Coffee break Effective interim measures in the MENA: arbitrator, emergency arbitrator or judge? Requests for interim measures in cases are playing an increasingly important role both before the commencement and during the arbitration. This session will provide a comparative approach to the use and enforceability of preliminary measures Lunch AFTERNOON ( ) Roundtable on the impact of the place of arbitration Panelists of this session will discuss the impact of the place of arbitration as to various issues such as: (a) how anti-suit injunctions are dealt with, (b) do State court proceedings prevent arbitrators to conduct the arbitral process, (c) how are the public policy rules respected and (d) what impact a bankruptcy proceeding would have on an arbitration procedure. Most countries in the MENA expressly allow for the use of arbitration in the oil and gas sector. In this session, current issues and potential pitfalls in arbitrating energy disputes with MENA parties will be discussed by international and local practitioners. The panel will also examine the involvement of State parties, the benefits and risks of the arbitral process and the enforcement of awards in oil and gas arbitrations. Coffee break Interactive session on ethics in international arbitration: how to protect the integrity of the arbitral proceeding? This session will feature the different point of views as to the current debate on the need for increased rulemaking to protect arbitral proceedings and the role of different players in the process Lunch AFTERNOON ( ) Evaluation and calculation of damages in construction disputes: theory and practice The damages phase is one of the most technically demanding stages of the arbitration process. This panel will address the different perspectives from the point of view counsel, quantum expert and arbitrator. The discussion will focus on issues such as the legal standards for evaluating complex damages claims, the different approaches for their calculation and the use of evidence in assessing damages. 4 ADVANCED LEVEL TRAINING: DRAFTING ENFORCEABLE AWARDS Monday 10 March 2014 MORNING ( ) Welcoming address and introduction Drafting an arbitral award: which drafting style? Participants will receive first-hand guidelines and knowledge on best practices pertaining to award legal drafting styles. How legal systems and traditions can influence drafting techniques, the different approaches in civil and common law; How to improve the quality of the award, by getting away from the copy and paste drafting style, to properly reflect the reasons behind the arbitral decision, identifying how much reasoning is necessary to render a fully convincing award and secure its enforceability. Drafting an arbitral award: spotlight on specific issues This session will focus on particular sections of the award which often present difficulties and challenges in particular: Jurisdiction and applicable law; Damages; and Auxiliary remedies: interest and costs Lunch AFTERNOON ( ) Introduction to scrutiny of the award by the ICC International Court of Arbitration (ICC Court) Participants will gain a deeper insight into a distinctive feature of ICC arbitration, the ICC Court s scrutiny of all draft awards. ICC representatives will share their expertise on the ICC Court scrutiny process, the different levels of review, the assistance and tools provided by the Secretariat of the Court, such as the ICC Award Checklist, to help arbitral tribunals, although respecting their liberty of decision, draft more legally effective awards. Working groups: draft awards review before scrutiny by the ICC Court Participants will be given the opportunity to study a draft award, in the conditions in which a draft award would be reviewed before scrutiny by the ICC Court. Each working group will be responsible for reviewing the draft award and will make its comments as if it were a Counsel of the Secretariat of the ICC Court. Mock Court session: scrutiny of awards by the ICC Court and debate This is an opportunity for participants to witness the type of discussions that are held between members of the ICC Court and representatives of the Secretariat when reviewing a draft award. The parties to this mock court session will debate on the draft award reviewed by the working groups.
