Mayor Bruce T. Lyon at Dolgeville Fire House called this Regular Meeting of the Dolgeville Village Board of Trustees to order at 6:00 p.m. The Pledge of Allegiance was said. Approval of Meeting Minutes Abstract of Audited Vouchers Resolution # By Trustee Brandow Motion to approve and place on file the meeting minutes of June 18 th, 28 th and July 9, Sec. Trustee Loucks. Ayes all. The following resolution was offered by Trustee Brandow and sec. by Trustee Loucks. Ayes all. 2 *Police dept. will submit tow bill to court for reimbursement. Village will work with police department and create a policy regarding towing vehicles. C.T. Male I & I Upgrade Chet Szymanski of C.T. Male came before the Board on the following: Chet submitted final design plans and bid specifications to NYSDEC and NYSEFC. Cost estimate packet should be ready within a week. Chet also submitted temporary easement maps (3 copies) to Village and Attorney. Town of Manheim Beaver Brook Dam Town of Manheim Supervisor John Haughton came before the Board on the following: John reported the Town of Manheim at their regular meeting discussed the Beaver Brook Dam issue and reviewed the current operation and maintenance agreement dated July 21, Their conclusion is to wait for a decision from D.E.C. to determine ownership. The current deed says the Town owns the dam but the dam was built to protect the Village of Dolgeville. John spoke to Mary Wojcik of NYSDEC asking when we will we receive a response and she said sooner than later. Village Attorney advised he wrote a letter dated July 13, 2012 requesting NYSDEC determine ownership and included supporting documents. Department Heads Police Department Sale & Possession of Synthetic Drugs Ban Provisional Chief of Police Richard Congdon came before the Board on the following: Rich is requesting permission to work on implementing a local law banning the sale and possession of synthetic drugs, including bath salts. Rich will work with Village Attorney on proposal and make it available for the August Board meeting. Village will use sample law implemented by the City of Rome. By Trustee Luther Motion to draft a local law to ban the sale and possession of synthetic drugs in the Village of Dolgeville. Sec. Trustee Puznowski. Ayes all. New Hire P/T Patrolman

3 Motion to hire part time patrolman Joseph Parisi. Sec. Trustee Brandow. Ayes all. Softball Field Damages The damage done at the softball field in the amount of $ was submitted to court for reimbursement. Dog Control Barbara Boucher asked what the role of police department is re: dog control in the Village. Police can write tickets and call D.C.O. There was in incident this past weekend with an unattended dog and due to the extreme heat brought concerns. Police called dog control and they were unavailable. Food and water was given to the dog. Owner was in the process of moving and took dog to new home. D.C.O. officer Town of Oppenheim William Lints and Town of Manheim Kenneth Decker. Curfew Law Police Monthly Report Code Enforcement Code Enforcement Monthly Report D.P.W. Trail Barricades Pergola Canopy Margaret Doxtader asked if the curfew law is still in effect. Yes, summer hours weekdays until 11:00 p.m. and Fri./Sat. until midnight. Curfew during school year is 9:00 p.m. for children under the age of 17. Code Enforcement Officer Barry Vickers was unavailable for the meeting but submitted the following: By Trustee Brandow Motion to approve and place on file the June 2012 Code Enforcement report as submitted. Sec. Trustee Luther. Ayes all. D.P.W. Superintendent John Houle came before the Board on the following: Concrete barriers with reflectors were installed on the trail system to stop vehicle traffic. Pergola canopy installed. Dolomite and John will call Al Cowen Lochner to consider a rail system to prevent flexing during wind events. Yotin Podungton was in Monday to take pictures of Main St. Project updates. Yotin was advised about crosswalks and Brandow building. Fire Hydrant Replacement Next week working on moving fire hydrant on Beaver St. and prepare to pave street.

4 County Summer Help County helpers are working on Beaver Brook Dam maintenance. Plowe Park Greg Jorrey community band member is requesting more lighting in the gazebo for band concerts. They are currently using portable lighting. Blue spruce trees around monument were removed. Request to remove rotten benches in park. Village Hall Wiring Water Leak North Main Street John is recommending tabling the stair project to the Youth Center and get estimates on re-wiring Village Hall starting with a couple rooms. John will get quotes. Water leak at 66 North Main Street. D.P.W. will repair this week. 44 South Main Street Trustee Puznowski asked if the old tree issue was addressed. Codes notified and owner contacted. Volunteers HealthNet Grant Money Safe Routes to School Grant D.P.W. Monthly Report Planning Board Overlay District Village discussing volunteers to pull weeds and water flowers. Village will contact insurance carrier to see if they are covered. Planters by farmer s market tent need replanting or remove containers are getting over grown. Karen Goyette asked if the Village is pursuing more trail grant money from Herkimer Co. HealthNet program. Village applied for additional funding. John will meet with D.C.S. regarding safe routes to school grant funding application. Motion to approve and place on file the June D.P.W. report as submitted. Sec. Trustee Luther. Ayes all. Planning Board member Jan Murphy came before the Board on the following: Overlay district will run from North Main Street Spofford Avenue. The definitions will incorporate the Village Master Plan. Next step is to change Zoning Law district classification, definitions, site plan reviews, permissible uses, special permits, facades, paint, siding, roofs, local law, public hearing, notify affected property owners. Trustee Puznowski will set in on discussions to draft local law.

5 Planning Board Meeting Minutes Water Plant Meter Readings Motion to approve and place on file the June 11, 2012 Planning Board meeting minutes as submitted. Sec. Trustee Luther. Ayes all. Water Plant Operator Neal Winkler came before the Board on the following: Report submitted Rawlings, Bus Garage, Easy Mart, Dollar General, Parkside Court, Tricot numbers unavailable. to Rich Coriale re: whose responsibility to purchase meters? Need to set up a special meeting to discuss industrial rates and changing the local law. Check other school district for rates. Check O.G.S. for municipal rates. Reservoir Cleaning D.O.H. Water Monthly Report WWTP Fire Department Two-way Radios Firemen Training Fire Department Monthly Report Neal is recommending not cleaning reservoir due to low water. Mang Reservoir and Cold Brook reservoir water still going over dams. Village will start laying pipe for cleaning and won t order bags until ready to do cleaning. Contacted D.O.H. Friday and there is no reports of water problems in the area due to the lack of rain. Motion to approve and place on file the June 2012 water report as submitted. Sec. Trustee Brandow. Ayes all. WWTP Operator Edward Scharpou was unavailable for the meeting: Fire Chief Randy Tennant came before the Board on the following: Randy is requesting to purchase three sets of two-way radios for fire police. The radios will help at scenes and not interfere with county dispatch and communications. The cost is approximately $ 40 per set. Three firemen completed training and two more are scheduled for classes in Van Hornsville. Motion to approve and place on file the June 2012 Fire Department report as submitted. Sec. Trustee Luther. 6 Treasurer Expenditures, Encumbrances, and Appropriations Balance Sheet Financial Workshop Treasurer Michele Weakley was unavailable for the meeting but submitted the following: By Trustee Luther Motion to place on file the Statement of Expenditures, Encumbrances and Appropriations for the period ending July 16, 2012 as submitted. Board will schedule financial workshop with Treasurer after the submittal of annual report to the State Comptroller. Public Comment Local Laws Online Meeting Minutes Online Chief of Police Justin Izzo likes the Village meeting minutes on line and would like to see local laws online. Justin volunteered to help with scanning documents for this purpose. Barbara Boucher commented the meeting minutes are not up to date online. Clerk said they were sent to web administrator for posting. Clerk will receive training to do posting. Karen Goyette asked what is being done with the agreement to waive the settlement agreement with Marilyn Williams to allow her to apply for the Chief of Police position. Village Attorney drafted a proposal and the Board did not act on it. The Board chose to hire Richard Congdon for the position of Chief of Police as a second provisional appointment to continue until the next civil service test and for which the Village of Dolgeville is requesting the Herkimer County Personnel Department to schedule a departmental promotional exam. 7 Notice of Certificate of Completion Resolution # 87A-2012 Motion authorizing Mayor Bruce T. Lyon to sign the Notice of Certificate of Completion on behalf of the Village of Dolgeville for the former Silvernail/Vaza Property located at South Main Street, Tax Map # and Sec. Trustee Brandow. Ayes all. AYES: Trustees Brandow, Loucks, Luther, Puznowski NAYS: None ADOPTED July 16, 2012 Next step is to request final delinquent taxes, liens on property be forgiven from Herkimer County, determine if property is needed for any public purpose, get an appraised value, notify neighbor s property is for sale, public hearing, possible bid, auction or other form of sale of premises. RESTORE Interest 48 North Main Street Trustee Loucks asked, what is the status of repayment of RESTORE loan interest for 48 North Main Street? Village Attorney received notice from one owner s attorney stating he will not be repaying anything. Mayor Lyon will talk to owners regarding the other 2/3 share and make monthly payments. Board is requesting a response in writing to this issue from owners. Shelter Planning AHC Application-HOME NYS Affordable Housing Corp. has received the Village application ID# 5M24 for HOME grant funding. New Business Use of Village Premises Dolgeville Pop Warner Association requesting use of the softball field, pavilion, and lights from July 31 st November 1 st for football and cheerleading. They would also like to hold a chicken barbecue and kick ball tournament on August 4 th. By Trustee Brandow Motion to approve use of village premises to Dolgeville Pop Warner Association as requested above. Sec. Trustee Puznowski. Ayes all. 8 D.P.W. Application Excellus Projected Increase Jan Irondale Mine Inspection Place on file. Excellus Simply Blue High Deductible Health Plan is proposing a 14.70% increase effective January 1, May 24, 2012 inspection noted a no permanent markers delineating the 2.0 acre permit term area. John is working on markers. Is it insured, do we use it, could we close it. Yes it is insured and we do use it. Payroll Certification Resolution # The following resolution was offered by Trustee Loucks and sec. by Trustee Puznowski. Ayes all. WHEREAS, Michele Weakley does hereby submit for certification that the following payroll period of 6/9/12 6/22/12 in the amount of $ 28, be approved for payment from the appropriation authorized by the Village of Dolgeville Board of Trustees. Board discussed if village insurance covers such events and whether Board could request insurance coverage from not-forprofits. Board will check with insurance company and if there isn t a problem not-for-profits organizations will be granted permission with prior Board approval for events. Delinquent Water/Sewer Shut Offs Delinquent water/sewer list submitted. No hardship requests granted. Shut off date July 30, Communication Logging Property Attorney ASCAP Village will contact brokers to cruise Summerhouse Hill and other village properties for logging. Village Attorney Norman Mastromoro came before the Board on the following: Village received communications from ASCAP re: Licensing agreement for lawful performance of music at band concerts.
