2 General Bid Information Montrose County is accepting sealed bids for the supply and delivery of approximately 612,000 gallons of liquid magnesium chloride. Bidder Instructions Submitted bids must be enclosed in a sealed opaque envelope marked 2018 Bulk Magnesium Chloride Bid with the name of the bidder and delivered to Montrose County Road & Bridge, Attn: Keith Laube, 949 North 2nd St, Montrose, CO 81401, no later than 10:00 a.m. local time, Thursday, March 29, The bids will be opened immediately thereafter and read aloud. Bids received after the time due will not be considered and will be returned to the bidder un-opened. A 5% bid security is required with the bid as outlined in C.R.S The bid security shall be placed in a separate envelop marked Bid Security that is either attached to the outside of the bid envelope or placed in a larger envelope that contains both the sealed bid envelope and the bid security envelope. Bids not including a bid security will not be considered and will be returned to the bidder un-opened. Bids are to be submitted on the Bid Forms included within the bid package. Bidder must provide the Unit Bid Price and Total Bid Price on the Bid Schedule Form. In case of discrepancy on the Bid Schedule Form, the Unit Bid Price governs. Any bid questions must be received by 2 pm local time, March 21, Any modifications to the Invitation to Bid package will be an Addendum and posted to the County website by 2 pm, March 23, 2018 and distributed to all known bidders. It is the responsibility of the bidder to verify if an addendum has been issued. Bidder shall acknowledge Addenda in the Bid and Addenda Acknowledgment section of the Bid Form. General Conditions All bids shall be irrevocable for 45 days from the date of the bid opening. Contractor shall carry insurance coverage as outlined in the contract agreement. Payment to successful bidder will be made upon delivery of the liquid magnesium chloride and approval of invoice(s). Invoices shall be submitted to Montrose County Finance, 1845 South Townsend Ave, Montrose CO Payment will follow normal County payment processing cycles for issuance of checks. 2

3 Awarding of Bid Award may be made to the lowest responsive, responsible bidder meeting applicable county and state procurement requirements. In reviewing the bids received, the County reserves the right to reject, for any reason whatsoever, any and all bids, and to waive any informality or irregularity in a bid. The County reserves the right to accept the bid that provides the best value to the County in the County s sole discretion. The action to award a contract is subject to approval by the Board of County Commissioners. The submission of a bid does not in any way commit the County to enter into an agreement or contract with that bidder. It is anticipated that award of the contract will be made within two (2) weeks of the bid opening. All bidders will be notified of the Commissioners decision. A purchase order will be used for authorization to proceed. Requirements of Successful Bidder A payment and performance bond equal to 100% of the bid amount will be required as outlined in C.R.S and the contract agreement. Furnish a completed Form W-9 Request for Taxpayer Identification Number and Certification. Furnish an Equal Employment Opportunity Certification letter. Furnish certificates of required insurance coverage. A Product Data Sheet and MSDS Sheet must be enclosed with each delivered shipment. Enter into a contract agreement with the County, which includes a signed Notification of Immigration Compliance Requirements and Certification by Contractor. A sample copy of the agreement is included in this bid package. If the railroad siding in Montrose, Colorado will be used, written documentation authorizing the use of the siding by Union Pacific Railroad is required prior to bid award. Additional Terms and Scope of Services 1. The magnesium chloride shall be in liquid form. The magnesium chloride content shall be a minimum 30% (typical). The magnesium chloride solution shall not contain any other substance whose application to Montrose County Roads would violate any Federal or State Law or Regulation. 2. County will place orders for product as needed. Each order will consist of the quantity of product contained in one or more rail cars or trucks, as applicable. 3

4 3. Bidder shall specify lead-time required from order placement until delivery on the bid form. 4. The majority of the product will be used during the months of May, June, and July but can extend through the fall. Actual gallons purchased will be dictated by bid price, appropriated budget, and schedule. 5. The product is to be delivered to Montrose County by rail car to bidder s railroad siding within Montrose County, by tanker truck or by other approved method. The County will off-load the product into its own trucks as needed. 6. If multiple railroad sidings within the county are bid, the County may choose to have product shipped to any/or all of the locations for the associated unit bid price. 7. Bidder will be responsible for any cost of normal siding usage. 8. Demurrage charges may apply if the County fails to unload the product within one week. Bidder must specify demurrage charges that would accrue after one week on the bid form. 9. The County, at its discretion, may take samples of the product and run a complete chemical analysis. If the test results fail to meet the minimum specifications, Montrose County will have the option to seek remedy or terminate the contract. 10. All magnesium chloride shall be priced F.O.B. destination at the bidder s designated railroad siding or location. 11. A notification of shipping shall be ed to jfletcher@montrosecounty.net. Contractor shall contact Montrose County at if an exception arises to the lead time stated in the bid. 12. The first shipment of product should arrive no later than May 21, 2018, unless a later date is agreed to by the County. The County may assess liquidated damages in the amount of $300 per calendar day against the Contractor if the deadline for delivery is not met. 13. Pricing shall be guaranteed through October 31,
