Bids must be placed in SEPARATELY SEALED envelopes marked Hot Mix Asphalt Bid #1186 2PM or Milling Bid #1187 2:30PM or Line Painting Bid #1188 3PM in the lower left corner and sent to: HCG Purchasing Co-op, 99 Main Street, Northampton, MA, Bid specifications: ATTENTION: All bidders must be pre-qualified by MassDOT. Wage rates for all bids are subject to prevailing wage rates as per MGL C. 149, s F inclusive. The Board of Hampshire Councilors and the town of Hinsdale reserve the right to accept or reject any or all bids in total or in part as they may deem to be in the best public interest. 2 SPECIFICATIONS - BID #1188 HIGHWAY LINE PAINTING 1. Companies must submit a firm, fixed price for Highway Line Painting for the town of Hinsdale on the enclosed Bid Sheet for the period of August 1, 2018 to June 30, 2019 subject to favorable weather conditions, according to specifications. Awarded bidder will be notified by the Hampshire Council of Governments (HCG) no later than 30 days from the date of the bid opening. 2. The estimated needs for Hinsdale are listed on the Information Sheet. The estimates are for information purposes only; actual volumes may be more or less than indicated. 3. This bid is being conducted by HCG, on behalf of the town of Hinsdale. 4. Specifications for materials and services shall conform to Section 860 for the MassDOT Standard Specifications for Highways and Bridges (1988). 5. Materials shall meet the appropriate requirements specified in the following subsections of Division III Materials: General requirements for paints & protective coatings White thermoplastic traffic line Yellow thermoplastic traffic line Fast drying white traffic paint Fast drying yellow traffic paint Waterborne Fast drying white traffic paint Waterborne Fast drying yellow traffic paint M M M M M M M Markings shall be applied only in seasonable weather in accordance with good painting practices. The surface shall be dry and free of sand, grease, oil, and other foreign substances prior to application. The contractor shall prepare the surface to accept the application as part of the bid price, with no additional compensation. 7. All warning signs and traffic devices as required shall be in accordance with MassDOT specifications and the MUTCD manual. Awarded vendor MUST have proper warning signage on both sides of the work area. 8. The waterborne paint must be reflectorized for night visibility by adding reflective spheres before the paint dries or sets, by using drop-on or pressurized methods. The reflective spheres shall be evenly dispersed to wet a film thickness of 15+/- l mils ( square feet per gallon) at an equivalent rate of 6 pounds per gallon. There shall be no pickup in more than three minutes of drying time. The lines shall be applied with airless spray equipment so as to have the paint at a temperature of degrees Fahrenheit at the spray nozzle. The maximum drying time shall not be exceeded when the pavement temperature is less than 55 degrees Fahrenheit or greater than 120 degrees Fahrenheit, under all humidity conditions or dry pavement. The paint shall dry
3 in not more than 12 minutes at 77 degrees Fahrenheit when tested according to ASTM D711 and drawn down to a wet film thickness of 15 mils. 9. The chlorinated low VOC traffic paint, to be used for crosswalks and sidebars, parking lines, and symbols and legends, must be a fast-drying alkyd, modified with chlorinated rubber, as well as a VOC compliant traffic paint for use on bituminous and portland cement concrete pavements. 10. All logistics, such as hours of work, etc., shall be arranged between the contractor and each municipality's highway superintendent or his designate, and shall be at the highway superintendent's discretion. 11. The town of Hinsdale will be responsible for the payment of its invoices through due process of the town's warrant. 12. The contractor must be pre-qualified through MassDOT. 13. It is the policy of HCG to contract with organizations who agree not to engage in any discriminatory employment practices or in any discrimination in the provision of services based on race, color, religion, national origin, ancestry, age, sex, sexual preference, or disability. HCG does not discriminate on the basis of disability with respect to the admission to, access to, or operation of its programs, services, or activities. Individuals who need auxiliary aids for effective communication are invited to make their needs known. 14 Wages to be paid employees shall be in accordance with the minimum wage rates as established by the Department of Labor and Industries. The Weekly Payroll Records Report, Statement of Compliance Form, and the Prevailing Wage Rates schedules can be found at: Awarded contractor must submit the following information to the awarding authority (HCG PURCHASING CO-OP, 99 MAIN ST., NORTHAMPTON, MA 01060), on a project-by-project basis, for every week the contractor is on site: 1) A Certified Weekly Payroll Report 2) Statement of Compliance 16. As an optional addition to this bid, a price is sought for the painting of crosswalks, stop bars, parking lines, and symbols and legends. 17. Each section of the bid - waterborne, thermo plastic markings, etc., in addition to the crosswalks, stop bars and parking lines sections - may be awarded to different contractors.
4 18. Crosswalk lines and stop bars will be understood to mean white or yellow nonreflective fast drying paint, OR, chlorinated low VOC compliant traffic paint as specified. Prices submitted will be for a price per linear foot. 19. Parking lines will be understood to mean white or yellow non-reflective fast drying paint, OR, chlorinated low VOC compliant traffic paint as specified. Prices submitted will be priced per linear foot. 20. The above mentioned non-reflective fast drying paint and applications must be in accordance with MassDOT Standard Specifications for the same. 21. Each bidder must submit with the bid a minimum security bond of 5% of the bid price. 22. A Payment Bond in the amount of 50% of the contract price will be required of the successful bidder. 23. The enclosed Tax Compliance/Non-Collusion Certificate, Public Contracts Debarment Form, and Reference List (see bid checklist), must all be properly executed and submitted with the Bid Sheets. 24. The awarded vendor must supply a Certificate of Insurance listing liability and worker s compensation coverage, through a company licensed to do business in the Commonwealth of Massachusetts. The contractor shall at all times during the contract maintain in full force and effect Worker s Compensation, Employer s Liability, Public Liability and Property Damage Insurance, including contractual liability coverage. All insurance shall be by insurers and for policy limits acceptable to HCG and before commencement of work hereunder the contractor agrees to furnish HCG certificates of insurance or other evidence satisfactory to HCG to the effect that such insurance has been procured and is in force. The certificates shall contain the following express obligation: This is to certify that the policies of insurance described herein have been issued to the insured for whom this certificate is executed and are in force at this time. In the event of cancellation or material change in a policy affecting the certificate holder, thirty (30) days prior written notice will be given the certificate holder. For the purpose of the contract, the contractor shall carry the following types of insurance in at least the limits specified below: COVERAGES Worker s Compensation LIMITS OF LIABILITY Statutory Employer s Liability $1,000, Bodily Injury Liability Except Automobile Property Damage Liability Except Automobile $1,000, each occurrence $2,000, aggregate $1,000, each occurrence $2,000, aggregate

The general liability insurance policy should contain a broad form general liability endorsement. 25. HCG reserves the right to terminate the awarded contract by issuing a thirty (30) day notification of cancellation to the successful bidder. 26. Bidders must be experienced companies having a minimum of three years work experience in highway line painting. 27. TWO copies of the Bid Sheet are to be submitted; the original and a photocopy of the original. 28. If apropos to one or more towns, said town(s) will provide traffic control, if deemed necessary by town personnel. It is the town s responsibility to advise the vendor when and where traffic control is necessary. Prior to the start of any work it will be decided between the town and the vendor who is responsible for any costs associated with traffic control. 29. The contract(s) resulting from this bid will be awarded to the lowest responsible and responsive bidder based upon bid price, past performance and reliability of the bidder, quality of product and/or service, and degree of exclusion, exemption, or restrictions on the bid form. Contracts may be awarded to separate bidders. Contract(s) will be signed by the awarded bidder(s) and HCG, acting on behalf of the participating town. 30. The locations in which work is to be completed for MassDOT funded projects, including the length of the project and the estimated cost are listed on the attached Project Sheet. 31. All contractors working on public works projects will be required to furnish labor that can work in harmony with all other elements of labor employed or to be employed in the work, and to certify that ALL employees employed at the work site have successfully completed an OSHA approved course in construction safety at least 10 hours in duration. This law requires general contractors to have on file records of all employees OSHA 10-hour training and provide proof to the various agencies in charge of the work. This also applies to all subcontractors, hired trucks, and hired equipment with operators. Every bidder must certify that all persons who are employed by them for this bid are certified. Proof does not have to be submitted with this bid, but must be available upon request.
6 Please submit with your bid a letter similar to the sample as follows: I hereby certify that all of our employees who will be employed at the work site have successfully passed the OSHA approved 10-hour safety course, and we have proof on file. 32. QUARTERLY REPORTING AND ADMINISTRATIVE FEE Awarded contractors, as a condition of acceptance of their bids, shall pay an administrative fee to the Hampshire Council of Governments in the amount of one point four percent (1.4%) of the total sales volume reported under the awarded contract. By submitting a bid, you agree to file QUARTERLY REPORTS of the total amount of money spent by each entity under the awarded contract. Quarterly Reports are due twenty-one (21) days following the end of each quarter. The HCG Purchasing Co-op will provide the quarterly report form and the HCG Finance Department will generate invoices payable by the contractor. Failure to submit the Quarterly Reports and administrative fees shall constitute a material breach of contract. By submitting a bid, you agree to submit to the jurisdiction of the Hampshire County District Court and the Hampshire Superior Court located in Northampton, Massachusetts over any suit, action or proceeding arising out of or related to this bid and the awarded contract, including but not limited to breach of this provision. In the event of breach of this provision, you shall be liable for all attorneys fees, costs of collection and interest payable at a rate of eighteen percent (18%), compounded annually.
