PPRA: NEMC complies with procurement law This is according to the procurement and performance audit report for Financial Year 2014/15 released by PPRA in Dar es Salaam recently. The overall assessment in terms of competitiveness, accountability, transparency and fairness is generally satisfactory. APPRA audit report has revealed that the National Environmental Management Council (NEMC) conducted its procurement activities in a competitive, open and fair manner. According to the report released in Dar es Salaam recently, the audit for NEMC also found that with the exception of procurement that involved other procuring entities (joint procurement), the entity exhibited accountability and efficiency in procurement processes and value for money was obtained for all contracts implemented in Financial Year 2014/15. The report on the NEMC audit, which covered seven tenders, two call-off orders and 20 local purchase orders, further notes that on the basis of compliance indicators established by PPRA, the overall compliance of the entity was assessed to be satisfactory, having scored 70 percent or in implementing some of the awarded contracts. The audit covered 25 tenders; representing 96 percent of the total tenders under PFMRP. They included 13 in the category of consultancy services, nine in goods, one in works and non-consultancy services categories, respectively. The audit, which involved all PFMRP activities, sought to determine whether the procedures and documentations for procurement and contracting were in accordance with the provisions of the public procurement law; and also whether value for money was achieved. Furthermore, the audit determined if contract implementation conformed to the terms and conditions of relevant contracts. The audit report among others, recommends to the ministry to pay consultants and service providers in compliance with relevant provisions on payments stipulated in the respective contract documents. The Ministry should also efficiently implement procurement functions and ensure complete records and documents are kept in compliance with the law, the report further recommends. above in every aspect assessed. However, the report called upon NEMC to improve record keeping and to ensure a close follow-up in joint projects and those that require speeding up procurement processes. The objective of the audit was to determine whether procedures, documentations and contracting were in accordance with the provisions of the public procurement law and whether value for money was achieved. Hata hivyo kumekuwepo na changamoto kwenye baadhi ya mikataba zinazotokana na sababu mbalimbali ambazo husababisha mikataba hiyo kubadilishwa. Mabadiliko ya kazi yanaweza kutokea kwenye muundo wa kazi, ukubwa wa kazi, ubora wa kazi, mazingira ya kufanyia kazi na mtiririko wa kazi. Kwa mujibu wa sheria ya manunuzi ya umma ya mwaka 2011, mkataba wa manunuzi unaweza kubadilishwa au kurekebishwa pale ambapo marekebisho hayo yatakuwa na faida kwa Serikali, na uwe umeidhinishwa na Afisa Masuuli na sharti idhini ya kuongeza fedha itolewe na mamlaka iliyoidhinisha bajeti ya taasisi husika. Kazi za nyongeza kwenye mikataba husababishwa na mojawapo ya sababu zifuatazo, mwajiri kubadili ukubwa wa kazi, kubadilika muundo wa kazi, kubadilika kwa ratiba ya utekelezaji wa kazi kwenye mradi husika, mwajiri kukumbwa na matitizo ya kiuchumi, kukinzana kwa vipengele kwenye nyaraka za Ununuzi. Sababu nyingine ni kukosekana kwa wataalam, mkandarasi kukumbwa na matatizo ya kiuchumi, kubadili aina ya vifaa vinavyotakiwa kutumika kwenye kazi tofauti kama ilivyoainishwa kwenye mkataba, kubadilika kwa technolojia ya kazi, utofauti wa hali ya hewa kati ya eneo moja na lingine, mwajiri kubadili maelezo ya kitaalam ya vifaa, ukosefu wa michoro ya kitaalam ya mradi, ukosefu wa vifaa bora vya ujenzi katika eneo husika, tofauti ya muundo wa kazi uliobuniwa na hali halisi, mchakato wa manunuzi wenye mapungufu na kuandaa kazi zinazokinzana na kanuni za nchi. Njia za kukabiliana na changamoto za mabadiliko ya kazi Zifuatazo ni baadhi ya njia ambazo zikitumika ipasavyo zinaweza kupunguza mabadiliko ya kazi katika mikataba kwa kiasi kikubwa; Kuhusisha wadau katika hatua za mwazo za maandalizi ya mradi Ni muhimu kuhusisha wadau wengi kadri iwezekanavyo hasa katika kipidi cha bajeti. Kuwahusisha wadau wengi huondoka kero nyingi kama utata wa mipaka katika eneo la kazi, eneo linalotumiwa na taasisi nyingine kwa wakati mmoja husaidia taasisi hizo kuwa na mipango ya uendelezaji kwa wakati mmoja. Hii husaidia taasisi moja kubeba gharama kubwa kwa niaba ya taasisi nyigine kwa kazi zinazowahusu. Mfano wa mazingira haya ni barabara ya Lion iliyoko Manispaa ya Kinondoni, ambapo manispaa katika kutengeneza barabara hiyo ililazimika kuingia gharama za kuhamisha mabomba ya maji yanayomilikiwa na Dawasco, kuhamisha nguzo za umeme na za simu zinazomilikiwa na Tanesco pamoja na TTCL. Wadau hao hawakuwa na bajeti ya kazi hizo wakati huo Manispaa ya Kinondoni ililazimika kujenga barabara. Ili mradi ukamilike na hivyo kutoa huduma kwa wananchi manispaa ililazimika kugharimia shughuli hizo. Muundo wa kazi uliofungwa (freezing design) Muundo wa kazi uliofungwa ni njia nzuri ya kuzuia mabadiliko ya kazi kwenye mikataba. Waajiri wengi baada ya kukamilisha muudo wa mradi wanaoutaka hufunga milango ya mabadiliko kwenye muundo huo. Hivyo muundo huo hubakia kama ulivyo kwenye michoro hadi mradi unapokamilika. Mpango na bajeti vyenye kuzingatia hali halisi ya mradi (proper planning and budgeting) Bajeti za taasisi zinatakiwa kuzingatia mahitaji halisi ya gharama na muda wa ukamilishaji wa mradi. Bajeti iliyotengwa inapotofautiana na hali halisi husababisha mabadiliko ya kazi kwenye mkataba. Bajeti ikiwa ndogo, taasisi hulazimika kuahirisha baadhi ya kazi kwenye mkataba, ambazo hufanyika baadae kwa bajeti nyingine na kwa gharama iliyoongezeka. Kuweka kiwango kidogo cha fedha za dharura Uwepo wa kiasi kikubwa cha fedha za dharura husababisha timu ya usimamizi kutokuwa makini katika kusimamia matumizi ya fedha kulingana na makadirio ya mradi husika. Timu haiwezi kuwa na njia mbadala ya kuhakikisha kazi zenye ubora zinafanyika kwa kutumia fedha iliyo kadiriwa. Kutumia wataalam washauri (engaging consultants during design) Baadhi ya taasisi za umma hazitumii wataalam washauri katika kuandaa michoro na kusimamia kazi za majenzi. Hii kwa kuandaa bajeti ya mradi bila kuweka gharama za mtaalam mshauri. Hii inasababisha makadirio ya mradi kutokuwa halisi na hivyo kusabisha kuwa na mabadiliko ya kazi na hatimaye kwenye mkataba. Uzoefu wa kazi zilizopita Wataalam kwa kutumia uzoefu wa miradi mingine inayofanana na hiyo huweza kuandaa mipango mizuri. Hii husaidia kuangalia matatizo na mafanikio yaliyotokea kipindi cha nyuma kwenye miradi ambapo matatizo hutafutiwa ufumbuzi na mafanikio kuendelezwa ambapo husaidia kupata miradi iliyo bora zaidi. Mikataba ya kuandaa muundo wa kazi na kujenga (design and construct contracts) Imekuwa ikitokea kwamba mara baada ya kusaini mkataba mkandarasi afikapo eneo la kazi huandika barua za angalizo (early warning). Barua hizo mara nyingi hueleza kusahaulika kwa baadhi ya kazi kwenye mkataba. Kwa sababu hiyo, mikataba inayo waruhusu wakandarasi kuandaa muundo wa kazi na kuitekeleza husaidia kuondoa mabadiliko ya kazi kwenye mikataba husika. Kuidhinisha haraka maombi ya mabadiliko katika kazi (prompt approval of procedures) Mara baada ya kuwasilishwa kwa maombi ya mabadiliko kwenye kazi za mkataba ni muhimu sana kufuata hatua zote zilizoainishwa kwenye sheria ya manunuzi. Aidha, majibu ya kukubali au kukataa yatolewe mapema ili kuruhusu kazi kuendelea. Kuchelewa kutoa majibu huongeza gharama za mradi. Ni vyema kuepuka mabadiliko ya kazi katika mikataba au yapunguzwe kadri iwezekanavyo kwani mabadiriko haya yamekuwa chanzo cha migogoro na kuongeza gharama kwenye mikataba. Aidha, muda mwingi hutumika katika mijadala kabla ya kufikia makubaliano. 5 Tuesday October 20, 2015 Journal Public Notices 5 PUBLIC NOTICE COMPLETION OF DEBARMENT PERIOD Pursuant to Section 62 of the Public Act, 2011 and Regulation 98 of the Public Regulations 2013, PPRA has a mandate, where there are justifiable grounds, to debar a firm or an individual from participating in public procurement proceedings and notify all procuring entities on such action. Also, Regulation 99 gives the Authority powers to notify procuring entities and relevant statutory bodies upon debarring and blacklisting a tenderer. On the basis of the cited Section and Regulations, at its 60th extra ordinary meeting held on 6th October, 2015, the Board of Directors of PPRA decided to debar 19 firms (including their directors) from participating in public procurement for a period of one year (from 6th October, 2014 to 5th October, 2015) for failure to meet their contractual obligations. This notice intends to inform the public that the 19 debarred firms have completed their debarment period with effect from 5th October, Following expiry of the debarment period, the under listed firms are now allowed to participate in public procurement.
