3 Transfer of Funtions (Eonomi Development and Eduation) Artile 1 Statutory Doument No. 2017/0325 Government Departments At 1987 TRANSFER OF FUNCTIONS (ECONOMIC DEVELOPMENT AND EDUCATION) ORDER 2017 Approved by Tynwald: 22 November 2017 Coming into Operation: in aordane with artile 2 The Governor in Counil makes the following Order under Shedule 2 of the Government Departments At Title This Order is the Transfer of Funtions (Eonomi Development and Eduation). 2 Commenement (1) If approved by Tynwald, this Order omes into operation on 24 November 2017, subjet to paragraph (2) 1. (2) The amendment to setion 1(2A) of the Shops At 2000 in Shedule 22 to the Equality At 2017 ontained in Shedule 1 to this Order omes into operation on 1 January Renaming of the Department of Eonomi Development (1) The Department of Eonomi Development is renamed the Department for Enterprise. (2) To give effet to paragraph (1), Shedule 1 to this Order ontains amendments to enatments as speified in that Shedule. 4 Renaming of the Department of Eduation and Children (1) The Department of Eduation and Children is renamed the Department of Eduation, Sport and Culture. 1 Paragraph 4(4) of Shedule 2 to the Government Departments At 1987 speifies that an order made under paragraph 1 or 2 of that Shedule shall not have effet unless it is approved by Tynwald. 4 Artile 5 Transfer of Funtions (Eonomi Development and Eduation) (2) To give effet to paragraph (1), Shedule 2 ontains amendments to enatments as speified in that Shedule. 5 Transfer of funtions from the Department of Eonomi Development The following provisions have effet in respet of the transfer of funtions from the Department of Eonomi Development () (d) Shedule 3 to this Order, in respet of the Department of Infrastruture; Shedule 4 to this Order, in respet of the Department of Eduation, Sport and Culture; Shedule 5 to this Order, in respet of the Treasury; and Shedule 6 to this Order, in respet of the Department of Environment, Food and Agriulture. 6 Transfer of funtions from the Department of Eduation and Children Shedule 7 to this Order has effet in respet of the transfer of funtions from the Department of Eduation and Children to the Treasury. 7 Consequential provisions (1) Without limiting any provision in a Shedule to this Order, a referene in an enatment, agreement, deed, instrument, liene, onsent, appliation, notie or other doument whatsoever to the Department of Eonomi Development is to be taken as (i) (ii) a referene to that Department as renamed by artile 3; or a referene to the Department to whih a funtion is transferred from the Department of Eonomi Development by this Order; and the Department of Eduation and Children is to be taken as (i) (ii) a referene to that Department as renamed by artile 4; or a referene to the Department to whih a funtion is transferred from the Department of Eduation and Children by this Order. (2) In this artile, enatment inludes any legislation of the United Kingdom (or any part of it) that applies to the Island () either expressly or by impliation (with or without modifiation); by virtue of an Order in Counil; or by virtue of an At of Tynwald or under a power ontained in an At of Tynwald. (2) The funtions of the Department of Eonomi Development in respet of the Gaiety Theatre are also transferred. (3) The funtions of the Department of Eonomi Development are transferred in relation to the provision of () (d) (e) the Voational Training Assistane Sheme (previously known as the VTFSS ); the Junior Ahievement Award; general voational training; fees to the University College Isle of Man; and the Skills Development Sheme 2007 (known as Apprentie Wage Support ). 2 Consequential amendments The Ats speified in paragraphs 3 and 4 are onsequentially amended as follows. 3 Villa Marina At 1999 In the Villa Marina At 1999 for the long title, substitute «AN ACT to make provision for the vesting of the title to the Villa Marina; and for onneted purposes.»; and in setion 1 (vesting of Villa Marina) for Transfer of Funtions (Dissolution of the Department of Community, Culture and Leisure) Order 2014 vest in the Department of Eonomi Development (in this At referred to as the Department ) as it was vested in the former Department of Community, Culture and Leisure immediately before suh ommenement., substitute «Transfer of Funtions (Eonomi Development and Eduation) Order 2017 vest in the Department of Eduation, Sport and Culture (in this At referred to as the Department ) as it was vested in the Department of Eonomi Development immediately before suh ommenement.». 16 SCHEDULE 4 Transfer of Funtions (Eonomi Development and Eduation) 4 Eduation At 2001 In the Eduation At 2001, for setion 32(1) and (2) and the heading to that setion (ontinuing eduation), substitute «32 Continuing eduation, training and support (1) The Department shall make suh arrangements as it onsiders appropriate for ontinuing the eduation (otherwise than in aordane with setion 31), training and support of persons in the Island over ompulsory shool age who have ompleted their full-time eduation; and their employers. 17 Transfer of Funtions (Eonomi Development and Eduation) SCHEDULE 5 SCHEDULE 5 [artile 5()] TRANSFER OF FUNCTIONS TO THE TREASURY 1 Transfer of funtions The funtions of the Department of Eonomi Development are transferred in relation to the provision of employment and training initiatives, inluding the Employment Rehabilitation Sheme ; () the Employment (Persons with Disabilities et.) Sheme ; and any other arrangements, support or payments (by way of grant, loan, allowane or otherwise) designed to assist persons to obtain or retain employment, but subjet to any more speifi provision of this Order. Here employment inludes self-employment. 2 Consequential amendments In the Employment At 2006, after setion 171 insert «171A Arrangements for employment and training P1973/50/2 (1) The Treasury shall make suh arrangements as it onsiders appropriate for the purpose of assisting persons to selet, train for, obtain and retain employment; or obtain employees (inluding partners and other business assoiates). (2) Arrangements under this setion may inlude arrangements for providing temporary employment for persons in the Island who are without employment; () inlude arrangements for enouraging inreases in the opportunities for employment and training that are available to persons with a disability; subjet to the restrition of paragraph to persons in the Island, be made in respet of employment and training anywhere in the Island or elsewhere; 3 GC 1989/ GC 1999/0024 V01 Page 17

18 SCHEDULE 5 Transfer of Funtions (Eonomi Development and Eduation) (d) (e) (f) provide for the making of payments by the Treasury, by way of grant, loan, allowane or otherwise (i) (ii) (iii) to persons who provide failities or training under the arrangements; to persons who use or will use those failities or undertake that training; and to other persons speified in or determined under the arrangements; provide for the making of payments to the Treasury by other parties to the arrangements and by persons who use those failities or undertake that training; and inlude arrangements for seuring that assistane in relation to the matters mentioned in subsetion (1) is provided by persons other than the Treasury. (3) The Treasury may make any regulations whih the Treasury onsiders are neessary or expedient to give effet to this setion. (4) Regulations under subsetion (3) may in partiular () provide for their ontravention to be an offene and presribe a penalty for ommission of the offene of a fine not exeeding level 5 on summary onvition; permit a person to exerise a disretion in respet of any of the matters speified in the regulations; and ontain onsequential, inidental supplementary and transitional provisions whih the Treasury onsiders to be neessary or expedient. (5) Regulations made under subsetion (3) must not ome into operation unless they are approved by Tynwald. (6) In this setion employment means employment under a ontrat of servie or apprentieship or a ontrat for servies or otherwise than under a ontrat.». Page 18 V01

19 Transfer of Funtions (Eonomi Development and Eduation) SCHEDULE 6 SCHEDULE 6 [artile 5(d)] TRANSFER OF FUNCTIONS TO THE DEPARTMENT OF ENVIRONMENT, FOOD AND AGRICULTURE 1 Transfer of funtions The funtions of the Department of Eonomi Development under the following provisions are transferred the Minerals At 1986; and the Mineral Workings (Offshore Installations) At Consequential amendments (1) In the Minerals At 1986 in setion 1(1) (vesting of mines and minerals in the Department) for Department of Eonomi Development, substitute «Department of Environment, Food and Agriulture»; for the ross heading preeding setion 1, substitute «Vesting of mines, minerals and oal in the Department of Environment, Food and Agriulture»; () after setion 1, insert «1A Vesting of oal in the Department (1) The property in oal existing in natural ondition; and all mines for the working of oal; on, in or under the sea bed beneath the extended territorial sea is vested in the Department free from all laims or estates whatsoever. (2) In this setion, oal means bituminous oal, annel oal and anthraite. (3) This setion is without prejudie to setions 1 to 3 of the Territorial Sea (Consequential Provisions) At 1991.»; (d) for setion 5 substitute «5 Powers to work mines and minerals (1) The Department may, subjet to any rights onferred by any lease or liene granted by the Department, work any mines and V01 Page 19

(2) The Department of Infrastruture may, subjet to a lease or liene being granted by the Department and in aordane with the lease or liene, work any mines and minerals and may dispose of any minerals so worked by sale or otherwise.»; and (e) for setion 5, substitute «setion 5(1)» in (i) (ii) (iii) setion 11(1) and (3) (onditions of disposal); setion 12 (rights of entry and user of land ontaining mines and minerals vested in the Department); and setion 29A (powers of entry and inspetion: issue of warrants). (2) In the Flood Risk Management At 2013 in setion 25(3) (spoil from works) for Department of Eonomi Development, substitute «Department of Environment, Food and Agriulture»; and for setion 69(1) (mineral rights) substitute «the funtions or the rights of any of the following (a speified person ) under the Minerals At 1986 (i) the Department of Environment, Food and Agriulture ( DEFA ); (ii) a person on whom rights have been onferred by a lease, liene, permission or permit granted by DEFA under that At; or». 22 SCHEDULE 7 Transfer of Funtions (Eonomi Development and Eduation) SCHEDULE 7 [artile 6] TRANSFER OF FUNCTIONS FROM THE DEPARTMENT OF EDUCATION AND CHILDREN TO THE TREASURY 1 Funtions in respet of funding for shool meals (1) The funtions of the Department of Eduation and Children under setion 39(2) of the Eduation At 2001 under paragraph are transferred to the Treasury; and under paragraph () are transferred to the Treasury to the extent neessary to make them exerisable by the Department of Eduation, Sport and Culture with the onurrene of the Treasury. (2) Paragraph 2 makes amendments onsequent on the transfer. 2 Consequential amendments (1) Setion 39 is amended in aordane with sub-paragraphs (2) and (3). (2) In subsetion (2) omit paragraph. (3) After subsetion (2) insert «(2A) Regulations under subsetion (2)() may only be made with the onurrene of the Treasury. This Order transfers ertain funtions from the Department of Eonomi Development to (i) the Department of Infrastruture; (ii) the Department of Eduation, Sport and Culture; (iii) the Treasury; and (iv) the Department of Environment, Food and Agriulture; and from the Department of Eduation and Children to the Treasury, and makes amendments to enatments whih are neessary as a onsequene of those transfers of funtions.
