Whereas the first party has agreed to award House Keeping and allied servlces ",~" v :;..., '. - to the second party for smooth and hygienic sanitation in the premises of the first party. 2. In consideration of the services provided by the second party as per the terms and conditions mentioned herein, the first party shall make payment to the second party as per details mentioned in Annexure-I appended to this agreement. 3. The second party shall provide employeesas mentioned in annexure no. 1 w.ej. 1st April The number of employees to be hired may be increased or decreasedas per the requirements of the First Party which will be communicated to the first party in writing by the secondparty. 4. Any dispute arising out of this agreement during the tenure of the agreement will be referred to an arbitrator appointed by the Chairman of the a.p. Suri Memorial EducationSociety and the decision of the arbitrator shall be binding on both the parties. 5. The second party shall deposit an interest free refundable security of Rs /- (rupees six lakh only) with the first party. The amount will be refundable on the expiry of this agreement. The first party will have the right to waive off the clause of depositing of refundable security by the second party. 6. Although this agreement is being made on this day, this agreement is valid for the period 1st April 2017 to 31st March This agreement is further ble for another year depending on the quality of services provided by the (MJG Suraksha sanstha (Pvt.) 3 first party and subject to mutual agreement on the terms and conditions of the to-be-renewed agreement. 7. The agreement is non-transferable in whole or in part thereof. 8. The second party shall keep the housekeeping material and any other material of their use in a safe and secure place. Any harmful material shall be kept under lock and key, for which provision will be made by the first party. The second party shall keep the premises clean and hygienic in all respects. 9. The second party shall ensure that staff deployed by it in the school are free from any contagious diseases/infection etc. 10.The second party shall get the Police Verification Report from concerned authorities in respect of each staff stationed in the premises of the first party. A certified copy of such a report with respect to each such employee shall be submitted to the School Principal prior to the said employees entering the school premises for work. 11. During the tenure of this agreement, any loss or damage caused to any school property or otherwise by any of the employees of the second party, the second party shall make good the loss. 12.The first party shall not be responsible for any untoward incident, accident leading to harm or injury on account of negligence or otherwise to any of the employees of the second party during their presence on duty in the school. 13. Non compliance of any terms and conditions mentioned in this agreement shall render the agreement null and void. The first party shall have the right to terminate this agreement prematurely by giving a one month written notice to the second party. 14.The staff stationed by the second party shall work under the directions of a Superviso 0 be employed by the Second Party. 4 . -~~-- --7":7_- _ ~ stationed in the premises of the first party shall work under the directions of the Principal of the School or any other person authorised by him to do so. 15.The cleaning material etc. will be provided to the second party by the first party. 16.The staff stationed by the second party to work in the school premises shall wear proper uniform at all times while on duty. The uniform so worn shall be neat and tidy. An authorization card cum Identity Card shall be issued to all its employees by the second party and no such employee shall present himself/herself for duty without an Identity Card. 17.The second party shall undertake all liabilities pertaining to the staff provided by it with regard to payment of wages/medical reimbursement facilities, bonus, EPF, ~-! ESI, family pension and any other statutory requlrement/s of the government. Payment will be made accordingly to the second party by the first party on production of bills by the end of every month. 18.The second party shall submit to the first party, certified copies of details/records/statements/challans/returns/certificates with respect to the following for each employee for whom payment is made by the first party: (i) (ii) (iii) (iv) (v) Provident Fund- ECR and Challan ESI- Challans with details Salary sheet with transfer details Attendance Sheet Any other that is relevant and demanded 19.The second party shall comply with all requisite provisions of Labour Laws, Income Tax Rules, Service Tax Provisions as applicable in Delhi and as amended/modified/notified by the Government of NCT of Delhi or any of its offices from time to time. Rates for wages etc. will be revised as and when notified by the Government of NCT of Delhi and payments shall be made by the first party to the second party in accordance with any such notification. 21. The staff employed by the second party to be working in the School shall be purely the staff employed by the second party. The school will have no role in the employment terms and status whatsoever. Any dispute arising out of any such claim by any of the employees mentioned herein shall lie exclusively on the second party. 22. The Principal of the school shall be the authorised signatory and administrator in all respects for carrying out the provisions of this agreement.
