4 Programme Programme CLE Information The ABA directly applies for and ordinarily receives CLE credit for ABA programs in AK, AL, AR, AZ, CA, CO, CT, DE, GA, GU, HI, IA, IL, IN, KS, KY, LA, ME, MN, MS, MO, MP, MT, NH, NJ, NM, NV, NY, NC, ND, OH, OK, OR, PA, SC, TN, TX, UT, VT, VA, VI, WA, WI, and WV. These states sometimes do not approve a program for credit before the program occurs. The expected number of credit hours will be posted to the 2017 Fall Conference website: under the CLE Events and Information tab approximately four weeks before the meeting. This transitional program is approved for both newly admitted and experienced attorneys in NY. Attorneys may be eligible to receive CLE credit through reciprocity or attorney self-submission in other states. For more information about CLE accreditation in your state, visit A limited number of registration fee reductions are available for this program upon application. The fee-reductions will be determined on a one-time only, case-by-case, first-come first-serve basis. Requests must be received at least three weeks before the program start date. You will be notified prior to the program if your application is approved. A minimal fee may be charged on all approved applications to defray expenses. For programs with tuition costs of $500 or more, qualifying attorneys will receive at least a 50% reduction in the course fee(s) only. Tips for foreign litigants in Russian courts A 2001 study of the experience of foreign litigants in Russia s commercial (arbitrazh) courts concluded that although the data provide some evidence of anti-foreign bias, particularly outside of Moscow and St. Petersburg, they do not support the conception of most Westerners of their likely fate in a Russian court a Soviet-style show trial with a foregone conclusion. The study recommended that foreign companies having business dealings in Russia should consider making greater use of the Russian courts. What has happened since then? What should a foreign company expect if it finds itself in a Russian court? Anyone interested in the answers to these questions or in lending their voice to the debate are welcome to join the discussion. How are parties responding to this change? When does it make sense to arbitrate in Russia, and under what circumstances might a party consider other options? OJSC NLMK and other recent cases. The 2011 Moscow Arbitrazh (commercial) court ruling setting aside an arbitration award on the basis that corporate disputes are not arbitrable sent shock waves through the Russian legal and business communities. Six years later, the same case Maximov v. NLMK is still making news as Maximov seeks to enforce the annulled Russian arbitration award in foreign courts. A court in Paris agreed to enforce the award, while courts in London and Amsterdam refused enforcement. Further litigation in foreign courts seems likely. Systema cases This past year, Russian courts issued a series of decisions that captured the attention of the Russian legal and business communities, in part because the disputes involved some of Russia s largest companies and huge amounts of money, but also because the claims were out of the ordinary, and some of the outcomes caught some observers by surprise. A panel of experts who participated in these cases will discuss the impact of these judicial decisions on the business environment and court practice in Russia and whether they hold any broader lessons for the evolution of Russia s judicial system. The investigatory and compulsive powers of the state can also be helpful in tracing and recovering assets and uncovering fraud. But the tactic is potentially subject to abuse. Daniel Russell is the President and CEO of the U.S.-Russia Business Council, the premier Washington-based bilateral trade organization dedicated to commercial relation between the U.S. and Russia. Alexander graduated from the International Law Faculty of the Moscow State Institute of International Relations (University) of the Ministry of Foreign Affairs of the Russian Federation. He started his practice in the jurisprudence sphere in 2003 and has been specializing in the field of arbitration proceedings, energy law and private international law. Richard Happ Partner, Luther Rechtsanwaltsgesellschaft mbh Dr. Richard Happ joined Luther's Hamburg office in 2001 and since then has worked as a lawyer specialising in litigation and dispute resolution. Dmitry Lysenko Senior Associate, Baker & McKenzie Dmitry Lysenko is a senior associate in the Moscow office of Baker & McKenzie. He specializes in litigation and international commercial arbitration, including commercial disputes, bankruptcies and disputes with state authorities. Dmitry also has advisory experience in commercial contracts, insurance, IT/telecoms and international law matters, as well as experience in compliance investigations. Ed Crosse Partner, Simmons & Simmons Ed Crosse is a partner at Simmons and Simmons LLP, specialising in complex financial and contentious regulatory disputes. Ed is President of the London Solicitors Litigation Association. He was invited to join a working group established by the Lord Chief Justice to advise the MOJ on the implications of Brexit for UK Civil Justice. Mr. Crosse is currently working on proposals fundamentally to reform the Civil Procedure Rules on disclosure. Alexey Yadykin Senior Associate, Freshfields Bruckhaus Deringer Alexey Yadykin is a senior lawyer of dispute resolution practice Moscow Freshfields office. Alexey specializes in arbitration, litigation and internal investigations and sanctions. In 2000 he graduated from the Moscow State Law University. Mr. Yadykin was a member of the working group in the Ministry of Justice of the Russian Federation on the development of the new arbitration rules. Fedor Vyacheslavov Partner, V Lawyers Feodor Vyacheslavov successfully advises and represents clients interests in Russian state courts of all instances (arbitrazh and general jurisdiction courts), including the Supreme Arbitrazh Court of the RF and the International Commercial Arbitration Court under the Chamber of Commerce of the RF. Anna Grischenkova Partner, KIAP Anna Grischenkova is a partner at KIAP, obtained LL.M in US Law. In 2016 Anna was elected a new regional representative of Russia in the IBA Litigation Committee and also was granted the status of Member of The Chartered Institute of Arbitrators (CIArb).
