Answer each question. If questions are not applicable, put N/A in the appropriate space. Attach a copy of your Arizona Transaction Privilege (Sales) Tax (TPT) License, if your type of business is required to collect and remit sales tax. If the City of Maricopa is not included as a Program City on your current TPT License, you must contact the Arizona Department of Revenue at (602) The business license will not be issued until the Applicant has updated their TPT License with the State. Contractors must submit a copy of their Arizona State Registrar of Contractor s License. If you are a corporation or limited liability company, please provide a copy of your Certificate of Good Standing and a copy of your Federal Employer Identification Number. If registered trade name, please submit a copy of your Certificate of Trade Name. If liquor is involved, you must apply with the Arizona Department of Liquor Licenses and Control. The fee for your business license will be an additional $ per year. The owner shall inform the City of Maricopa of any changes in his/her business activities or uses thirty (30) days prior to such change. If the business becomes inactive, you are responsible to notify the City in writing that you are no longer conducting business in the City. Attach a copy of the Pinal County Health Card if you are selling edible foodstuffs. The business license must be on display in the licensee s place of business. A license must be issued before you can lawfully engage in business in Maricopa. Issuance of a Business License by the City of Maricopa shall in no way be construed as permission to operate a business activity in violation of any other law or regulation to which such activity may be subject. All Commercial Business License Applications must have a Certificate of Occupancy from City of Maricopa Building Safety. All Commercial & Home-Based Business License applicants must contact the Fire Marshal to schedule a fire inspection (520) Fees will be assessed with all inspections. All new signs require a permit from the Planning & Zoning Department (520) ATTENTION APPLICANT: Issuance of a business license by the City of Maricopa does not permit full occupancy of the proposed location. The applicant is required to contact building safety for necessary permits/inspections. City of Maricopa Business License Fee Schedule: The annual Business License Transaction Fee is $ The fee is prorated to ½ a year. 2 REGULATORY BILL OF RIGHTS This past legislative session (Fiftieth Legislature, First Regular Session), the Arizona Legislature passed Senate Bill This Regulatory Bill of Rights went into effect on July 20, 2011 (with full implementation on December 31, 2012). The rights afforded private regulated parties under the new law are provided below. A.R.S : REGULATORY BILL OF RIGHTS TO ENSURE FAIR AND OPEN REGULATION BY CITIES, A PERSON: Is eligible for reimbursement of fees and other expenses if the person prevails by adjudication on the merits against a city in a court proceeding regarding a city decision as provided in A.R.S Is entitled to receive information and notice regarding inspections as provided in A.R.S (effective June 30, 2012). Is entitled to have a city not base a licensing decision in whole or in part on licensing conditions or requirements that are not specifically authorized as provided in A.R.S May have a city approve or deny the person s license application within a predetermined period of time as provided in A.R.S (effective December 31, 2012). Is entitled to receive written or electronic notice from a city on denial of a license application (effective December 31, 2012). o That justifies the denial with references to the statute, ordinance, regulation, Delegation Agreement or authorized substantive policy statement on which the denial is based as provided in A.R.S o That explains the applicants right to appeal the denial as provided in A.R.S Is entitled to receive information regarding the license application process at the time the person obtains an application for a license as provided in A.R.S May inspect all ordinances, regulations, and substantive policy statements of a city, including a directory of documents, at the offices of the city as provided in A.R.S Unless specifically authorized, may expect cities to avoid duplication of other laws that do not enhance regulatory clarity and to avoid dual permitting to the maximum extent practicable as provided in A.R.S May file a complaint with the City Council concerning an ordinance regulation or substantive policy statement that fails to comply with A.R.S

6 Full Name (Last, First, Middle): Individuals and Sole Proprietors Only REQUIRED SUPPLEMENTAL INFORMATION Licensing Eligibility Requirement (A.R.S ) Business Address (as shown on license or application): City: State: Zip Code: On May 1, 2008, Governor Napolitano signed Laws 2008, Ch. 152 (House Bill 2745) into law. The new law contains a licensing eligibility section (A.R.S ) preventing a state/city agency from issuing a (new or renewed) license to an individual unless the individual has provided the agency with one of the forms of identification listed in the law. To become or remain eligible for a license, complete this form, staple or photocopy showing both sides of your identification to the back, and return with your City of Maricopa Business License Application. Failure to complete and submit this form (and attached form of identification) to the cited address and/or the falsification of any information provided herein shall subject applicant to denial, cancellation, or revocation of the business license. Only provide one of the following forms of identification (check the box next to the one you are submitting): 1. An AZ driver s license issued after 1996 or an AZ non-operating identification license. 2. A driver s license issued by a state that verifies lawful presence in the U.S. (licenses from HI, IL, ME, MD, NM, TX, UT and WA are not acceptable). 3. A birth certificate or delayed birth certificate issued in any state, territory or possession of the U.S. 4. A U.S. certificate of birth abroad. 5. A U.S. passport. 6. A foreign passport with a U.S. visa. 7. An I-94 form with a photograph. 8. A U.S. citizenship and immigration services employment authorization document or refugee travel document. 9. 8 PERMIT & LICENSE APPLICATION PROCESS 1. Customer receives Application, Bill of Rights, Business License Review Timeframe and checklists online or at City Hall. 2. Customer submits completed Application and fees to Front Counter Representative. 3. Front Counter Representative reviews for initial completeness prior to receiving, then submits to reviewing staff for Administrative Review. 4. (a) City accepts Application and provides Substantive Review (b) within overall time frame; or City rejects incomplete Application within Administrative Review time frame, and provides notice of deficiencies to Applicant. 5. (a) City approves Application and issues electronic or written approval to Applicant; or (b) City denies Application or mutually agrees to subsequent resubmittal(s). All subsequent reviews occur within 25% of the overall time frame. 6. City issues a written or electronic notice granting or denying a license to Applicant. If denied, written notice shall include justifications for denial with specific references and an explanation of Applicant s right to appeal the denial, including deadline to submit protest and contact information for questions on appeal process. BUSINESS LICENSE REVIEW TIMEFRAME Pursuant to A.R.S , the City of Maricopa (the City ) establishes overall permitting timeframes during which the City will either grant or deny each type of permit (license) that it issues. The timeframe includes an administrative completeness review period to accept or reject the application, and a substantive review period to provide a technical review of the request. The City shall approve or deny the request within the overall time frame listed below; however, should the City extend the review period for additional submittal(s), said extensions shall not exceed 25% of the overall timeframe. Please note: These are projected timeframes only and may change due to workload and staffing considerations: Application Type Administrative Completeness Substantive Review Total Timeframe Review Business License: 10 days 35 days 45 days Solicitor/Peddler Business License: 10 days 35 days 45 days Out-of-Town Business License: 10 days 35 days 45 days Home Based Business License: Commercial 10 days 35 days 45 days *The City may request the applicant submit additional information or make corrections to the application, in lieu of denying the request. In this event, the substantive review timeframe and the overall timeframe are suspended from the date the request is issued until the date that the municipality receives the additional information from the applicant.
9 TENANT CHANGE, CERTIFICATE OF OCCUPANCY REQUIREMENTS Note: Development Services general , I AM A NEW TENANT THAT IS NOT DOING ANY BUILDING, ELECTRICAL, PLUMBING, MECHANICAL OR STRUCTURAL WORK, WHAT DO I NEED TO OPEN FOR BUSINESS? Apply for a City of Maricopa Business License. You have or plan to move into a new place of business where the previous tenant was the same occupancy classification and have not made any changes requiring a tenant improvement permit. Here is what you need: 1. A sketch of your floor plan, include the following on the plan. a. ADA/Handicap accessible counter : i high ii. 36 long iii. 12 wide b. A water cooler. c. A Fire extinguisher. The process can be completed at the Development Services counter located at City Hall. There is a one-time $110 fee which includes a $60 Building Department permit and a $50 Fire Department permit for your place of business. Permit fees cover the inspection costs. Once you obtain a Building permit and Fire permit you will need to set up your place of business as if you are ready to open for business. Once this is complete you will need to schedule a Fire and Building inspection. Once all departments have electronically approved the Business License the Finance department will mail out the Business License.
