ADDENDA AMENDMENTS MUST BE ACKNOWLEDGED IN THE MISCELLANEOUS SECTION OF THE EXPEDITE (EBS) FILE AND ALL AMENDMENTS LOADED IN ORDER FOR YOUR BID TO BE CONSIDERED FOR AWARD OF THIS PROJECT. BID EXPRESS WILL NOT ACCEPT BIDS THAT DO NOT HAVE AMENDMENTS INCORPORATED. 2 Be advised of the following changes: Proposal Addendum for LIC Williams Street Garage; PID Project If the bidder chooses to submit an on-line bid, please follow the directions outlined on page 2, Proposal Note 019, of the proposal. If the bidder chooses to submit a paper copy of their bid, Proposal Note 019, is replaced with the following: BIDDING REQUIREMENTS The Department will not accept a handwritten bid or a bid electronically generated from software other than that used and supplied by the Department. The Department will only accept and consider bids that have been produced from the Department s electronic bidding software (EBS), any other type of bid submitted will be declared non-responsive and ineligible for award. Bidders must prepare their bids electronically by using the EBS software furnished by the Department of Transportation. This software can be found on the Office of Contracts Web Page at Bidders are required to submit a paper copy of their Bid Item Schedules and an electronic disk containing that same schedule with their proposal. Bidders are required to submit a bid amount for each bid item and they must complete the Miscellaneous Data Section on the disk. The disk shall be marked with the bidder s name and all call order numbers for the project being bid. No more than one set of Bid Item Schedules can be submitted on each disk. When requested, the Department will provide planholders with the following documents: Electronic Items Provided on ODOT s Web Site EBS Files Addenda for Estimated Quantity Changes Addenda Bid Bond Proposal Plans Hard Copy Documents Included with the Bid Package Proposal Plans Bid Envelope All Issued Addenda Electronic bids must comply with all special provisions, the Standard Specifications for Highway Construction, Supplemental Specifications to the Standard Specifications for Highway Construction, and the Rules and Regulations of the Ohio Department of Transportation regarding bid preparation and bid submittal.

3 Bidders MUST submit the following items in order for their bid to be considered valid: *Complete Bid Proposal Bid Guaranty w/ supporting documentation EBS Disk (3½" or Compact Disk) **Signed Addendum #1 Printed Paper Copy of EBS Bid Copies of all addenda issued for this project *NOTE: In addition to the diskette containing your bid quotation, a complete bid proposal must be submitted. **This addendum contains a signature block that must also be completed, signed and submitted with the bid package. Blank unit prices are not permitted and will render the bid non-responsive EXCEPT in the case of optional designs (where the bidder is required to bid on only one of the design options). Unit prices of zero are not permitted at any time and will render the bid non-responsive and ineligible for award. In the event there is a discrepancy between the information submitted on the disk and the paper bid item pages submitted with the proposal, the figures on the bid item pages will take precedence. The Director may conduct such investigation as he deems necessary in order to assist in the evaluation of any bid. Each bidder is required to guaranty their bid. The guaranty may be in the form of a certified or cashier s check in an amount equal to five percent (5%) of the bid, but in no event should the check exceed fifty thousand dollars, or a bid bond for ten percent (10%) of the bid. Checks should be made payable to the Director of Transportation. In the event a bidder chooses to use a bid bond, the bidder must use the Department s Bid Bond form (copy attached). You can also find a copy of the Department s Bid Bond form at Any other bid bond form submitted with the bid, including, but not limited to a form from another state agency or surety company will render your bid non-responsive and ineligible for award. By submitting a paper copy of a bid bond, you will not need to submit your bond electronically. If a bid bond is submitted, said bond must be accompanied by (1) a certificate of the superintendent of insurance, that such surety company is authorized to transact business in this state; and (2) the power of attorney of the agent of such company showing this authority to execute said bond in its behalf, which power of attorney must be dated not more than ninety days previous to the signing of the contract; and (3) a recent financial statement of the surety company. The successful awarded bidder must furnish a performance bond and a payment bond in an amount equal to one hundred percent (100%) of the state s estimate (Section O.R.C.). Planholders will receive notification by electronic mail at the time that an addendum has been issued for this project. Acknowledgment of receipt of each addendum will be confirmed when you load an amendment to your project EBS file. Failure to load all amendments and incorporate changed quantities or items into your EBS submission will render your bid non-responsive and ineligible for award.

4 Sealed bids for this Ohio Department of Transportation Project will be received at the Department s Office of Contracts, First Floor, 1980 West Broad Street, Columbus, Ohio 43223, until 10:00:59 a.m. Ohio Standard Time on the day of the letting. Bidders must allow sufficient time for mailing their bids to ensure delivery prior to the opening time and date. The Department will not be responsible for a late bid due to the failure of the bidder to allow sufficient time for delivery of the bid. All bids will be time/date stamped upon receipt and as such shall be the official time/date of receipt. Postmarks, or other times/dates appearing on the bid will not be considered as the official time/date of receipt. Delivery to any other location within the Department, including the Mail Room, or to departmental personnel other than a Customer Service Representative or the Letting Manager who has authority to receive bids, does not constitute the bid being received by the Department. Bids submitted with insufficient postage will not be accepted. Bids will be received during regular business hours, 7:30 a.m. - 4:30 p.m., Monday through Friday, excluding recognized holidays. Telegraphic, facsimiles, or any other mode of transmission other than stated above shall not be considered as a valid submission to the Department. Bidders using express mail or similar types of service must verify with the service as to which address is required to ensure proper delivery of the response to the Department and time of delivery. The Department will not be held liable for non-delivery and/or late delivery of any bid response due to a bidder listing an incorrect address. Any bid received after 10:00:59 a.m. on the scheduled day of opening will be marked as late, will remain sealed and will be declared non-responsive and ineligible for award. Late bids will be returned to the bidder. The Department will not be responsible for a late bid due to failure of the bidder to allow sufficient time for delivery of the bid. Bidders on this non-highway project need not be pre-qualified with the Department. Bidders must complete, sign and submit the signature page of this addendum in blue or black ink. Addenda with stamped or copied signatures will be considered non-responsive. Any additions, revisions, deletions or conditions made to the bid documents will render the bid nonresponsive and ineligible for award. This includes the removal of any pages of the proposal or contents of an addendum. Submit one bidding proposal in its entirety. If a bidder submits more than one bid for this project, all bids submitted by that bidder will be declared non-responsive and ineligible for award. After all bids are reviewed for math and procedural errors, the Department s Award Committee acts to award or reject bids within ten days of the opening of bids. If there are no errors, the project will be awarded to the low bidder. A contract will be prepared by the Office of Contracts and mailed to the awarded contractor within two working days of the Award Meeting. The contractor must obtain payment and performance bonds, sign the contract and return it to the Office of Contracts with all required documents within ten days after receipt of the contract. The Director will review the contract documents and, if all requirements are met, he will execute the contract enabling the contractor to commence work upon notice from the district.

5 EXECUTION OF PROPOSAL AND CONTRACT On acceptance of the proposal for said work I do hereby bind the below referenced company to enter into a written contract with the Director of the Ohio Department of Transportation within ten (10) days from the date of notice of award. Further, I acknowledge that I am fully aware of the site, plans and specifications for the above improvement and the conditions of this proposal, and I hereby agree to furnish all services, labor, materials, and equipment necessary to complete the entire project, according to the plans, specifications and completion dates, and to accept the unit prices specified for each item as full compensation for the work on this project. Further, by my signature certifies, under penalty of perjury and under other such penalties as the laws of the State of Ohio and the United States of America provide, that neither I nor anyone in my company or agent thereof has violated Title 23 United States Code, Section 112 Non-Collusion Affidavit, and further I certify, except as previously noted under penalty of perjury and under other such penalties as the laws of the State of Ohio and the United States of America provide, that I, the company or any person associated therewith in the capacity of owner, partner, director, officer, principal investigator, project director, manager, auditor, or any position involving the administration of federal funds are in compliance with the Certification Against Debarment And Suspension Clause found in the Miscellaneous Section of the EBS file.
