2 TOWNSHIP OF SEVERN TENDER FOR THE SUPPLY OF LOW SULPHUR (CLEAR) DIESEL FUELS Sealed Tenders, in an envelope clearly labelled DIESEL FUELS, on forms supplied by the Township of Severn will be received by the undersigned at the Township Office until: 10:00 A.M. 3 3 TENDERING REQUIREMENTS BIDDER S RESPONSIBILITY A bidder who has already submitted a bid may submit a further bid at any time up to the official closing time. The last bid received will supersede and invalidate all bids previously received from that bidder. A bidder may withdraw a submitted bid at any time up to the official closing time by letter bearing their signature. Any tender received after the deadline shall be initialed, dated and time stamped. It shall be returned immediately or as soon as possible thereafter to the representative of the firm advising that the tender was received after the deadline. The tender shall not be opened. Bids may be rejected for any of the following reasons: Bids received after the specified closing date and time as specified in the bid document. No exceptions. Bid does not comply with the requirements at time of closing as specified in the bid document. No exceptions. Bids are incomplete, conditional or obscure, or which contain additions not called for, erasures, alterations or irregularities of any kind. Does not meet specification requirements. INSURANCE The standard insurance minimums are as follows: $ 5 million general liability and automobile liability policies, for contract work done for most Public Works and Environmental Services Department project Bid documents must clearly indicate insurance requirements to be provided by the successful bidder. The successful bidder must furnish the Township at their cost a certified copy of a liability insurance policy covering public liability and property damage for no less than the minimum amounts stated (above) to the satisfaction of the Township and in force for the entire contract period.

4 The policy must contain: a Cross Liability clause or endorsement; an endorsement certifying that the Corporation of the Township of Severn and successful bidder are included as an additional insured; an endorsement to the effect that the policy or policies will not be altered cancelled or allowed to lapse without thirty days prior written notice to the Township of Severn. W.S.I.B. CERTIFICATE The Contractor must maintain coverage with the Workplace Safety and Insurance Board throughout the term of this contract and shall provide the Township of Severn with a Certificate of Clearance from the Workplace Safety and Insurance Board prior to performing any work. HEALTH AND SAFETY POLICY The Contractor shall certify to the Township the establishment and maintenance of a health and safety program, with objectives and standards consistent with applicable legislation and this Corporation's Health and Safety Policy and requirements. The Contractor shall include health and safety provisions in their management system to reach and maintain a consistently high level of health and safety. The Contractor shall ensure the workers in their employ are aware of the hazardous substances that may be in use at the workplace and wear the appropriate personal protective equipment required for the area. The successful bidder will be required to enter into a Contractor Health & Safety Responsibility Agreement with the Township of Severn. FUEL AND SALES TAX The Contractor shall pay all taxes under existing legislation on all fuels and materials used by him in the performance of the contract. The Contractor undertakes not to make any claim for refund of taxes paid by him or any Subcontractor and acknowledges that no refund of tax shall be granted to him or any Subcontractor on any fuel and materials used for any purpose whatsoever in the performance of the contract unless such a refund is specifically authorized under existing legislation. 4

5 5 TAXES Any applicable taxes including HST shall be shown in the appropriate specified space for bidding purposes. SPECIFICATIONS 1. DELIVERY: Deliveries will be made on an as required basis as determined by the Township and fuel shall be delivered within 24 hours of call, between the hours of 8:00 a.m. to 3:30 p.m., Monday through Friday. All fuel delivered shall meet Ontario Government specifications. 2. ENVIRONMENTAL PROTECTION ACT: The successful tenderer agrees that it shall become the owner of the diesel fuels to the point of delivery (Township of Severn Public Works Operations at 4251 Burnside Line (South Yard) and 2068 North River Drive (North Yard) and shall have full liability pursuant to Part IX of the Environmental Protection Act. 3. TYPE OF FUEL: a) Low Sulphur (Clear) Diesel Fuel 4. SPILLS: The Vendor shall be responsible for any spills during delivery of fuel and a contingency plan shall be forwarded to the Township for review. 5. DELIVERY TO TANKS: Fuel shall be metered into Township owned tanks which have 10,000 gallon capacity (low sulphur clear diesel) South Division and (2) two 1,000 gallon (low sulphur clear North Division. 6. LOCATION: Delivery to Public Works Operations at 4251 Burnside Line (South Yard) and 2068 North River Drive (North Yard). 7. COMPLETION OF CONTRACT: Upon completion of this contract the fuel tanks shall be topped up by the supplier.

6 Specifications listed below are the Ontario Provincial Standard Specifications (OPSS) current at the time of tendering. TENDER FOR THE SUPPLY OF LOW SULPHUR (CLEAR) DIESEL FUELS ESTIMATED QUANTITIES: LOW SULPHUR (CLEAR) DIESEL 125,000 LITRES Payment will be made on actual quantities supplied. No extra compensation will be allowed as a result of a reduction of contract work from that shown in the quantities identified herein. ITEM NO. DESCRIPTION UNIT UNIT PRICE All taxes included 1. Low Sulphur (Clear) Diesel litres $ /litre NOTE: It is agreed that the tender quantities are estimated only and may be increased or decreased by the Municipality without alteration of the contract price, however such increase or decrease shall not exceed 25 percent. In the event of any discrepancy between the unit price and the extensions, the unit prices shall govern. 6
