2 Information Old City Seaport Festival kicks off Friday, October 11 with a majestic parade of boats along Penn s Landing followed by two days of deck and river tours aboard Tall Ships and music, food and maritime fun for the whole family. Visitors can come dressed as their favorite pirate for the Pirate Battle Sail, Saturday October 12 where the tall ships stage a mock battle on the river. The Festival comes to a close on Sunday, October 13 with a beautiful sunset sail when the Tall Ships parade the river. Exhibitors are an important part of the Old City Seaport Festival. With your help, we are able to keep maritime heritage, skills and culture alive. Thank you for your support. Ticketing information: All visitors must purchase tickets to gain access to the Festival. Tickets include admission to the Seaport Museum, the Historic Ships, crafts, entertainment and deck tours of the Tall Ships. River Tours aboard the Tall Ships are an additional ticket. 3 Boats: Each participant will get a dock space, help launching vessel if needed, two invitations to Ship s Crew dinner on Sunday, October 13 onboard Olympia from 5:30 9:00 p.m., and discounted parking including trailer (see Parking Information below). T-shirts can be purchased for $10 each and up to two additional tickets to Crew Dinner can be purchased for $5 each. Each exhibitor will receive 1 additional weekend pass to Festival for crew. Eligibility: The Old City Seaport Festival is open to traditional and classic vessels whether steam, motor, sail or human powered. Space is limited on land and in the water. To give the chance for as many people as possible to participate, registrations will be limited to one boat per entrant. Those wishing to bring more than one boat should indicate on the entry form and, if space is available, those people will be contacted two weeks prior to the Festival and offered space. Event Brochure: For inclusion in our event brochure, images and description of vessel must be received by August 31, Please include one to three high res digital images. Send the images to gpickton@phillyseaport.org. Please type Image for OCSF in the subject line of the . Notification and Dock Selection: Your acceptance will be confirmed via or phone. You will be notified of your dock location no later than two weeks prior to the event. Independence Seaport Museum reserves the right to change dock locations up to, and during, the day of the Festival, as it deems appropriate. Space will be assigned on a first come basis, taking into consideration the number of years an Exhibitor has participated. ISM makes every effort to place vessels in requested areas or as close as possible. Applications will be accepted until all spaces are filled. In water boats should bring fenders and line as those resources are limited. Land display boats should bring trailer wheel chocks, cable locks that go through at least one wheel and around the trailer frame, and a boat cover (if available). Festival grounds will be fenced off and will have security overnight. Load In/Load Out: Load in begins at 6:00 a.m. on Saturday, October 12 and Sunday October 13. The load in entrance will be off Columbus Blvd. at the Market Street entrance of Penn s Landing. There will be a sign at this point and vehicles should proceed southbound towards Museum to the registration table where you will be checked in, your display space confirmed and notified the time until load in. All vehicles must be off the Festival grounds by 9:00 a.m. or they may be towed and fined. Setup must be completed by 9:30 a.m. Boat Exhibitors must remain at the Festival during the specified hours (Saturday from 10:00 a.m. to 6:00 p.m. and Sunday from 10:00 a.m. to 5:00 p.m.). No dismantling is allowed during Festival hours. Dismantling early will be noted, and may constitute being excluded from the following years Festival. Load out must be completed by 7:00 p.m. Saturday, October 12 and 7:30 p.m. Sunday, October 13. All Exhibitors are responsible for cleaning up in and around their space during and after the event. All trash is to be hauled out by Exhibitors to specified locations. 3

4 Parking: Parking is available for a fee at Delaware River Waterfront Corporation (DRWC) lots on Columbus Boulevard. More information will follow with parking specifics. Note: You must bring your receipt to the front desk to be reimbursed for your discount. Rain Plan: In case of rain or inclement weather, the Festival will be held inside of the Museum. A comprehensive layout of vendor placement will be inside of registration packets if the rain plan is set in motion. The Seaport Museum will place vendors where they deem appropriate. Old City Seaport Festival Standards and Rules Exhibitors may not use their space to interfere with or jeopardize the health or safety of Exhibitors or patrons. Exhibitor agrees not to store any gasoline, petroleum, explosives or any other dangerous items or noxious products on the Festival site. All walkways and driveways are fire and ambulance lanes and must remain clear of merchandise. Exhibitors are required to stay within their assigned spaces. If Exhibitor s conduct is unacceptable, within the Seaport Museum s sole and exclusive discretion, then the Exhibitor shall forfeit all monies paid and may be ejected from the remainder of the Festival. If any legal action is brought for the enforcement of any of the Standards and Rules contained herein, or to recover damages for breach of these Standards and Rules or any part thereof, the Seaport Museum, its officers, directors, employees, volunteers, agents, landlord, successors and assigns shall recover, in addition to the relief demanded, all costs and attorney s fees. Independence Seaport Museum, its officers, directors, employees, volunteers, agents, landlord, successors and assigns shall not be responsible for or liable to Exhibitor for any loss or damage that may result to Exhibitor or his or her property from water, fire, explosion, theft, or from any source or any cause whatsoever. Exhibitor shall and does hereby agree to indemnify, defend and hold the Seaport Museum its officers, directors, employees, volunteers, agents, landlord, successors and assigns ( Indemnified Parties ), harmless from and against any and all claims, losses, injuries, costs, taxes, expenses, liabilities, causes of action, and demands (including the cost of defending against the foregoing and including, without limitation, attorney s fees using counsel of the Indemnified Party s choice), arising from, resulting or occurring directly or indirectly, from Exhibitor or Exhibitor s guests, members of Exhibitor s family, or Exhibitor s employees, agents or contractors, or as a consequence of any product sold or representation made by Exhibitor or its agents at the Festival site. This indemnification is absolute, personal to the Exhibitor, and is not limited by the Exhibitor s insurance coverage. The Seaport Museum shall have complete and final authority over the Festival operations and reserves the right to immediately remove any Exhibitor from the Festival who violates any Standard or Rule. Refunds: There will be no refund of booth or dock fees. Booth/dock spaces may not be transferred or otherwise assigned. The Old City Seaport Festival will not be canceled due to bad weather. Therefore, no refunds will be made due to inclement weather. Any booth space not claimed by 7:30 a.m. on the day of the Festival may be reassigned to waiting Exhibitors. Refunds will not be given to no shows. On site evaluations will be conducted to ensure that Festival Standards and Rules are followed. Failure to comply could result in a negative evaluation and/or expulsion from the Old City Seaport Festival and loss of all fees paid. 4

I am entering it in the 2013 Old City Seaport Festival promoted by Independence Seaport Museum taking place October 11 th through October 13 th, Further, I certify that I currently have effective insurance to cover any damage to my boat, and to cover my liability for any damages to others, or their property, arising from any use of my boat during this Festival. Liability Release: I hold free and harmless the officers and volunteers of Independence Seaport Museum and/or DRWC, any sponsors, partners and/or advertisers from any and all actions, claims, liabilities, and/or assertions of liability which in any manner arise or be alleged to arise from any and all activities connected directly or proximately with the Festival listed above. It is agreed by the parties that the nature of the facilities, the presence and circulation of large numbers of people and the large number of removable articles in numerous booths and boats make it reasonable that: The Exhibitor shall assume the risk of injury, loss or damage; the Exhibitor signing this contract hereby assumes such risk of injury, loss, or damage; and the Exhibitor signing this contract hereby assumes such risk and releases the Seaport Museum, its officers, directors, employees, volunteers, agents, landlord, successors and assigns from any and all claims for loss, damage or injury. Reservation of Rights: Independence Seaport Museum reserves the right to refuse participation to any group, individual association, business, or any other entity of any nature or type that the Seaport Museum feels in its sole discretions would not further the goals of the Museum, would not be appropriate considering circumstances, or might reflect negatively upon the Seaport Museum, an individual or group. The undersigned applicant accepts and agrees to this reservation of rights. In the event of damage due to negligence on the part of the Exhibitor, or Exhibitor s guests, member of Exhibitor s family or Exhibitor s employees, agents or contractors, or as a consequence of any product sold or representation made by Exhibitor or its agents at the Festival site, the necessary charges to repair or replace items will be assessed to the above stated Exhibitor. If any of the provisions of this agreement are determined to be void or unenforceable, the remaining provisions hereof shall remain in full force. Exhibitor acknowledges and confirms that Exhibitor has read and approves the terms and conditions set forth in this agreement. The Seaport Museum shall be entitled to recover all of its costs, including but not limited to attorney fees, in any action brought as a result of any breach hereof by Exhibitor. Acceptance of this Application constitutes a contract. As an Exhibitor, I agree to the liability I misrepresent myself or my exhibit, I may be asked to leave and will forfeit my Application fee and name will be removed from acceptable applicants for future events. By signing this Application, I accept and agree to all of the terms and conditions stated in the attached Festival Application Standards and Rules, which are incorporated into the Application by a reference.
