (and the Bank shall not be obliged to disclose its reason). The Bank reserves the right to determine at its sole and absolute discretion all matters arising out of or in connection with the Promotion, including your eligibility for a Chance, the Prize and/or the Promotion. The Bank s determination of all matters relating to this Promotion shall be final and binding and no correspondence will be entertained. 31. These MyWay Savings Account Mastercard Experience (17 Jul 30 Sep 2017) Promotion Terms and Conditions are to be read in conjunction with the Bank s Customer Terms, Current/Cheque/Savings Account and Time Deposit Terms and MyWay Savings Account Product Terms & Privileges Terms and Conditions (collectively, "Standard Terms"). If there is any inconsistency between the Standard Terms and these terms, these terms shall prevail to the extent of such inconsistency. Deposit Insurance Scheme Singapore dollar deposits of non-bank depositors are insured by the Singapore Deposit Insurance Corporation, for up to S$50,000 in aggregate per depositor per Scheme member by law. Foreign currency deposits, dual currency investments, structured deposits and other investment products are not insured. 6
