One copy of all bid sheets and this form must be returned. All bids are subject to the conditions specified hereon and on the attached sheets. All bids are final. 3. All items purchased are in a as is condition and shall be removed by the purchaser from the Aqueduct property within 10 days after acceptance of bid. Failure to remove purchased equipment within the time period specified may result in storage charges being levied against the purchaser. 4. All bidders shall be required to use this sheet which forms a part of these specifications. Bids received on a separate sheet will be considered informal and may be rejected as such. 5. Bids must be delivered by mail to: Purchasing Dept., Florida Keys Aqueduct Authority, 1100 Kennedy Drive, Key West, FL Bidders may bid on any or all line items. Separate awards will be made for each line item. 7. All bids shall constitute an offer to purchase. A bidder may withdraw his or her bid at any time prior to the opening bid date without prejudice to him or herself. 9. Payment shall be made in full within 10 working days of notification of award. Vehicles can not be removed before payment is received. Failure to pay within 10 days may result in a rental fee for storage. Payment shall be by cash or check. All checks shall be made payable to the Florida Keys Aqueduct Authority. 10. All applicable taxes and cost of transfer of title and registration shall be the responsibility of the successful bidder. 11. CONFLICT OF INTEREST: The award hereunder is subject to Chapter 112, Florida Statutes, wherein it states, in part all bidders must disclose with their bid the name of any officer, director, or agent who is also an employee of the FKAA. All bidders must disclose the name of any employee who owns directly or indirectly an interest of 5% or more in the bidder s firm or any of its branches 12. LEGAL REQUIREMENT: Federal, State, country, and local laws, ordinances, rules, and regulations that in any manner affect the items covered herein apply. Lack of knowledge by the bidder will in no way be cause for relief from responsibility. 13. The Governing Board of Directors of the Florida Keys Aqueduct Authority reserve the right to reject any or all bids, in whole or in part, to waive any irregularities or informalities in any bid and to award to any party considered to be in the best interest of the Authority. 14. In case of a tie bid, the time of receipt of the bid proposal will be the deciding factor. 15. SPECIAL CONDITIONS: Any and all special conditions that may vary from these General Conditions shall have precedence. 8. AWARDS: As the interest of the FKAA may require, the right is reserved to reject any and all bids and to waive any irregularity in bids received. 1

All proposals must be sealed in envelopes and addressed as indicated. On the face of the envelope containing the bid shall be written: SEALED BID FKAA-IFB SALE OF SURPLUS VEHICLES & EQUIPMENT DUE DATE: August 3, 2018, 1:00 p.m. 4. All items are to be purchased in an as is condition. 5. Bidders may bid on any or all line items. Separate awards will be made for each line item. 6. All bids shall constitute an offer to purchase. 3 9. The FKAA in no way warrants (either expressed or implied) that the vehicle or trailer being sold is fit for their intended or any other use. The purchaser agrees to indemnify and hold the Authority harmless for all claims, suits and costs (to include legal fees) arising out of the use of the vehicle, equipment or trailer being sold by the purchaser or any other person, organization or entity.
