Collins, Planning, Zoning and Engineering Director SUBJECT: Planning, Zoning & Engineering Monthly Report DATE: October 6, 2009 Programs/Issues Updates Planning: BEBR Population Estimate Challenge The University of Florida Bureau of Economic and Business Research provided preliminary population estimates for the City (based on April1, 2009 data) which were received in August. The preliminary estimate was 55,759, which was down a little from last years estimate of 56,316. City Management directed staff to challenge the preliminary estimate. Staff provided a challenge based on Certificates of Occupancy data from April 1, 2008 through March 31, 2008 which, not taking other factors such as vacancy rates into account provided an estimate of 57,034. BEBR contacted the City and said that for them to completely respond to the City s challenge, the City needed to provide Certificate of Occupancy data for the period of April 1, 2000 through March 31, The Building department provided printouts of all of the Certificate of Occupancy data and Planning staff manually counted each. Based on the count, staff found that 14,117 residential units had been built during that period. Staff has provided this new information to the BEBR demographer. The City should hear back form BEBR in the next few weeks as BEBR is required to provide their final estimates to the State Legislature by November 1 st. Staff will provide an update on the next Monthly Report. Community Rating System Recertification Staff is an active participant in the National Flood Insurance Program Community Rating System (CRS) which, because of actions taken by the City to reduce flooding and to provide customer service, gives the City a Class 7 rating in the CRS and, in turn, means that residents in the Special Flood Hazard area receive a 15% premium discount on their flood insurance. Staff completed the annual st recertification package and transmitted it to the CRS reviewer prior to the October 1 deadline. Some examples of activities undertaken include maintaining accurate Elevation Certificates in the Building Department, purchasing and preservation of land in flood hazard areas (Myakkahatchee Creek), maintaining and enhancing the City s drainage system, providing an annual Floodplain Management

2 Plan report, and informing citizens that flood map information can be obtained at the Planning, Zoning, and Engineering Department. Comprehensive Planning Staff has been communicating with DCA about the large-scale Comprehensive Plan Amendments that are currently under review by DCA. These are the Sarasota Memorial Hospital amendment to add the Village land use to lands on Thomas Ranch that were annexed into the City over a year ago and the City amendments to change the transportation level of service standard from C to D. The Objections, Recommendations, and Comments (ORC) report will be issued by DCA around October th 11. It appears that there may be objections relating to the percentages of land uses that are allowed in the future Town Center and the need for analysis to show that with an expanded Town Center that water and traffic projections portray the anticipated impact and that the City is planning to address any deficiencies that result from the larger Town Center. Capital Improvements Element (CIE) Staff has also prepared the annual amendment to the Capital Improvements Element (CIE) that incorporates the new CIP 5 Year Schedule of projects that was recently adopted as part of the budget. This amendment is essentially administrative in nature. Staff will be bringing this item before the Planning and Zoning Advisory Board on October 15 th and the City Commission on November 9 th and 23 rd. Stormwater: Florida Stormwater Association (FSA) Legislative Committee E. Wong served on the FSA legislative committee on Sept 10, Much discussion was centered on the ever-changing Numeric Nutrient Rule standards for total nitrogen (TN) and total phosphorus (TP) concentrations. Many agencies are in litigation with EPA and FDEP over these standards. Corresponded with FDEP on the possibility of EPA proposing in January 2010, TN and TP standards for South Florida, and whether it is reasonable to consider manmade canals with multiple control structures as equivalent to Flowing Streams with the same TN and TP standards. The Technical Advisory Committee (TAC) on the Statewide Stormwater Quality Treatment Rule is proposing that all new developments and redevelopments that rebuild from dirt up, meet the lesser of the following two requirements (1) 85% reduction of TP from the developed condition; (2) Post -development water quality < Pre-development water quality. Expect a draft rule in July FDEP Workshop on Impaired Waters Draft Verified List Attended the workshop where FDEP staff discussed the newly proposed Sarasota-Peace-Myakka Basin draft verified impaired waters. Many waters were included in the proposed list due to low dissolved oxygen (D.O.) which FDEP has attributed to Nutrient levels. FDEP staff admits the D.O. standard may not be applicable to all waters. If so many waters are on the list due to a questionable D.O. standard, E. Wong asked what FDEP is doing to re-evaluate the applicability of the D.O. standard. 2

3 Traffic Concurrency Management Program/Transportation: US41 / River Road Intersection Improvements The Technical Advisory Committee last met August th 14. Design and permitting were to have been completed by September 30 th. Verified that City of North Port Utilities has reviewed the plans and provided any comments to Sarasota County. P rice Boulevard Corridor Study - Interconnectivity Selecting specific sites for the proposed 32 bridges (includes an additional one north of Price, between Ponce De Leon and Sumter per Commission direction). Strategizing on the method of procurement of associated parcels for the bridges to bring forward to City Commission for approval. US41 / Salford Intersection The Florida Department of Transportation District One Access Management Manager was queried on their review of the accident reports and any corresponding changes to be implemented. This matter is still under review by their safety staff. Traffic Concurrency Management System Reviewed and revised the data base for some minor corrections. Assessing the transfer of data from the traffic counters to the data base. Reviewing traffic impacts of the Heron Creek Parcel K proposed development. G rant Funding Submitted an application for a Transportation Investment Generating Economic Revenue grant application for the balance of the Sumter Boulevard Phase III Widening Project. Financial Overview S WFWMD Community Educational Grant SWFWMD staff indicated that they will be recommending to their Basin Board for approval, the City s request for $2,637 that will help pay for the Myakkahatchee Creek cleanup, storm drain markers and environmental public message sign boards. Total monthly payroll for Planning is $54,252. Executive Salaries are $43,031 monthly and Regular Salaries are $11,221 monthly. Total monthly payroll for Engineering is $56,725. Executive Salaries are $35,760 monthly and Regular Salaries are $20,965 monthly. The Budgeted Line Item for Planning Comprehensive Planning/books, subscriptions, etc. - 90% of this line item has been expended. As explained in last month s report, approximately 67% of this line item was a one-time expenditure for the renewal of ecivis Grants Locator Support. The Budgeted Line Items and 31-11, for Engineering, is over its line item percentage on YTD Actual due to use of appraisal services and surveying for non-project related items as requested by 3

4 Administration. Line Item 46-50, also for Engineering, is at 100% for prepayment service charges to Fleet. Activity Reports Myakkahatchee Creek South Trailhead Parking Lot Completed the in house ACAD design and Engineering analysis - water quality treatment calculations; ICPR, CHAN and modified rational attenuation modeling; infiltration hydraulic MODRET analysis, and pond sizing design for this facility. Submit Environmental Resource Permit application to SWFWMD on September 30, No external consultants were used on this project. Big Slough Model update by Ardaman and Associates Inc. The long awaited 2007 LiDAR data has just been received by Ardaman and Ardaman who will be updating the model with this 2007 data and projects constructed between 2004 and When this is completed, another draft of the 100-year floodplains will be produced for comments.
