5 Semua petender hendaklah mematuhi semua syarat-syarat yang telah ditetapkan di dalam dokumen pelawaan ini, melainkan setakat mana syarat-syarat tersebut ditolak atau diubah oleh pihak Yayasan Pahang. 1.0 KENYATAAN TENDER 1.1 Syarat-Syarat Penyertaan Tender ini adalah tender terbuka dan dipelawa seperti berikut: Semua firma perunding tempatan yang berdaftar dengan Kementerian Kewangan di bawah kod bidang: a) Bidang kejuruteraan (Kejuteraan awam), (kejuteraan struktur), (Kejuruteraan elektrik) b) Bidang perancangan (Ukur Bahan) Tempoh pendaftaran firma dengan Kementerian Kewangan hendaklah masih berkuat kuasa sekurang-kurangnya empat (4) bulan daripada tarikh tutup tender. 1.2 Taklimat Tender (tidak berkaitan) 1.3 Tempoh Tender Tempoh tender adalah selama 8 hari kalendar bermula pada 28 Ogos 2012 (Selasa) dan tarikh tutup tender adalah pada 5September 2012 (Rabu) Petender hendaklah mengemukakan Cadangan Tender sebelum atau jam tengah hari pada tarikh tutup tender. Cadangan Tender yang dikemukakan selepas jam tengah hari Tidak Akan Dipertimbangkan. YAYASAN PAHANG 4/38

6 1.4 Penjualan Dokumen Pelawaan (tidak berkaitan) 1.5 Pertanyaan Petender adalah dibenarkan untuk mengemukakan pertanyaan atau memohon penjelasan mengenai arahan/syarat tender tertakluk pertanyaan tersebut hendaklah dibuat secara bertulis kepada Urusetia Tender selewat-lewatnya tiga (3) hari sebelum tarikh tutup tender melalui medium-medium berikut sahaja: i. E-mel ii. 7 1.5.2 Semua pertanyaan akan dijawab melalui emel/faks/alamat surat yang diberikan petender dan akan turut disalin untuk paparan di dalam laman web Kementerian ini dan laman web eperunding sebagai makluman kepada petender lain yang menyertai tender ini Tiada pertanyaan boleh dibuat selepas tarikh tutup tender. Bukti penghantaran pertanyaan tidak boleh dianggap sebagai bukti penerimaan oleh pihak Kementerian. 2.0 ARAHAN/SYARAT KEPADA PETENDER 2.1 Cadangan Tender Cadangan Tender yang dikemukakan oleh petender hendaklah menggunakan Bahasa Malaysia atau Bahasa Inggeris Cadangan Tender hendaklah dibuat di atas borang yang disediakan di mana yang berkenaan. Borang-borang lain tidak diterima kecuali sebagai tambahan kepada borang asal. Borang tambahan tersebut hendaklah mengandungi tajuk dan bilangan medan yang sama Cadangan Tender yang lengkap dan sempurna diisi hendaklah dimasukkan ke dalam Peti Tender yang disediakan sebelum tarikh dan waktu tutup tender. Petender dikehendaki untuk menghantar keseluruhan lampiran tender dan lain-lain dokumen sokongan yang dijilidkan dengan kemas secara manual. Semua medan melibatkan cop dan tandatangan wajib dicop dan ditandatangani oleh wakil syarikat yang sah Cadangan Tender yang mengandungi Cadangan Teknikal dan Cadangan Kos hendaklah dimasukkan ke dalam sampul surat yang berasingan yang berlakri. Peti Tender ditempatkan di alamat berikut: Kompleks Yayasan Pahang, Tanjung Lumpur, Kuantan, Pahang Darul Makmur Yayasan Pahang tidak akan bertanggungjawab terhadap sebarang kehilangan, kelewatan dan sebagainya ke atas dokumen yang dihantar melalui Pos atau Kurier Semua dokumen dan peralatan (CD/Pendrive) yang dikemukakan oleh petender adalah menjadi hak milik Yayasan Pahang dan tidak akan dikembalikan. 2.2 Format Cadangan Tender Cadangan Tender hendaklah mengandungi Cadangan Teknikal dan Cadangan Kos, di mana kedua-dua cadangan tersebut hendaklah dikemukakan dengan lengkap dan mematuhi format YAYASAN PAHANG 7/38

9 yang telah ditetapkan. Format Cadangan Tender yang telah ditetapkan adalah seperti berikut: i. Cadangan Teknikal hendaklah mengandungi semua item di Lampiran A; dan ii. Cadangan Kos hendaklah mengandungi semua item di Lampiran B Kegagalan petender mematuhi dan mengemukakan dokumen mengikut format yang ditetapkan akan mengakibatkan cadangan petender Tidak Akan Dipertimbangkan. 2.3 Senarai Semak Mandatori Cadangan Tender Petender hendaklah mematuhi dan mengemukakan semua item-item di dalam Cadangan Teknikal seperti Lampiran A dan Cadangan Kos seperti Lampiran B. Petender yang gagal mengemukakan mana-mana item di Lampiran A dan Lampiran B akan mengakibatkan cadangan petender Tidak Akan Dipertimbangkan. 2.4 Imbuhan Balik Perunding Item-item imbuhan balik (bagi petender berjaya) yang dibenarkan bagi kajian ini adalah terhad seperti berikut: Bil. 10 2.4.2 Petender hendaklah memastikan tuntutan imbuhan balik di atas tidak melebihi kadar-kadar maksimum yang telah ditetapkan di dalam Manual Perolehan Perkhidmatan Perunding Edisi Yayasan Pahang berhak membuat pelarasan semula sekiranya didapati item dan kadar imbuhan balik yang ditawarkan oleh petender melebihi kadar yang dibenarkan. 2.5 Cadangan Kos Semua Cadangan Kos yang dikemukakan oleh petender hendaklah berdasarkan Skala Piawai Profesional yang diiktiraf oleh kerajaan iaitu: Kejuruteraan scale of fees (revised 1998)PU(B)548 Ukur bahan Jadual Skala fi ukur bahan (Pindaan 2004) Cadangan kos mengikut skala piawai profesional adalah berbentuk cost basis dan berdasarkan kepada peratusan daripada kos kerja (cost of work) dan secara sliding scale bergantung kepada nilai kos kerja bidang berkenaan bagi sesuatu projek Petender perlu mengemukakan skala yuran piawai lengkap yang telah dikeluarkan oleh badan profesional masing-masing Petender juga perlu mengemukakantawaran skala yuran bagi projek ini. Anggaran keseluruhan kos projek ini adalah kurang RM 30 juta. 2.6 Percukaian Selaras dengan Akta Cukai Perkhidmatan 1975, Cukai Perkhidmatan sebanyak 6% daripada yuran perunding akan disediakan oleh Yayasan Pahang ini di mana pembayaran kepada Jabatan Kastam Diraja Malaysia akan dibuat oleh petender yang berjaya bagi pihak Yayasan Pahang. 11 2.6.2 Selaras dengan Akta Cukai Pendapatan 1967, Cukai Pegangan adalah dikenakan ke atas perkhidmatan yang diberikan oleh individu/firma asing. Sekiranya di dalam Cadangan Teknikal Petender ada dinamakan kakitangan asing, petender hendaklah mengenakan Cukai Pegangan ke atas kakitangan tersebut dengan membuat pemotongan terus ke atas yuran perunding kakitangan asing berkenaan dan mengemukakan bayaran tersebut kepada Lembaga Hasil Dalam Negeri. 2.7 Cadangan Pilihan (Alternative Offer) Petender hanya dibenarkan untuk mengemukakan satu Cadangan Tender sahaja. Yayasan Pahang berhak membatalkan penyertaan manamana petender yang mengemukakan Cadangan Pilihan di dalam tender ini. 2.8 Pengiklanan Semula Oleh Petender Tiada maklumat mengenai tender ini boleh disiarkan di dalam sebarang akhbar, majalah atau medium pengiklanan yang terkini melainkan jika pengiklanan itu telah pun dihantar dan diluluskan oleh Yayasan Pahang terlebih dahulu. 2.9 Tindakan Tatatertib Selaras dengan usaha Yayasan Pahang untuk mewujudkan komuniti perniagaan yang berdisiplin, bertanggungjawab, berintegriti serta mengamalkan tadbir urus korporat yang baik semasa berurusan dengan Yayasan Pahang, Kerajaan telah menggubal satu pekeliling bagi mencapai maksud di atas Surat Pekeliling Perbendaharaan (SPP) Bilangan 6 Tahun 2010 Tindakan Tatatertib Ke Atas Syarikat Dan Firma Perunding Yang Berdaftar Dengan Kementerian Kewangan; telah menyatakan dengan jelas akan kesalahan-kesalahan dan juga tindakan tatatertib yang boleh diambil ke atas firma perunding. 12 2.9.3 Tindakan-tindakan tatatertib ini termasuklah: i. Surat Amaran; ii. Batal Kod Bidang; iii. Gantung Pendaftaran; iv. Batal Pendaftaran; dan v. Pemilik Modal/Ahli Lembaga Pengarah Firma Perunding Disenarai Hitam Tanpa prejudis kepada tindakan-tindakan lain, tindakan tatatertib boleh diambil sekiranya didapati firma perunding yang berdaftar dengan Kementerian Kewangan terlibat dengan mana-mana kesalahan yang dinyatakan di dalam pekeliling tersebut Peringatan Mengenai Kesalahan Rasuah Sebarang perbuatan atau percubaan rasuah untuk menawar atau memberi, meminta atau menerima apa-apa suapan secara rasuah kepada dan daripada mana-mana orang berkaitan perolehan ini merupakan suatu kesalahan jenayah di bawah Akta Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) 2009 (Akta 694) Sekiranya mana-mana pihak ada menawar atau memberi apaapa suapan kepada mana-mana anggota Pentadbiran Awam, maka pihak yang ditawar atau diberi suapan dikehendaki membuat aduan dengan segera ke Pejabat SPRM atau Balai Polis yang berhampiran. Kegagalan berbuat demikian adalah merupakan suatu kesalahan di bawah Akta Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) 2009 (Akta 694) Tanpa prejudis kepada tindakan-tindakan lain, tindakan tatatertib terhadap anggota Perkhidmatan Awam dan menyenaraihitamkan perunding boleh diambil sekiranya pihakpihak terlibat dengan kesalahan rasuah di bawah Akta YAYASAN PAHANG 11/38

13 Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) 2009 (Akta 694) Mana-mana perunding yang membuat tuntutan bayaran berkaitan perolehan ini walaupun tiada kerja dibuat atau tiada perkhidmatan diberi dan mana-mana anggota Perkhidmatan Awam yang mengesahkan tuntutan berkenaan adalah melakukan kesalahan di bawah Akta Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) 2009 (Akta 694) Satu klausa mengenai rasuah akan dimasukkan di dalam perjanjian perkhidmatan perunding yang akan ditandatangani antara petender yang berjaya dengan pihak Yayasan Pahang. Klausa tersebut adalah seperti berikut:- Termination on Corruption, Unlawful or Illegal Activities (a) Without prejudice to any other rights of the Government, if the [Company/Firm], its personnel, servants or employees is convicted by a court of law for corruption or unlawful or illegal activities in relation to this [Agreement/Contract] or any other agreement that the [Company/Firm] may have with the Government, the Government shall be entitled to terminate this [Agreement/Contract] at any time, by giving immediate written notice to that effect to the [Company/Firm]. (b) Upon such termination, the Government shall be entitled to all losses, costs, damages and expenses (including any incidental costs and expenses) incurred by the Government arising from such termination. (c) For the avoidance of doubt, the Parties hereby agree that the [Company/Firm] shall not be entitled to any form of losses including loss of profit, damages, claims or what so ever upon termination of this [Agreement/Contract]. 14 3.0 TEMPOH SAH LAKU CADANGAN TENDER Tempoh sah laku Cadangan Tender hendaklah sekurang-kurangnya 180 hari kalendar daripada tarikh tutup tender. 4.0 TERMA RUJUKAN Petender bertanggungjawab berdasarkan terma rujukan seperti di Lampiran F. 5.0 KRITERIA PENILAIAN Penilaian ke atas Cadangan Tender akan dilaksanakan berdasarkan kriteriakriteria seperti di Lampiran E. 6.0 HAK YAYASAN PAHANG UNTUK MENERIMA/MENOLAK CADANGAN TENDER Yayasan Pahang tidak terikat untuk menerima Cadangan Tender yang terendah atau mana-mana Cadangan Tender atau memberi apa-apa sebab di atas penolakan tersebut. Yayasan Pahang juga berhak menerima keseluruhan atau sebahagian daripada Cadangan Tender dan keputusan Yayasan Pahang adalah muktamad. YAYASAN PAHANG 13/38

15 7.0 SURAT SETUJU TERIMA 7.1 Petender yang berjaya juga akan dimaklumkan melalui Surat Setuju Terima (SST). Petender yang berjaya adalah terikat dengan tempoh dan skop perkhidmatan yang telah ditetapkan di dalam Surat Setuju Terima yang akan ditandatangani dan dipersetujui sehinggalah tarikh tamat obligasi yang terakhir. 7.2 Petender yang berjaya mestilah menyempurnakan perkhidmatan mengikut tempoh yang dipersetujui dan ditetapkan di dalam SST yang ditandatangani. 7.3 Penyerahan semula SST yang telah ditandatangani oleh petender adalah tidak melebihi empat belas (14) hari kalendar selepas penerimaan SST oleh petender. Kegagalan petender menyerah kembali SST yang telah ditandatangani dalam tempoh yang ditetapkan boleh mengakibatkan pembatalan SST oleh Yayasan Pahang. 8.0 DOKUMEN PERJANJIAN PERKHIDMATAN PERUNDING 8.1 SST adalah dianggap sebagai dokumen perundangan yang sah dan merupakan sebahagian daripada dokumen perjanjian antara Yayasan Pahang dan petender yang berjaya sehingga Dokumen Perjanjian rasmi dimeterai oleh kedua-dua pihak. 8.2 Semua syarat yang terkandung di dalam dokumen tender atau di manamana jadual yang terdahulu adalah merupakan sebahagian daripada kontrak yang akan ditandatangani di antara Yayasan Pahang dan petender yang berjaya. Petender yang berjaya dikehendaki menandatangani kontrak dengan pihak Yayasan Pahang dan membayar segala ganti rugi jika tidak memenuhi syarat-syarat kontrak. YAYASAN PAHANG 14/38

16 9.0 PENGENAAN GANTI RUGI TERTENTU & DITETAPKAN (LIQUIDATED & ASCERTAINED DAMAGES - LAD) KEPADA PERUNDING BAGI PROJEK/KAJIAN YAYASAN PAHANG 9.1 LAD boleh dikenakan ke atas petender yang berjaya sekiranya melibatkan kelewatan penyerahan deliverables mengikut tempoh/tarikh akhir yang telah dipersetujui bersama. 9.2 Pengenaan LAD kepada petender yang berjaya adalah dibuat melalui pemotongan bayaran kemajuan perkhidmatan perunding berdasarkan formula yang telah ditetapkan oleh Yayasan Pahang seperti berikut: LAD = Base Lending Rate (BLR) x Consultancy Fees (subject to a minimum of RM100 per day) 9.3 Kadar BLR adalah pada kadar tarikh SST ditandatangani oleh kedua-dua pihak. Kadar tersebut adalah berdasarkan kadar yang dikeluarkan oleh CIMB BANK Berhad. Nota: Agensi boleh menamakan mana-mana institusi kewangan tertakluk institusi tersebut dilesenkan oleh Bank Negara Malaysia. Sila rujuk di Menu Related Links dan pilih List of Licensed Banking Institutions in Malaysia SUMBER-SUMBER RUJUKAN ATAU BAHAN BACAAN 10.1 Petender hendaklah merujuk kepada Surat Pekeliling Perbendaharaan (SPP) Bil 2 tahun 2011 Peraturan Perolehan Perkhidmatan Perunding Bagi Kajian Projek Atau Kajian, dan Manual Perolehan Perkhidmatan Perunding (MPPP) Edisi 2011 yang dikeluarkan oleh Kementerian Kewangan SPP Bil.2/2011 dan MPPP Edisi 2011 ini boleh dimuat turun dari laman web eperunding, YAYASAN PAHANG 15/38

17 SENARAI SEMAK DOKUMEN MANDATORI CADANGAN TEKNIKAL LAMPIRAN A Dokumen Cadangan Teknikal perlu dihantar dalam sampul surat berasingan yang berlakri dan ditandakan Cadangan Teknikal di sebelah kiri sampul surat berkenaan. Senarai semak berikut perlulah dimasukkan sebagai muka surat pertama di dalam sampul yang berkenaan. Petender hendaklah memastikan Cadangan Tender adalah lengkap merangkumi semua item-item yang dinyatakan di bawah. Kegagalan petender melaksanakan demikian akan mengakibatkan Cadangan Tender Tidak Akan Dipertimbangkan. Bil. Dokumen Yang Perlu Disertakan 1. Yayasan Pahang berhasrat untuk menggunakan khidmat Perunding Fizikal (Kod Bidang ) bagi menjalankan kajian terperinci, kerja-kerja ukur, rekabentuk kejuruteraan terperinci, panggilan tender dan penyeliaan pembinaan bagi CADANGAN PEMBANGUNAN LOT PERUMAHAN SESEBUAH DI ATAS TANAH SELUAS 250 EKAR DI KM 19 JALAN KUANTAN-PEKAN MUKIM PENOR, DAERAH KUANTAN, PAHANG DARUL MAKMUR (FASA 1 74 EKAR) 1.2 Cadangan ini secara keseluruhannya mempunyai 3 fasa iaitu bagi Fasa 1 seluas 74 ekar, Fasa 2 seluas 72 ekar dan ketiga seluas 63 ekar. 1.3 Bagi fasa 1 yang berkeluasan 74 ekar dijangkakan terdapat 180 buah lot dapat disediakan. 2.0 OBJEKTIF PERLANTIKAN 2.1 Perunding akan berperanan sebagai Wakil Pegawai Penguasa(P.P) projek dan menjalankan tugas sepertimana disenaraikan dalam Surat Perwakilan Kuasa serta lain-lain perkara yang diperuntukan dalam Kontrak yang dimeterai di antara kontraktor dan Yayasan Pahang. 2.2 Tugas utama perunding meliputi peringkat Kajian Kejuruteraan, Rekabentuk Terperinci, Tawaran Tender dan Penyeliaan Projek. 2.3 Menyelia dan memantau prestasi pelaksanaan projek berdasarkan keperluan Kontrak serta memberikan laporan dan saranan kepada Yayasan Pahang bagi mencapai objektif projek. 2/16 YAYASAN PAHANG l TERMA RUJUKAN

Walau bagaimanapun, senarai ini tidak boleh dianggap muktamad dan pihak Yayasan pahang berhak menambah atau mengurangkan tugas-tugas perunding. 3.1 OBLIGATIONS OF THE LEAD CONSULTANT/PMC Responsibilities of the LEAD CONSULTANT (a) The LEAD CONSULTANT shall carry out the Services with due diligence and efficiency and in conformity with sound engineering, administrative and financial practices. (b) The LEAD CONSULTANT shall act at all times so as to protect the interest of the Client and shall take all reasonable steps to keep all expenses to a minimum consistent with sound economic and engineering practices. Specifications and Designs (a) The LEAD CONSULTANT shall prepare all specifications and designs using the metric system and to embody the latest design criteria. (b) The LEAD CONSULTANT shall ensure that the specifications and designs and all documents relating to procurement of goods and services for the project are prepared on an impartial basis so as to promote competitive bidding. (c) The LEAD CONSULTANT shall specify standards, which are accepted and well known among industrial nations. Records (a) The LEAD CONSULTANT shall keep accurate, systematic and up-to-date records and accounts in respect of the provisions of the said Services in such form and detail as is customary in the profession or as may be required by the Client from time to time as shall be sufficient to establish accurately that the costs and expenditure have been duly incurred. 3/16 YAYASAN PAHANG l TERMA RUJUKAN

Information The LEAD CONSULTANT shall furnish the Client such information relating to the Services and the Project as the Client may from time to time reasonably request. Accident or failure to or in connection with the Works (a) If any accident, failure or other event occurs due to any cause whatsoever to, in or in connection with the Works or any part thereof either during the execution of the Works or during the Defect Liability Period / Period of Maintenance the LEAD CONSULTANT shall immediately report the accident, failure or event to the Client and unless otherwise directed by the Client generally or in any particular respect, conduct a full investigation into the said accident, failure or event in order to determine the cause or reason for the accident, failure or event and submit a report thereon to the Client together with his proposals for remedial works in respect thereof. (b) The LEAD CONSULTANT shall not, however, cause the remedial works to be carried out in respect thereof until directed to do so by the Client in writing. And upon so directed the LEAD CONSULTANT shall proceed with the remedial works within fourteen (14) days from the date of such direction. (c) Where the Client, its employees or any person or body appointed or authorized by it carries out any investigation in relation to such accident, failure or event, the LEAD CONSULTANT shall render all such necessary assistance and facilities as may be required by the Client, its employees or such person or body, including the giving or access to all specification, designs, records and other available information relating to the Works. 44 CADANGAN PEMBANGUNAN LOT PERUMAHAN SESEBUAH DI ATAS TANAH SELUAS 250 EKAR DI KM 19 JALAN KUANTAN-PEKAN MUKIM PENOR, DAERAH KUANTAN, PAHANG DARUL MAKMUR (FASA 1 74 EKAR) (a) Except with the prior written approval of the Client the LEAD CONSULTANT shall not assign or transfer the benefits or obligations or any part thereof nor engage any independent consultant or sub-contractor to perform any part of the services. (b) The approval of the Client to the assignment of any part of this services or to engagement by the LEAD CONSULTANT of independent consultants or subcontractors to perform any part of the Services shall not relieve the LEAD CONSULTANT of any of his obligations. Confidentiality Except with the prior written consent of the Client, the LEAD CONSULTANT and the personnel shall not at any time communicate to any person, or body or entity any confidential information disclosed to him for the purpose of the provision of the Services or discovered by him in the course of the provision and performance of the said Services, nor shall the LEAD CONSULTANT and the personnel make public any information as to the recommendations, assessments and the opinions formulated in the course or as a result of the provision and performance of the said Services, nor shall the LEAD CONSULTANT and the personnel make or course to be made any press statement or otherwise relating to the Project nor publish or cause to be published any material whatsoever relating to the Services without the prior approval of he Client. Prohibition on Association The LEAD CONSULTANT shall limit his role under the Project to the provision of the Services and disqualify himself from the provision of goods or services in any capacity for the Project including bidding for any part of the Project except as the Client may otherwise agree. Prohibition on Conflicting Activities No personnel of the LEAD CONSULTANT assigned to this Project shall engage, directly or indirectly, either in his name or through the LEAD CONSULTANT in any other business or professional activities in Malaysia other than the performance of his duties or assignment Independent Contractor (a) The LEAD CONSULTANT shall instruct and coordinate the Consultants throughout the Project; 5/16 YAYASAN PAHANG l TERMA RUJUKAN

45 CADANGAN PEMBANGUNAN LOT PERUMAHAN SESEBUAH DI ATAS TANAH SELUAS 250 EKAR DI KM 19 JALAN KUANTAN-PEKAN MUKIM PENOR, DAERAH KUANTAN, PAHANG DARUL MAKMUR (FASA 1 74 EKAR) (b) Nothing contained herein shall be construed as establishing or creating between the Client and the LEAD CONSULTANT the relationship of master and servant or principal and agent, it being understood that the position of the LEAD CONSULTANT and of anyone else performing the Services is that of an independent contractor. Indemnification The LEAD CONSULTANT shall indemnify, protect and defend at his own expense the Client and its agents from and against all actions, claims and liabilities arising out of acts done by the LEAD CONSULTANT or the personnel in the performance of his Services including the use or violation of any copyright works or literary property or patented invention, article or appliances. Law and regulations of Malaysia (a) The LEAD CONSULTANT shall respect and abide by all applicable laws and regulations in Malaysia (b) The LEAD CONSULTANT shall comply with relevant policies, procedures and regulations of the Client at all times in the execution of his duties. Propriety Right of the Client in Equipment (a) Equipment supplied by the Client for the Project shall remain at all times the property of the Client and shall be returned by the LEAD CONSULTANT in accordance with the procedures to be determined by the Client (b) Equipment purchased by the Client or by the LEAD CONSULTANT for the Client for the purposes of the Project shall be the property of the Client. (c) The equipment and tools brought into Malaysia by the LEAD CONSULTANT and the personnel and used either for the Project or their personal use shall remain the property of the LEAD CONSULTANT and the personnel. (d) Equipment furniture and all other items purchased for the Services and paid for in whole or in part with fund allocated by the Client shall be the property of the Client, 6/16 YAYASAN PAHANG l TERMA RUJUKAN

An inventory of all such items shall be maintained by the LEAD CONSULTANT. Proprietary Rights of the Client in Reports and Records All reports and relevant data such as maps, diagrams, plans, drawings, statistics and supporting records or materials complied or prepared in the course of the Services shall be confidential and shall be the absolute property of the Client throughout their preparation and al all times thereafter. The LEAD CONSULTANT shall deliver all these materials to the Client upon completion of this Agreement. The LEAD CONSULTANT may retain a copy of such data for his own record but shall not use the same for the purpose unrelated to thus Agreement without the prior written approval of the Client. The Client shall be entitled to make use of all reports and such data for other projects without any charge or payments. Insurance (a) The LEAD CONSULTANT shall take out and maintain at his own expense adequate insurance against loss of or damage to equipment purchased in whole or in part with funds provided by the Client for the purpose of this Agreement. (b) The Client undertakes no responsibility in respect of any life, health, accident, travel and other insurances which may be necessary or desirable for the personnel of or sub-contractors and specialist associated with the LEAD CONSULTANT for the purpose of the Service nor for such members of the family of any such person. (c) The LEAD CONSULTANT shall indemnify the Client against any claims for damages to life and property that may arise during the performance of the Services and shall take out the necessary insurance cover in this connection at his own expense. (d) The LEAD CONSULTANT shall undertake responsibility in respect of life, health, accident and travel of his employees, personnel or sub-contractors or specialist associated with the LEAD CONSULTANT for the purpose of carrying out his Services and for the dependents of any such persons as may travel to or from Malaysia and shall take out at his own expense all such life, health, accident and travel insurance in respect of such persons as may be necessary and desirable. (e) In areas where the Social Security Organization Scheme (SOCSO) operates, the LEAD CONSULTANT shall contribute to such scheme in respect o his employees, the 7/16 YAYASAN PAHANG l TERMA RUJUKAN

Reports All reports, recommendations and general correspondence fro the LEAD CONSULTANT to the Client and all tender documents prepared by the LEAD CONSULTANT under this Agreement shall be in Malay or English language. Notice of Delay In the event the LEAD CONSULTANT encounters delay in obtaining the required services or facilities for the conduct of the Services, the LEAD CONSULTANT shall promptly notify the Client of such delay and may request an appropriate extension of time for the completion of the Services. 3.2 SCOPE OF WORKS FOR CIVIL AND STRUCTURAL CONSULTING ENGINEER The design, drawing and specification of all civil and structural elements in the project and obtaining all necessary information on all existing services including drainage in and adjacent to the site and providing coordinated underground services drawings showing both existing and proposed Design drawing and specification for the support and integrity of non-structural elements, eg. Specialist masonry ties, masonry support angles, wind posts etc Specification of pipe class and bedding of underground drainage Agreeing with the Project Manager and Architect, a production program for design, drawings and specifications Providing to the Architect all information of a structural nature necessary for building regulations or other statutory approvals Providing of builder s work/service holes on structural drawings where services pass through any part of the structure Providing the Architect and Project Manager with a certificate of readiness to tender on completion of design Periodic Supervision and inspection of all civil and structural work on site Examining and approving the Contractor s proposals and working drawings. 48 CADANGAN PEMBANGUNAN LOT PERUMAHAN SESEBUAH DI ATAS TANAH SELUAS 250 EKAR DI KM 19 JALAN KUANTAN-PEKAN MUKIM PENOR, DAERAH KUANTAN, PAHANG DARUL MAKMUR (FASA 1 74 EKAR) a) Preliminary Stage (i) Investigating data and information relevant to the works and considering any reports relating to the works; (ii) Advising the Client on making any further topographical survey of the proposed site of the works which may be necessary to supplement available topographical information; (iii) Advising the Client on the need to carry out any geo-technical investigation which may be necessary to supplement the available geo-technical information, arranging for such investigation, certifying the amount of nay payment to be made by the Client to the person, firm or company carrying out such investigation under the Consulting Engineer s direction, and advising the Client on the results of such investigation; (iv) Consulting any architect appointed by the Client in connection with architectural treatment of the work; and (v) Preparing such reports and documents as are necessary to enable the Client to consider the Consulting Engineer s proposals, including alternative proposals, for the construction of the works in the light of the investigations carried out by him at this stage, and to enable the Client to apply for approval in principle from the appropriate authorities for the execution of the works in accordance with the proposals. b) Design Stage (i) (ii) (iii) Preparing design, including reinforced concrete and structural steel works design, inclusive of bar bending schedule and tender drawings in connection with the works; Pre-qualification of contractors, and Preparing such conditions of contract, specification, schedules and bill of quantities as may be necessary to enable the Cleint to obtain tenders or otherwise award a contract for carrying out the works 9/16 YAYASAN PAHANG l TERMA RUJUKAN

49 CADANGAN PEMBANGUNAN LOT PERUMAHAN SESEBUAH DI ATAS TANAH SELUAS 250 EKAR DI KM 19 JALAN KUANTAN-PEKAN MUKIM PENOR, DAERAH KUANTAN, PAHANG DARUL MAKMUR (FASA 1 74 EKAR) c) Tender Stage (i) Advising the Client as to the suitability for carrying out the works of the person, firm or company tendering and as to the relative merits or tenders, including relative merits of alternative tenders, prices and estimates received for carrying out the works. d) Construction Stage (i) (ii) (iii) (iv) (v) (vi) (vii) (viii) Advising on and preparing normal contract documents, including Letter of Acceptance for carrying out the works or part thereof; Advising the Client on the appointment of site staff; Preparing any further designs, bar bending schedule and drawings relating to the works; Examining and approving the Contractor s proposals and his working drawings relating to the works; Making such visits to site as the Consulting Engineer considers necessary to satisfy himself as to the performance of any site staff appointed and to satisfy himself that the works executed generally according to contract and otherwise in accordance with good engineering practice; Giving all necessary instructions relating to the works to the Contractor; Issuing all certificates as required in the contract; Performing any duties which the Consulting Engineer may be required to carry out under any document which he has prepared for the execution of the works C CONSULTING MECHANICAL AND ELECTRICAL ENGINEER 1. The design, drawing and specification of all mechanical and electrical elements in the project. 2. Investigating data and information relevant to the marks and considering reports relating to the works. 3. Agreeing with the Project Manager and Architect a production program for design, drawings, specifications and tendering. 10/16 YAYASAN PAHANG l TERMA RUJUKAN

Providing to the Architect all information of a mechanical and electrical nature necessary for building permit, fire regulations and other statutory approvals. 5. Preparing such conditions of contract, specifications, schedule of rates etc. As may be necessary to enable the client to obtain tenders or otherwise award contract for carrying out the works. 6. Providing to the Structural Engineer areas where holes are required to be formed for services to pass through for inclusion into the structural design. 7. Providing the Project manager and Architect with a certificate of readiness to tender on completion of design. 8. Supervision and inspection of all mechanical and electrical works on site. (Note: All instructions are to be given through the Architect) 9. Examining and approving the contractor s proposals and working drawings. 10. Where diversions are necessary, arranging diversions to suit the program. 11. Delivering to the Client on completion of the works such records, manufacturer s manuals and warranties as are necessary to enable the Client to operate and maintain the works. a) Preliminary Stage i) Consulting any local or other approving authorities on matters of principle in connection with the design of the works ii) Providing sufficient preliminary information and approximate estimates (based on unit volume, unit surface area or similar bases of estimation) regarding the works to enable the Client or the architect to prepare architectural sketch plans and budget estimates for the project iii) Investigating data and information relevant to the works and considering any report relating to them 11/16 YAYASAN PAHANG l TERMA RUJUKAN

51 CADANGAN PEMBANGUNAN LOT PERUMAHAN SESEBUAH DI ATAS TANAH SELUAS 250 EKAR DI KM 19 JALAN KUANTAN-PEKAN MUKIM PENOR, DAERAH KUANTAN, PAHANG DARUL MAKMUR (FASA 1 74 EKAR) iv) Consulting the architect and others appointed by the Client in connection with the architectural treatment of the works, and v) Preparing such report and documents as are necessary to enable the Client to consider the Consulting Engineer s proposals, including the alternative proposals for the installation of the works in the light of the investigations carried out by him at this stage and to enable the Client to apply for approval in principle from the appropriate authorities for the execution of the works in accordance with the proposals. b) Design Stage i) Preparing designs and tender drawings and providing information as to plant rooms, main service ducts and other similar elements to be incorporated in the building structure and information as to the approximate weights of items of heavy plant and equipment which are to be incorporated in the works, and ii) Advising on condition of contract, preparing specifications and schedules as may be necessary to enable the Client to obtain tenders or otherwise award a contract for carrying out the works, and preparing such calculations and details relating to the works as may be required for submission to any appropriate authorities c) Tender Stage i) Advising the Client as to the suitability for carrying out the works of the persons, firms or companies tendering and as to the relative merits of tenders, but excluding relative merit of alternative tenders, prices and estimates received for carrying out the works d) Construction Stage i) Advising on the preparation of formal contract documents relating to accepted tenders for carrying out the works or any part of them ii) Advising the Client on the appointment of site staff iii) Providing the contractor with such further information as are necessary, in the opinion of the Consulting Engineer, to enable the installation drawings to be prepared iv) Examining the contractor s proposals 12/16 YAYASAN PAHANG l TERMA RUJUKAN

52 CADANGAN PEMBANGUNAN LOT PERUMAHAN SESEBUAH DI ATAS TANAH SELUAS 250 EKAR DI KM 19 JALAN KUANTAN-PEKAN MUKIM PENOR, DAERAH KUANTAN, PAHANG DARUL MAKMUR (FASA 1 74 EKAR) v) Making such visits to the site as the Consulting Engineer considers necessary to satisfy himself as to the performance of any site staff appointed and to satisfy himself that the works are executed generally according to his designs and specifications or otherwise in accordance with good engineering practice vi) Checking shop details and installation drawings vii) Giving all necessary instructions to the contractor viii) Advising the Client or the architect as to the need to vary any part of the works ix) Approving the contractor s commissioning procedures and performance tests and inspecting the works on completion x) Advising on interim valuation, issuing certificates for payment to the contractor where appropriate and advising on settlement of the contractor s final account xi) Performing any services which the consulting engineer may be required to carry out under any document which he has prepared in relation to the works xii) Delivering to the Client on completion of the works, copies of records drawings, contractor s operating instructions, manufacturer s manuals and where appropriate, the certificate of work tests and arranging for the delivery of spares and tools, if necessary xiii) Deciding any disputes or differences arising between the Client and the contractor in connection with the works and submitted to the consulting engineer for his decision, provided that this professional service shall not extend to advising the Client following the taking of any step in or towards any arbitration or litigation in connection with the works xiv) Inspecting and testing during manufacture and installation such materials and equipment supplied for incorporation in the works where the inspection and test are within the technical competency of the Consulting Engineer, and arranging and witnessing acceptance test xv) Advising the Client on the need for special inspection or test other that that referred to in (d)(xiv) above 13/16 YAYASAN PAHANG l TERMA RUJUKAN

Tempoh perkhidmatan bermula daripada pelantikan rasmi sehingga tamat tempoh kecacatan atau penutupan akaun projek mengikut keperluan Yayasan Pahang. 5.0 KAEDAH PENETAPAN KOS PERKHIDMATAN PERUNDING 5.1 Kos perkhidmatan perunding adalah kos yang terdiri daripada yuran perkhidmatan perunding dan kos imbuhan balik. 5.2 Yuran perkhidmatan perunding bagi basic services diperolehi menggunakan Skala Yuran Piawai (SOF) yang ditetapkan oleh Lembaga-Lembaga Profesional dan dipersetujui Kementerian Kewangan.
