1 Terms & Conditions Governing the Use of AmBank PrePaid MasterCard / Visa ( Card ) Any person issued with the Card (the Cardmember ) by AmBank (M) Berhad [Company No D] ( Bank or AmBank ) and registers the Card with the Bank agrees that the use of the Card is subject to the conditions printed below and in using the Card is deemed to have read, understood and agreed to them. 1 DEFINITIONS & INTERPRETATION 1.1 In these conditions:- AmBank Card Centre means the place where the Bank handles their daily operations for the Card. AmBank Contact Centre means the place that the Cardmember may call (at a telephone number which the Bank has made known to the Cardmember) to enquire about Stored Value and the Transaction history of the Card. AmBank Group means AMMB Holdings Berhad [Company No V] and its group of companies and includes any or all of its subsidiaries. ATM means an automatic teller machine linked to MasterCard or VISA at which the Cardmember can use the Card with PIN to access his/her Stored Value. Bank or AmBank means AmBank (M) Berhad [Company No D] a company incorporated in Malaysia and having its registered office at 22nd Floor, Bangunan AmBank Group, No. 55, Jalan Raja Chulan, Kuala Lumpur. Bank s website means Business Day means any day (excluding Saturdays & Sundays) on which commercial banks in Kuala Lumpur are open for business. Card means the MasterCard /VISA PrePaid Card issued by the Bank (and includes co-branded MasterCard /VISA prepaid cards issued by the Bank with other third parties). Card Account refers to the Cardmember s MasterCard /VISA PrePaid Card account to which all Transactions on the Card and all annual fees and/or any other fees are debited. Cardmember means any individual who has been issued with and has registered the Card. Cash Withdrawal means a Transaction using the Card to withdraw cash from any ATM (with CIRRUS/PLUS network) or at the Bank s branch which shall be subject to the following limits and the Card s available Stored Value: Minimum Maximum Per withdrawal ATM daily withdrawal RM10.00 RM5, Subject to respective bank s ATM withdrawal limit Daily withdrawal over the counter at the Bank branches Minimum Maximum RM RM10, Consumer Goods means goods which are bought for personal, domestic and household purposes. Merchant(s) means any establishment who accepts the Card from the Cardholder to pay for the purchase of Consumer Goods and services by the Cardmembers. PIN means the Personal Identification Number provided to Cardmembers for use with the Card. Online Statement means the statement containing the Transaction history accessible by the Cardmember from the Bank s website in accordance with Clause 12. Starter Pack Fee means the one time fee of Ringgit Malaysia Twenty Five (RM25.00). The Bank may increase this fee from time to time. Statement means the statement containing all Transactions posted to the Cardmember s Card Account. Stored Value means the balance in the Card Account that is available for Transactions. Stored Value Currency means currency in Ringgit Malaysia. Top Up means the adding of monetary value to the Card Account. Transaction means all transactions debited to the Card or made using the Card including the purchase of Consumer Goods or services or Cash Withdrawals, ATM transactions, teller s terminal, telephone, or remote (internal or ) purchases and payments credited to the Card. 1.2 These conditions are governed by the laws of Malaysia. 1.3 References to singular numbers shall include plural numbers and vice versa. 1.4 References to masculine genders include feminine and neuter genders. 1.5 References to a person include a partnership, firm or corporation. 1.6 The headings to these conditions shall be ignored in interpreting the conditions. 2 ACCEPTANCE OF CONDITIONS 2.1 The Bank will make available the Card facilities to the Cardmember subject to these conditions upon the Cardholder s successful registration of the Card. 2.2 As soon as the Cardmember receives the Card he must:- immediately sign on the signature panel on the Card; register the Card with the Bank by filling up the registration form and submit to any AmBank Branch. Bank will verify the Cardmember s identification. If the Cardmember holds a valid Malaysian MyKad and is at least 18 years old, he may walk into any of the Bank s branches during business hours for immediate Card activation. 2.3 The Bank may refuse to register the Card at its absolute discretion without disclosing the reasons. 2.4 Reasons for non registration may include pending bankruptcy proceedings against the Cardmember or if the Cardmember is an undischarged bankrupt. 3 CARDMEMBER S AGREEMENT 3A 3.1 The Cardmember agrees: That only the Cardmember who is successfully registered by the Bank is allowed to use the Card; At all times to keep Card safe and secure and to maintain the secrecy of the PIN; (c) To inform the Bank in writing as soon as possible if there are any changes in the details of the Cardmember given to the Bank during card application/registration. The Cardmember must also give the Bank other details or information as the Bank may ask for from time to time; (d) To also comply with all other conditions which the Bank may impose on the use of the Card from time to time; (e) To use the Card for personal use only to buy Consumer Goods and services and not for any business use or unlawful activities (for example illegal online banking, betting or gambling); (f) Not to use the Card for more than six (6) purchase Transactions per day (or such other number that the Bank may at its absolute discretion decide) and to ensure each purchase Transaction does not exceed Ringgit Malaysia Two Thousand (RM2,000.00); (g) To ensure that the Stored Value shall at all times not exceed RM10,000 (or such other number that the Bank may at its absolute discretion decide); and (h) To ensure that the Transactions using the Card and monies or funds used to Top Up /reload of the Card(s) are not obtained from unlawful sources nor relate to any unlawful activities as specified under the Anti-Money Laundering And Anti Terrorism Financing Act 2001 ( AMLA ). FINANCIAL SERVICES ACT 2013 & AMLA 3A.1 The use of the Card is subject to the Financial Services Act 2013, AMLA and all regulations and directives made by Bank Negara Malaysia. The Bank may

2 block a Transaction if it has reasonable grounds to believe that it is illegal in Malaysia or any other country and the Bank is not liable to the Cardmember if it does so. The Cardmember releases the Bank from all liability and also agrees to indemnify the Bank from any loss or damage that the Cardmember may suffer as a consequence of the Bank blocking the transaction. 3A.2 The Cardmember knows that the Bank may have to act promptly and on limited information if there is a suspicion of fraud, money laundering or other illegal activity. 4 TERMINATION/WITHDRAWAL/SUSPENSION OF USE OF THE CARD 4.1 All Cards belong to the Bank and the Bank may at its absolute discretion terminate and withdraw the Card or suspend its use or otherwise refuse any Transactions to be made on the Card if the Cardmember has breached any of these conditions. 4.2 The Cardmember shall release the Bank from all liabilities and shall indemnify the Bank and hold it harmless against all claims arising directly or indirectly from the termination, withdrawal of, suspension of or refusal to effect any Transactions on the Card including any claim for defamation or other losses. 4.3 In addition to the Bank s rights in clause 4.1, the Bank may terminate the Card if either: the Cardmember defaults in any payment due to the Bank; or the Cardmember is adjudged a bankrupt or is insolvent, dies or becomes insane; or (c) any of the Cardmember s property is the subject of a levy of execution, writ of attachment, or other legal encumbrance; or (d) after a credit check, the Bank deems its position to be risky (even though the Cardmember s account may be current); or (e) the Cardmember uses the Card in excess of the Stored Value; or (f) the Cardmember has failed to comply with any of these conditions; or (g) the Cardmember cannot be located by the Bank; or (h) the Cardmember enters or tries to enter into a settlement arrangement with his creditors; or (i) if the Bank is of the view that the Card has been used for any business purpose (i.e. used by the Cardholder to make any profit. Any decision of the Bank on this matter shall be conclusive and shall not be challenged at all). Upon the termination and/or withdrawal of the Card, the Cardmember has to settle with the Bank all outstanding sums owing under the Card Account immediately. 4.4 The Cardmember may cancel the Card by returning the Card cut in halves to the Bank. The Bank may cancel the Card at any time at its sole and absolute discretion with prior notice and without having to give the Cardmember any reason. Upon cancellation of the Card by the Bank the Cardmember s obligation to pay to the Bank all monies owing remain. 4.5 Upon cancellation of the Card:- all monies owing under the Card Account is immediately due and payable immediately and the Cardmember shall upon demand settle such monies in full, failing which the Bank may take any action deemed necessary to recover the same; and if there is any credit balance in the Card Account the Cardmember may redeem the Stored Value in the manner set out in Clause 16A. 5 LIABILITY OF CARDMEMBERS/LOST OR STOLEN CARD 5.1 The Cardmember must take reasonable precautions to prevent loss or theft of the Card. If the Card is lost or stolen or an unauthorised person discovers the PIN, once the Cardmember is aware of this he shall immediately notify the AmBank Card Centre by telephone (with confirmation in writing within a reasonable period thereafter), so that the losses to the Cardmember can be mitigated. The Cardmember must make a police report for the lost/stolen Card / PIN disclosure to an unauthorized person and give a copy of this report to the AmBank Card Centre. The Bank will invalidate the Card once the Bank receives notification from the Cardmember. 5.2 The Cardmember shall be liable for all Transactions incurred from unauthorized usage of the Card prior to the Card being reported as lost/stolen. The Bank will not under any circumstances be responsible to the Cardholder or reimburse or refund to the Cardholder any monies lost from the Card due to the Cardholder losing his Card or due to the theft of the Card. 5.3 If a Card reported lost is subsequently recovered, the Cardmember shall immediately return such Card cut in half, to the Bank. The Bank will refund the Stored Value balance (if any) to the Cardholder but will not issue a replacement Card following the loss or theft of the Card or the disclosure of the PIN to any unauthorised person. 6 DISCLAIMER OF LIABILITY BY BANK 6.1 The Bank is not liable if any Merchant refuses to honour the Card or if there are any defects or deficiencies in any Consumer Goods or services provided by the Merchant. The Cardmember must resolve all complaints and disputes against the Merchant directly. The Cardmember promises and confirms not to involve the Bank in any legal proceedings against the Merchant. The Bank is not liable to the Cardmember in making payments to the Merchant even though the Cardmember has a claim and/or dispute against the Merchant. If the Cardmember disputes any Transaction, the disputed Transaction shall only be refunded when the Bank has fully investigated the case and decides that the Cardmember is not liable for the disputed Transaction. Any monies to be refunded shall be credited to the Card Account. 6.2 The Cardmember shall release the Bank from all liability if the Card is not accepted by any Merchant. 6.3 The Bank disclaims and the Cardmember fully releases the Bank from all liability where the Bank fails to comply with any of these conditions even if such failure is caused by or within the Bank s control. 7 TERMS OF PAYMENT 7.1 Time is of the essence in respect of the Cardmember s payment obligations. 7.2 Notwithstanding anything else stated in these conditions, the Cardmember shall immediately pay in full all amounts owing to the Bank in any of the following events: If the Card or its use is withdrawn; or On the termination of the use of the Card for any reason whatsoever; The Cardmember has no right to withhold payment of any monies due to the Bank under any circumstances whatsoever. 8 CASH WITHDRAWAL 8.1 If there is enough funds in the Card Account, the Cardmember may obtain cash from any licensee of MasterCard International Incorporated/VISA through the use of the Card at designated locations and/or ATMs in and outside Malaysia. 8.2 A Cash Withdrawal by the Cardmember shall be debited from the Card Account. 9 FOREIGN CHARGES & CURRENCY 9.1 All Card Transactions will be denominated in the Stored Value Currency. 9.2 Any Transaction incurred in other currencies will be converted into the Stored Value Currency at the exchange rates determined by MasterCard or VISA plus an administration cost of 1% and RM1.00 for each transaction, as the case may be, at the date the Transaction is posted onto the Card Account. 10 CREDITS FROM MERCHANTS 10.1 The Bank may credit refunds from Merchants to Cardmember as Stored Value into the Card if the Bank receives a credit from the Merchant or Merchant s bank acceptable to the Bank If available, upon the Cardmember s request the Bank will give copies of the credit slips to the Cardmember at the Cardmember s cost.

3 10A. TOPPING UP / MAXIMUM STORED VALUE / DEBIT BALANCE 10A.1 The Cardmember may Top Up and pay monies into the Card Account as follows or in any other manner that the Bank may allow:- Banking in cash or cheques at any of the Bank s branches over the counter or using the Bank s cash / cheque deposit machines; Funds transfer from any of the Cardmember s other accounts held with the Bank in any manner allowed by the Bank; (c) Inter-bank money transfer (GIRO) from Cardmember s other accounts held with other banks; or (d) Making payments at AmG Insurance Berhad branches and such other participating epay outlets bearing the NexG Recharge logo. 10A.2 Top Up by the Cardmember is not effective until the actual value of the Top Up has been received by the Bank. Top Up by outstation cheques shall include the bank commissions where applicable otherwise the Bank may debit the Cardmember s Card Account for such commission. 10A.3 The maximum Stored Value that can be credited to the Card is RM10, or any other amount which the Bank may allow. If due to any error, the Bank s system permits the Cardmember s Stored Value to exceed the permitted limit, the Bank will notify the Cardmember and require the Cardmember to fully utilize such excess or redeem such excess in the manner set out in Clause 16A within 14 days from the date of the Bank s notification. 10A.4 If any error results in a debit balance on the Card the Cardmember shall repay this amount to the Bank within 14 days from the Bank s request for repayment. Such repayment may be made by the Cardmember by way of Top Up. Any amount of the Top Up in excess of the debit balance shall be treated as Stored Value. 11 SERVICE FEES, COSTS & CHARGES 11.1 In consideration of the services provided, the Cardmember shall pay the Bank:- a Purchase Transaction Fee of Ringgit Malaysia One (RM1.00) for every Transaction which is a retail purchase at any Merchant outside Malaysia through the use of the Card; a service charge of 2% of the amount withdrawn or Ringgit Malaysia Ten (RM10.00) whichever is higher, for any Cash Withdrawal obtained from non AmBank ATMs; (c) an administration cost of 1% of the Stored Value Currency amount incurred (upon conversion) for Transactions denominated in foreign currency; (d) a Top Up fee of Ringgit Malaysia Two (RM2.00), or such other amounts as may be specified by the Bank from time to time, for every Top Up performed by the Cardmember over-the-counter in any of the Bank s branches; (e) an account service fee of Ringgit Malaysia Three (RM3.00) per month for the use of the Card, which fee is chargeable upon registration; (f ) a service fee of Ringgit Malaysia Five (RM5.00) for each and every copy of the Statement requested for by the Cardmember; (g) a service fee of Ringgit Malaysia Twenty (RM20.00) for each and every copy of any sales draft requested for by the Cardmember if such sales draft is available; (h) Credit Refund Fee of RM2 will be imposed on any refund of unutilized stored value; and (i) all costs and expenses (including the Bank s solicitors fees on a solicitor and client basis) incurred by the Bank in order to preserve and/or enforce any of the rights of the Bank hereunder All fees, costs and expenses and/or charges due from the Cardmember shall be reflected in the Statement and debited from the Stored Value. All fees, costs or charges charged to and paid by the Cardmembers shall not be refundable under any circumstances The fees and charges may be changed by the Bank at any time and from time to time at its sole and absolute discretion with such changes posted to the Bank s website. The Bank will give the Cardmember at least twenty one (21) days prior notice before the date such changes take effect. The Cardmember shall keep track of the current fees or charges imposed by the Bank at Bank s website. 12. CHECKING STATEMENT DETAILS 12.1 The Cardmember can check his Online Statement containing information about the Stored Value or Transactions history from the Bank s website by logging into his/her AmOnline account with the Cardmember s user name and password. Alternatively the Cardmember may check on the Transaction history via phone at AmBank Contact Centre by calling The Online Statement will contain Transaction history, fees and charges that took place 48 hours ago and keep a record of the Transaction history, fees and charges for the last 90 days, but will not contain Transactions which are not yet processed by the Bank The Cardmember shall examine his/her Transactions record at least once a month from the Bank s website The Cardmember shall inform the Bank of any error within 14 days from the date Transactions are posted to the Online Statement otherwise the entries contained in the Statement are deemed to be correct, conclusive and binding on the Cardmember and the Cardmember shall not after that claim that the Statement contains errors or inaccuracies Cardmembers below the age of 18 are not entitled to access the Bank s Online Banking Services and are only allowed to check:- the Stored Value at any Bank s ATM or via phone to AmBank Contact Centre; or the Transaction history via phone at AmBank Contact Centre. 13 CONCLUSIVENESS OF EVIDENCE 13.1 The Cardmember agrees to accept as final and conclusive for all other purposes:- The Statement issued by the Bank, as conclusive evidence of the Cardmember s indebtedness to the Bank; and A certificate from any manager of the Bank as conclusive evidence on whether due notice of any matter arising out of these has been given to the Cardmember. 14 VARIATION OR ADDITION OF TERMS AND CONDITIONS 14.1 The Bank may change (by adding to or deleting from) these conditions at any time and from time to time by written notice to the Cardmember/Notice can be given by advertisement in any media and/or publication in the Bank s website. Such changes shall be effective on the date specified by the Bank. The Cardmember is required to check the Bank s website for the most recent updates of terms and conditions from time to time. The Bank will give the Cardmember at least twenty one (21) days prior notice before the date such changes take effect If the Cardmember does not accept any changes to these conditions as notified the Cardmember shall cancel the use of the Card by written notice to the Bank together with the Card cut in half If the Cardmember uses the Card after the effective date of any change of these conditions, the Cardmember shall be deemed to have accepted and agreed to be bound by such changes. 15 NOTICES 15.1 Any communication to the Cardmember is deemed received by the Cardmember if left at or sent by ordinary post to his/her last known address or sent by short messaging system services ( SMS ) to the Cardmember s mobile phone number on record or by electronic mail to the Cardmember address on record or advertised in any media including the Internet as decided by the Bank at its sole and absolute discretion Service of any notices or legal process is deemed effected on the date of

4 delivery if sent by hand or if sent by post, on the second Business Day after posting to the Cardmember at his last known address or at the time of sending if sent by SMS or electronic mail or on the date of any advertisement by the Bank if advertised. 16 CONSENT TO DISCLOSURE OF INFORMATION 16A 16.1 The Bank may disclose any information and conduct relating to the Cardmember or the Cardmember s Card Account or any other account held with the Bank, the Cardmember s particulars and the Cardmember s affairs (financial or otherwise) howsoever obtained by the Bank (collectively referred to as Cardmember s information ) to:- The Central Credit Unit established by Bank Negara Malaysia or to any other credit bureau or agencies approved by the Association of Banks of Malaysia; and/or Any Merchant, participating Financial Institutions, MasterCard/VISA and any member institution of MasterCard/VISA which accepts the Card, any member of VISA International Service Association and/or MasterCard International Inc; and/or (c) AmBank Group, its agents and/or associates (i) to enable the Bank to perform its functions; and/or (ii) to prevent crime and for audit, debt collection and service process purposes; and/or (iii) to investigate, report and prevent money laundering, terrorist financing and criminal activities generally; and/or (iv) for any and all other purposes required by law. REDEEMING STORED VALUE 16A.1 The Cardmember may redeem and/or the Bank may required the Cardmember to redeem Stored Value upon the occurrence of the following events: Where the Stored Value exceeds RM10, or any amount as may be determined by the Bank and the Cardmember has failed to utilize the amount in excess within 2 weeks from the date the excess occurs; and If the Cardmember cancels the Card due to the Card being lost or stolen. 16A.2 Upon the occurrence of any of the events set out in Clause 16A.1, the Cardmember may redeem and/or the Bank may required the Cardmember to redeem all or part of the Stored Value in the following manner: by having the Bank issue to the Cardmember a cashier s order for the amount redeemed subject to the Cardmember bearing the bank charges for the issuance of the cashier s order; or by funds transfer to another Card successfully registered with the Bank or to the Cardmember s savings/current account held at the Bank. 16B EVENTS BEYOND BANK S CONTROL & FORCE MAJEURE The Bank shall not be liable to the Cardmember if it cannot carry out its obligations due to reasons beyond the control of the Bank (such as events due directly or indirectly to any Acts of God, war (whether declared or undeclared), strike, riot, civil commotion, acts of terrorists, labour unrest, lock out, fire, accident, or other events which is in the nature of a force majeure, breakdown of machinery, failure of any electronic device, data processing system, transmission or telecommunication line, electrical failure). 17 PRIVACY 17.1 Cardmember confirm that he / she has read, understood and agreed to be bound by the Privacy Notice of AmBank Group (which is available at and the clauses herein, as may relate to the processing of his / her personal information. For the avoidance of doubt, Cardmember agree that the said Privacy Notice shall be deemed to be incorporated by reference into this Agreement In the event Cardmember provide personal and/or financial information relating to third parties, including information relating to his / her next-of-kin and dependents, for the purpose of registering or operating the Card with the Bank or otherwise subscribing to the Bank s products and services, Cardmember: a. confirm that he / she has obtained their consent or are otherwise entitled to provide the information to the Bank and for the Bank to use it in accordance with these conditions; b. agree to ensure that the personal and financial information of the said third parties is accurate; c. agree to update the Bank in writing in the event of any material change to the said personal and financial information; and d. agree to the Bank s right to terminate the Card should such consent be withdrawn by any of the said third parties Where Cardmember instruct the Bank to effect any sort of cross-border transaction (including to make or receive payments), the details relevant to the cross-border transaction (including information relating to those involved in the said transaction) may be received from or sent abroad, where it could be accessible (whether directly or indirectly) by the Bank s agents abroad, overseas regulators and/or authorities in connection with their legitimate duties (e.g. the prevention of crime). In instructing AmBank and/or our agents to enter into any cross-border transaction on the Cardmember s behalf, Cardmember agree to the above said disclosures on behalf of the Cardmember and others involved in the said cross-border transaction Additionally, but always subject to any laws, (including regulations, guidelines and/or obligations) applicable to the Bank (whether in or outside Malaysia), Cardmember agree that other companies in the AmBank Group, their merchants and strategic partners may contact the Cardmember about products, services and offers, which the Bank and AmBank Group believe may be of interest or beneficial to the Cardmember The Bank and AmBank Group may communicate with Cardmember through various channels, including telephone, , electronic / mobile messaging, facsimile or post, using the contact information Cardmember has provided Cardmember may inform the Bank at any time if Cardmember do not wish to receive marketing communications from the Bank, AmBank Group and/or their merchants and business partners, by contacting the Bank at the various channels given below: Customer Service Officer Phone : (24 hours) customercare@ambankgroup.com Post : Privacy, AmBank Contact Centre, P.O. Box No , Kuala Lumpur 17.7 Cardmember s latest written instructions to the Bank will prevail. Cardmember acknowledges that certain communications such as the Statements to the Cardmember and AmBank Group s websites may contain standard information regarding other products and services of the Bank and the AmBank Group that cannot be removed without affecting the delivery / operation provision of the Card and/or without additional costs to Cardmember Even after Cardmember have provided the Bank with any information, Cardmember will have the option to withdraw the consent given earlier. In such instances, the Bank will have the right to terminate the Card The Bank reserves the right to amend this Clause from time to time at the Bank s sole discretion by providing notice to the Cardmember This section shall be without prejudice to Clause 16 of these conditions on Disclosure of Information. 18 MISCELLANEOUS 18.1 If any of these conditions are found to be illegal, invalid or unenforceable, such condition shall be deemed deleted and the remaining conditions shall remain in full force and effect and shall not be affected by the deleted condition. The deleted clause shall be replaced by a condition (to be determined by the Bank) that is similar in terms to such deleted condition that is legal, valid and enforceable so as to give effect to the intent of the Bank The Bank is entitled to assign any receivables due from the Cardmember to any

5 person upon such terms, as the Bank deems fit The Cardmember agrees to submit to the jurisdiction of the Courts at Kuala Lumpur or Shah Alam or such other court as may be decided by the Bank Failure or delay by the Bank to exercise any right, power or privilege shall not affect the Cardmember s liability to the Bank nor shall any single or partial exercise of any right, power or privilege prevent the Bank from further exercising its right, power or privilege contained in these conditions The obligations of the Cardmember shall be binding on the Cardmember s legal representatives or successors in title In the event there is any uncertainty arising from these conditions, such uncertainty shall be resolved by the Bank. The Bank s decision of the meaning of any provision and where applicable, the Bank s choice of the appropriate provision to be applied to a particular situation shall be final and binding on the Cardmember All Cardmembers aged 18 to 70 years are entitled to a FREE RM10,000 Accidental Death insurance cover underwritten by AmG Insurance Berhad [Company No W]. The maximum cover per individual is RM10,000 regardless of the number of Cards the individual is registered for. The free insurance covers death due to an accident. The free cover is for a maximum duration of 12 months from the date the Card is registered or until the Card is cancelled, whichever is earlier. For details of the cover and policy contract, please visit Notwithstanding anything in these conditions, the Bank s rights and entitlement under this Agreement and the Cardmembers obligations shall continue to remain in full force and effect although the Card has been cancelled, revoked or suspended by the Bank The Bank may, at any time: combine any or all of the Cardmember s accounts with the Bank (including the Card Account regardless of where these accounts are located and whether these accounts are denominated in Ringgit Malaysia or in any other currency); and/or set-off or transfer any sum standing to the credit of any such account(s) towards payment of all monies due (regardless of where these monies due are located and whether denominated in Ringgit Malaysia or in any other currency) and the set-off may be done notwithstanding that credits and the debits are in different currencies. The Bank may effect any of the combination, consolidation set-off or transfer with the necessary conversions at the Bank s prevailing exchange rates determined by the Bank at its sole discretion. The Bank may, at any time freeze the Cardmember s current and deposit accounts held at the Bank before giving the Cardmember notice of the Bank s intention to exercise its right to set-off or transfer A Bahasa Malaysia version of this Agreement is available to the Cardmember at the Bank s website. 6 Syarat-syarat Penggunaan Kad Prabayar AmBank MasterCard / Visa ( Kad ) Sesiapa yang diberikan Kad ( Ahli Kad ) oleh AmBank (M) Berhad [No. Syarikat D] ( Bank atau AmBank ) dan mendaftarkan Kad dengan Bank bersetuju bahawa penggunaan Kad adalah tertakluk kepada syarat-syarat yang tertera di bawah dan dengan menggunakan Kad adalah dianggap telah membaca, memahami dan bersetuju dengan syarat-syarat tersebut. 1 DEFINISI & TAFSIRAN 1.1 Dalam syarat-syarat ini:- Pusat Kad AmBank bermakna sebuah tempat di mana Bank mengendalikan operasi harian mereka untuk Kad. Pusat Panggilan AmBank bermakna sebuah tempat yang Ahli Kad boleh memanggil (di nombor telefon yang telah Bank maklumkan kepada Ahli Kad) untuk bertanya tentang Nilai Simpanan dan sejarah Transaksi Kad. AmBank Group bermakna AMMB Holdings Berhad [No. Syarikat V] dan kumpulan syarikatnya dan termasuk mana-mana atau semua anak syarikatnya. ATM bermakna sebuah mesin teler automatik yang menghubungkan MasterCard atau VISA di mana Ahli Kad boleh menggunakan Kad dengan PIN untuk memasuki Nilai Simpanannya. Bank atau AmBank bermakna AmBank (M) Berhad [No. Syarikat 8515-D] sebuah syarikat yang diperbadankan di Malaysia dan mempunyai pejabat berdaftar di Tingkat 22, Bangunan AmBank Group, No. 55, Jalan Raja Chulan, Kuala Lumpur. Laman Web Bank bermakna Hari Urusniaga bermakna sebarang hari (tidak termasuk Sabtu dan Ahad) di mana bank komersial di Kuala Lumpur dibuka untuk perniagaan. Kad bermakna Kad Prabayar MasterCard /VISA yang telah dikeluarkan oleh Bank (dan termasuk kad-kad prabayar MasterCard /VISA jenama bersama yang dikeluarkan oleh Bank dengan pihak-pihak ketiga yang lain. Akaun Kad merujuk kepada akaun Kad Prabayar MasterCard /VISA Ahli Kad di mana semua Transaksi pada Kad dan semua yuran tahunan dan/atau apaapa yuran lain didebitkan. Ahli Kad bermakna mana-mana individu yang telah diberikan dan telah mendaftarkan Kad. Pengeluaran Tunai bermakna Transaksi menggunakan Kad untuk mengeluarkan tunai dari mana-mana ATM (dengan rangkaian CIRRUS/PLUS) atau di cawangan Bank yang harus tertakluk kepada had berikut dan Nilai Simpanan Kad yang sedia ada: Minimum Maksimum Setiap pengeluaran Minimum Maksimum Pengeluaran harian ATM RM10.00 RM5, Tertakluk kepada had pengeluaran ATM bank masing-masing Pengeluaran harian di kaunter cawangan Bank RM RM10, Barangan Pengguna bermakna barangan yang dibeli untuk tujuan kegunaan peribadi, domestik dan rumah tangga. Peniaga bermakna mana-mana pertubuhan yang menerima Kad daripada Ahli Kad untuk membayar pembelian Barangan Pengguna dan perkhidmatan oleh Ahli Kad. PIN bermakna Nombor Pengenalan Peribadi yang diberikan kepada Ahli Kad untuk digunakan dengan Kad. Penyata Dalam Talian bermakna penyata yang mengandungi sejarah Transaksi dan boleh dilihat oleh Ahli Kad dari Laman web Bank mengikut Klausa 12. Yuran Pek Permulaan bermakna yuran sekali Ringgit Malaysia Dua Puluh Lima (RM25.00). Bank boleh menaikkan yuran ini dari masa ke semasa. Penyata bermakna penyata yang mengandungi semua Transaksi yang diposkan ke Akaun Kad Ahli Kad. Nilai Simpanan bermakna baki di dalam Akaun Kad yang sedia ada untuk Transaksi. Matawang Nilai Simpanan bermakna matawang dalam Ringgit Malaysia. Penambahan bermakna penambahan nilai kewangan ke Akaun Kad. Transaksi bermakna semua transaksi yang didebitkan kepada Kad atau dibuat dengan menggunakan Kad termasuk pembelian Barangan Pengguna atau perkhidmatan atau Pengeluaran Tunai, transaksi ATM, terminal teler, pembelian melalui telefon atau kawalan (dalaman atau e-mel) dan pembayaran dikreditkan kepada Kad. 1.2 Syarat-syarat ini adalah tertakluk kepada undang-undang Malaysia. 1.3 Perkataan yang membawa maksud satu juga membawa maksud majmuk dan sebaliknya. 1.4 Perkataan yang membawa maksud jantina lelaki membawa maksud jantina perempuan dan tanpa jantina. 1.5 Perkataan yang membawa maksud seorang juga membawa maksud perkongsian, firma dan juga syarikat. 1.6 Tajuk syarat-syarat ini akan diabaikan dalam pentafsiran syarat-syarat. 2 PENERIMAAN TERMA-TERMA DAN SYARAT-SYARAT 2.1 Bank akan menyediakan kemudahan kad kepada Ahli Kad tertakluk kepada syarat-syarat ini setelah Ahli Kad berjaya mendaftarkan Kad. 2.2 Sebaik sahaja Ahli Kad menerima Kad, Ahli Kad mesti:- menandatangani di bahagian panel tandatangan Kad dengan serta merta; dan menghubungi Pusat Panggilan AmBank untuk pengaktifan Kad. Sebaik sahaja Kad diaktifkan, Ahli Kad telah bersetuju kepada terma-terma dan syarat-syarat yang telah ditetapkan. 2.3 Bank boleh menolak untuk mendaftarkan Kad mengikut budi bicara mutlaknya tanpa memberikan alasan. 2.4 Alasan-alasan untuk tidak mendaftar mungkin termasuk prosiding kebankrapan yang belum selesai terhadap Ahli Kad atau Ahli Kad adalah seorang bankrap yang belum dilepaskan. 3 PERSETUJUAN AHLI KAD 3.1 Ahli Kad bersetuju: (c) (d) (e) bahawa hanya Ahli Kad yang telah berjaya didaftarkan oleh Bank dibenarkan untuk menggunakan Kad; pada sepanjang masa menyimpan Kad dengan selamat dan terjamin dan mengekalkan kerahsiaan PIN; untuk memberitahu Bank secara bertulis dengan serta-merta sekiranya terdapat sebarang pertukaran kepada maklumat Ahli Kad yang telah dimaklumkan kepada Bank semasa pemohonan/pendaftaran kad. Ahli Kad juga hendaklah memberikan Bank apa-apa butiran atau maklumat lain yang Bank meminta dari masa ke semasa; untuk mematuhi segala syarat lain yang dikenakan oleh Bank untuk penggunaan Kad dari masa ke semasa; untuk menggunakan Kad ini untuk penggunaan peribadi sahaja untuk membeli Barangan Pengguna dan perkhidmatan dan tidak

7 3A (f) (g) (h) menggunakan Kad untuk sebarang penggunaan perniagaan atau aktiviti-aktiviti yang menyalahi undang-undang (contohnya perbankan, pertaruhan atau perjudian haram dalam talian); tidak menggunakan Kad melebihi enam (6) Transaksi pembelian setiap hari (atau bilangan lain yang Bank boleh berdasarkan budi bicaranya menentukan) dan memastikan setiap Transaksi pembelian tidak melebihi Ringgit Malaysia Dua Ribu (RM2,000.00); untuk memastikan Nilai Simpanan pada setiap masa tidak melebihi RM10,000 (atau jumlah lain yang boleh ditentukan oleh Bank berdasarkan budi bicaranya); dan untuk memastikan Transaksi yang menggunakan Kad dan wang atau dana yang digunakan untuk Penambahan/isi semula Kad tidak diperolehi sama ada dari sumber yang menyalahi undang-undang atau berkaitan dengan aktiviti-aktiviti yang menyalahi undang-undang seperti yang ditafsirkan di bawah Akta Pencegahan Pengubahan Wang Haram Dan Pencegahan Pembiayaan Keganasan 2001 ( AMLA ). AKTA PERKHIDMATAN KEWANGAN 2013 DAN AMLA 3A.1 Penggunaan Kad adalah tertakluk kepada Akta Perkhidmatan Kewangan 2013, AMLA dan semua peraturan dan arahan yang dibuat oleh Bank Negara Malaysia. Bank boleh menyekat Transaksi sekiranya Bank mempunyai dasar yang munasabah untuk mempercayai bahawa Transaksi menyalahi undangundang Malaysia atau negara lain dan Bank tidak akan menanggung liabiliti kepada Ahli Kad sekiranya Bank berbuat demikian. Ahli Kad melepaskan Bank daripada semua liabiliti dan bersetuju untuk mengecualikan Bank daripada apa-apa kehilangan atau kerugian yang dialami oleh Ahli Kad sebagai akibat daripada Bank menyekat transaksi tersebut. 3A.2 Ahli Kad mengetahui bahawa Bank harus bertindak serta-merta dengan informasi yang terhad sekiranya terdapat kesangsian dalam penipuan, pengubahan wang haram atau aktiviti lain yang menyalahi undang-undang. 4 PENAMATAN / PENARIKAN / PENGGANTUNGAN PENGGUNAAN KAD 4.1 Semua Kad adalah kepunyaan Bank dan Bank boleh berdasarkan budi bicara mutlaknya menamatkan dan menarik semula Kad atau menggantung penggunaannya atau sebaliknya menolak sebarang Transaksi yang akan dibuat pada Kad sekiranya Ahli Kad telah melanggar mana-mana syaratsyarat ini. 4.2 Ahli Kad hendaklah melepaskan Bank daripada segala liabiliti dan harus mengecualikan Bank dan tidak memegangnya untuk menanggung rugi segala tuntutan sama ada berpunca secara langsung atau tidak langsung daripada penamatan, penarikan semula, penggantungan atau keenggangan untuk melaksanakan apa-apa Transaksi kepada Kad termasuk apa-apa tuntutan untuk fitnah atau kerugian lain. 4.3 Tambahan kepada hak-hak Bank dalam Klausa 4.1 di atas, Bank boleh menamatkan Kad jika sama ada: a) Ahli Kad gagal membayar sebarang jumlah terhutang kepada Bank; atau b) Ahli Kad diisytiharkan bankrap atau tidak dapat membayar hutang, meninggal dunia atau sakit jiwa; atau c) sebarang harta Ahli Kad adalah tertakluk kepada levi pelaksanaan, saman tahanan atau halangan undang-undang lain; atau d) selepas pemeriksaan kredit, Bank memutuskan bahawa kedudukan Bank adalah berisiko (walaupun Akaun Ahli Kad masih berkuatkuasa); atau e) Ahli Kad menggunakan Kad melebihi Nilai Simpanan; atau f ) Ahli Kad telah gagal mematuhi mana-mana syarat ini; atau g) Ahli Kad tidak dapat dicari oleh Bank; atau h) Ahli Kad membuat atau cuba melakukan pengaturan penyelesaian dengan pemiutang; atau i) sekiranya Bank berpendapat bahawa Kad telah digunakan untuk sebarang tujuan perniagaan (iaitu digunakan oleh Ahli Kad untuk mendapat apa-apa keuntungan. Sebarang keputusan Bank berkaitan dengan perkara ini adalah muktamad dan tidak boleh dicabar). Apabila Kad ditamatkan dan/atau ditarik semula, Ahli Kad hendaklah menyelesaikan kepada Bank semua jumlah tertunggak yang terhutang di bawah Akaun Kad dengan serta-merta. 4.4 Ahli Kad boleh membatalkan Kad dengan mengembalikan Kad yang telah dipotong dua kepada Bank. Bank boleh membatalkan Kad pada bila-bila masa berdasarkan budi bicaranya dengan memberikan notis terdahulu dan tanpa memberikan Ahli Kad apa-apa sebab. Setelah pembatalan Kad oleh Bank, obligasi Ahli Kad untuk membayar Bank semua wang yang terhutang kekal. 4.5 Apabila Kad dibatalkan:- semua wang yang dihutang di bawah Akaun Kad akan perlu dibayar dengan serta merta dan Ahli Kad harus atas permintaan Bank membayar wang tersebut sepenuhnya, sekiranya gagal Bank boleh mengambil apa-apa tindakan yang dianggap perlu untuk menuntut yang sama; dan sekiranya terdapat sebarang baki kredit dalam Akaun Kad, Ahli Kad boleh menebus kembali Nilai Simpanan mengikut cara yang ditetapkan di bawah Klausa 16A. 5 LIABILITI AHLI KAD / KAD HILANG ATAU DICURI 5.1 Ahli Kad mesti mengambil semua langkah berjaga-jaga yang munasabah untuk mengelakkan kehilangan atau kecurian Kad. Sekiranya Kad hilang atau dicuri atau orang yang tidak diberi kuasa mengetahui PIN, Ahli Kad harus apabila mengetahuinya memaklumkan kepada Pusat Kad AmBank dengan serta-merta melalui telefon (dengan pengesahan bertulis dalam jangkamasa yang munasabah selepas itu), supaya kerugian kepada Ahli Kad dapat dikurangkan. Ahli Kad mesti membuat laporan polis untuk Kad hilang/dicuri/pendedahan PIN kepada sesiapa yang tidak diberi kuasa dan memberikan sesalinan laporan polis tersebut kepada Pusat Kad AmBank. Bank akan mentaksahkan Kad setelah Bank menerima pemberitahuan daripada Ahli Kad. 5.2 Ahli Kad hendaklah bertanggungjawab terhadap semua Transaksi yang dilakukan akibat daripada penggunaan Kad yang tidak diberi kuasa sehingga Kad dilaporkan hilang/dicuri. Bank tidak akan dalam apa-apa keadaan bertanggungjawab kepada Ahli Kad atau membayar balik atau memulangkan kepada Ahli Kad apa-apa wang yang hilang dari Kad disebabkan Ahli Kad menghilangkan Kad dia atau disebabkan kecurian Kad. 5.3 Sekiranya Kad dilaporkan hilang dan seterusnya ditemui, Ahli Kad harus memulangkan Kad dengan serta-merta dengan Kad dipotong dua kepada Bank. Bank tidak akan mengeluarkan Kad gantian berikutan dengan kehilangan atau kecurian Kad atau pendedahan PIN kepada sesiapa yang tidak diberi kuasa. 6 PENOLAKAN LIABILITI OLEH BANK 6.1 Bank tidak akan bertanggungjawab jika mana-mana Peniaga enggan menerima Kad atau jika terdapat sebarang kecacatan atau kekurangan dalam Barangan Pengguna atau perkhidmatan yang disediakan oleh Peniaga. Ahli Kad mesti menyelesaikan semua aduan dan pertikaian dengan Peniaga secara terus. Ahli Kad berjanji dan mengesahkan untuk tidak melibatkan Bank dalam apa-apa prosiding undang-undang terhadap Peniaga. Bank tidak akan bertanggungjawab kepada Ahli Kad dalam membuat bayaran kepada Peniaga walaupun Ahli Kad mempunyai tuntutan dan/atau pertikaian terhadap Peniaga. Sekiranya Ahli Kad mempertikaikan apa-apa Transaksi, Transaksi yang dipertikaikan hanya boleh dibayar balik setelah Bank menyiasatkan kes itu dengan sepenuhnya dan memutuskan bahawa Ahli Kad tidak perlu bertanggungjawab untuk Transaksi yang dipertikaikan. Apa-apa wang yang akan dibayar balik akan dikreditkan ke Akaun Kad. 6.2 Ahli Kad harus membebaskan Bank dari semua liabiliti sekiranya Kad tidak diterima oleh Peniaga.

8 6.3 Bank menolak semua liabiliti dan Ahli Kad membebaskan Bank daripada semua liabiliti di mana Bank gagal mematuhi mana-mana syarat ini walaupun kegagalan tersebut disebabkan oleh atau dalam kawalan Bank. 7 TERMA-TERMA PEMBAYARAN 7.1 Masa adalah penting berhubung dengan tanggungjawab pembayaran Ahli Kad. 7.2 Walau apa pun yang dinyatakan dalam syarat-syarat ini, Ahli Kad harus dengan serta-merta membayar sepenuhnya semua amaun yang terhutang kepada Bank dalam salah satu perkara berikut: Sekiranya Kad atau penggunaannya ditarik balik; atau Penamatan penggunaan Kad atas sebarang sebab. Ahli Kad tidak mempunyai hak untuk menahan pembayaran sebarang wang terhutang kepada Bank dalam apa-apa keadaan sekalipun. 8 PENGELUARAN WANG TUNAI 8.1 Sekiranya terdapat wang yang mencukupi di dalam Akaun Kad, Ahli Kad boleh mendapatkan tunai daripada mana-mana pemegang lesen MasterCard International Incorporated/VISA melalui penggunaan Kad di lokasi tertentu dan/atau ATM di dalam atau di luar Malaysia. 8.2 Pengeluaran wang tunai oleh Ahli Kad akan didebitkan ke dalam Akaun Kad. 9 CAJ & MATAWANG ASING 9.1 Semua Transaksi Kad akan dimasukkan ke dalam Matawang Nilai Simpanan. 9.2 Sebarang Transaksi yang dibuat dalam mata wang lain akan ditukar kepada Matawang Nilai Simpanan mengikut kadar pertukaran yang ditentukan oleh MasterCard atau VISA, mengikut mana yang berkenaan, pada tarikh Transaksi diposkan ke dalam Akaun Kad. 10 KREDIT DARIPADA PENIAGA 10.1 Bank boleh kreditkan pembayaran balik daripada Peniaga kepada Ahli Kad sebagai Nilai Simpanan ke dalam Kad sekiranya Bank menerima kredit daripada Peniaga atau bank Peniaga yang boleh diterima oleh Bank Sekiranya ada, atas permintaan Ahli Kad, Bank akan memberikan salinan slip kredit kepada Ahli Kad atas kos Ahli Kad. 10A PENAMBAHAN / NILAI SIMPANAN MAKSIMA / BAKI DEBIT 10A.1 Ahli Kad boleh menambah dan membayar wang ke dalam Akaun Kad seperti berikut atau dalam cara-cara lain yang mana Bank benarkan:- (c) (d) mendepositkan tunai atau cek di mana-mana cawangan Bank melalui kaunter atau menggunakan mesin deposit tunai / cek Bank; pemindahan dana dari mana-mana akaun lain Ahli Kad dengan Bank dalam apa-apa cara yang dibenarkan oleh Bank; pemindahan wang antara bank (GIRO) dari akaun lain Ahli Kad dengan bank lain; atau membuat bayaran di cawangan-cawangan AmG Insurance Berhad atau mana-mana cawangan epay memiliki logo NexG Recharge yang mengambil bahagian. 10A.2 Penambahan oleh Ahli Kad adalah tidak efektif sehingga nilai sebenar Penambahan tersebut telah diterima oleh Bank. Penambahan melalui cek bukan tempatan hendaklah termasuk komisyen bank yang berkenaan, kalau tidak, Bank boleh mendebitkan Akaun Kad Ahli Kad untuk komisyen tersebut. 10A.3 Nilai Simpanan maksimum di mana Ahli Kad boleh kreditkan ke dalam Kad adalah RM10, atau apa-apa amaun lain yang Bank benarkan. Sekiranya disebabkan oleh apa-apa kesilapan, sistem Bank membenarkan Nilai Simpanan Ahli Kad melebihi had yang dibenarkan, Bank akan memaklumkan kepada Ahli Kad dan meminta Ahli Kad untuk menggunakan dengan sepenuhnya jumlah melebihi had tersebut atau menebus jumlah melebihi had tersebut mengikut cara di bawah Klausa 16A dalam tempoh 14 hari dari tarikh notifikasi Bank. 10A.4 Sekiranya terdapat apa-apa kesilapan dalam baki debit Kad, Ahli Kad hendaklah membayar balik amaun ini kepada Bank dalam tempoh 14 hari dari permintaan Bank untuk pembayaran balik. Pembayaran balik tersebut boleh dibuat oleh Ahli Kad melalui Penambahan. Apa-apa jumlah untuk Penambahan yang melebihi baki debit akan diambil kira sebagai Nilai Simpanan. 11 YURAN PERKHIDMATAN, KOS & CAJ 11.1 Sebagai balasan untuk perkhidmatan yang diberikan, Ahli Kad akan membayar Bank:- (c) (d) (e) Yuran Transaksi Pembelian sebanyak Ringgit Malaysia Satu (RM1.00) untuk setiap Transaksi yang merupakan pembelian runcit dengan mana-mana Peniaga di luar Malaysia melalui penggunaan Kad; caj perkhidmatan 2% daripada jumlah yang dikeluarkan atau Ringgit Malaysia Sepuluh (RM10.00), yang mana lebih tinggi, untuk setiap Pengeluaran Tunai dari ATM bukan AmBank; kos pentadbiran sebanyak 1% daripada Matawang Nilai Simpanan yang dikenakan (apabila ditukarkan) untuk Transaksi di dalam mata wang asing; Yuran Penambahan Ringgit Malaysia Dua (RM2.00) atau apa-apa jumlah lain yang boleh ditentukan oleh Bank dari masa ke semasa bagi setiap Penambahan yang dibuat oleh Ahli Kad di kaunter di manamana cawangan Bank; yuran perkhidmatan akaun sebanyak Ringgit Malaysia Tiga (RM3.00) setiap bulan untuk penggunaan Kad, di mana yuran ini dikenakan apabila pendaftaran; (f ) yuran perkhidmatan sebanyak Ringgit Malaysia Lima (RM5.00) bagi satu dan setiap salinan Penyata yang diminta oleh Ahli Kad; (g) (h) (i) yuran perkhidmatan sebanyak Ringgit Malaysia Dua Puluh (RM20.00) bagi satu dan setiap salinan deraf jualan yang diminta oleh Ahli Kad jika Bank mempunyai deraf jualan tersebut; Yuran mengembali kredit sebanyak RM2 akan dikenakan untuk setiap pengembalian nilai yang tidak digunakan. segala kos dan perbelanjaan (termasuk yuran guaman Bank atas dasar peguamcara dan anak guaman) yang ditanggung oleh Bank untuk menjaga dan/atau melaksanakan apa-apa hak Bank Semua yuran, kos dan perbelanjaan dan/atau caj terhutang oleh Ahli Kad akan ditunjukkan di dalam Penyata dan didebitkan dari Nilai Simpanan. Semua yuran, kos atau caj yang dicajkan kepada dan dibayar oleh Ahli Kad tidak akan dibayar balik di dalam apa jua keadaan Yuran dan caj mungkin ditukar oleh Bank pada bila-bila masa dan dari masa ke semasa di atas budi bicara mutlak Bank dan perubahan ini akan diposkan ke Laman web Bank. Bank akan memberi Ahli Kad sekurang-kurangnya dua puluh satu (21) hari notis terdahulu sebelum tarikh perubahan tersebut berkuatkuasa. Ahli Kad perlu mengambil perhatian terhadap yuran atau caj terkini yang dikenakan oleh Bank di Laman web Bank. 12 PENYEMAKAN KANDUNGAN PENYATA 12.1 Ahli Kad boleh menyemak Penyata Dalam Taliannya yang mengandungi informasi berkenaan Nilai Simpanan atau sejarah Transaksi dari Laman web Bank dengan memasuki akaun AmOnline dengan nama pengguna dan kata laluan Ahli Kad.
