3 WAIVER/RELEASE FORM AMP Athletics DBA Stars Vipers California 7442 Vincent Circle Huntington Beach, CA Participant s Name Parent/Legal Guardian Name For good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, I,, as parent or legal guardian of, minor (hereinafter minor ) hereby Grant the permission necessary to allow Minor to participate in the class conducted by AMP Athletics. I acknowledge and agree, in my own behalf and on the behalf of the Minor, acknowledge that the Minor is assuming the risk of such illness or injury by participating in the classes. In the event of such illness or injury, I authorize AMP Athletics to obtain necessary medical treatment for the Minor. I further acknowledge and understand that I will be responsible for any and all medical and related costs that may be incurred on behalf of the Minor for illness of injury that the Minor may sustain during the classes and while traveling to and from the class site. I, in my own behalf and on behalf of the Minor, further agree to release and hold harmless Releases for any and all liability for negligence or any other claim, judgment, loss, liability, cost and expenses (including, without limitations, attorney s fees and costs) arising out of or connected with AMP Athletics Classes, including traveling to and from the classes. I further expressly agree to indemnify and hold harmless Releases and Releases heirs, successors, assigns, executors and administrators against loss from any further claims, demands or actions that may subsequently be brought by Minor or by any other person or persons on account of damages of any character resulting to the Minor in any way from the forgoing activities. I further agree to reimburse and to make good to Releases any loss, damages or costs Releases may have to pay as a result of any such action, claim or demand. By signing this document, I acknowledge that if anyone is hurt or property is damaged during the Minor s participation in the facilities activities, that the Parent holds full responsibility for the Minors actions in the event that the Minor may be found by a court of law to maintain a lawsuit against AMP Athletics it s owners and instructors on the basis of the Minor s claim from which I have released the Minor herein. I, in my own behalf and on behalf of the Minor, hereby warrant that I have read this Release and Waiver in its entirety and fully understand its contents. I, in my own behalf and on the behalf of the Minor, am aware that this Release and Waiver releases from liability and contains an acknowledgment of my voluntary and knowing assumption of the risk of injury or illness. I, in my own behalf and behalf of the Minor have signed the document voluntarily and of my own free will. I grant AMP Athletics its subsidiaries, affiliates, licensees, successors, assignees, management and employees the right to use my child s name, voice, musical, renditions, and my likeness, image and picture of my child for any lawful purpose whatsoever, regardless of whether or not I am ever employed by or remain employed by AMP Athletics. I waive my right to inspect and/or approve the finished product or the advertising copy. I also release, discharge, and agree to save and hold AMP Athletics and it subsidiaries, affiliates, licensees, successors, assignees and management and employees harmless from any liability by reason of blurring, distortions, alterations, optical illusions or use in composite form, whether intentional or otherwise, that may occur or be produced in the taking of the pictures or recording or in the processing or completion of the finished product. All work performed, or products produced by me or my child are the property of AMP Athletics and its affiliates. 4 COMMUNICATION: A weekly update will be sent every Monday. We also have team communication files, bulletin boards in the parent viewing, Facebook pages and team moms. FEES AND PAYMENTS: Monthly tuition fees are due on the 1 st of every month and team assessments are due on the 15 th of every month, If not paid by the 7 th, a $25 late fee will be applied to the account. An invoice will be sent on or around the 25 th of each month. All fees will be deducted from the credit card provided on the 1 st and the 15 th. Your credit card information will be held on file and secured. If you wish to use an alternate form of payment (cash or check) please do so before the due date. NO REFUNDS: Under no circumstances or for any reason will a refund be issued for any fees and/or fundraisers. (Injury, illness, team changes, quitting, absences, etc.) If your athlete quits or leaves the team and your fees were pre-paid for the season or a part of the season, that amount (less the $500 cancellation fee if applicable) will be held in your athletes account for future classes, teams, etc. A refund WILL NOT be given in the form of a check, cash, credit on a credit card or any other form. CURRENT BALANCES: All athletes must be cleared at a zero balance before they are able to participate in private lessons or classes. AMP Athletics reserves the right to pull any athlete from an event if there is an outstanding balance. QUTTING THE TEAM: There is a cancellation fee of $500 for any athlete that quits, is removed or does not follow the guidelines of our program anytime between June 1, 2018 to the end of the 2019 competition season (April 30, 2019 or May 10,2019 for summit). FINES: Fines may be assessed for athletes missing practice the week of a competition or 2 weeks prior to a National Event. $50 Missed work out fine and possible replacement from the competition and/or team. Parent Policies PROMOTIONAL USE: AMP Athletics reserves the right to use any member s picture and first name for promotional, advertising and website purposes. No further personal information will be posted. CONFRONTATIONS: Confrontations of any kind are not to be discussed in the presence of any athletes, parents or spectators. Please schedule a meeting with the owners. SIDELINE COACHING: All coaching decisions are made by the staff. Parents are not allowed to Coach Decisions are made to benefit the entire team as well as each individual athlete. PRACTICES: There is a viewing area designated for all parents, spectators and friends. Please do not come into the training area as it is a safety hazard for you and the athletes. We need to get the most out of each athlete at practice and need their full attention. If a parent, spectator, friend etc. is speaking negatively about a team, athlete, coach, or other parent they will be asked to leave the viewing area. Should this continue, the parent will be asked not to attend practices. If the behavior continues, they athlete will be asked to leave the program. FUNDRASING: There may be opportunities to participate in fundraisers that require efforts outside of cheer. All profits results from fundraisers will be directly deposited into your account. SUPPORT: Stay positive. Your athletes feed off of you. Continue to support them and the program. Sitting with other parents and cheering on other teams is encouraged.

After seeking medical attention, please provide AMP Athletics with a copy of the athletes injury/status report. COMPETITONS AND TRAVEL: During the competition season, there will be travel for some/all teams. Some teams will travel to events outside of the state. All transportation/travel is the responsibility of each athlete/parent. UNIFORMS AND CLOTHING: Please keep all uniforms, practice wear, warm up, shoes etc. in good, clean condition. The cost of replacement will be the responsibility of the athlete/parent. Please wear ASSIGNED practice clothing to practice. NO jewelry. AMP Athletics assumes NO responsibility for lost jewelry or any other valuables. TEAM PLACEMENT: All athletes are places on teams at the sole discretion of the coaches/owners. Age, ability and experience are all factors when being placed on teams. Please understand that athletes may be moved, replaced or repositioned at any time on any team at the discretion of the coaches. Any and all changes are made to benefit the team as a whole. DISCIPLINE: If any of the above rules are not followed, the following actions will take place: 1 st occurrence- A meeting with the athlete 2 nd occurrence- A meeting with the athlete AND parent/guardian. 3 rd occurrence- The athlete may be removed from the team and/or program. STAY POSITIVE: We want a positive environment for each athlete walking into the gym. A positive environment creates positive outcomes!

6 AMP ATHLETICS DBA STARS VIPERS CALIFORNIA TEAM CONTRACT Please acknowledge/initial each item and return with your payment on acceptance day (first day of practice) 1.) COMMITMENT The competitive cheer season is a commitment from September 2018-March 2019 (or May 2019 for Summit) 2.) PAYMENTS All Payments are due on the specified due dates. Each month you will be ed an invoice on or around the 25 th of each month. Please speak with the front office if there are any questions with your invoice. In the event a new card must be used, please contact the office to update your records. 3.) CURRENT BALANCES Your account must be current in order for your athlete to participate in practices, tumbling classes, open gyms, private lessons, competitions or other special events. 4.) NON-REFUNDABLE All fees are 100% NON REFUNDABLE for any reason. This may include but is not limited to quitting the team, removal from the team, changing teams, sickness, injury, or other unforeseen events. This includes all monies earned from fundraising and events. 5.) PAY IN FULL If you choose to pay your season s fees in full (no discount offered) and later choose to discontinue or are removed from the team/program anytime from September 2018-March 2019, your paid fees are NON-REFUNDABLE and your DROP/CANCELLATION FEE of $250 will be deducted (if applicable) and the remaining balance will be kept in your Account for future use. 6.) QUITTING I understand that if my child quits the AMP Athletics Competitive Program for any reason other than Family Relocation with a valid Real Estate document or a season ending injury with a valid physician s certificate at any time from October 1, 2018-March 30, 2019 I will be charged a $250 CANCELLATION FEE. This fee will be deducted from the card on file or will be paid by check within 7 days if the card does not authorize or is not available. After 7 days the account will be turned over to our Collection Department for further action. If your athlete quits or is removed from the team, all items (such as uniform, work out war, shoes, bows etc) will be forfeited. 7.) ABSENCES I understand that absences affect the individual as well as the team. Summer Vacation Request forms are available during the summer months only and will be approved as long as they do not fall on mandatory choreography or camp dates. After September 4th, all practices are mandatory. The only excused absences will be a graded school event with a teacher s note, EXTREME illness or a SERIOUS family emergency. An absence request form must completed 2 weeks prior to the missed practice. One (1) unexcused absence will result in a $25 fine. In the event that the athlete misses 2 weeks prior to any competition, AMP Athletics reserves the right to replace/remove the athlete from the routine and a $50 fine may be assessed. Two (2) unexcused absences will result in probation, and further unexcused absences will result in more serious action being taken. (Unexcused absences include homework, back to school night, headache, stomach ache, grandmas bday dinner etc) 8.) PRIVATE LESSONS All private lessons are required to pay the front office prior to the private lesson occurring. Please make checks payable directly to the coaches or you may choose to pay cash. No CC s or account credits will be accepted. All account balances must be current in order for an athlete to participate in private lessons. 9.) AHTLETE/GYM AND PARENT POLICIES I have read, understand and agree to the FAQs Page, GYM POLICIES, ATHLETE POLICIES, PARENT POLICIES, and the ENTIRE TRY OUT INFORMATION PACKET. I understand that if my athlete is enrolled in Academy classes, a 10-day notice is required if the athlete chooses to drop. 8.
