2 1. INTRODUCTION 1.1. PROJECT OBJECTIVE Evacuation of power to Nairobi from the generation plants in Mombasa PROJECT SCOPE 1. Lot 1: Construction of 24km of 220kV overhead transmission line from Rabai Substation to future Mariakani Substation and about 167km of 400kV overhead transmission line from future Mariakani Substation to Tsavo River. 2. Lot 2: Construction of 12km of 220kV overhead transmission line from Embakasi Substation to future Athi-River Substation and about 279km of 400kV overhead transmission line from future Athi-River Substation to Tsavo River. 3. Lot 3: Extension and modification to the 220kV substations at Embakasi and Rabai to accommodate two new overhead transmission line circuits from Embakasi to Rabai, including 8km of 220kV cable from Embakasi Substation. 4. 3 2. EXECUTIVE SUMMARY 2.1. Lot 1, Lot 2 and Lot 3 Overall project progress as at 31st December 2013 is 89.3% LOT 1 Overall contract progress is at 95.75%. By the end of this quarter, Lot 1 have completed all the foundations, i.e. 492 out of 492 foundations and 483 out of 492 towers have been erected. 120 km out of 190km of conductor stringing has been done. Most of the right of way issues have now been resolved. Negotiations for the remaining sections are being addressed with a view of clearing as soon as possible. The target is to complete this contract by end of March LOT 2 Overall contract progress is at 82.24% By the end of this quarter, 657 out of 750 foundations had been completed and 430 out of 750 towers erected. About 100km of this contract has no work going on as land owners have not given consent to proceed LOT 3 Overall, the Siemens contract is about 94.7% complete. The contract has been extended to 30th June 2014 owing to the works at Embakasi substation. This is due to the frequency of outages that can be given. All the equipments have been delivered. Rabai Substation At Rabai sub-station, all equipments have been installed, termination of protection, communication and control cables completed. Commissioning tests are ongoing and a shutdown schedule has been planned in February The substation shall be completed by mid-february
4 Embakasi Substation Embakasi sub-station construction progress is at 97% complete, 85% of 220kV equipment installation, 99% of civil works and 95% of gantries and steel structure installation is done. Termination of LV cables is on-going and the progress here is at 97.3%. Commissioning tests are ongoing as well. This substation is planned to be completed by the end of June

14 4.3. LOT 3 Overall, this contract is about 94.7% complete. The progress of the main components of the contract is approximately as follows: Engineering: 97% complete Procurement: 100% complete Construction: 88% complete Pre-commissioning: 49% For Rabai sub-station, Pre-commissioning tests are complete; Commissioning functional tests are in progress. There are two commissioning shutdowns planned for Rabai substation in the month of February Rabai substation construction progress is at 99% complete. At Embakasi sub-station, Pre-commissioning tests are on-going. A total of six shutdowns have been scheduled for commissioning of Embakasi substation. Embakasi substation construction progress is at 97% complete. The 22O KV underground cable at Embakasi has been rerouted into the substation so as to be located away from the KPC fuel pipelines. The new route has been agreed in principle and confirmed to have no major hurdles that will hinder progress. This proposal has provided a solution for the completion of this activity. The High Voltage cable works are 82.4% complete. The components of the actual cable works is as follows. 15 5. ACCESS, WAYLEAVES & COMPENSATION ACQUISITION OF WAYLEAVES. The table below shows a summary of payments made to identified structures, crops and land in Lot 1 and Lot 2 as at end of December 2013: S/no. 16 Summary Report for MNTL Lot 1 Wayleave Status S/No LOCATION AREA PROBLEM DETAILS PROPOSED SOLUTION 01 AP 6/0 to AP 0/0 (220kV section) 02 AP 0/3,0/12 (400kv Section) Army barracks to Mariakani s/station Mwavumbo Group Ranch(Maji ya Chumvi) 03 AP10-AP11 Ndara Ranch/Sagalla Ranch Land offers given, but 2 PAPs have declined claiming compensation is too low. This affects stringing between AP6/0 to 6/8 (Terminal Tower) at the substation. Payment for PAPs within the Mariakani s/s is also pending (AP0/0). Compensation for land for a PAP in location 0/3.Cheque returned to rectify names but is yet to be released back to the PAP-Kamanza Beja Dele Two PAPS were claiming compensation for the same parcel of land in Mwavumbo Group Ranch. Dispute has now been resolved and payment is awaited Disputed compensation by Mr Mwamunga. Case is still in court. Stringing has been completed. 04 AP15/17 Muraru -Voi PAP (Mr Harold Mwangasu) has disputed the compensation and even returned cheque to Ketraco.He wants a re-valuation he has written to Ketraco that the tower has taken up the remaining parcel of land in such a way that he cannot perform any other economic activity on the affected part. 1. For AP 0/0,6/7,6/8--Pay compensation packages to PAPs living within the substation land and recover the amounts from monies set aside for the outright purchase of the substation. 2. For AP6/1-PAPs (Mupa Chigamba & Peter Chigulu Chigamba) KETRACO is engaging them to resolve the issue. 3. AP 6/3-Compensation for crops needs to be done all details are with KETRACO accounts section. 1. PAP to be paid immediately. 2. Pay PAPs as per the recommendations of the dispute resolution committee of the Ranch. Details of the same have been given to KETRACO s Finance Division. 1. KETRACO to send in a valuer as soon as possible to establish these details and advise before stringing starts in this section. 16
17 Summary Report for MNTL Lot 2 Wayleave Status S/No LOCATION AREA PROBLEM DETAILS PROPOSED SOLUTION 01 AP 1/19 Isinya -Athiriver Land Owner...Mr Parantai Wayleave status Not Clear was done on December 2013 and the owner wants payment before works resume. He remains adamant that the compensation must be negotiated with him. 02 Desire 1/3,1/4,1/5,1/6,- Maasai Rural Institute (Centre) Isinya-Athiriver There is dispute of ownership between - ACK Church & Locals(Two Parties) There are three blocks i.e Block 67, 9, 8. Owned as follows: i)block 67 Owned by Emboloi Group Ranch ii)block 9 by ACK iii)block 8 owned by locals Land is also said to be owned by olkejuado county council. The Governor is aware of the disputes and has written a letter adressing to Ketraco on the issue. Following prior meeting of the above interested parties in regard to the disputes, Money for the affected areas was deposited in a suspense account to await resolution of the dispute to enable Ketraco know who to compensate. KETRACO to pay Mr Parantai. 1. A meeting between Ketraco and the County commissioner, Governor, Chiefs and the management of ACK and representative of the locals has been proposed to chart the way forward as the locals have stopped worked claiming they have not been paid. 03 Desire 2/0 Isinya-Athiriver Section Land owner Mr Kepiro Tungas Compensation for Land has been paid. 4 towers have already been constructed in his land constructed and 1 is remaining ( T30) The line has been re-routed thus leaving out his structures which were previously 17 KETRACO plans to meet Mr Kepiro and the Local Adminstration and iron out the outstanding issues

He has received 70% of the affected structure though not in the Wayleave corridor now following the re-routing. He is demanding the remaining 30% although he has not demolished though he doesn t qualify to be paid. Land Owner. Mr Gachiko Disputed affected acreage Mr Gachiko has employed the services of a lawyer to follow up on the disputed acreage and compensation. The Offer letter for land Compensation was given out on 08/01/2014 to the lawyer Awaiting the lawyers response which is expected by 12 h January Land owners Erick & Mbugua. The said Parcel is owned by two brothers who have refused to meet Ketraco. They claim the compensation package offered by Ketraco is too low. One of the Brothers Mr Erick is willing to meet Ketraco and negotiate by next week. Land owner -Ukulima Sacco The land is owned by Afya Sacco and has been subdivided into plots. The plots are titled The PIT has already set the stage for negotiation with elected officials of the Sacco. Although the land is owned by Afya Sacco,some locals (Masais.are KETRACO or is following up on the issue. 1. KETRACO is engaging the land owners to resolve the issue. 2. The wayleave status is assumed to be clear as there has been no resistant here. 3. The Contractor has been asked to move in and start site works

Land Owner-K-Ref Bank The land owners are not opposed to the line traversing their land They want to be involved in the process of determining the compensation package. The land has been subdivided into plots and beaconed. Land owner Winnie Njeri/Comp West Still waiting for land ownership documents for parcel claimed by Winnie Njeri. Ketraco or resurveyed the land parcels in Question as the acreage was disputed, Offer letter to be given upon submission of land ownership documents as promised by owners. Wayleave not clear. 1. The land owner has questioned the rational of compensating 30% of valued land. 1. Land owners questioning rationale of paying 30% of valued land. 1. Agree with owner to continue with site works as negotiations continue. 19

The report has been submitted to NEMA for review and licencing.. Install erosion control Contractor No appreciable soil erosion has taken place in the measures quarter either due to dust storms or rain. Restoring the site to a condition that is visually acceptable to the community and reclaiming the areas impacted for future use (agricultural for example) Remove any contaminated soils Safe disposal procedures in accordance with NEMA waste management regulations, 2006 Natural drainage patterns are reinstated where they have been altered or impaired. Trenches/terraces (if any) are backfilled daily at close of day s work Top soil is always removed and retained for subsequent rehabilitation. Contractor The contractor has employed a safe waste management system in accordance to the waste management regulations of Waste from the sites including cement bags and food packaging is collected in the evenings to a central place. 23 Possible Impact Mitigation measure Responsible person Health, Sanitation and Hygiene. HIV/AIDS and other sexually transmitted diseases. Awareness campaign among Workers and local residents on health risks particularly of HIV/AIDS. Contractor to liaise with the Government and local NGO`s to provide both female and male condoms in appropriate designated places in the labour camp. Provision of first aid facilities at all sites where construction is being undertaken. Use of toilets /latrines in project. Status of implementation/corrective and preventive action collects and disposes the waste from the sites, camp and store. Contractor HIV/AIDS awareness together with other sexually transmitted diseases covered in the Tool Box Talk done daily before work commences. First aid facilities have been provided at appropriate places in the site and parties are encouraged to have clean, hygienic and sterilized first aid equipment.
