1 VEHICLE FOR HIRE ADMINISTRATOR S PUBLIC HEARING June 1, 2017 MINUTES On Thursday, June 1, 2017 at 9:00 a.m., the Vehicle for Hire Administrator, Deputy Chief Eric D. Smith held an Administrator Public Hearing, as prescribed by Chapter 55 of the City Code of Orlando. The hearing was held in the Auditorium of the Orlando Police Headquarters which is located at 1250 West South Street, Orlando, Florida. The Public Hearing was advertised in accordance with Sections and 119, Florida Statutes. The hearing was called to order at 9:08 a.m. by the VFH Administrator. Staff Present: Deputy Chief Eric D. 2 ENFORCEMENT Lauris Resetniks Notice of Violation Mr. Resetniks was not present. On April 27, 2017, Mr. Resetniks was issued a Notice of Violation #17028 to appear at today s Administrators Public Hearing. Officer Felshaw discovered in viewing the files of Mr. Resetniks showed a lapse of insurance of 13 days with an active vehicle permit #L between (04/10/17 and 04/24/17). Officer Felshaw issued Notice of Violation #17028 for no insurance coverage with an active permit. Mrs. Tatyana Kocheleva owner of the vehicle spoke on behalf of Mr. Resetniks, explained the current insurance company raised their premiums. Ms. Kocheleva stated while in search of replacement coverage the policy lapsed. Ms. Kocheleva stated during this time period the vehicle was not used. Results: The Vehicle for Hire Administrator issued a warning and waived $500 fine in favor of Mr. Resetniks. Ronald Edouard Notice of Violation Mr. Edouard was present. On April 5, 2017, Mr. Edouard was issued a Notice of Violation #17040 to appear at today s Administrators Public Hearing. Officer Felshaw discovered in viewing the files of Mr. Edouard showed a lapse of insurance of 8 days with an active vehicle permit #L between (01/12/17 and 01/20/17). Officer Felshaw issued Notice of Violation #17040 for no insurance coverage with an active permit. Mr. Edouard explained he has CDL; which allows him to work commercial vehicles. His work schedule changed drastically with flexible hours; ranging from 60 to 65 hours weekly. During this time period, the insurance company raised their premiums. Mr. Edouard stated while searching to replace the insurance; benefits coverage lapsed. Mr. Edouard stated during this time period, the vehicle was not used. Results: The Vehicle for Hire Administrator issued a warning and waived $500 fine in favor of Mr. Edouard. Vinicius Fonesca Notice of Violation Mr. Fonesca was present. On April 5, 2017, Mr. Fonesca was issued a Notice of Violation #17041 to appear at today s Administrators Public Hearing. Officer Felshaw discovered in viewing the files of Mr. Fonesca showed a lapse of insurance of 54 days with active vehicle permits #L17-489/490 between (08/26/16 and 10/19/16). Officer Felshaw issued Notice of Violation #17041 for no insurance coverage with an active permit. Mr. Fonesca stated he did not have knowledge of the lapse of coverage; prior to receiving a letter and a returned check by mail from the insurance company. Results: The Vehicle for Hire Administrator ruled a $500 fine for lapse of insurance. Page 2

3 Gulbert Lubin - Notice of Violation Violation: Chapter (1) (R); Charge: Operating permitted (Vehicle for Hire) out of class. Mr. Lubin was present. On April 26, 2017, Mr. Lubin was issued Notice of Violation #17005 to appear at today s Administrators Public Hearing. Officer Alves was conducting a routine detail on 7800 Universal Blvd. (Crowne Plaza). Officer Alves observed Mr. Lubin operating a Vehicle for Hire permit, working out of class without posted taxi signs on the windshield. Officer Alves issued Notice of Violation # Mr. Lubin admitted it was his error and apologized for not being within compliance of the Chapter 55 guidelines. Results: The Vehicle for Hire Administrator ruled a one day suspension with $100 fine. Vorbb Sovey Notice of Violation Violation: Chapter (1) (T); Charge: Failed to update application information with City Mr. Sovey was present. On May 22, 2017, Mr. Sovey was issued Notice of Violation #17001 to appear at today s Administrators Public Hearing. Officer Alves was conducting a routine detail at (6582 International Drive). Officer Alves observed Mr. Sovey operating in an unlicensed vehicle that was not registered with the VFH Unit. Officer Alves approached Mr. Sovey, due to an improper fare. Officer Alves issued Notice of Violation #17001, failure to update information on file with the City of Orlando. Mr. Sovey stated the taxi company he were employed with went out business. Mr. Sovey explained that he was aware of the violation, but was attempting to make income to support his family. Results: (VFH) Administrator ruled a $100 fine with an indefinite suspension. Americo Galarza Notice of Violation Mr. Galarza was present. On April 5, 2017, Mr. Galarza was issued a Notice of Violation #17035 to appear at today s Administrators Public Hearing. Officer Alves discovered in viewing the files of Mr. Galarza showed a lapse of insurance of 17 days with an active vehicle permit #L between (11/30/16 and 12/17/16). Officer Alves issued Notice of Violation #17035 for no insurance coverage with an active permit. Mr. Galarza explained due to sickness and death occurred within his family, which lead to hardship. Mr. Galarza stated during this time period, the vehicle was not used. Results: The Vehicle for Hire Administrator issued a warning and waived $500 fine in favor of Mr. Galarza. Page 3

4 Anas Abouyussef Notice of Violation Mr. Abouyussef was present. On April 5, 2017, Mr. Abouyussef was issued a Notice of Violation #17036 to appear at today s Administrators Public Hearing. Officer Alves discovered in viewing the files of Mr. Abouyussef showed a lapse of insurance of 7 days with an active vehicle permit #L Officer Alves issued Notice of Violation #17036 for no insurance coverage with an active permit. Mr. Abouyussef stated he was notified by his current insurance company, they no longer insured commercial vehicles. Mr. Abouyussef stated because of this change in coverage, it lead to cancellation of insurance coverage, while seeking to replace coverage on the vehicle. Results: The Vehicle for Hire Administrator issued a warning and waived $500 fine in favor of Mr. Abouyussef. Mario Santos Notice of Violation Violation: Chapter (1) (A); Charge: Shuttle Van without trade name displayed. Mr. Santos was present. On April 5, 2017, Mr. Santos was issued a Notice of Violation #17038 to appear at today s Administrators Public Hearing. Officer Alves observed Mr. Santos operating his vehicle without trade name displayed. Officer Alves issued Notice of Violation # Ms. Cordero spoke on behalf of Mr. Santos, apologized for the error, but did not take notice of updating the company name on the vehicle. Results: The Vehicle for Hire Administrator issued a warning in favor of Mr. Santos. Israel Catala Notice of Violation Chapter (1) (T); Charge: Failed to update application information with City. Mr. Catala was present. On May 5, 2017, Mr. Catala was issued Notice of Violation #17050 to appear at today s Administrators Public Hearing. Officer Alves received notice from the Kingdom Global Movement, Inc., discovered in viewing the files of Mr. Catala showed canceled insurance coverage effective 4/14/17 with an active permit #L Officer Alves also was notified that Mr. Catala no longer worked with Kingdom Global Movement, Inc. Officer Alves issued Notice of Violation #17050 for both violations. Mr. Catala explained that he was experiencing hardship and was seeking insurance coverage for his vehicle. Mr. Catala apologized for the inconvenience caused by his error. Results: The Vehicle for Hire Administrator ruled a $500 fine with indefinite suspension. Page 4

5 Renauld Lubain Notice of Violation Violation: Chapter (1) (T); Charge: Failed to update application information with City Mr. Lubain was not present. On May 4, 2017, Mr. Lubain was issued Notice of Violation #17052 to appear at today s Administrators Public Hearing. Officer Alves discovered in viewing the files Mr. Lubain was no longer employed at Diamond Cab, since 11/27/16. Officer Alves were notified that Mr. Lubain was currently employed at Quick Cab Company. Officer Alves issued Notice of Violation # Results: The Vehicle for Hire Administrator ruled a one day suspension with $100 fine. Jose Juaristi, III Notice of Violation Violation: Chapter (3) (G); Charge: Company Name Company or Trade name shall be Displayed on exterior of non-motorized vehicle. Chapter (3) (D); Charge: No Mirrors attached to non-motorized vehicle. Mr. Juaristi was present. On April 5, 2017, Mr. Juaristi was issued Notice of Violation #17013 to (Corner of Church Street & Hughey Avenue). Officer Monn observed Mr. Juaristi in operating his Pedi Cab committing two violations. Officer Monn issued a Notice of Violation #17013 for both violations. Mr. Juaristi apologized for not complying to have company name displayed on the vehicle and not wearing the proper company shirt, while on duty. 1. Three day suspension with a $12.50 fine. 2. No suspension with a $12.50 fine. Justin Falcon Notice of Violation Violation: Chapter (1); Charge: Pedi Cab with 3 passengers with 1 on lap. Chapter (1) (D); Charge: No Mirror on Pedi cab. Chapter ; Charge: No rate sheet showing/attached warning. Mr. Falcon was present. On January 29, 2017, Mr. Falcon was issued Notice of Violation #17015 to (Corner of Anderson Street & Rio Grande Avenue). Officer Monn observed Mr. Falcon operating the Pedi Cab committing three violations. Officer Monn issued a Notice of Violation # Mr. Falcon apologized for not being within compliance of the Chapter 55 guidelines. 1. Three day suspension with a $12.50 fine. 2. $12.50 fine waived. 3. $12.50 fine waived. Page 5

6 Mark Brown Notice of Violation Violation: Chapter (1); Charge: Pedi Cab with 3 passengers with 1 on lap. Chapter (1) (D); Charge: No Mirror on Pedi cab Chapter ; Charge: No rate sheet showing/attached warning. Mr. Brown was present. On January 29, 2017, Mr. Brown was issued Notice of Violation #17016 to (Corner of Church Street & Terry Avenue). Officer Monn observed Mr. Brown operating his Pedi Cab vehicle committing three violations. Officer Monn issued a Notice of Violation #17016 for three violations. Mr. Brown apologized for not being within compliance of Chapter 55 guidelines. 1. Three day suspension with a $12.50 fine. 2. $12.50 fine waived. 3. $12.50 fine waived. Terry Bagwell Notice of Violation Violation: Chapter (1) (3); Charge: Prohibited Conduct. Mr. Bagwell was present. On April 2, 2017, Mr. Bagwell was issued Notice of Violation #17018 to (Corner of Anderson Street & Orange Blossom Trail). Officer Monn observed Mr. Bagwell travelling the wrong way on Anderson Street, which is a one-way road, east bound only. Officer Monn issued a Notice of Violation # Mr. Bagwell apologized for not being within compliance of the Chapter 55 guidelines. Three day suspension with a $12.50 fine. Faical Denden Notice of Violation Mr. Denden was present. On February 10, 2017, Mr. Denden was issued a Notice of Violation #17019 to appear at today s Administrators Public Hearing. Officer Monn discovered in viewing the files of Mr. Denden showed a lapse of insurance of 14 days with an active vehicle permit #L between (1/23/17 and 2/7/17). Officer Monn issued Notice of Violation #17019 for no insurance coverage with an active permit. Mr. Denden stated he was notified by his insurance company, they were no longer insuring commercial vehicles. Mr. Denden stated due to this notification, it lead to cancellation of insurance coverage on the vehicle. Mr. Denden stated during this time period, the vehicle was not used. Results: The Vehicle for Hire Administrator issued a warning and waived $500 fine in favor Mr. Denden. Page 6

7 Willard Green Notice of Violation Violation: Chapter (3) (G); Charge: Company Name Company or Trade name shall be Displayed on exterior of non-motorized vehicle. Chapter (3) (D); Charge: No Mirrors attached to non-motorized vehicle. Mr. Green was not present. On April 5, 2017, Mr. Green was issued Notice of Violation #17042 to (Corner of Church Street & Hughey Avenue). Officer Monns observed Mr. Green operating his Pedi Cab committing two violations. Officer Monns issued a Notice of Violation #17042 for both violations. 1. First violation, three day suspension with a $12.50 fine. 2. Second violation $12.50 fine. Joseph Moy Notice of Violation Violation: Chapter (3) (G); Charge: Company Name Company or Trade name shall be Displayed on exterior of non-motorized vehicle. Chapter (3) (D); Charge: No Mirrors attached to non-motorized vehicle. Mr. Moy was present. On April 5, 2017, Mr. Moy was issued Notice of Violation #17043 to appear at today s Administrators Public Hearing. Officer Monn was conducting a detail on the (Corner of Church Street & Hughey Avenue). Officer Monns observed Mr. Moy operating his Pedi Cab committing two violations. Officer Monns issued a Notice of Violation # Mr. Moy stated he was not aware of the regulations of the mirrors or the posting of the company name on the Pedi Cab. Mr. Moy apologized for not being within compliance of the Chapter 55 guidelines. 1. First violation, three day suspension with a $12.50 fine. 2. Second violation, $12.50 fine waived.
