1 Page 1 of 10 GENERAL INFORMATION Expressions at Rancho Niguel Association The Association is governed by a Board of Directors which normally meets monthly in order to make decisions pertaining to common matters. The responsibility of the Board of Directors is to maintain, protect and enhance the Common Area Property. Experts have been employed to guide and assist the Board of Directors in fulfilling this responsibility and doing an audit each year. Calendar of Business The Annual Meeting of members is held in August. Notice will be mailed to all homeowners of record prior to the meeting. In order to establish a quorum so that business can be conducted, it is imperative that owners either attend in person or submit their proxy. An audit is prepared each year and mailed to homeowners of record upon completion. The master insurance policy for the project is renewed each year by the Board of Directors. A synopsis of the insurance provided is contained in this booklet. This information is to be used only as a guide since changes in coverage may be made from time to time. Additional information can be obtained by contacting the insurance agent directly or the management company in writing at Avenida de la Carlota, Suite 700, Laguna Hills, CA Architectural Control All proposed changes or additions to the exterior of units must be submitted in writing. An Architectrctural Application is available at ot by contact Accell Property Management, Inc. Insurance Information The Board of Directors has arranged for property and liability insurance for the Association s real and personal property.
2 Page 2 of 10 The Association s master insurance policy, however, DOES NOT cover the owner s personal property, such as wall coverings, floor coverings, furniture, clothing, et cetera, nor personal liability. Additionally, any upgrades from the original builder materials are NOT covered. The insurance to cover these items would be the responsibility of the individual unit owner. There are two (2) basic types of condominium exposures: RESIDENT OWNER/NON-RESIDENT OWNER: The policy most often used by the unit owner to cover these exposures is known as HO6. The HO6 policy, also known as condominium unit owner s policy, insures the unit owner s personal property, personal liability, condominium loss assessment and other coverages pertinent to condominium unit ownership. RENTER: The renter should purchase a HO4 policy to cover personal property and personal liability. The unit owner s policy DOES NOT cover the property or liability of the renter. Note: The name and number for the Association s insurance carrier is Keith Hatch, LaBarre/Oksnee Insurance, Common Area Problems To report problems related to the common area: 1. If it is an emergency, call (24 hours a day). 2. 3 Page 3 of 10 GENERAL RULES AND REGULATIONS Introduction The, as contained herein, are issued by the Board of Directors as authorized by the governing documents of the EXPRESSIONS AT RANCHO NIGUEL Association. The are intended as a guide to the conduct and activities of all members, lessees, residents and their guests. Each owner or resident living within the project and using the facilities is entitled to maximum pleasure without annoyance or interference from others. EXPRESSIONS AT RANCHO NIGUEL Association falls under the jurisdiction of the City of Laguna Niguel and all ordinances and codes apply. Each unit shall be used for single family or residential purposes only. Conducting a business of any kind on the premises is forbidden. Enforcement 1. All homeowners, residents and guests are required to abide by all established rules. Anyone refusing to abide by these rules may face corrective action by the Board of Directors. 2. The property management company, acting for the Association, has been instructed by the Board of Directors to require the compliance of persons on EXPRESSIONS AT RANCHO NIGUEL properties with the provisions of the, By Laws and CC&Rs. If there is a violation thereof, the property management company has been instructed to do any of the following: A. Obtain names and addresses of violators and report to the Board of Directors. B. Call upon a law enforcement agency for assistance. C. In the case of children, make every reasonable effort to contact their parents or host immediately, prior to taking the action called for in (B) above. 3. Violations of the : A. It is the right and duty of each resident to report violations, in writing, to the property management company.

Notice of actual violations will be brought to the attention of the owner and/or resident, in writing, by the property management company, carrying out the policies established by the Board of Directors. FAILURE TO CORRECT THE VIOLATIONS BY THE RESIDENT MAY RESULT IN LEGAL ACTION, THE COST OF WHICH WILL BE THE OWNER S RESPONSIBILITY. Community Relations 1. Members are responsible for payment of cost of repairs for all damage to EXPRESSIONS AT RANCHO NIGUEL property caused by themselves, members of their families, their guests, tenants or pets. 2. Common are equipment, i.e., time clocks and watering systems, are to be adjusted and set by authorized personnel only and not by residents. 3. Destruction of Property: As applied to living units specifically, the owners shall reconstruct it as soon as is reasonably practical, in accordance with the original plans and specifications or approved modifications thereof. As to the common area, each owner is liable to the Association and shall reimburse it for any expenditures made to repair damage to replace item(s) damaged by the owner or any occupant of the owner s unit. Trash Regulations 1. Trash service is paid and coordinated through the property management company. Members are responsible for picking up their own trash spilled on common areas and disposing of it in the proper containers or receptacles. 2. Large discarded items such as old furniture, mattresses, et cetera should be disposed of properly at a junk yard or disposal area off the property. 3. No trash or debris is to be left in any area that is visible to others, such as walkways, decks, patios, common areas, et cetera. 4. Do not use electrical meter closet to store trash cans. 5. Do not place trash out until Wednesday afternoon or Thursday morning. Cans must be brought in by Thursday evening. If the trash receptacles remain out more than twentyfour (24) hours, Solag Disposal will remove them from the premises.
5 Page 5 of 10 Noise Control 1. Noise can be a problem anytime and particularly during the summer months when windows are open. Please be considerate of those living close to you and keep noise volume as low as possible. Nothing shall be done that interferes with the quiet enjoyment of other occupants. 2. It is the responsibility of parents to see that their children do not unnecessarily disturb other residents. Children must have proper supervision in the pool area. Parents are responsible for any damage caused or incurred by their children and/or guests. No child under fourteen (14) years old may use the pool without a parent or responsible adult. 3. Radios, televisions, musical instruments, party activities and other noise sources (including barking dogs, car horns and extended warming-up of car engines), must be restricted at all times to a level that does not disturb other residents. 4. Unless authorized by the Association, no person shall use power tools, maintain a hobby shop or do auto repairs on the premises. 5. Roller skating, roller blading, skateboarding and big wheels are not permitted on the project at any time, with the exception of tot lots. Pool and Spa Facilities 1. Guests must be accompanied by a resident at all times when using the pool and spa facilities. 2. Showers are required before entering the pool or spa. 3. General rules of good conduct should be observed at all times. This includes no running, pushing or boisterous behavior. Radio volume and voices should be kept to a minimum level. This is especially important during late evening and early morning hours. 4. Pool hours are as follows: SUNDAY - THURSDAY 8:00 a.m. - 10:00 p.m. FRIDAY - SATURDAY 8:00 a.m. - 12:00 midnight
6 Page 6 of The Association does not provide any type of lifeguard or supervisory service. Anyone using the recreation facilities shall do so at their own risk, responsibility and liability. 6. Usual and customary swimming attire is required. Cut-offs or blue jeans do not meet this requirement. 7. Hair pins, hair clips or other similar objects should not be worn in the pool or spa. 8. Entry to the pool area should be through the gate only. Climbing over the fence or gate is prohibited. The gate must be closed and locked at all times. 9. Keys must not be duplicated or loaned to friends. There is a $75.00 replacement fee for keys. 10. Only unbreakable containers are permitted in the pool and spa areas, and these must be removed or disposed of in the containers provided. Injuries are not the responsibility of the Association. Please be thoughtful and considerate of your neighbors. Anyone seen with glass will be asked to remove the glass and/or leave the area. 11. It is the responsibility of each resident to ensure that children under the age of fourteen (14) are under the direct supervision at all times of a designated, responsible adult (eighteen (18) years of age or older) while in the pool area. 12. Children under the age of sixteen (16) years old may not use the spa (State Law). 13. No inflatable toys, rafts or sports equipment are permitted, except for legitimate lifesaving devices (this does not include floating rings or tires). 14. Throwing non-floating items, such as rocks, marbles, coins and the like, into the pool is prohibited. 15. Pool users are responsible for disposing of trash in the containers provided. 16. Animals are not allowed in the pool or spa area. 17. Persons with open cuts and wounds are not permitted in the pool or spa. 18. Bicycles, roller skates, roller blades and skateboards are not permitted in the pool or spa area. 19. Pool furniture is to be used on the decks around the pool and spa. Please do not remove furniture from the pool area.
7 Page 7 of No bottles, glass containers, food or barbecues allowed in the pool or spa area. 21. Absolutely no foreign substances, such as bubble bath, soap, beer, et cetera, may be added to the pool or spa. Persons observed doing so will be assessed the cost of draining, cleaning, refilling and any incurred costs due to pool or spa damage. 22. Posted regulations for pool and spa must be obeyed. 23. Owners transfer all their rights to the use of the pool facilities when their units are rented, leased or occupied by a non-owner. 24. Please do not water the plants with the pool water. Animals 1. No pet may interfere with the rights of other owners to the quiet and peaceful enjoyment of their property. 2. No animals, livestock or poultry of any kind shall be raised, bred or kept within any unit, except that one (1) domestic dog or one (1) domestic cat, fish in aquarium and birds inside cages may be kept as household pets, provided that they are not kept, bred or maintained for commercial purposes. 3. Dogs must be on a leash at all times and under personal control when outside individual living quarters or patio enclosures. 4. Dogs must not be left unattended on patios or decks. 5. Any litter deposited by pets on lawns, sidewalks, paths or other common areas must be removed immediately by the owner of the animal involved. 6. Please do not allow animals to urinate on plants, shrubs and artifical grass. 7. Residents are to be responsible and liable for any personal injury or property damage caused by their pets. If the pet owner is a tenant, the owner of the unit is liable. 8. Violations must be submitted, in writing, to the property management company. 9. Legal action will be taken against owners of pets that make excessive noise. 10. Pets are not allowed within the confines of the pool or spa areas.

Residents who are disturbed by an animal are urged to (1) contact theirneighbor and, if unsucessful, (2) write to the Association or (3) contact the Animal Control Department at For after hourse emergencies, please contact the Orange County Sheriff s Department at No structure for the housing or confinement of any animal or bird shall be maintained so as to be visible from neighboring properties. 14. Service dogs may be considered exempt from the above rules, i.e., seeing eye dogs. Architectural Control 1. The Association shall provide all maintenance of the common area. In addition, the Association shall provide exterior maintenance of each unit, except for glass surfaces, interior surfaces of doors including the metal frames, tracks and exterior screens of glass doors and windows, and decks and patio areas which shall be maintained by each owner in a manner acceptable to the Board of Directors. 2. Each owner has the right, at his sole cost and expense, to maintain, repair, paint, paper, panel, plaster, tile and finish the interior surfaces of the ceilings, floors, window frames, door frames, trim and perimeter walls of the Living Unit. Owners may substitute new finished surfaces in place of those existing on the ceiling, floors, walls and doors of their unit, however, no hard surface flooring (including, but not limited to, vinyl, wood, linoleum or tile) may be installed on the floor of any unit located above the first floor in a building, except within the kitchen or bathrooms. 3. No changes or additions to the exterior of the units (including planting of trees, shrubs, flowers and vegetables, exterior painting, or installation of antennas, patio covers, screens, sunshades, awnings, walls, fences, screen doors, et cetera) may be made unless accepted by the Board of Directors. Plans and specifications must be submitted, in writing, on forms obtainable from the property management company. 4. No outside television or radio antennas, masts, satellite dishes, transmitter tower or facility, poles or flag poles may be constructed, installed or maintained on the property for any purpose whatsoever. 5. No window air conditioning units or balcony enclosures are permitted, and no exterior clotheslines are to be installed. 6. Decks and patios are not to be used for such purposes as drying laundry, miscellaneous storage, et cetera. These areas are considered an aesthetic addition to the buildings and should be utilized in good taste so as to be generally attractive and inoffensive to other residents.
9 Page 9 of One (1) aesthetically acceptable sign, not to exceed twenty-two inches (22 ) by twentyfour inches (24 ) advertising a unit for sale or lease, may be displayed for public view from the inside of a window of that unit. 8. All equipment, garbage cans, wood piles or storage piles must be screened and concealed from view of neighboring units, streets, association property and common area, except on trash days. 9. All rubbish, trash or garbage must be regularly removed from each unit and shall not be allowed to accumulate thereon or on the adjacent Association property or common area. 10. No fences, hedges or walls may be erected or maintained upon the Association property. 11. No exterior clothesline shall be erected or maintained, and there shall be no outside drying or laundering of clothes on Association property or on the common area. 12. Only conventional patio furniture and potted plants are permitted on a balcony or patio; however, no items (including potted plants) may be placed upon or over any deck railing. Potted plants must have a non-porous plastic tray placed underneath the pot to prevent water spillage onto the deck. 13. Owners may not paint, decorate, remodel, alter or attach any items to the Exclusive Use Common Area or any other part of the common area without the prior written consent of the Board of Directors. 14. Windows shall be covered only by drapes, blinds, curtains and shades, and may not be painted or covered by aluminum foil, paper or similar materials.
10 Page 10 of 10 INFRACTION SCHEDULE IN THE EVENT THE RULES AND REGULATIONS ARE NOT FOLLOWED, THE FINE SCHEDULE LISTED BELOW WILL BE IMPLEMENTED: 1. First Notice Written warning 2. Second Notice Notice of Hearing and subject to a $25.00 fine 3. Third Notice Notice of Hearing and subject to a $50.00 fine 4. Fourth Notice Notice of Hearing and subject to a $ fine Rental Requirements 1. No short-term rentals are allowed (City Zoning Department and Association document restriction). 2. All owners must provide their tenant with a copy of the, and all tenants must comply with these regulations, the By Laws and the CC&Rs. Owners are held responsible for their tenants and guests, and are financially liable for damage to the common area and equipment, and for violations of the. 3. Owners are responsible for the proper repair and maintenance of their units. Also, all electrical appliances and plumbing fixtures within a unit must be maintained by the owner. 4. All owners must provide the Association with the lease agreement, together with the telephone number and street address of the residence of the owner, per the CC&Rs.
