1 (1) R. 17 Measures Anti-dumping measures in the fm of interim dumping duty (IDD) have been imposed on zinc coated (galvanised) steel expted from the People s Republic of China (China), the Republic of Kea (Kea) and Taiwan. Anti-dumping measures in the fm of interim countervailing duty (ICD) have also been imposed on galvanised steel expted from China. Anti-Dumping Notice (ADN) 2013/66 provides further infmation to assist impters and Customs brokers. Description of the goods The goods covered by measures are galvanised steel: a flat rolled product of iron and non-alloy steel; plated coated with zinc; whether not surface treated including combinations of surface treatments; and in any width. Australian Customs Dumping Notices (ACDN s) 2012/40 (initiation of the investigation) and 2012/62 (clarification of the goods subject to the measures) provide further infmation to assist impters and Customs brokers. Identifying the goods subject to measures Goods subject to measures should be classified using the appropriate tariff sub-heading and associated statistical code contained in Table 1. IDD and/ ICD do not apply to goods subject to the Tariff Concession Orders (TCOs) shown in Table 2. Exemption type GOODS applies to goods subject to these TCOs entered f home consumption on and after the dates shown in Table 2. 2 (2) Exemptions (continued) There are three expters exempt from IDD: Dongkuk Steel Mill Co Ltd (Dongkuk) from Kea and Sheng Yu Steel Co Ltd and Ta Fong Steel Co Ltd from Taiwan - exemption type SUPPLIER applies. Please note f goods supplied by Dongkuk from Kea: the exemption applies only to goods branded Union Steel and produced at the Busan Nam-gu manufacturing plant; and impters should ensure there is adequate documentation to verify this f each instance the exemption type SUPPLIER is used. All other expters suppliers from China, Kea and Taiwan are subject to ICD and/ IDD as advised in Table 3. Dates of Effect IDD and/ ICD were initially imposed on 5 August IDD and ICD rates applying to galvanised steel expted from China (only) were varied on 20 February 2014 following the Minister s acceptance of the outcomes of a review conducted by the Anti-Dumping Review Panel (ADRP). ADN 2014/12 provides further infmation to assist impters and Customs brokers. Dumping securities (DSA) and countervailing securities (CSA) were imposed on 13 October 2014 f Jiangyin Zongcheng Steel Co., Ltd (Zongcheng) following initiation of an accelerated review. Please refer to ADN 2014/119 f me infmation. Direction f collection of IDD and/ ICD Goods subject to IDD and/ ICD must be entered using the relevant dumping specification number (DSN) f the nominated expter/supplier as shown in Table 3 and the expt price terms shown in Table 4. The IDD is in the fm of a fixed + variable measure. The IDD liability is calculated as follows: the dumping expt price (DXP) ascertained expt price (AEP), whichever is the greatest, multiplied by the IDD ad valem duty rate; Plus the amount, if any, by which the DXP is lower than the AEP. The ICD is in the fm of a fixed measure. The ICD liability is calculated by multiplying the DXP by the ICD ad valem duty rate. DSA f Zongcheng are also in the fm of a fixed + variable measure. The DSA liability is calculated by: DXP ascertained expt price (AEP), whichever is the greatest, multiplied by the DSA ad valem duty rate; Plus the amount, if any, by which the DXP is lower than the AEP. CSA f Zongcheng are in the fm of a fixed measure. The CSA liability is calculated by multiplying the DXP by the CSA ad valem duty rate. PLEASE NOTE: The All Other Expter rate of IDD and/ ICD will apply unless an impter/broker can provide proof that the goods are being supplied either directly by a named expter through a linked supplier(s). Release of details of measures Unless otherwise advised, the rate of IDD and/ ICD and the AEP f each DSN in Table 4 are considered Confidential and will not be published. Bona fide impters of the goods may be provided with the confidential infmation relevant to a nominated expter/supplier country in the case country wide measures. The onus is on the impter to prove their bona fides by providing evidence of either: a previous trading histy with a nominated expter/supplier of the goods from a country subject to dumping/countervailing measures. Evidence of a trading histy would take the fm of at least commercial invoices, packing list and bills of lading from previous shipments. Customs and Bder Protection may also request additional documentation as proof of an impter s bona fides;

The offer quotation must be on the expter/supplier s company letterhead s will not generally be accepted. Impters should note that only as much of the confidential infmation as is necessary to enter the goods will be provided by Anti-Dumping Commission Australian Customs and Bder Protection (ACBPS) officers. Australian Customs Dumping Notice (ACDN) 2012/61 provides further infmation to assist impters and Customs brokers. ACBPS will conduct moniting of impts subject to anti-dumping measures consistent with its published policy. Duty Assessment Where anti-dumping measures have been imposed on goods expted to Australia, the impter is liable to pay IDD and/ ICD at the time of imptation. The rates of IDD and/ ICD are based on prices verified during the iginal dumping investigation subsequent review of the duty and are in place f a period of five years unless revoked earlier. To ensure that the amount of IDD and/ ICD collected by ACBPS does not exceed the actual dumping and/ subsidy margin f each consignment over the five-year period, provision exists f assessment of the final duty liability under the Customs Tariff (Anti-Dumping) Act This system allows f any excess interim duty to be refunded where it is found that prices have changed since the iginal investigation subsequent review. There are a series of time frames fixed by legislation that govern the duty assessment system. An application f duty assessment must cover all shipments entered f home consumption by an impter in a specific six-month imptation period. The six-month period is determined by the date of publication of the initial notice imposing the dumping duty. Where securities have been taken pending the Minister's decision, the imptation period may be less than six months. An application f a duty assessment cannot be lodged pri to the end of the particular imptation period to which it relates, but must be lodged with the Anti-Dumping Commission within six months from the end of that imptation period. Table 5 provides detail of the relevant imptation periods and application periods f galvanised steel expted from China, Kea and Taiwan.
