1 Information to Bidders Stockey Centre Building Remediation 0. General Information The Town of Parry Sound (The Town) is seeking Bids from experienced contractors for repairs at The Charles W. Stockey Centre for the Performing Arts and the Bobby Orr Hall of Fame as per attached tender documents. Also attached, is Building Assessment Report #1, which could be used as a reference to assist bidders in getting familiar with site conditions. The Charles W. Stockey Centre for the Performing Arts and the Bobby Orr Hall of Fame is a multi-storey community complex in Parry Sound, Ontario. The building was constructed in 2000 and is managed by The Town. In the fall of 2003, the building envelope started to allow water infiltration into the building. This resulted in cosmetic damages to the interior finishes in addition to disruption in the operation of the kitchen and in both facilities due to the water leakage issues. For the full scope of the work, refer to: 1) The Stockey Centre Remediation - The Scope of Work document 2) Project Manual Volume 1: Specifications Division 01 to 09 3) Drawings A100, A101, A400, A401 4) Sketches and Details SK-1 to SK-5 The scope of work, drawings, Sketches and details, and specifications for the required repairs are shown. The contract is split into a base contract items, and additional separate items. Statement D form, is to be completed indicating the fee for the base items and separate cost items. Depending on the available funds the town will choose the items to be included in the contract. The contractor will be responsible to apply for the building permit and to include an allowance, at cost, to cover the building permit fees. In order to assist bidders to obtain a clear understanding of this RFT, the Town will conduct a non-mandatory site visit on August 16th at 10:00AM, at the Stocky Centre 1
2 located at 2 Bay Street, Parry Sound, ON. It is highly recommended that interested general contractors and trades attend the site visit. 1. Delivery and opening of proposals Tenders, sealed in an envelope shall be clearly marked The Stockey Centre Building Remediation" and will be received at the Municipal Office, 52 Seguin Street, Parry Sound, ON P2A 1B4, in person, by mail or by courier, up to and including August 24th, 2017 at 2:00pm. The use of the mail or courier for delivery of the proposal will be at the risk of the bidder. Please submit three (3) copies. 2. Disqualification of proposals Under no circumstances will tenders be considered which: are received after August 24th, 2017 at 2:00pm local time on the advertised closing date; are received by or fax. 3. Withdrawl or qualifying of proposals A bidder who has already submitted a proposal may submit further proposals at any time up to the official closing time. The last proposal received shall supersede and invalidate all proposals previously submitted by that bidder for this contract. A bidder may withdraw the proposal at any time up to the official closing time by submitting a letter bearing his/her signature and seal to the Town of Parry Sound, 52 Seguin St., Parry Sound, Ontario P2A 1B4. Such a submission must be received in sufficient time to be marked before 2:00 p.m. on the date for closing. Submit Supplementary Bid Information within 48 hours after closing time for receiving Bid Forms. The bidder shall show his/her name and the name of the proposal on the envelope containing such letter. No s, faxes or telephone calls will be considered. 4. Informal proposals All submissions shall be made in ink, by typewriter or by printer. Un-initialed entries or changes made in pencil shall be deemed invalid. Proposals which are incomplete, illegible or obscure, or that contain additions not called for, erasures, alterations (unless properly and clearly made and initialed by the bidder s signing officer), or irregularities of any kind, may be rejected. The Town reserves the right to waive formalities at its discretion. Bidders who have submitted proposals that have been rejected by the Town because of informalities will be notified of the reasons for the rejection within ten (10) days after the closing date for proposals. 2
3 5. Supervision General review for work done under this contract will be done by AECOM. 6. Omissions, discrepancies and interpretations Should a bidder find omissions and/or discrepancies in any of the tender documents or should he/she be in doubt as to the meaning of any part of such documents, he/she should notify The Corporation of the Town of Parry Sound not later than eight days before the closing date for proposals. If the Town considers that a correction, explanation or interpretation is necessary or desirable, an addendum will be issued to all who have taken out tender documents. No oral examination or interpretation shall modify any of the requirements or provisions of the proposal documents. 7. Right to accept or reject tenders The Corporation of the Town of Parry Sound shall not be responsible for any liabilities, costs/expenses, loss or damages incurred, sustained or suffered by any bidder prior or subsequent to or by reason of the acceptance or the non-acceptance by the Town of any tender or by reason of any delay in the acceptance of a contract being prepared and executed. The Town reserves the right to reject any or all tenders and to waive formalities, as the interests of the Town may require, without stating the reasons and the lowest or any tender will not necessarily be accepted. 8.Tender deposit Not Required 9. Proof of ability and sub-contractors In order to aid the Town in determining the responsibility of each bidder, the bidder shall complete the following statement sheets which are attached herein: Statement A stating the bidder s experience in similar work which the contractor has successfully completed. Statement B stating the work and equipment the contractor proposes to use to perform the work. Statement "C" listing proposed sub-contractors. 3
4 Statement "D" Proposed price schedule. The bidder or the contractor shall not be allowed to substitute sub-contractors in place of those named in the proposal without written approval from the owner. 10. Workplace Safety Insurance Board (WSIB) The contractor shall provide Certificate of WSIB e-clearance stating that all assessments or compensation payable to the W.S.I.B. have been paid. 11. Occupational Health and Safety For the purposes of the Occupational Health and Safety Act, the successful bidder is considered to be the constructor as defined in the Act. It is specifically drawn to the attention of the bidder that the Occupational Health and Safety Act provide, in addition to other things: THAT the measures and procedures prescribed by this Act and the regulations are carried out on the project; THAT every employer and every worker performing work on the project complies with this Act and regulations; and THAT the health and safety of workers on the project is protected. 12. Accessibility for Ontarians with Disabilities Act (AODA) The successful bidder must sign a declaration stating that all staff involved in this project have received AODA training as outlined on "Schedule A", attached. 13. Harmonized sales tax (HST) The tender shall include HST if applicable. 14. Inquiries Bidders are advised that inquiries regarding the interpretation of the tender shall be directed to the Corporation of the Town of Parry Sound. 16. Insurance 4
5 General liability insurance in the amount of at least $5,000, coverage for any one claim must be carried by the contractor. In addition, the Corporation of the Town of Parry Sound and AECOM Canada Ltd. shall be named as an additional insured party. Both owned and non-owned vehicles employed under this contract will require a minimum of $5,000, coverage in any one claim, showing the Town as one of the insured parties. The bidder to whom this contract is awarded shall supply the Town with proof of insurance and a copy of the policy prior to the signing by Town officials and provide coverage throughout the term of the contract in the amounts specified. 17. Hold harmless The contractor shall be responsible for any and all damages, or claims for damages or injuries or accidents done or caused by him or his employees or resulting from the prosecution of the works, or any of his operations, caused by reason of the existence or location or condition of works, or of any materials, plant, or machinery used thereon or therein or which may happen by reason thereof or arising from any failure neglect or omission on his part, or on the part of any of his employees to do or perform any or all of the several acts or things required to be done by him or them under and by these condition and covenants and agrees to hold the Corporation of the Town of Parry Sound harmless and indemnified for all such damages and claims for damage. 18. Additional Work All unforeseen and or additional work to be performed by the contractor must be approved by the Corporation of the Town of Parry Sound prior to the commencement of the work 5
