2 I. Rental Agreement 1. Qualifications for rental We rent to adults only (age 21 or older only). Neighborhood-disturbing parties are not allowed. 2. Check-in, Check-out time Check-in time is 4:00 pm on the day your rental commences. Check-out time is 11:00 am on the day your rental ends. 3. Length of stay requirement For stays between May 1 and September 30, there is a two-night minimum stay requirement on weekend-only reservations when both Friday and Saturday nights are available. Likewise, there is a two-night minimum stay requirement on legal holidays. 4. Cleaning the Beach House There is a Cleaning Fee of $75. To help our housekeeping staff, please make sure these items are taken care of before you leave: Run all dishes in the dishwasher; wash & dry all pots and pans. Wash used linens (sheets and towels) so that you do not leave any more than two loads of laundry for the housekeeper. Do not make the beds (leave all used beds unmade). Please note that there is a notebook in the Beach House that contains a checklist for all cleaning procedures. 5. Clothes drying Towels, bathing suits and other items may not be left on the patio or railings so as to be visible to passers-by. 6. Children Parents are responsible for the conduct of their children. Children are expected to play and behave in a manner that does not create any undue disturbance to the neighbors or cause damage to the Property. Children eighteen (18) years of age or younger shall not be left in the home unsupervised. 7. Responsible use of the Property No illegal substances are allowed at the Beach House. Minors shall not be in possession of alcohol. 8. Smoking Smoking is not permitted anywhere in the house, the garage, nor anywhere else on the property. If this is violated, you may be required to vacate the premises immediately and you will forfeit all monies paid for rent and deposit. Additionally, you will be charged a $ Smoking Policy Violation Fee. Renter acknowledges agreement: (initials) Page 2 of 6

3 9. Pets Dogs may be permitted with the Owner's approval and the payment of a Pet Fee of $75.00 for one average size dog or two small dogs; or $ for two dogs of the larger breeds. Other pets are not permitted. If this is violated, you may be required to vacate the premises immediately and pay for extra cleaning and repair for pet odor and damage. Animals are not allowed on the furniture or beds under any circumstances. 10. Maintenance and repairs If any items are broken or damaged, or if maintenance or repairs to the Beach House are required during your stay, please notify Us immediately and allow access for Our designated representative to make the necessary repair(s). You must notify Us immediately upon Your arrival if you are unsatisfied with the condition of the Beach House. For such notifications, please call Us at Personal property Owners are not responsible for any belongings left by You or Your guests. 12. Signs No sign, advertisement, notice or other lettering shall be exhibited, displayed, inscribed, painted or affixed to or on any part of the Property without Our written permission. 13. Failure to Vacate If You or a member of your Party fails to vacate the Property by the Check-out time on the last day of your reservation, You will be subject to the repayment of all costs incurred by Us, and other consequences. 14. Entry We have keys to all areas of the Property. In case of emergency, We may enter the Beach House and will notify occupant, as soon as reasonably possible, of the reason for such entry. 15. Guarantee All information contained in Our website is deemed reliable, but is not guaranteed. 16. Additional charges We reserve the right to deduct from your security deposit the cost of any damage, missing items or excessive cleaning as a result of Your tenancy in the Beach House. 17. Modifications No structural changes, reorganization or removal of furniture, wall hangings, floor coverings, or redecorating of any kind within the Beach House are permitted. 18. Barbecue and Fire Pit Grilling is permitted only on the concrete back patio. The Fire Pit shall remain on the concrete back patio. If you use the propane barbecue, refill the tank before you leave. 19. Occupancy Limits Occupancy is limited to eight (8) persons, including children of all ages. Day use prohibited Only those persons who are occupying the house may use the Beach House, Kayaks or Bicycles, except that You may have daytime visitors within the Occupancy Limits allowed for the Beach House. 21. Reservations Half down to hold the reservation is required for reservations made three weeks or greater in advance. The entire cost of reservation is required within seven days for reservations made less than three weeks prior to arrival. 22. Cancellations You may cancel your reservation at any time prior to fourteen (14) days before your arrival with a full refund. Cancellations between fourteen (14) and seven (7) days prior to your arrival qualify for a fifty percent refund. All other cancellations will not be refunded. 23. Locked areas Areas that are locked, such as Owner's personal storage spaces, for which tenants are not provided a key, are off-limits to tenants. Tenants will be held responsible for damaged or missing items if locked areas are entered. 24. Departure At the conclusion of your stay, please return the key to the lock-box, and follow the checklist outlined in the Cleaning Home notebook in the Beach House (or download the information sheet from our website: Waste Disposal If your stay includes Monday night, Please put garbage can out by the street Monday night for Tuesday morning pickup. Otherwise leave it on the east side of the house. II. Kayak(s) 1. Kayak use is at Your own risk. We are not responsible for personal injury or loss of property. 2. You acknowledge that any person allowed to use a Kayak has sufficient knowledge and skills to safely operate the Kayak at all times. 3. All persons must wear a Personal Flotation Device while using the Kayak. 4. No person under the age of 18 years shall be allowed to use a Kayak except under the supervision of an adult in Your Party. In no event shall any person under the age of 10 years be allowed to use a Kayak. 5. Alcoholic beverages and pets are not permitted in or around the Kayaks. 6. Intentional capsizing or swamping of a Kayak is prohibited. 7. No motors may be attached to Our Kayaks. Renter acknowledges agreement: (initials) Page 4 of 6

5 8. Do not stay on the water in the event of thunder or lightning. 9. You will be required to reimburse Us for all damaged or lost equipment. 10. In case of emergency, call 911. III. Bicycle(s) 1. You acknowledge that any person allowed to use a Bicycle has sufficient knowledge and skills to safely operate the Bicycle at all times. 2. You will require all members of your Party using Bicycles to wear an approved helmet. 3. No person under the age of 18 years shall be allowed to use a Bicycle except under the supervision of an adult in Your Party. 4. You will be required to reimburse Us for all damaged or lost equipment. 5. In case of emergency, call 911. IV. Indemnification In consideration of being allowed to use Our Kayak(s) or Bicycle(s), You acknowledge, appreciate and agree that: 1. The risk of injury from Kayak or Bicycle use is significant, including the potential for permanent paralysis and death, and while particular skill, equipment and personal discipline may reduce this risk, the risk of serious injury does exist, and, 2. You KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OR CARELESSNESS OF THE Releasees, and assume full responsibility for Your participation and all participants in Your Party, and, 3. You willingly agree to comply with the stated and customary terms and conditions for participation. If, however, you observe any unusual or significant hazard during Your participation or use of any of Our equipment, You will safely remove yourself from such participation or use, and, 4. You, for yourself and on behalf of your heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS THE Releasees WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property associated with Your presence or participation, WHETHER ARISING FROM THE NEGLIGENCE OF THE Releasees OR OTHERWISE, to the fullest extent permitted by law. 6 V. Violations Violators of this agreement will be required to vacate the premises immediately without a refund. VI. Entire Agreement This is the entire Agreement between You and Us. There are no verbal amendments. I HAVE READ THIS RENTAL AGREEMENT AND RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT. I FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING THIS AGREEMENT AND I SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT OR COERCION.
