DEPOSIT - A reservation deposit equal to 50% of your room charges is required to confirm a reservation with the balance being charged to the credit card provided 30 days prior to your arrival date. Reservations made less than 30 day prior to arrival will require payment in full at time of booking. We gladly accept Visa, Discover, or MasterCard. We do not accept personal checks. Deposits will be non-refundable for holiday cancellations. To avoid any misunderstandings, you will be charged for the number of nights of your reservation, so please check your dates carefully. All damages or excessive cleaning will be charged to the credit card provided to us for the deposit by the lessee. Please note that there will be additional guest fees of $25pp for CABIN (not tree house) reservations if guest number exceeds the base rate number of guests. Check CABIN rates for specifics.
2 TAXES-There is a 10.25% additional tax added to each reservation (7.25% sales tax and 3% lodging tax). CANCELLATION POLICY - If cancelled 30 days prior to your arrival date the deposit will be refunded minus a $30.00 per cancellation fee. If cancelled less than 30 days the reservation is non-refundable. Early departures and no shows due to weather or any other reason will not receive a refund. No refund will be given for failure to use the property due to inclement weather. Local roads can be very curvy and steep and may be impassible from time to time. We do not give refunds due to road conditions. If you do not show up for your reservation you will be charged the entire amount of the reservation. All reservation changes must be confirmed in writing to The Mohicans by mail or (info@themohicans.net). PARTIES - Absolutely no house parties are allowed. Should this occur you will be evicted without a refund. OCCUPANCY - Only the suggested number of people will be allowed for each property. Overcrowding of our cabins/tree houses is not permitted, and maximum occupancy noncompliance will result in eviction. You must be 24 year of age of older to obtain a The Mohicans rental unit. The Mohicans DOES NOT rent to high school and/or college students under the age of 24 without their parents reserving the property in the parent s name(s) and the parents being present at the property during the entire stay. Any violation of these standards or misrepresentation of your group will be grounds for eviction without a refund. Motor Homes and/or tents are not permitted at the cabins. CHECK-IN for NON WEDDING GUESTS- is at 4:00 p.m. Early arrival will result in unnecessary waiting. Due to the size and complexity of our properties, our housekeepers need every minute of their 11:00am to 4:00pm window to ensure the cleanliness of your vacation cabin. Please do not interfere with their work or pressure our staff to allow you to enter before 4:00pm. There will be no check-ins after 11:00 pm. as a courtesy to other guests. No keys/access codes will be issued until the balance is paid in full and Rental Agreement and Waiver have been returned to The Mohicans. CHECK-IN for WEDDING GUESTS OF THE GRAND BARN- is at 2:00 p.m. Early arrival will result in unnecessary waiting. Due to the size and complexity of our cabins, our housekeepers need every minute of their 11:00am to 2:00pm window to ensure the cleanliness of your vacation cabin. Please do not interfere with their work or pressure our staff to allow you to enter before 2:00pm. There will be no check-ins after 11:00 pm. as a courtesy to other guests. No cabin keys/access codes will be issued until the cabin balance is paid in full and Rental Agreement and Waiver have been returned to The Mohicans.
3 CHECK OUT/CLEANING- is prior to 11:00am. Should this check out time be violated, you will be charged an additional night's stay. Lessee agrees to remove all trash from cabin and take to dumpsters/receptacles, wash and put away all dishes, lock all doors and windows, remove bedding and place on floor beside beds, place all towels in shower/bath tub, take trash to the dumpster located in the corner of the Grand Barn parking lot, and report all damages to The Mohicans, and return key to lock box. Cigarette butts found on the property will result in a $50 cleaning fee. Housekeeping arrives shortly after 11am. PETS No pets of any kind are permitted at the cabins/treehouses. SMOKING - Smoking is prohibited inside all rental cabins. If evidence is found, a minimum of $50.00 will be charged to the credit card provided to us by the lessee. Please dispose of all cigarette butts in appropriate containers-not on the ground. VEHICLES - There is a limit of 4 vehicles per cabin, 2 vehicles for the White Oak and Old Pine Tree Houses and 1 vehicle for the Little Red Tree House. Drives must be kept clear per the Fire Marshall. Please observe the 5 mph speed limit. Parking is restricted to designated parking areas only and parking in any grass area is prohibited. REPAIRS AND SERVICE CALLS - We perform regular maintenance on each and every cabin, however, as with all homes, occasionally something malfunctions at the most inopportune times. We will do our best within our ability to correct the problem during your visit and make you as comfortable as possible. We cannot guarantee appliances, TV's, DVD players, VCR's, Air Conditioners, ect. and there will be no refunds, discounts, or rate adjustments in the event of mechanical failure. The Mohicans, the property owner ( Property Owner ), their agents, service providers and employees shall have the right to access the premises during the vacation rental to make repairs or inspections. Prompt reporting of a problem will expedite its repair by contacting the The Mohicans at or calling or texting or We will make every effort to have repairs done quickly and effectively. ACCOMMODATIONS - Each cabin is decorated and furnished by the owner. Rearranging of the furniture is not permitted. If you have specific needs or requirements you must seek permission from The Mohicans. CLEANING CHARGE - We have a cleaning service for each property. If there is a need for any extra or excessive cleaning after your departure, you will be charged a minimum of at least $ or more depending on the nature of the damage or mess. Please keep in mind that the signed rental agreement is a legal and binding contract and therefore gives The Mohicans the right to collect payments for damages, missing items, and excessive cleaning made necessary by your stay. Full payment for all damages, missing items and extra cleaning are the responsibility of the guest and will be charged to the credit card provided by the lessee and/or the one who signs the rental agreement. (Please leave beds unmade at the end of your
4 stay so that The Mohicans can identify linens that need to be changed. Made up beds indicate that the beds were unused and do not need the linens changed. Thank you for helping us reduce our water and energy usage.) GARBAGE- Please dispose of trash in the dumpster located in the corner of the Grand Barn parking lot. FIREPLACE - (15 man cabin only) - Fireplace is only operational during October 1st to April 1st each year. The only control that may be adjusted is the thermostat. If any other adjustments are made and we need to call a technician you will be charged a minimum of $50.00 to the credit card provided to us by the Lessee. FRESH TOWELS - Towels are provided. Personal toiletries (soap, shampoo, ect.) are not provided in any of the cabins. Please bring extra towels for canoeing or other water activities that you may be enjoying in the area. We do not provide linen service during your stay. Loudonville has a Laundromat on State Rt. 3 behind the Marathon gas station across from Mohican Adventures Canoe Livery if you are in need of laundry service. WILDLIFE/INSECTS - The Mohican area has one of the most enjoyable ecosystems on earth and insects are a part of that system. We try to control this natural occurrence by regularly spraying for insects. The most common pests which may find their way into our properties include ladybugs, flies, mosquitoes and wasps. Hopefully, any bugs you find will be dead and you can quickly dispose of them. Hairspray sprayed on bees and wasps makes them immediately drop to the ground where they can easily be swatted. Naturally, it is a good idea to keep doors closed while enjoying one of our cabins. We do not give refunds due to any pest discomfort issue. DO NOT leave any garbage outside or on porch or decks as this invites unwanted guests to your cabin. GROUND FIRES - Ground fires are allowed in the provided fire rings only. All fires must be attended to at all times and be out by 12:00 am. CHILDREN - Children are the responsibility of the parents, and must be supervised at all times. You will be held accountable for your child's safety and actions. QUIET TIME - 11 pm to 7 am is quiet time. There will be no check-ins during this time. Sounds carry farther at night. Please be considerate of others. Loud noise/music, etc. must be confined to your property at all hours. Loud or abusive behavior or language will not be tolerated. Eviction will result without any refunds. HUNTING,WEAPONS, FIRECRACKER, ATV'S- Absolutely no hunting, weapons of any kind (including paintball or air guns) are permitted on our cabin properties. Likewise, we do not allow ATV's, dirt bikes or fire crackers to be used at any of our cabins. If they are found on the
5 property, you will be asked to leave the premises with no refund. DRIVING CONDITIONS-IMPORTANT!!!!! Most roads in our area are very well maintained, but can be curvy and steep. All of our properties have gravel driveways, with some being very long. While they are routinely maintained, they can be bumpy or slippery at times. We recommend four-wheel or all-wheel drive whenever possible, especially during the winter-front-wheel AND REAR-WHEEL DRIVE VEHICLES FREQUENTLY CAN NOT NAVIGATE THE STEEP HILLS IN THE AREA DURING THE WINTER IF THERE IS SNOW OR ICE ON THE ROADS- PLEASE PLAN ACCORDINGLY. There are no refunds due to inclement weather. The Mohicans practices Leave Not Trace (LNT) Land Ethics Policy. This simply means that you leave the natural surroundings as you found them which includes staying on the walking paths to protect natural ground vegetation, not removing any items from their original environment, collecting all trash and other items that you brought with you into the woods, minimizing fire impact, and educating yourself on the rules and regulations related to outdoor recreation. ANY TREES FOUND TO BE DEFACED AT THE CABIN PROPERTY WILL RESULT IN A $300 FINE. We ask you to select beverages in non-glass containers to reduce the possibility of glass breakage and injury to guests. (It s really hard to pick up broken glass from the grassy areas). Thank you for caring about the environment as much as we do What to bring to The Mohicans: Kitchen-spices (although we have some), ICE!, aluminum foil, plastic wrap, ziploc bags, paper towels/napkins, extra garbage bags, specialty cooking items (roasters, blenders, etc.) Bathroom-bath soap, shampoo/conditioner, extra toilet paper, blow dryer General-dvd s as tv is for movie watching only (no satellite or cable) charcoal, firewood for outdoor fire pit, alarm clock, camp chairs.
6 I HAVE READ THE RULES AND POLICIES STATED ON THIS AGREEMENT AND AGREE TO ABIDE BY THEM INCLUDING ALL PERSONS OCCUPYING THE CABIN DURING THE LEASE PERIOD. I ALSO AGREE TO ABIDE BY THE RULES AND POLICIES SET FORTH AND WILL BE RESPOSIBLE FOR THE CABIN AND THE OCCUPANTS. MOHICAN CABINS HAS THE RIGHT TO CHANGE ANY & ALL POLICIES AT ANY TIME WITH NO NOTICE. 7 RELEASE AND WAIVER OF LIABILITY ASSUMPTION OF RISK AND IDEMNITY AGREEMENT VESS, LLC The undersigned are guests at Vess, LLC. In consideration of being permitted to enter into grounds and common areas of the premises, including to or being permitted to enter for any purpose any restricted area (defined as any area posted as restricted or prohibited or by a warning sign), each of the undersigned, for himself/herself/ his or her personal representatives, heirs, children and next of kin: 1. Acknowledges, agrees, and represents that he or she has or will immediately upon entering any of such restricted areas, and will continuously thereafter, inspect the areas which he or she enters, and he or she further agrees and warrants that, if at any time, he or she is in or about restricted areas and feels anything to be unsafe, he or she will immediately advise the management of such and if necessary will leave the restricted areas and not use the restricted areas.

Hereby releases, waives, discharges and covenants not to sue Vess, LLC, its members, officers and employees, from all liability to the undersigned, his or her personal representatives assigns, children, heirs and next of kin for any and all loss or damage, and any claim or demands therefor on account of injury to the person or property or resulting in death of the undersigned arising on the premises, including restricted areas to the event(s) whether caused by the negligence of the Releasees or otherwise. 3. Hereby assumes full responsibility for and agrees to indemnify and save and hold harmless the Releasees and each of them from any loss, liability, damage, or cost they may occur on the grounds or premises whether caused by the negligence of the Releasees or otherwise. 4. Hereby acknowledges that activities such as swimming in the pond may be very dangerous and involve the risk of serious injury and/or death and/or property damage. Each of the undersigned, also expressly acknowledges that injuries received may be compounded or increased by negligent rescue operations or procedures of the Releasees. 5. Hereby agrees that this Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement extends to all acts of negligence by the Releasees and is intended to be as broad and inclusive as is permitted by the laws of Ohio and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. I have read this release and waiver of liability, assumption of risk and indemnity agreement, fully understand its terms, understand that I have given up substantial
9 rights by signing it, and have signed it freely and voluntarily without any inducement assurance or guarantee being made to me and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
