1 VEHICLE FOR HIRE ADMINISTRATOR S PUBLIC HEARING December 1, 2016 MINUTES On Thursday, December 1, 2016 at 9:05 a.m., the Vehicle for Hire Administrator, Captain Isiah M. White held a public hearing, as prescribed by Chapter 55 of the City Code of Orlando. The hearing was held in the Auditorium of the Orlando Police Headquarters which is located at 100 S. Hughey Avenue, Orlando, Florida. The Public Hearing was advertised in accordance with Sections and 119, Florida Statutes. The meeting was called to order at 9:05 a.m. by the Acting VFH Administrator. 2 Elias Rebolledo Notice of Violation Mr. Rebolledo was present. On October 28, 2016, Mr. Rebolledo was issued Notice of Violation #1282 to appear at today s Administrators Public Hearing. Officer Monn was conducting a routine detail on 1 Airport Blvd., Orlando, Florida. During this detail Officer Monn observed Mr. Rebolledo operating with failure to show fare charge on demand and name of the transportation network company assigned to the (VFH) permit was not displayed nor provided. Mr. Jacob V. Stuart, Attorney at Law spoke on behalf of Mr. Rebolledo ask for a continuance due to lack of proper notice and not having adequate information about the Notice of Violation. Mr. Elsweiss was present. On October 26, 2016, Mr. Elsweiss was issued Notice of Violation #1424 to appear at today s Administrators Public Hearing. Officer Monn was conducting a routine detail on 1 Airport Blvd., Orlando, Florida. During this detail Officer Monn observed Mr. Elsweiss failure to show fare charge on demand not moving forward, with the vehicle driver to display driver permit on outermost garment or in vehicle and display the name of the transportation network company assigned a (VFH) permit was not displayed nor provided. Mr. Jacob V. Stuart, Attorney at Law spoke on behalf of Mr. Elsweiss ask for a continuance John Dez - Notice of Violation Mr. Dez was present. On October 12, 2016, Mr. Dez was issued Notice of Violation #1252 to appear at today s Administrators Public Hearing. Officer Felshaw discovered in viewing the files of Mr. Dez showed lapse of insurance of 35 days with active vehicle permit #L between (08/26/16 and 09/30/16). Officer Felshaw issued Notice of Violation #1252 for no insurance coverage with active permit. Mr. Dez explained at the time his insurance lapsed, he was attending a family member funeral out of state in Pennsylvania. Mr. Dez stated, he attempted to renew his insurance online, but was unable to do so, due to the insurance agency required his original signature for the renewal documents due to changes in the policy. Mr. Dez stated, during the lapse of coverage the registered vehicle was not used and upon his return the insurance was reinstated. Results: The Vehicle for Hire Administrator ruled to waive fine in favor of Mr. Dez. Page 4
5 Roger Jones - Notice of Violation Mr. Jones was present. On November 2, 2016, Mr. Jones was issued Notice of Violation #1290 to appear at today s Administrators Public Hearing. Officer Felshaw discovered in viewing the files of Mr. Jones showed lapse of insurance of 50 days with active vehicle permit #L between (09/06/16-10/26/16). Officer Felshaw issued Notice of Violation #1290 for no insurance coverage with active permit. Mr. Jones stated his insurance company advised him to overnight his payment for his policy. During this transaction the company issued a new policy and canceled the current. Mr. Jones said, the company advised him that overnight payment would be reimbursed back to him within a 12 month time period. Mr. Jones stated, his payment was scheduled to be taken out of this credit card account, but was not without his knowledge. During this transaction his insurance lapsed. Results: The Vehicle for Hire Administrator ruled to waived fine in favor to Mr. Jones. Alejandro Vargas - Notice of Violation Mr. Vargas was present. On November 10, 2016, Mr. Vargas was issued Notice of Violation #1291 to appear at today s Administrators Public Hearing. Officer Felshaw discovered in viewing the files of Mr. Vargas showed lapse of insurance of 44 days with active vehicle permits #L , #L and #L between (07/17/16-08/30/16). Officer Felshaw issued Notice of Violation #1291 for no insurance coverage with three active permits. Mr. Vargas stated, he failed to follow up on received notice from the insurance provider. Mr. Vargas stated, once error was discovered, he reinstated the insurance coverage. Mr. Vargas explained, though he has three vehicles, but only one vehicle is used for commercial purpose. Results: The Vehicle for Hire Administrator ruled a $500 fine for lapse of insurance to Mr. Vargas. Wilfrantz Vixama - Notice of Violation Mr. Vixama was present. On October 24, 2016, Mr. Vixama was issued Notice of Violation #1281 to appear at today s Administrators Public Hearing. Officer Alves discovered in viewing the files Mr. Vixama showed lapse of insurance of 11 days with an active vehicle permit #L between (9/11/16 9/22/16). Officer Alves issued Notice of Violation #1281 for no insurance coverage with active permit. Mr. Vixama stated it was his error the insurance lapsed. Due to a personal issue with a family member, he changed insurance provider. Mr. Vixama said, during this time period, the vehicle was not being operated. Results: The Vehicle for Hire Administrator ruled to waived fine in favor to Mr. Vixama. Page 5
6 Claude Dorceus Notice of Violation Violation: Chapter (F); Charge: Failed to show fare charge on demand not moving forward Mr. Dorceus was present. On October 30, 2016, Mr. Dorceus was issued Notice of Violation #1287 to appear at today s Administrators Public Hearing. Officer Alves was conducting a routine detail on 1 Airport Blvd., Orlando, Florida. During this detail Officer Alves observed Mr. Dorceus failure to show fare charge on demand not moving forward and display the name of the transportation network company assigned a (VFH) permit was not displayed nor provided. Mr. Jacob V. Stuart, Attorney at Law spoke on behalf of Mr. Dorceus ask a continuance due to lack of proper notice and not having aliquot information about the (Notice of Violation). *Recorded: VFH Administrator were informed Mr. Dorceus were excused earlier based on Mr. Jacob V. Stuart, Attorney at Law spoke on behalf of Mr. Dorceus ask for a continuance due to lack of proper notice and not having aliquot information about the Notice of Violation. Results: The Vehicle for Hire Administrator ruled case to be reset for next scheduled hearing on Humberto O. Lafee Oliviari Notice of Violation Violation: Chapter (F); Charge: Failed to show fare charge on demand not moving forward Mr. Lafee Oliviari was not present. On November 3, 2016, Mr. Oliviari was issued Notice of Violation #1059 to appear at today s Administrators Public Hearing. Officer Monn was conducting a routine detail on 6550 Adventure Way, Orlando, Florida. During this detail Officer Monn observed Mr. Lafee Oliviari failure to show fare charge on demand not moving forward and display the name of the transportation network company assigned a (VFH) permit that was not visible. Results: (VFH) Administrator stated let the record reflect Mr. Lafee Oliviari was not present. **Unrecorded: (VFH) Administrator were informed the Notice of Violation will be reset for next scheduled hearing on Page 6
7 Robert Philippe Notice of Violation Violation: Chapter (1) (T); Charge: Failed to update application information with City Mr. Philippe was not present. On October 8, 2016, Mr. Philippe was issued Notice of Violation #1251 to appear at today s Administrators Public Hearing. Officer Monn was conducting a routine detail and observed Mr. Philippe operating in an unlicensed vehicle that was not registered with the VFH Unit. Officer Monn approached Mr. Philippe, due to an improper fare. Mr. Monn was informed by Mr. Philippe that he was no longer employed with Blue Tie Transportation company for the past several months. Officer Monn issued Notice of Violation #1251, failure to provide updated information to the Vehicle for Hire company application within 10 days. Results: (VFH) Administrator ruled the driver permit #24087 be suspended indefinitely with a $100 reinstatement fee. Jean M. Michel Notice of Violation Violation: Chapter (1) (T); Charge: Failed to update application information with City Mr. Michel was not present. On November 11, 2016, Mr. Michel was issued Notice of Violation #1276 to appear at today s Administrators Public Hearing. Officer Monn was conducting a routine detail on 4900 Block of International Drive. Officer Monn observed Mr. Michel operating an unlicensed taxi. Officer Monn approached Mr. Michel at which time, was informed that he was no longer employed with the Diamond Cab company, due to lack of work. Officer Monn issued Notice of Violation #1276, failure to provide updated information to the Vehicle for Hire company application within 10 days. Results: The Vehicle for Hire Administrator ruled the driver permit be suspended indefinitely until Mr. Michel employed with and an active company. No reinstatement fee.
