1 April 12, 1989 TO: MEMBERS OF NEII DOING BUSINESS IN THE JURISDICTION OF IUEC LOCAL NO. 31 Subject: Expense Agreement - Houston, TX Gentlemen: The following is a modification revising the mileage agreement for IUEC Local No. 31, Houston, TX. USE OF PERSONAL VEHICLES An employee who is authorized to use his own vehicle for the employer's business shall be compensated at the rate of twentyfive (25 ) cents per mile. It is agreed that for each four (4 ) cents per gallon increase in gas cost the mileage allowance will be increased by one-half (1/2) cent. Recognizing that the gas cost may be reduced it is also agreed that if the cost per gallon is lowered by four (4 ) cents, a decrease at the rate of one-half (1/2) cent will be put into effect. However, these adjustments will not be made more often than every three months. The base average cost of full service regular unleaded gasoline from four stations listed below on March 13, 1989 was cents per gallon. This base shall be used to determine future increases or decreases in Local 31's mileage rate. When the price of gasoline indicates a change in Local 31's mileage rate, the Business Manager and the designated representative of NEII shall visit the following four (4) service stations and check current prices: 1. Exxon, Richmond and Kirby. 2. Gulf, Buffalo Speedway and Southwest Freeway. 3. Texaco, Kirby and Southwest Freeway. 4. Shall, Westheimer and Kirby. Should any or all of the above service stations cease to adequately serve this agreement, the Business Manager and the designated representative of NEII shall meet and mutually agree upon alternate station or stations. Should the employee be authorized to use other means of transportation, he shall be paid the necessary time involved plus all the transportation charges. The employers shall pay the cost for necessary parking on contract service work after the first stop
2 when the employee's vehicle is used on company business. Minimum mileage per move shall be four (4) miles. When the mechanics and helpers are authorized to transport or convey any heavy material, parts, or tools (other than hand tools), they shall be paid drayage or cartage. Amount of drayage or cartage to be reasonable according to weight and distance. June 28, 1979 TO: MEMBERS OF NEII DOING BUSINESS IN HOUSTON, TX Subject: Expense Agreement - Local #31 Gentlemen: The following Expense Agreement for Local #31 is effective and retroactive to June 18, 1979: PRIMARY ZONE: The primary zone of Local #31 shall be all area within a nine (9) mile radius of the Harris County Courthouse. ZONE A: Zone A shall include all area from the nine (9) mile radius to the twenty (20) mile radius. When Elevator Constructor Mechanics and Elevator Constructor Helpers work eight (8) hours on a job in Zone A between 8:00 AM and 4:30 PM, each mechanic and helper shall receive, as travel expense, $7.79 per work day. On April 16, 1980, the $7.79 shall be increased to $8.29, and on April 16, 1981, the $8.29 shall be increased to $8.89. Effective at the time of Local #31's wage increase in 1982 and all wage increases thereafter, the hourly
3 wage increase granted to the mechanic and to the helper shall be added together, take seventy-five (75) percent of that amount and divide by two (2), then add that amount to the prevailing travel expense for Zone A. ZONE B: Zone B shall include all area from the twenty (20) mile radius to the thirty-five (35) mile radius. When Elevator Constructor Mechanics and Elevator Constructor Helpers work eight (8) hours on a job in Zone B between 8:00 AM and 4:30 PM, each mechanic and helper shall receive as travel expense, $16.77 per work day and shall continue to receive the $16.77 until Local #31's wage increase in At that time and at all wage increases thereafter, the hourly wage increase granted to the mechanic and to the helper shall be added together and that total amount shall be added to the prevailing travel expense for Zone B. NOTES FOR ZONES A & B: The arrangements in Zones A and B shall apply to new construction, modernization and major repair work. The Employers shall have the option to pay the prevailing per diem expense in lieu of the zone expenses for Zones A and B. AREA BEYOND ZONE B: When Elevator Constructor Mechanics and Elevator Constructor Helpers work beyond Zone B, each mechanic and each helper shall receive, as per diem expense, seventeen dollars ($17.00) minimum per work day. Per diem shall be paid for Saturdays and Sundays provided work continues the following week. Per diem shall be paid for holidays which fall during the regular work week. Effective July 8, 1980, the per diem shall be increased to seventeen seventy-five ($17.75) minimum per work day and effective July 8, 1981, the per diem shall be increased to eighteen-fifty ($18.50) minimum per work day. On the first day out and the last day on the job, each mechanic and each helper shall be paid full per diem expense if they complete eight (8) hours on the job. Should the job be completed before the end of the work day and they travel home, fifty (50%) percent of the per diem shall be paid for the last day on the job. When a job is in an area where living expenses are unreasonable, it will be considered a hardship case. Receipts for room rent presented to Superintendent and the Business Representative shall be used as a guide to determine if additional expenses are justified.
4 When adequate living facilities are not available within nine (9) miles of the job site, mechanics and helpers will live at the nearest available adequate place and receive travel expenses, in addition to per diem, as provided in Zones A and B around Houston, Texas. All elevator mechanics and/or helpers working beyond Zone B will receive the following subsistence; travel time and traveling expense for cities outlined below. Recognizing that gas cost may be reduced, it is also agreed that if the cost per gallon is lowered by 4, a decrease at the rate of.005 (one-half cent) will be put into effect. However, these adjustments will not be made more often than every three months. HOLIDAYS: The following paid and unpaid holidays will be observed: Paid Holidays: New Year's Day; Memorial Day; Independence Day; Labor Day; Thanksgiving Day; Friday after Thanksgiving & Christmas Day. Unpaid Holidays: Good Friday; Veterans Day ~ National Presidential Election Day. DAY OF RESPECT: No work, other than emergency, shall be performed on the day of the funeral of any elevator mechanic and/or helper if the funeral is held in our Jurisdiction and whose death resulted from any injury received on the job while working at the trade. Any emergency work per formed that day during the regular working hours shall be at straight time rates. EFFECTIVE DATE - LENGTH OF AGREEMENT: This agreement shall be effective June 18, 1979, and cannot be re-opened (except for mileage rate) prior to Local #31's wage increase in 1982, at which time this agreement shall continue in effect as long as satisfactory to both parties.
