2 2 Barren County Board of Education Furnishings Bid Barren County Schools District 202 West Washington Street Glasgow, KY ***Invitation to submit a bid proposal for Barren County newest building (CTE) and newly renovated building (ATC)*** Project: The Barren County Board of Education is accepting furnishings for the opening its newest facility, CTE Building, and its newest renovated building (ATC). 475 Trojan Trail, Glasgow, KY is the address of the CTE Building.

3 3 General Specifications: Award or Rejection of Bid Vendors shall prepare bid submissions in compliance with instructions contained in this document. All bids must be submitted on the bid response forms provided. In addition to the bid response form, the bidder shall supply detailed specifications of each item they bid on. The specifications must contain: warranty information, brand name, model name, dimensions, etc. Failure to list items in the bid response forms or supply additional specifications shall constitute a NO BID. The Barren County Board of Education reserves the right to reject any and all bids. Bid awards will be made in the best interest of the school district with regard to price, suitability to purposes, design, quality, past service, ability of the vendor to deliver goods within a timely manner and/or factors determined by the awarding committee. Bid awards may be made on a unit, group, category, or total bid basis. The bid may be awarded to a single vendor or multiple vendors. Bidders are required to provide individual pricing as well as any discounts for quantity purchases. Quantities of items quoted are made in a good faith as a best estimate to be purchased. Actual purchase may be for greater lesser quantities pending unforeseen circumstances. Bids shall remain open, valid and subject to rejection or acceptance for a period of no less than sixty days following the bid open.

4 4 Waiver The Barren County Board of Education reserves the right waive any bid irregularities held to be within the scope of bid law which may be in the interest of school district. Interpretations for Changes Changes in brand(s) specified for quality references purposes and/or specifications presented in the bid package shall be made by written notice and will be mailed to vendors who have received/requested a bid packages. All bids will be bound to these changes. Should the bidder find discrepancies, errors, or omissions in this bid package, that bidder should notify Anthony Frazier, of the Barren County Board of Education no later than five (5) days prior to the bid opening. Withdrawal of Bid Bids may be withdrawn by the vendor at any time prior to the bid opening, but may not be withdrawn for a period of sixty (60) days thereafter, unless otherwise required by law. Technical Specifications The bid response form and other relevant data to this request for bids are contained in this packet. It is the bidder s responsibility to obtain and verify all information required to submit a bid prior to the bid opening. To claim a lack of knowledge or understanding of stated specifications is unacceptable.

5 5 No objections with regard to the application, meaning or interpretation of these specifications will be considered after the bid opening. Verification The successful vendor(s) shall furnish, deliver, and verify the proper functioning of the units in the quantities ordered as designated by a Barren County Schools District Purchase Order. All materials, goods and/or services furnished under this contract shall be in accordance with the specifications furnished by the bidder and accepted by the bid award committee. Materials or supplies which are not considered to be in accordance or conformity with stated specifications shall be rejected and the vendor shall be held liable for liquidated damages. Purchasing All purchases made to the successful bidder(s) will be made using a Barren County Board of Education Purchase Order. No deliveries will be accepted without prior request through an approved purchase order. Payment for Goods and Services The bidder shall not assign or transfer any or all of its rights, burdens, duties, or obligations without the prior written consent of the Barren County Board of Education

6 6 Payment for purchases will be made pending approval by the Barren County Board of Education,. Items must be verified against a punch list and invoices must be received by the 10 days prior to the next board meeting in order to be processed for approval at the board meeting. No payment will be made of materials which are suspected, or found to be with defect until they are replaced. Quality EQUIVALENT OR ALTERNATE BID ITEMS Bids are requested in accordance with the brands and specifications as stated in this bid package. However, manufacturer names, brand and model names are used for the purpose of establishing a standard of quality and/or basis of design for an item. Vendors are welcome to submit alternate items that meet or exceed stated standards using the following procedure. Vendors must: (1.) provide a sample of each alternate bid item; (2.) include appropriate concise literature with pictures and specifications for each alternate bid item; (3.) provide pricing in the alternate bid item column on the bid response form for easy reference by the bid award committee; and

7 7 (4.) specify on the bid form where any exception exists for a specified item. These specifications must be met prior to, or at, the bid opening. Failure to meet the above listed specifications will constitute a NO BID for the items under consideration. PROTECTION FROM CLAIM AGAINST OR EQUAL Determination of the meets or exceeds specification standards rests solely with the bid award committee. Submission of a bid proposal will signify vendor agreement to this specification. No claims may be made following the decision of the bid award committee. ITEM DESCRIPTION / ITEM WARRANTY / LONGEVITY OF ITEM A description of each set of items bid will be provided. Warranties for each set of furniture included in the bid will be provided along with statements of general longevity for each set of furniture. Warrantees will be considered when determining bid selection. BID SECURITY Bid Bond A bid bond from a satisfactory surety company must be submitted, with the bid, in a sum equal to five per cent (5%) of the bid amount. A personal company check may be an acceptable substitute.

8 8 SERVICE BIDDER REFERENCES All bids must be accompanied by a brief history of the bidding firm and three (3) customer references (including company name, representative, title, address, and telephone number) as an indication of the vendor s ability to meet the specifications of the potential bid award. SERVICE RESPONSE Bidder shall guarantee on-site personnel within a 24 hour period in the event of a service related issue which requires verification for repair/replacement or unacceptable merchandise delivery. Successful bidder must specify names and contact information for an internal project management team which shall oversee the order entry, delivery, installation, and replacement of damaged items. Bidder must also provide a Project Management Binder for verification of services rendered (punch list). This binder shall be provided to the bid award committee and shall contain detailed information of delivery dates, floor plans, and furniture/equipment to be installed per room. DELIVERY AND INSTALLATION Delivered products shall be shipped for inside delivery and coordinated with the Barren County Schools over a 15 day work window. Installation shall include assembling all items needing assembly and subsequently placing all assembled furniture in locations as specified by the Project Management Binder along with the removal of all cartons and wrapping materials off-site. All furniture and equipment must be delivered and installed by no later than July 15,

9 Failure to meet this absolute deadline will result in a financial penalty of 1% of the total purchase order price for each 1-7 day increments of delay. This deadline assumes vendor receipt of purchase orders by May 15, FORCE MAJEURE The parties to any ensuring purchase order contract shall be excused from performance thereunder during the time and to the extent that they are prevented from obtaining goods or performing services due to acts of nature, fire, strike, loss or shortage of transportation, facilities, lockout, power failure or reduction, commandeering of materials, products, or plants by the U.S. government. Satisfactory evidence thereof must be provided to the Barren County Board of Education to establish the state of non-performance or negligence of the awarded vendor. Scheduled completion date stipulated in the purchase order contract shall be adjusted by a period of time equal to such time lost due to stated conditions. Pricing Submission All bids must be submitted in a sealed envelope and delivered to the Barren County Public Schools Central Offices, 202 West Main Street, Glasgow, KY ( ), on or before 12:00 P.M. CST, April 26, Bids must be clearly marked 2018-Furnishings Bid on the outside of the envelope. Bidders are to input prices on the

10 10 It is the responsibility of the bidder to ensure that completed bids and all subsequent addenda are received prior to the bid opening date and time. Any bid submissions received after the stated date and time will be considered null and void and will not be opened. Bid submissions must be made on forms provided through this bid packet. All notations must be typed, written in ink, or computer generated on the bid response form. Any written corrections or changes must be initialed. Failure to do so will render the item null and void. No corrections or modifications may be made following the bid opening. Bid submissions may be delivered or sent through postal or courier service. All signatures must be original and no facsimile copies will be accepted. The Barren County Board of Education cannot assume responsibility for any delay as a result of failure of the mailer to deliver proposals on time. Sectional and total pricing must be submitted both in numeric and written form. Example $ one hundred dollars Failure to do so will render the section or total null and void. Tax The Barren County Board of Education is exempt from all federal excise taxes and state sales taxes. Prices must not include taxes. Additional Charges No charges for containers, packing, drayage, or any other purpose will be allowed over and above the prices bid.

11 11 DELIVERY FREIGHT CHARGES All shipping and handling charges shall be included in the cost of each item. There shall be no additional charges for shipping and handling. FREIGHT DAMAGE T he bidder is responsible for the filing of all freight damage claims. The school district shall report within ten (10) days after delivery of awarded products by freight carrier, any damaged goods to the vendor. All freight damage is the sole responsibility of the vendor and the Barren County Schools District is exempt from any replacement costs and/or paperwork due to the said freight damage. HOLD HARMLESS AND INDEMNITY INSURANCE

12 12 The Barren County Schools District reserve the right to require evidence of Public Liability Insurance in an amount not less than $500,000 for one (1) person injured in one (1) accident, and not less that $1,000,000 for more than one (1) person in any one (1) accident, naming the school district, its officers or agents as additional insured. A certificate of insurance will be required in such cases. Additionally, the bidder most hold workers compensation insurance for its employees. As part of this bid, please provide a copy of the certificates (both workers compensation and general liability) with the submitted bid. SAFETY All equipment and supplies furnished shall meet all applicable regulations of the prevailing codes and safety regulations of the Division of Industrial Safety of the existing state health and safety codes. DEFENSE The vendor shall assume the defense of and shall pay, indemnify and save harmless the Barren County Board of Education, its agents and employees, for all suits, actions, claims, damages, losses, and costs of every kind and description to which they or their agents may be subjected by reason of injury, including death, to persons, or damage to property resulting from or growing out of any act of commission or omission by the vendor, its agents or employees, or its subcontractors.

13 13 Said defense will be applicable in connection with any activity, including the removal, relocation, construction, installation or maintenance work, service or operation being undertaken or performed by or for the vendor whether on or off the site or any portion thereof, whether such suits, actions, claims, or damages or its agents and employee, or by other persons, corporations, or legal entities to whom the district or its agents and employees, may be liable. ASSIGNMENT The bidder shall not assign or transfer by operation of law or otherwise, any or all of the rights, burdens, duties or obligations without the prior written consent of the surety on the contract bond and the Barren County Board of Education. NON-DISCRIMINATION During the performance of this contract, the seller agrees as follows: (1) The seller shall not discriminate against any employee, applicant or subcontractor because of age, color creed, handicap condition, marital or parental status, national origin, race, sex, veteran status, or political opinion or affiliation. The seller agrees to post in conspicuous places notice setting forth the provisions of this equal opportunity clause. (2) The seller shall in all solicitations and/or advertisements for employees placed by or on behalf of the seller; state that all qualified applicants shall receive consideration for employment without regard to age, color, creed, handicap condition, marital or parental status, national origin, race, sex, veteran status, or political opinion or affiliation.

14 14 (3) The seller shall cause any subcontractor engaged to perform any services required by this contract to include this equal opportunity clause in all solicitations, advertisements, and employment practices it shall perform. CONFLICT OF INTEREST It shall be a breach of ethical standards for any employee with procurement authority to participate directly in any proceeding or application; request for ruling or other determination; claim or controversy; or other particular matter pertaining to any contact or subcontract, and any solicitation of proposal therefore, in which to their knowledge; a. S/he, or any member of their immediate family, has a financial interest herein: or b. A business or organization which they or any member of their immediate family has a financial interest as an officer, director, trustee, partner or employee, is a party; o c. Any other person, business, or organization with whom s/he or any member of their immediate family is negotiating or had an arrangement concerning prospective employment is a party direct or indirect participation shall include, but not limited to, involvement through decision approval, disapproval, recommendation, preparation of any part of a purchase request, influencing the

15 15 content of any specification or purchase standard, rendering of advice, investigation, auditing, or in any other advisory capacity. d. It is a violation of Kentucky law for any board member or employee, or a member of their immediate family, to have a pecuniary interest either directly or indirectly in an amount exceeding $25.00 per year in any purchase of goods or services by the Board of Education or any school thereof.
