1 This Project is funded by the European Union This Project is implemented by the International Labour Organization EU-ILO PROJECT ENHANCING THE LABOUR ADMINISTRATION CAPACITY TO IMPROVE WORKING CONDITIONS AND TACKLE UNDECLARED WORK CALL FOR PROPOSALS Support to development and implementation of the multiannual strategy to tackle undeclared work The International Labour Organization (ILO) has been implementing the EU funded Project Enhancing the labour administration capacity to improve working conditions and tackle undeclared work 1 in Ukraine since July The development objective of the Project is to contribute to the improvement of working conditions and to the reduction of the scope of the undeclared work (UDW) in the country. The key activities under this Project include, among others, support to the State Labour Service (SLS) 2 of Ukraine to develop and implement the multiannual strategy to fight against undeclared work in Ukraine. To meet this objective the Project is looking for a service provider(s) to contribute to the implementation of this Project component (see the detailed Terms of Reference in Annex 1). If your organization has the relevant knowledge and expertise as well is interested in collaboration with the EU-ILO Project in Ukraine and the State Labour Service, you are kindly invited to participate in this Call for Proposals. Please your proposal in English with UDW. In case more than one company/independent consultant submit one joint proposal, the costs shall be breakdown by contribution of each party. 2 Annex 1 TERMS OF REFERENCE 1. - JUSTIFICATION AND BACKGROUND The current business climate in Ukraine is characterized by a relatively high share of undeclared work (UDW). This undermines the collection of tax revenues and social security contributions. As a consequence, Ukraine faces challenges of reduced tax revenues, social contributions. Low tax revenues induce higher corporate and labour taxation, which in turn pushes firms and individuals to exit the formal economy, worsening further the fiscal position and limiting the ability of the Government to stimulate investment, economic activity and job creation. Apart from significant negative impacts on the economy and social institutions, undeclared work implies several risks for the individual workers, lack of respect for workers rights to decent working conditions, remuneration, social protection, to proper OSH measures. According to the Ministry of Economic Development and Trade of Ukraine, as of 1 st quarter of 2017 the size of shadow economy was 37% of GDP. However, due to lack of reliable data the scope of undeclared work (total of informal employment in formal sector, payment of wages in envelopes, bogus civil contracts and bogus self-employment as well as employment in informal sector) is not known. Labour Inspection plays a fundamental role to promote the effectiveness of fundamental rights at work, through its main actions of information, advice and law enforcement. The quality of this State function depends on the capacity of national institutions with a mandate to supervise application of labour law to stimulate compliance with legal requirements and cover the entire universe of businesses and workers, including the informal economy. Tackling undeclared work was identified as one of the key priorities by the Government of Ukraine and, in this connection, the State Labour Service (SLS) performing the functions of labour inspection is the key institution to detect and tackle undeclared work in order to promote the transition from undeclared to declared labour relations. In 2017 the ILO Project The effectiveness of the Labour Inspection System and of Social Dialogue Mechanisms is Strengthened supported SLS in the development and piloting of the labour inspection campaign to tackle undeclared work in 4 regions of Ukraine. Its purpose was to test the awareness raising and labour inspection tools to prevent UDW, promote transition from undeclared to declared work and to take enforcement measures, to promote collaboration between SLS and other competent authorities. Its results and lessons learned are to be taken into account while the multiannual strategy to tackle undeclared work will be developed and implemented by SLS with support of the EU-ILO Project Enhancing the labour administration capacity to improve working conditions and tackle undeclared work. This support will be provided under the output 2.2 of the EU-ILO Project and it includes the activities listed in the Section 2. Several of them shall be implemented with the involvement of the external service provider(s) to be contracted by the EU-ILO Project. 2

3 2. - OBJECTIVE AND ACTIVITIES To contribute to the implementation of multiannual strategy to fight against undeclared work the service provider(s) shall be contracted by the ILO who will work in close coordination under the overall guidance of the EU-ILO Project team. The table below describe the key activities and the contribution of the service provider(s). Activity In line with the multi-annual strategy, implement preventive action: To design and implement communication campaign; To conduct seminars in the framework of communication campaign; Activity June-July June-July Based on the outcomes of the activity , to finalize the communication campaign and facilitate its implementation by the SLS Facilitation of the seminars/trainings: develop the training programmes, training materials; conduct trainings; prepare the reports; finalize the training materials to be uploaded on the distance learning platform. 3

4 In line with the multi-annual strategy, implement deterrent action namely an inspection campaign: To develop and produce the promotional materials To conduct the seminar to launch the inspection campaign June-August September Generate the ideas on the content of the promotional materials (booklets, leaflets, posters, billboards, calendars, videos etc.); Agree on the content with the ILO and SLS; Test the draft materials on the focus groups to select the most appropriate; Produce the promotional materials. Participate in the event Activity In line with the multi-annual strategy, support collaboration between the SLS and other administrative authorities, the judiciary and/or the social partners to tackle undeclared work: To organize a high level information and knowledge sharing event 1 st quarter of 2019 Participate in the event The service provider(s) shall: 1. As regards the trainings: a) develop the training programmes, training materials, b) provide trainers to facilitate the training sessions, c) prepare the reports on the trainings conducted, d) finalize the training materials and hand them over to the EU-ILO project for upload on the distance learning platform for labour inspectors. 2. As regards the communication campaign: a) hold consultations with the EU-ILO Project and get acquainted with the relevant supporting materials (see the list below) as well as with SLS; b) draft communication campaign and finalize it in consultations with the EU-ILO Project and SLS; c) draft promotional materials, test them on the focus groups, select and produce the most appropriate ones. 3. The communication campaign to tackle undeclared work shall include at least the following: a) development of at least 3 variants of logo for the campaign and its testing on the focus groups; b) development of the slogan and key messages for the target groups (workers and employers); c) development of the promotional materials (leaflets/booklets/posters/calendars/social videos etc.) and its testing on the focus groups; d) production of the promotional materials; e) series of trainings on development of the information campaign and media plan, assistance 4

5 to SLS in development of the information campaign and media plan including their implementation; f) series of trainings on effective communications based on the training materials tailored to the needs of the labour inspectors (to be provided by the Project); g) other relevant activities as proposed by the service provider(s). 4. TIMEFRAME AND CONTRACTUAL ARRANGEMENTS The activity will start on 20 April and is due to finish by the 30 May The first contract shall be concluded for the period of 20 April 30 June. The second contract, in case of successful completion of the tasks under the first contract, shall be concluded for the period of 15 July - 30 May The service provider(s) shall offer the scope of works and proposed remuneration for both contracts taking into account the timeframe given in the Section SUPPORTING DOCUMENTS THAT MAY BE SUBMITTED UPON REQUEST 1. Working paper on undeclared work in Ukraine and measures to tackle it; 2. Description of the pilot labour inspection campaign conducted in 2017; 3. Reports of the pilot labour inspection campaign (information component and inspection component); 4. Examples of the booklets and posters for workers and employers produced in
