1 2016 Illinois VOTING RECORD YOUR LEGISLATORS VOTING RECORD ON SMALL BUSINESS ISSUES 2016 EDITION Roll call votes by your state legislators on the following key small business issues during the last two years of the 99th General Assembly are listed below. Although this Voting Record does not reflect every element considered by a lawmaker when voting, nor does it represent a complete profile of a legislator, it can be a guide in evaluating your legislator s attitude toward small business. Remember that many issues that affect small business did not go to a roll-call vote in either the House or Senate. Please thank those legislators who supported small business. 1. Paid Sick Leave (HB 6162): This legislation requires employers who already offer paid sick leave to also allow the employee to use the paid time off for the illness of a family member, including: a child, spouse, sibling, parent, mother-in-law, father-in-law, grandchild, grandparent or stepparent. A NO vote supports the NFIB position. The bill passed the House and the Senate Prevailing Wage (SB 2964): This legislation requires the prevailing wage to be set by collective bargaining agreements (CBAs), codifying the fact that prevailing wage simply is union scale. A NO vote supports the NFIB position. The bill passed the House and the Senate Small Business Regulatory Act (HB 3887): An NFIB initiative, this bill requires state agencies to scrutinize its rules, administrative regulations and permitting processes every five years in order to identify those that are unreasonable, unduly burdensome, duplicative or onerous to small businesses. A YES vote supports the NFIB position. The bill passed the House and the Senate Unemployment Insurance Reform (HB 1285): This legislation significantly changes the definition of misconduct to stop claimants from receiving UI benefits if they violate workplace policies. A YES vote supports the NFIB position. The bill passed the House and the Senate Workers Compensation (SB 162): This legislation sought to codify current law and would have done nothing to change the current any cause standard under Illinois workers compensation causation law. A NO vote supports the NFIB position. The bill passed the Senate It was not called for a vote in the House. 6. Workers Compensation (HB 1287): This legislation sought to codify current law and would have done nothing to change the any cause standard under Illinois workers compensation causation standard. It also added a complicated process for employers and the Workers Compensation Commission to assign blame on the previous employers of a worker who has been found to have a repetitive trauma injury. A NO vote supports the NFIB position. The bill passed the House It was not called for a vote in the Senate. 7. Disclosure of Sales Tax Information (SB 2933): This legislation sought to require the Illinois Department of Revenue (IDOR) to disclose businesses private sales tax information to third parties hired by such municipalities. This would have included third parties hired on a contingency-fee basis to challenge tax allocation decisions made by IDOR. A NO vote supports the NFIB position. The bill failed in the Senate Leave Mandate (HB 4036): This legislation would have required all employers to provide a total of 12 weeks of unpaid leave for victims of domestic violence. A NO vote supports the NFIB position. The bill passed the House This bill was amended in the Senate to remove NFIB s opposition. 9. Minimum Wage Hike (SB 11): This legislation sought to raise Illinois minimum wage to $11 per hour. A NO vote supports the NFIB position. The bill passed the Senate The bill was not called for a vote in the House. 10. Constitutional Amendment to Raise Taxes (HJRCA 26): This constitutional amendment sought to raise taxes on high wage earners, which would have resulted in Illinois flat tax becoming more of a progressive tax. A NO vote supports the NFIB position. The bill passed the House Note: The

2 bill needed 71 votes to pass because it changes the Illinois constitution. The bill was not called for a vote in the Senate. 11. Healthcare Mandate (HB 5576): This legislation, which will affect only employers purchasing health insurance in the open market (which typically are smaller businesses), seeks to eliminate the tools used by health plans to control the quality and costs of their drug benefits. A NO vote supports the NFIB position.
