All work completed for the Metropolitan Park District will be considered a public works project with prevailing wage documentation required. 2 INSTRUCTIONS TO BIDDERS BACKFLOW TESTING BID#P SUBMISSION OF BIDS Bids must be delivered no later than Tuesday, April 12, 2016 at 2:00 P.M. Informal bids will be received by the Metropolitan Park District of Tacoma and delivered to 4702 S 19 TH St Tacoma, WA For more information, contact Doug Sawyer, Project Manager at (253) or to dougs@tacomaparks.com 2. BIDDING PROCEDURE AND FORMS Bidders shall submit their bids on the bid proposal and signature sheet form included in this invitation to bid. A Non-Collusion Affidavit is not required. A bid bond is not required with the bid proposal. Forms shall be filled in completely in ink or typewritten. The signature sheet must be signed by a responsible company official with their designated title. Bidders may submit additional product information with their bid as desired. 3. REJECTION OF BIDS & ACCEPTANCE OF BID The MPD shall have the right to reject any or all bids or any items of the bid and to reject a bid, which is in any way incomplete or irregular. Any or all bids may be rejected for good cause. It is the intent of the MPD to award one contract to the lowest responsible bidder, provided the bid does not exceed the funds available. The MPD shall have the right to waive any informality, irregularity, or technical defect in any bids or bids received and to accept the bid or bids which, in its judgment, is in its best interests. Contract will be awarded on the base bid. 4. AGREEMENT BETWEEN OWNER AND CONTRACTOR A Bidder whose proposal is accepted shall sign the written agreement between MPD and Contractor within forty-five (45) days from the date of mailing of a Notice from MPD to Bidder of acceptance of his proposal. 5. WARRANTY AND GUARANTEE Bidder warrants and guarantees to MPD that all work will be in accordance with the plans and specifications and will not be defective. If within one year after the date of delivery, any material is found to be defective, the Contractor shall promptly and without cost to MPD, correct such defect. 6. PUBLIC WORK & PREVAILING WAGE RATES Please be aware when submitting a bid that this project is classified as "public work" and is subject to Washington State Prevailing Wage Law. The law requires in part that the following conditions be met: All workers or laborers must be paid the prevailing wage rate for their job classification as determined by the Department of Labor & Industries. A copy of current prevailing wages is attached to this notice. The prime contractor and each subcontractor must file a Statement of Intent to Pay Prevailing Wages with the Department of Labor & Industries, ESAC Division, in Olympia. 3 The prime contractor and each subcontractor must file a corresponding Affidavit of Prevailing Wages Paid with the Department of Labor & Industries at project completion. Weekly certified payroll forms must be completed by prime contractor and each subcontractor and submitted to the Metropolitan Park District. Industrial Insurance: All Industrial Insurance premium payments must be current for prime contractor and each subcontractor working on the project. The Metropolitan Park District will check with the Department of Labor & Industries to verify current premium status. No progress payments will be made to the prime contractor until approved Statements of Intent to Pay Prevailing Wages have been received by the Metropolitan Park District. Final payment will not be made until approved Affidavits of Prevailing Wages Paid have been received along with determination that the prime contractor and each subcontractor is in a current premium status. Please note that it is the responsibility of the contractor to forward the statements and affidavits. 4 BID PROPOSAL METROPOLITAN PARK DISTRICT OF TACOMA BACKFLOW TESTING BID#P Bid Due: April 12, 2016 at 2:00 P.M. Scope of Work: Backflow Testing P The scope of this project shall be for materials and labor to perform preventative maintenance, inspection, diagnostics, minor repair, or replacement, emergency and professional services at District-wide locations, which may or may not include, Enterprise Fund locations and as otherwise identified and referenced in these documents. Metro Parks Tacoma has approximately 150 backflow assemblies which require testing on an annual basis to comply with WAC Metro Parks Tacoma is also requesting a separate hourly rate for tracking and repairing an assembly which has failed a test. All contractors will have BAT certification and provide owner with license information upon request. Test reports should be forwarded to: Tacoma Water, Water Quality Division, P.O. Box Tacoma, WA , Fax: , or at backflow@cityoftacoma.org. Recommended repairs approved and agreed to in advance by owner will be at the contract rate and materials. Refer questions to Doug Sawyer at 4702 S 19th St, Tacoma WA at Submittals for products used are required including MSDS and Product Data Sheets. The contractor shall, at its own expense, obtain and keep in force any necessary licenses, permits, and tax certificates. All projects will be completed within thirty days of notification to proceed from Project Manager. If not completed by such date, the contractor shall be liable to the District for damages. The Owner and Contractor agree that in the event this project is not completed on time, the Owner's damages are difficult to calculate. As a result, the Owner and Contractor agree that if the project is not completed by the completion date, Liquidated Damages will be assessed in the amount of $ per day. Deviation from the scheduled completion dates due to adverse weather conditions will be considered if coordinated with the Project Manager. The undersigned Bidder declares that he has read and fully understands the Notice Inviting Bids, General Conditions for Metropolitan Park District of Tacoma Public Works Projects, Small Works Master Agreement, Metro Parks Tacoma Master Contract for Work Awarded From Small Works Roster, and each and every other Contract Document referred to therein and agrees to all of the terms, conditions and provisions contained therein; that he has examined the site of the work and has made the investigations and formed the estimates as to all conditions and contingencies referred to in and required by the Contract Documents, and he proposes and agrees that if his bid as submitted in the Proposal be accepted, he will contract in the form provided to perform all of the work and in the manner required by the Contract Documents and to complete the same within the time stipulated; that he will accept in full payment therefore the prices named herein.

5 Said prices are to include and cover the furnishing of all materials, the performing of all labor requisite or proper, supervision, overhead, profit, taxes (excluding State sales tax), and the providing of all necessary machinery, tools, appurtenances, equipment and other means required to fully complete this contract, except as otherwise specifically provided in the Specifications. Metro Parks Tacoma may add or delete fire extinguisher, fire hydrant, fire suppression system maintenance, or alter the frequency of service, or other related items, as may be deemed advisable and mutually acceptable. At the request of the Metro Parks Tacoma representative, the contractor may be asked to do ADDED WORK not covered under the scope of complete maintenance and repair, such as changes in code or vandalism. Metro Parks Tacoma at its discretion reserves the right to solicit and award major repairs or modifications under the scope of this contract. Additions or deletions may be negotiated by the Metro Parks Tacoma representative and a change order to the contract issued if an agreement is reached. Added work not cited in the contract may, at the option of Metro Parks Tacoma, have added work performed at the labor rate per hour and cost per trip as bid below. Hourly Rate for Non-Contract Service The hourly rate for non-contract or non-scheduled service provided during Contract Normal Hours (8am to 5pm). $ (per hour) Hourly Rate for non-contract Service Provided outside of Contract Normal Hours The hourly rate for non-contract or non-scheduled service provided outside of Contract Normal Hours. $ (per hour) Owner will evaluate bids to determine the lowest most responsive, responsible bidder. The Owner reserves the right to reject a bid in the event it is determined that any price for any bid item is unreasonable, unbalanced, or otherwise not in the best interest of Owner. A contract will be awarded, if at all, based on the lowest price of the responsive, responsible bidder. Owner reserves the right, but without obligation, to weigh the irregularities and informalities. The Owner further reserves the right to reject any portion of any bid, and/or to reject all bids. This Bidder s Proposal will potentially result in a contract for a period of one (1) to two (2) years. Construction shall commence immediately upon receipt of the Notice To Proceed by Contractor, or as determined in the contract and shall be completed and invoiced no later than December 1st of the respective year. All costs associated with this contract are incorporated in the bid price of this project. This includes, but is not limited to all misc. labor, installation, benefits, freight, and materials. Construction shall commence immediately upon issuance of the Notice To Proceed by Contractor, or as determined in the contract. Liquidated Damages shall be as a result of the Contractor s failure to meet deadlines in accordance with the Bid Documents and Project Schedule. Receipt of addenda numbered (must circle if addenda issued) is hereby acknowledged and all costs of the work therefore have been included in the Proposal.
