1 INVITATION TO BID BUILDING ENVELOPE CONSULTANTS, LLC ALDINE I.S.D EMMETT ROAD ALDINE WESTFIELD ROAD Houston, Texas HOUSTON, TEXAS (713) Phone BEC Project No.: (832) Fax April 24, 2013 You are invited to bid on a Roofing Replacement Contract, relating to portions of the Aldine ISD, Teague Middle School located at Rayford Road in Houston, Texas. Bid packages shall be handed-out to all prime contractors at the pre-bid conference stipulated in the Instructions to Bidders. A Pre-Bid Conference will be conducted by the Consultant and Aldine ISD at 9:00 A.M., on April 29, All bidders are strongly encouraged to attend the conference and shall notify the Consultant of the number of representatives who will be attending the conference by 10:00 A.M., on the preceding work day. The Project Consultant is Mr. Val Kuntz and he can be reached at (713) and by at val@buildingenvelopetx.com. The property, an existing Aldine ISD Teague Middle School facility has up to approximately 140,000 square feet of built-up roof replacement, metal deck repair/replacement, and exterior wall renovations involved in this project. Bids shall be on a Lump Sum basis; Unit and Time/Material pricing shall be required for repair of latent defects. The Work shall proceed by June 1, 2013 and shall be completed by July 31, 2013, in compliance with the Contract Documents. Bids shall be received until 1:00 P.M. on May 6, 2013, by Mr. Herbert Harris, Aldine Independent School District, Aldine Westfield Road, Houston, Texas Bids received after this time shall not be accepted. Bids shall be opened privately after the designated Bid closing time. Bids will not be received or accepted by Building Envelope Consultants, LLC. The Owner reserves the right to reject any and all bids and to waive all informalities in the bidding. 2 INSTRUCTIONS TO BIDDERS BUILDING ENVELOPE CONSULTANTS, LLC ALDINE I.S.D EMMETT ROAD ALDINE WESTFIELD ROAD Houston, Texas HOUSTON, TEXAS (713) Phone BEC Project No.: (832) Fax April 24, 2013 To be considered, Bids must be made in strict accord with these Instructions to Bidders. QUALIFICATIONS The Contractor must be properly licensed in the state and municipality in which the Project is located to perform the Work herein specified and enter into a Prime Contract with the Owner. Proof of licensing (contractor\bidder) and license limitations (if applicable) shall be submitted with the enclosed Bid Form. The Contractor shall be approved by the Manufacturer of the roofing system specified and shall be able to provide the manufacturer s standard labor and material warranty at the completion of the Project. DOCUMENTS Bidders may obtain Drawings and Project Manuals from the Consultant as stipulated in the Invitation to Bid. No partial sets will be issued, and no sets will be issued by the Consultant to sub-bidders. Drawings included with the Specifications represent typical field conditions on the Project, and any exceptions to drawing which do not, in the opinion of the Contractor, represent existing conditions shall be clearly stated in letter form on company letterhead and must accompany the Bid Form at the time of submission. EXAMINATION Bidders shall carefully examine the Contract Documents and the project site to obtain first-hand knowledge of existing conditions. The Contractor shall not at any time after submission of the bid, dispute or plead misunderstanding in regard to the location, extent, nature, or amount of Work to be performed. All existing conditions shall be considered in the preparation of the Bid, and any exceptions to the project specifications shall be clearly stated in letter form on company letterhead and must accompany the Bid Form at the time of submission. Contractors shall not be given extra payments for conditions which can be determined by examining the site and documents. QUESTIONS Questions about the Drawings and Project Manual are to be submitted in writing or by to the Consultant. Replies will be issued to all prime bidders of record as Addenda to the Drawings or Project Manual and will become part of the Contract. The Consultant will not be responsible for oral clarification. Questions received less than 5 days prior to the Bid opening cannot be answered. To obtain approval to propose unspecified products, bidders shall submit written requests at least 5 days before the Bid opening date and hour. Requests shall clearly describe the product for which approval is Instruction to Bidders - 1
3 sought, including all data necessary to demonstrate acceptability. If the product is acceptable, the Consultant will approve it in an Addendum issued to all prime bidders of record. It shall remain the responsibility of all bidders to make inquiry as to the addenda and clarifications issued, as all addenda and clarifications become part of the final contract package; all bidders shall be bound thereby, whether received by them or not. The Owner will not be responsible for any oral instructions or interpretations. BASIS OF THE BID The bidder shall submit a Lump Sum Base Bid in order to bid on any Alternates or Additives. Unit price and Time/Materials Bids shall be included. Bids not complying will be rejected. Unit Prices shall be submitted as a supplement to the Contract Price as listed on the Bid Form and/or Attachments in the event that replacement of undefined components of the roofing assembly becomes necessary during the course of the Work. Unit Prices submitted shall be net and include all profit, overhead, and applicable taxes. Unit Prices submitted on the Bid Form and/or Attachments may be used to adjust the Contract Price by Change Order in the event that additional work is required, or shall establish the basis for DEDUCTs to the Contract Price in the event that all specified Work is not necessary or is not completed. If extra work is to be performed for conditions not included in the Unit Prices, it shall be compensated for on a Time and Material basis as stipulated on the Bid Form and\or Attachments under the heading Repair of Latent Conditions. Amounts per man-hour and material cost plus percentage listed will be considered in the award of the Contract. Certified material receipts must be submitted to the Owner with the Contractor s request for payment application. Extra work provided by subcontractors shall be calculated in the same fashion. A Unit Price and Time\Material Log shall be maintained by the Consultant s Resident Project Representative on a daily basis. Verification of quantities shall be accomplished by the contractor s field representative at the end of each work day. Quantities listed in this log shall be in accordance with the contractor stipulations made on Attachment B of the Bid Form. PREPARATION OF BIDS Bids shall be made on unaltered Bid Forms furnished by the Consultant or on unaltered photocopies of the Bid Form. Fill in all blank spaces, sign, date, and submit original and two (2) copies. Completed forms shall be typed without interlineation, alterations, or erasures. Bids shall be signed and the name printed below the signature. Where the bidder is a Corporation, the legal name of the Corporation must be signed, the State of Incorporation listed, and the signature of an Officer authorized to bind the Corporation to a Contract must be affixed. BONDS The selected bidder will be required to furnish 100% bonds covering faithful performance of the Contract and payment of all obligations arising there under. A Bid Bond in the amount of 5% of the Base Bid shall be submitted with the sealed bid. Bonds shall be furnished in such a manner as the Owner may prescribe and with a surety company acceptable to the Owner. The Contractor shall pay for all bonds. The bidder shall deliver the 100% Performance and Labor bonds to the Owner not later than the date of execution of the Contract. Failing or neglecting to deliver bonds, as specified, shall be considered as abandonment of the Contract. Instruction to Bidders - 2
4 SUBCONTRACTORS Names of principal subcontractors must be listed and attached to the Bid. There shall be only one subcontractor named for each classification listed. No changes to this subcontractor listing shall be made without the approval of the Owner. The Owner shall have the right to accept or reject any proposed subcontractor, and subcontracts shall be awarded in accordance with the Owner s selection. Nothing contained herein or action taken by the Owner shall relieve the Contractor of the primary responsibility for the full and due performance and completion of the Work under all terms, provisions, and conditions of the Contract. SUBMITTAL Enclose the completed Bid Form, 5% Bid Bond, Bid Form Attachments A, B & C, and Special Conditions Exhibit E in one opaque, sealed envelope. Clearly mark the envelope with: 1) the caption "SEALED BID ENCLOSED", 2) the Aldine Independent School District, Teague Middle School, Roof Renovations Project ) the name of the bidder. Submit in accord with the Invitation to Bid. ERRORS AND OMISSIONS Bidders are strictly accountable for their bids as submitted. The Owner will not consider any claims for relief due to errors, mistakes, or omissions. MODIFICATION AND WITHDRAWAL Bids may not be modified after submittal. Bidders may withdraw Bids anytime before the Bid opening, but may not resubmit them. No Bid may be withdrawn or modified after the Bid opening except where the award of contract has been delayed for 90 or more calendar days. DISQUALIFICATION The Owner reserves the right to disqualify Bids, before or after opening, upon evidence of collusion with intent to defraud or of other illegal practices upon the part of the bidder. GOVERNING LAWS OR REGULATIONS The Contractor must ascertain and comply with all ordinances, codes, and laws governing business practices and construction in the location of the project. OPENING AND AWARD Bids shall be opened as announced in the Invitation to Bid. The Contract shall be awarded on the basis of the lowest responsible Bid from the bidder of whose qualifications the Owner approves. Included in Bid selection shall be consideration of: Lump Sum Base Bids; Bids on Alternates and Additives contained in the original Project Manual; Bids on Alternates and Additives in approved Addenda; Unit Prices; Time/Material Repair Bids. EXECUTION OF THE CONTRACT The Owner reserves the right to accept any Bid, and to reject any and all Bids, or to negotiate Contract Terms with various bidders, when such is deemed by the Owner in his best interests. Not withstanding any delay in the preparation and execution of the formal Contract Agreement, each bidder shall be prepared, Instruction to Bidders - 3
5 upon notice of Bid acceptance, to commence work on the date stipulated in the Owner-Contractor Agreement. The accepted bidder shall assist and cooperate with the Owner in preparing the formal Contract Agreement, and within 7 days following its presentation shall execute same and return it to the Owner. INSURANCE CERTIFICATES The successful Bidder shall deliver to the Owner, prior to commencing work on the site, certificates of insurance attesting to the fact that policies of insurance required in Article 9 - Insurance, of the Special Conditions have been met. USE, CLARIFICATION AND RETURN OF OWNER S DATA All drawings, specifications, scopes of work, standards, data sheets, software, etc. are the sole property of the Owner and are intended solely for the work proposed herein. Except for a bidder whose proposal is accepted, said data must be returned in good condition upon notification that another proposal has been accepted. RELATED EXPERIENCE The successful Bidder shall submit the following: 1) A brief description of similar work performed within the past five years - submit names and phone numbers of references for the work; 2) A brochure or a letter describing their company - include information such as the annual dollar value of work constructed, years in business, special qualifications, and other information the bidder may wish to convey to the Owner; and 3) the name of the proposed field superintendent with resume and references.
