3 Regulation 1 Statutory Doument No. 2015/0043 Soial Seurity Contributions and Benefits At 1992 EMPLOYED PERSON S ALLOWANCE (GENERAL) (AMENDMENT) REGULATIONS 2015 Approved by Tynwald: 17 Marh 2015 Coming into Operation: 6 April 2015 The Treasury makes the following Regulations under setions 123(1), 128(6), 135(1) and 175 of the Soial Seurity Contributions and Benefits At as it has effet in the Island 2. PART 1 INTRODUCTION 1 Title These Regulations are the Employed Person s Allowane (General) (Amendment). 2 Commenement If approved by Tynwald, these Regulations ome into operation on 6 April General interpretation (1) In these Regulations the 2011 Regulations means the Employed Person s Allowane (General) Regulations (2) Unless the ontext otherwise requires it, phrases appearing in these Regulations have the meanings given to them in the 2011 Regulations or Part VII of the Soial Seurity Contributions and Benefits At 1992 as it has effet in the Island (as the ase may be) See SD 505/94. 3 Tynwald approval is required by setion 176 of the Soial Seurity Contributions and Benefits At 1992 as it has effet in the Island. 4 SD 431/11. 4 Regulation 4 PART 2 EMPLOYED PERSON S ALLOWANCE REGULATIONS AMENDED 4 Amendment of the 2011 Regulations The 2011 Regulations are amended in aordane with this Part. 5 Regulation 70 amended (1) Regulation 70 (onditions for appliable amounts for housing osts) is amended as follows. (2) Omit the words after paragraph (7). 6 Regulation 80 amended (1) Regulation 80 (maintenane and insurane osts) is amended as follows. (2) In paragraph (1) for speified in paragraph 1(6) of Shedule 6 substitute «of 13.25». 7 Regulation 83 substituted For regulation 83 substitute «83. Restrition on housing osts Restrit the amounts appliable under this Part in aordane with Shedule 6.». 8 Regulation 85 amended (1) Regulation 85 (appliable amount for non-householder s ontribution) is amended as follows. (2) In paragraph (1) for the amount speified in paragraph 1(7) of Part 1 of Shedule 6 substitute «a weekly amount of 14.80». 9 Regulation 86 amended (1) Regulation 86 (appliable amounts of housing osts of boarders) is amended as follows. (2) In paragraph (1) for speified in paragraph 1(8) of Part I of Shedule 6 substitute «a weekly amount of 54.65». 10 Regulation 87 amended (1) Regulation 87 (determination of appropriate appliable amount) is amended as follows. 5 Regulation 11 (2) In paragraph (11) omit and speified in Shedule 6 (appliable amounts for housing osts). 11 Shedule 3 amended (1) Shedule 3 (inome other than earnings disregarded) is amended as follows. (2) After paragraph 48 insert «Payments in respet of adoption arrangements 48A. Any payment made to the laimant in respet of a hild or young person who is a member of the laimant s family pursuant to regulations under setion 2(6), 3 or 4 of the Adoption and Children At (of Parliament) or in aordane with a sheme for an analogous purpose or under analogous arrangements. Payments in respet of speial guardianship support servies 48B. Any payment made to the laimant in respet of a hild or young person who is a member of the laimant s family in aordane with arrangements made pursuant to setion 17F(1) of CYPA (speial guardianship support servies). Payments in respet of residene orders 48C. Any payment made by the Department of Health and Soial Care to the laimant towards the ost of the aommodation and maintenane of a hild or young person who is a member of the laimant s family and with respet to whom the ourt has made a residene order under setion 11 of CYPA (orders with respet to hildren).». 12 Shedule 4 amended (1) Shedule 4 (apital disregarded) is amended as follows. (2) After paragraph 16 insert «Payments in respet of adoption arrangements 16A. Any payment made to the laimant in respet of a hild or young person who is a member of the laimant s family pursuant to regulations under setion 2(6), 3 or 4 of the Adoption and Children At (of Parliament) or in aordane with a sheme for an analogous purpose or under analogous arrangements. Any payment made to the laimant in respet of a hild or young person who is a member of the laimant s family in aordane with arrangements made pursuant to setion 17F(1) of CYPA (speial guardianship support servies). Payments in respet of residene orders 16C. Any payment made by the Department of Health and Soial Care to the laimant towards the ost of the aommodation and maintenane of a hild or young person who is a member of the laimant s family and with respet to whom the ourt has made a residene order under setion 11 of CYPA (orders with respet to hildren).». 13 Shedule 6 amended (1) Shedule 6 7 is amended as follows. (2) For Part 1 substitute «PART 1 - MAXIMUM AMOUNT OF HOUSING COSTS APPLICABLE UNDER PART 7 [Regulation 83] 1. (1) The amount of housing osts appliable to a laimant (C) under Part 7 is subjet to the following weekly maxima. (2) If C is a single laimant, (3) If C is member of a ouple whose family does not inlude a hild or young person, (4) If C is a lone parent or a member of a ouple whose family inludes one hild; or one young person, (5) If C is a lone parent or a member of a ouple whose family inludes two hildren; or two young persons; or one hild and one young person, 7 See amendments made to Shedule 1 by SD 2014/0034. 7 Regulation 14 (6) If C is a lone parent or a member of a ouple whose family inludes three or more hildren; three or more young persons; or () any ombination of hildren and young persons numbering three or more in total, ». (3) In the heading to Part 2 for 8 substitute «7». PART 3 SAVINGS AND TRANSITIONAL PROVISIONS 14 Savings provisions (1) This regulation applies to a person ( P ) who immediately before the ommenement date is () (d) entitled to employed person s allowane; residing in publi setor housing; a single laimant or a member of a ouple whose family does not inlude a hild or young person; and a person whose appropriate appliable amount inludes an amount (A) in respet of appliable housing osts of more than (2) If this regulation applies to P, the provision speified in paragraph (5) ontinues to have effet in relation to P as if regulations 5 to 10 and 13 had not been made until the earlier of the dates speified in paragraphs (3) and (4). (3) This date is the first day on whih any of sub-paragraphs to () of paragraph (1) does not apply to P. (4) This date is the first day on whih the amount speified in the provision speified in paragraph (5) is greater than or equal to A. (5) That provision is if P is a single laimant, paragraph 1(2) in Part 1 of Shedule 6 to the 2011 Regulations; or if P is a member of a ouple whose family does not inlude a hild or young person, paragraph 1(3) in that Part, as that Part would have effet were this regulation not to have effet. 8 Regulation Transitional provisions If regulation 14 applies to P, P s appropriate appliable amount shall inlude an amount in respet of appliable housing osts of A (within the meaning of that regulation). 16 Interpretation of Part 3 In this Part appliable housing osts means housing osts as determined under Part 7 of the 2011 Regulations; appropriate appliable amount means the appropriate appliable amount as determined under Part 8 of the 2011 Regulations; ommenement date means 6 April 2015; and publi setor housing means housing owned by an approved housing assoiation (within the meaning of Part II of the Housing (Misellaneous Provisions) At 1976; the Department of Health and Soial Care; or a loal authority. 9 Explanatory Note EXPLANATORY NOTE (This note is not part of the Regulations) These Regulations amend the Employed Person s Allowane (General) Regulations 2011 ( the Employed Person s Allowane Regulations ). Regulations 1 to 4 are introdutory provisions. Regulations 5 to 10 and 13 amend existing provisions in the Employed Person s Allowane Regulations in order that the maximum allowanes for housing osts whih urrently apply to persons living in private setor housing apply in the same way to persons living in publi setor housing. Regulations 11 and 12 insert new inome and apital disregards for payments made in respet of adoption arrangements, speial guardian support servies and residene orders. Regulations 14 to 16 make savings and transitional provisions in relation to regulations 5 to 10 and 13. SD No. 2015/0043 Page 9
