Staff: Fire Chief Stefan Szozda, Code Officer Jay Moose, Clerk Debbie Pinckney, Treasurer Lisa Schiminske, DPW Superintendent Dan Patterson, and WWTPO Bob Kneaskern Public: Michael Ogburn, Susan Fairbairn, Jack Frost, Jarett Powers, and Barry Schwarting. 1. Call to Order - Mayor Sherman called the meeting to order with the pledge to the flag at 7:00pm. 2. Changes/Additions to Agenda - none Mayor invited Union Springs Superintendent Jarett Powers and school board president Barry Schwarting to explain exactly what portion of the former Cayuga Elementary School property is being offered to the Village. Discussion amongst the Board, Chief Szozda, Dr Powers and Mr. Schwarting as to what parts of the property would the Village be interested in. Dr.Powers restated that there is a process that has to be followed as discussed last month. Mr. Schwarting explained that the School Board has a meeting in 2 weeks, Dr. Powers will present the portion of the property of interest by the Village Board and the school board will discuss it. What will have to happen first is a survey, then a draft from the school board stating they are interested in deeding a portion of the property to the Village of Cayuga, then a vote by the Board to approve this transfer, and then a public vote for the school district residents for final approval. 3, Presentations (if any) none 4. Announcements, Miscellaneous & Liaison Reports - I. Code Enforcement - Jay Moose see report II. Fire Department - Chief Stefan Szozda see report III. Waterfront Festival Don Wilson Jr. Meat Raffle Tickets for sale. $5.00 each, the drawing in early November.

2 Committee will meet Oct 21 st with Youngs Explosives for the 2019 Festival IV. Zoning Board of Appeals Mayor The appointed ZBA members had a 2 hr training session with County Planner Dave Nelson. Chairman Dave Freligh, members, Rich Palmer and Val Wheeler signed the oath book. V. Planning Board Mayor The appointed Planning Board in conjunction with the ZBA had a 2 hr training session with County Planner Dave Nelson. Chairman Mark Harris, members Pauline Harry, Devin Fricano, Mike Ogburn, and Diane Donnelly have signed the oath book. VI. Recreation Tara Fricano will report under the Trustees report VII. Steering Committee, Zoning Law Revision Attorney Quill ed the Board his comments and concerns on the July 10, 2018 draft. Trustee Wilson explained the Steering Committee will have to hold another meeting. Clerk will send out an with a few meeting date options asap. 5. First Open to the Public (Speakers will have five (5) minutes) Devin Fricano Court Street mentioned that with the sale of the Cayuga property, there are concerns about access by those on Rt 90 whose back yards a butt the school property, especially his property as the area is steep. Discussion from the board, looking at the map for a better visual of the problem. Note - This is more of a private citizen issue, and it was suggested the residents in question set up a meeting with the School Board. Sue Fairbairn Willard St asked how she could purchase one of the meat raffle tickets? Don Wilson Jr. explained there are 300 tickets sold, the drawing is usually the second week in November. He has tickets and will coordinate with Sue. Jack Frost Willard St asked why the Water St sale requires him to have a survey. It is his opinion since his plan is to own it and have his heirs deal with selling it upon his death, it seems like a survey is not needed until something has to be done with the property. Attorney Mike Quill explained since this village owned parcel is just one strip and he is required to have an accurate description of the village owned property to be able to complete the sale to all those interested in buying their portion, a survey is necessary. Not to mention that each of the buyers have a different footage, it s a bit more complicated. Jack asked about a time line for this to happen. Attorney Quill explained there have been some issues that need to be addressed. One, is getting a copy of the Village of Cayuga Subdivision Law of The Clerk found a copy of a draft and made inquiries to the State to see if this draft was filed as a Local Law. It was, and in tonight s bills is a voucher for $11.00 and a letter to State records requesting a copy of the law. Attorney Quill explained his is trying to complete this sale as quickly as he can, once he has a copy of that law, he will be able to determine the next step.

3 6. Approval of Minutes - September 12, 2018 Regular Meeting - Motion Fricano to approve the minutes as presented, Second Ellis. 3/0 approved. Trustee Wilson abstained. 7. Village Treasurers Report(s) a. See written report b. Cuddy and Ward Audit Cuddy and Ward gave notice they will no longer do Municipal Audits, they did give us a recommendation by a firm that does Not for Profit Audits, I have developed an RFP at my other job as bookkeeper for the Town of Fleming and I will modify it for the Village and see if I can find a reasonable, knowledgeable auditor. In the meantime, if you have questions about the audit, I will do my best to answer them. I completed the Village AUD based on the auditors input. c. Will be at a training for Finance Officers in Watertown next month and will miss the November Board meeting. Motion Wilson to accept the Treasurer s report as presented, Second Fricano. 3/0 approved. 8. Superintendent of DPW Report a. Leaf and brush continue, will have the leaf bag on in the next few weeks b. Plan to order salt in the next few weeks, we have some left c. Water, Lake and Cadet Streets have had roadsides mowed down d. Parks docks will be out when the water recedes, raft is in the barn e. Still mowing grass at both parks f. Bathroom fixtures at McIntosh done except for the bars. g. Cemetery on going mowing and maintenance working on clearing the top south side of the cemetery. It s been difficult with the rain. h. Have one more foundation to complete had a cremains burial and will do a full burial tomorrow, which will probably be the end of burials until spring because it s too wet. 9. Superintendent of WWTF Report Bob Kneaskern excused due to illness. Dan provided a short report on his behalf. a. Switched out the UV Bulbs at the Plant b. Did have Saxton Electric look at the panel box issue on River Rd. Mayor asked if Dan knew if Bob had reached out to the Attorney. Discussion, Trustee Ellis wondered why we as a municipality would be involved in an issue on private property. Will need to discuss with the Joint Committee to develop a policy. 10. Correspondence a. Letter to the Mayor with a suggestion for traffic control b. US Census Bureau Quarterly Tax Collection report c. Letter from Mary Jo and Larry VanWie Notice to quit at 6185 Railroad Street d. Cuddy and Ward Audit

4 e. Spectrum change order for internet speed per Dave Stathis our IT/Security representative f. Upcoming Recycling Events Household Hazardous Waste Oct 20 th visit blogs.cornell.edu/ccecayuga to find where to drop off. g. NYSCADV notice with regard to October being Domestic Violence Awareness Month. h. PO for made to order HP Desk Top for Treasurer, per Dave Stathis. i. NYSEG letter about gaining access to the Hall to read the meter instead of estimating. j. WeCare Waste and Recycling will be turning over their muni collection service to Casella beginning October 1, Clerk called and left a message for clarification no answer yet. k. Dig Safe will not be increasing their rates in Old Business - a. Water Street property sale, update As discussed by Attorney Quill, waiting for a copy of the Subdivision Law which was filed with the State. Known as Local law # Discussion how to communicate this hiccup to the property owners. Trustee Wilson suggested they can refer to the minutes. b. Zoning Law revisions Attorney Quill comments were ed, Board did not want to discuss at this time. Board referred the comments to the Committee. Clerk will coordinate a meeting asap. c. USCSD Board of Education, proposal handled out of agenda order d. Railroad Street Leases At this time, VanWie Railroad St, has not made the proper payment for the lease, paid the first installment for Town and County Taxes, none of the Village Taxes, and none of the School Taxes. Romocki Railroad St has paid the first half of the lease, the first half of the Town and County Taxes, none of the Village taxes and none of the School Taxes. Falconer 6181 Railroad St has paid the first half of the lease, all of the Town and County Taxes, none of the Village Tax and none of the School Tax. Mayor signed letters of eviction, Attorney Quill will begin proceedings at Aurelius Court. 12. New Business none 13. Executive Session Motion by Trustee Wilson to move to Executive Session at 7:55pm for the purpose of discussing possible litigation matters with 6188 Lake Street/John Greer. Second by Trustee Fricano. 3/0 approved. Mayor Sherman recused himself and left the room. Returned from executive session at 8:05pm. Motion by Trustee Ellis to table the matter. Second by Trustee Wilson. 3/0 approved. Mayor Sherman returned to the meeting.

Trustee Fricano, Parks & Recreation Rec Program Started last week. 1 st day had 15 children With the drop in attendance from 8 th graders and up Denise will have a Teen Night Friday October 19 th for grades 8 th and up. Open Gym, mini pumpkin pie baking and game night. C. Trustee Wilson, Planning & Development Attended the Assembly Minority Task Force on Critical Infrastructure Forum September 26 th at the County Highway Garage on York Street from 6pm- 8pm. The topic was the condition of the state's roads and bridges and to gather feedback. It was informative but discouraging. The cost to pave roads, maintain roads, and bridges is outreageous. CHIPS and severe weather money doesn t even cover an eighth of the costs. inform you of two meetings in our area. Pave New York, Bridge New York D. Trustee Wright, Public Safety Open Discussion among Trustees - none 16. Village Clerk Report a. Relevy of unpaid Village Taxes will be reported to County real Property on November 14 th to be added to the 2019 Town and County taxes. 17. Approval of Audited Vouchers - Motion by Wilson to approve the payment of Abstract #5-2018, Second Ellis. 4/0 approved. 18. Second Open to the Public (Speakers will have (5) minutes) - none 19.
