4 - Investor Visa Program - Simple Overview Introduction With new legal opportunities to apply for residence permit in Portugal (Europe Schengen Space ) pursuing investment activities that open your life to free traveling, free work and study in Europe and allow you to settle down in any of the European countries (Schengen Space). Getting a Portuguese Investor Visa is more than just obtaining a Residence Permit Card, is also the opportunity of becoming a Portuguese Citizen (European Union Citizen). To obtain Residence Permit Visa (Investor Visa) you need to fulfill investment requirements: A Investor Visa is only granted for foreign individuals non EU citizens that for minimum period of 5 years fulfill one of these requirements: a) Purchase Real Estate in total value equal or greater than Euro (half a million Euro) for new properties or greater than Euro (four hundred thousand Euros) for new properties in areas with less than 100 habitants per km2 or greater than Euro (three hundred and fifty thousand Euros) for old proprieties built over 30 years ago or greater than Euro (two hundred and eighty thousand Euros) for old properties built over 30 years ago in areas with less than 100 habitants per km2. In this case you are entitled to buy one or more than one property and it does not need to be residential property. You can choose between doing your investment in Residential, Commercial or Rural or Plots. The investment amount is a net amount; additionally you need to consider the Property taxes on top of this value (maximum level for transfer tax on residential properties is 6% and Stamp Tax is 0.8%). You can rent or use your property and it can always be a source of income. b) Transfer capital in an amount equal or greater than Euro (1 million) into a Portuguese Financial Institution for a period of 5 years. The certification of this transfer needs to be provided by Financial Institution in order to be able to apply for Investor Visa. c) The creation of a company that holds 10 permanent jobs. 6 - How to Obtain Investor Visa and European Passport (Portugal) Before you start the application to the Visa you are required to complete your full investment option. Only after that you will be able to request your Visa - Residence permit Card. To request the Residence Permit, we will need to submit your application to Portuguese Immigration Service (SEF). It is done by us and without your presence required. However for your information please find bellow fully complete application form and legal documents required: Passport Full Copy (all pages) and Scan with a validity of at least three months (please send to us at info@ptgoldenvisa.com); Proof of health insurance (if you have an international health insurance please bring a letter from your insurance company informing that you have a coverage including Portugal, if not we will provide you an health insurance solution in Portugal which will be a very competitive cost (example: 1000 euro/year for a family of 4 or 600 euro for 3 persons); Police Clearance Certificate from Residence Country of Past 3 years issued within last 6 month, duly recognized by apostille certification or by the corresponding Portuguese Embassy from issuing country if no apostille is available; Sworn statement by the Investor, attesting that the same will comply with the minimum quantitative and time requirements regarding the investment activity in Portugal (we will provide this form to you); Declaration issued by the Portuguese Tax Authorities and social security attesting the inexistence of any debts of the foreign national to the said entities (we will get this declarations in your name); Proof of one of the types of investment, mentioned above (we will obtain this for you once you have completed your investment). It s mandatory that all foreign documents must be officially translated to Portuguese and with apostille certification. (if your country has not signed Apostille Hague convention, the certification of the documents needs to be done with documents translated into Portuguese or English and presented at the Portuguese Consulate or Embassy corresponding to the country of origin of the documents). Once the request has been made with the Portuguese immigration authorities (SEF), with all the necessary documentation, the application request shall be decided within a minimum of 2 weeks till 12 weeks. Usual time for Investor Visas to be granted is 6 weeks after submission and around 3-4 weeks to collect the residence cards. (Lately due to high demand on the program the approval is taking over 6 weeks to be approved and issuing residence permit cards another 4 weeks). After approval you are requested to travel to Portugal for Biometric data submission for Immigration Department to be able to issue your residence card. 11 - Main Requirements The Investor must consider the following general requirements, regarding the investment, and the required minimum stay period in the country: I) A five-year minimum investment time is required, counting from the date of the granting of the residence permit; II) Minimum periods of permanence in the national territory are 7 days in the first year, and 14 days in the subsequent 2 years; The minimum stay requirement can be done with several trips or with just one. There is no restriction. III) The initial permit is valid for 1 year, and renewable subsequently for a period of 2 years, by meeting the requirements above mentioned. A) Real Estate Option In order to obtain the golden residence permit through the acquisition of real estate assets, it is necessary to present the following documents: I) The purchase and sale public deed, or the promissory purchase and sale agreement, in which shall be included a declaration issued by a financial institution certifying the effective transfer of capital for the purchase, or for payment of the down payment in the amount equal to or greater than minimum investment requirement (we will do the deed for you and collect the declaration from Bank); II) Updated land registry certificate, attesting the name of the investor as the owner of the real estate; (we will collect that for you) III) Purchase the property in co-ownership, as long as each co-owner invests the amount equal to or greater than minimum investment required for the option selected; IV) Through a promissory sale and purchase agreement, in which is required a down payment of an amount equal or greater than minimum investment requirement; In case of the Promissory Purchase and sale Agreement, the down payment of minimum required investment the actual purchase should be effected before the first renewal of the residence permit; V) Please note that the law refers to properties (plural), or real state assets, in the amount equal or greater to minimum investment required, which means the investor may, for example, purchase two properties each in half of the amount of the minimum investment required; VI) The property purchased may be leased or given to commercial, agricultural or touristic exploitation. 12 A1. Tax Implications When buying a property in Portugal the investor has to pay the following taxes: 1. Municipal Transfer Tax (IMT) this is a property purchase tax that must be paid before the final deed. As the payment takes place, a document is issued by the Local tax office, which proves its payment. the tax to pay depends on the price of the property or, if higher, on the ratable value that is registered on the Property tax document; 2. Residential purposes real estate A sliding scale applies, and a maximum of 6% is applied to values over ; 3. Commercial property or Touristic Properties or land for construction 6,5%; 4. Rustic property (without building permission) will be charged at a flat rate of 5%.; 5. Stamp Tax when signing a deed, the purchaser must pay the stamp duty, which varies according to the type of deed or operation. For real estate property, a sale and purchase is assessed at 0.8%; 6. Annual City Hall Tax ( IMI ) tax payable by whoever owns the property on 31 december of the year and taking into consideration the official valuation of the property for tax purposes. the rate varies between 0,3% and 0,5% for urban properties (the actual tax rate is fixed annually by the respective municipality) and 0,8% for rural properties; 7. Notary and Registration fees the investor will be responsible for paying these notary and registration fees once the final deed is signed. Expect to pay around 800 in total. 13 B) The Transfer of one million euros option For this option the investor only need s to open a Portuguese bank account, transfer the amount of one million euros to that account. Please note that applications made with several bank accounts are not accepted. The expected return on fix deposit as this moment is quite low (less than 1%). Each year the interest provided from the deposit of that amount will be taxed 28% by the Portuguese Government. C) For other available options mentioned above please consult us. - Renewal of the Residence permit Investor Visa The residence permit is valid for a period of 1 (one) year, from the date of issue, and may be renewed subsequently for periods of 2 (two) years, provided that the initial conditions of granting are maintained. For renewal of the Golden Visa, applicants must prove that they have stayed in Portugal for at least 7 (seven) days in the first year and 14 (fourteen) days in each subsequent period of 2 (two) years. - Family Reunification and Residency Permit for Family Members Holders of Golden Residence Permit for Investment Activity may apply for family reunification under the provisions of the general Law, for family members (parents, spouse and children), who are outside the country, which have lived in another country and are dependent; (Please note that for over 18 years old children the law requires them to be studying.) The Application for Residency Permit may also be extensive to all who are dependent of the applicant. A Residence Permit is granted to the family members for the same duration as the resident permit holder. Permanent Residence Permit and Portuguese Citizenship the holder and the family member of the investor visa may obtain a Permanent Residence Permit after (5) years, as well as Portuguese Citizenship after 6 years, according to legal provisions in force, by meeting the following conditions: i) Has held a legal residence permit for at least 6 years; ii) Possesses subsistence means; iii) Has guaranteed accommodation; iv) Has sufficient basic knowledge of Portuguese language with a score over 50% on a Portuguese language test.
