These changes give rise to new issues and strategies. They also create significant new compliance and administrative burdens. Through the use of practical case studies this session will focus on the many teething issues and opportunities flowing from the changes, including: CGT relief considerations and risks Practical and timing requirements for claiming CGT relief How to comply with the new event based reporting regime Pension issues, including exceeding the minimum draw-down When is it appropriate to amend pension terms mid-stream and how is it done Considerations and methodologies for calculating the total superannuation balance for contributions purposes How you should be advising on superannuation death benefits post-changes What are the new requirements for auto-reversionary pensions. However, equity plans can be complex to implement and operate, with legal, accounting and administrative implications to consider. 4 Presenter Profiles An overview of our experts Matthew Andruchowycz, CTA, is a Principal in the Business Transactions and Advice Practice at DMAW Lawyers. He is a taxation and superannuation specialist working primarily with accountants, business owners and high net wealth individuals on commercial transactions, advice and disputes. Michael Butler, CTA, is the Partner in charge of Finlaysons Tax & Revenue Group and advises domestic and foreign clients on federal, international and state tax matters. He has a special interest in mining and property taxation, corporate restructurings, international tax issues, and estate and succession planning. Michael is the Visiting Lecturer in Tax at the University of Adelaide Law School, and is a regular contributor to The Tax Institute events. Daniel Jenkinson, ATI, is a Principal at DMAW Lawyers, practising in corporate and commercial law, and has particular expertise in superannuation and financial services. Daniel regularly acts for trustees of APRA regulated funds, public sector funds, self-managed superannuation funds, accountants and other advisers in connection with all aspects of superannuation law. Suzanne Mackenzie, CTA, Suzanne is a founding Partner and Practice Leader at DMAW Lawyers in South Australia and has particular expertise in the financial services and superannuation industry having specialised in all aspects of superannuation law since she began practising over 25 years ago. She is the principal adviser to many large APRA-regulated and public sector superannuation funds and her practice is also involved in working with accountants, advisers and high net worth individuals in the area of self-managed superannuation funds, particularly in complex areas. Tasha Naige is a senior commercial lawyer at DMAW Lawyers who specialises in superannuation law. She advises on the full range of superannuation-related matters for both large funds and self-managed superannuation funds. Nicole Peterson, CTA, has worked at PKF Adelaide for fifteen years where she is involved with the various specialities PKF Adelaide provides. Early on Nicole developed a strong interest and now specialises in the areas of complex family structures and in particular the impacts of Division 7A, small business CGT concessions, structuring and compliance. In addition, Nicole has a keen interest in the Mining Sector and has been involved with the issues facing publicly listed companies including employee share schemes. Lisa Pritchard, CTA, is a Partner with Holman Hodge, advising on many levels of taxation and accounting, ranging from small start-up enterprises to reporting to boards of publicly listed corporations. Lisa now works predominantly on small to medium enterprises in the Adelaide market with a specific focus on tax planning, structuring, capital gains tax and compliance work for businesses across many industries. Mary-Anne Sotiropoulos, ATI, is a tax lawyer in the Finlaysons Tax & Revenue Group, predominantly working with SMEs and high-net worth individuals. Mary-Anne advises clients with regard to structuring and restructuring dealing with both their corporate and personal structures to meet their specific objectives; whether it be to keep things simple, avoid liability or use tax effective strategies to support operations and growth. Other areas of her practice include the application and consequences of income tax, capital gains tax, GST, stamp duty and land tax, as well as assisting SMEs seeking to expand their operations internationally (including China). Leanne Thomas, CTA, is a Director of Private Client Services at EY and has twenty years experience in providing taxation, advisory and management accounting advice to a range of clientele. Leanne has a broad portfolio of Family Business clients in industries including property, agriculture, retail and non-profit organisations. Leanne works closely with her clientele to optimise the current taxation and ownership structures while ensuring the succession plans are well integrated into the business planning. Ben Turner, FTI, is a Senior Manager in EY s People Advisory Services team. Ben is a Chartered Accountant with over 10 years experience specialising in taxation issues including expatriate taxation, Fringe Benefits Tax, superannuation/ social security and payroll tax. Ben works closely with major organisations, particularly in the Human Resources and Finance areas to address remuneration and tax issues affecting the workforce. This includes designing effective processes, systems and tools to maximise planning opportunities and manage risks particularly with globally mobile workforces. Claire van Malland is a Senior Manager in EY s Private Client Services team. Claire has a broad range of tax and business advisory experience assisting both private and corporate clients with various tax compliance obligations, tax advisory services and group structuring over the last nine years. Claire has an interest in Division 7A, FBT and superannuation, and has assisted clients with both managing risk and optimising opportunities for themselves and their employees in these areas. Craig Whiteman, CTA, is the lead tax Partner at EY in Adelaide and has over 20 years of tax and business consulting experience. Craig specialises in the areas of remuneration and tax effective planning for international assignments, employment taxes and employee share and option plans. Although a back injury later restricted his number of Test appearances to 38 and One Day Internationals to 71, Hoggy has some fascinating stories to tell; in his own words: I was there for the 500 to one, I was there for the 43 cans, I was there for the underarm, I was there for the aluminium bat...
